How to read this level. Every statement here is anchored either in the text of the Shulchan Arukh and its nossei kelim, or in a named and verifiable posek (Tur, Beit Yosef, Rambam, Gemara Avodah Zarah). On Yoreh De'ah there is no Mishnah Berurah (which comments only on Orach Chaim) and no Shulchan Arukh HaRav (the Alter Rebbe did not write Yoreh De'ah). The Arukh HaShulchan is not cited here: his text on this siman is not accessible to us, and one does not quote what one cannot verify. Siman 137, by contrast, is richly commented: Shach (19 ס״ק), Taz (8), Ba’er Hetev (10) and Pitchei Teshuva (3) — and it is on them that this level rests. Where the question exceeds the siman, this level says so and stops: halakha lema'asse goes through your Rav.

📜 The text of the Shulchan Arukh — seif 1

כל הכלים האסורים מחמת יין של עובד כוכבים שהכניס בהם ישראל יין קודם שהכשירן אסור בשתייה ומותר בהנאה אפילו הוא יבש כל זמן שלא עבר עליו י״ב חדש

The founding case. A vessel forbidden on account of a non-Jew’s wine; the kashering was not done; kosher wine was poured into it. The Mechaber does not say that all is lost: he gives a statusאסור בשתייה ומותר בהנאה — and a limit, twelve months, beyond which the vessel gives nothing back.

And he at once adds a quantitative way out. If water was mixed with the wine and amounts to six times the vessel’s peel, everything becomes permitted again, even for drinking.

1. שורש הפסק — what is measured, and against what

This siman has only one operation: measuring. It never asks whether the vessel is forbidden — it is — but how much it retained, and what is needed against it. The whole practice therefore turns on two questions, and if either is badly framed the answer is wrong even when the arithmetic is right: what is forbidden, and against what does one measure?
The Shach’s sentence that holds both ends. It explains why the absorbed wine forbids in the least quantity and yet forbids only for drinking:
« שאני הכא דקודם שנבלע בכלי היה אסור בהנאה נמצא כשמתערב ביין שבקנקנים איסור הנאה מתערב אלא שלפי שלא נתערב בעין רק מפליטת הכלי אינו אוסר רק בשתייה » (ש״ך יו״ד קל״ז ס״ק ג)

What this changes for you. Before an unkashered vat in which kosher wine has stood, the first question is never “how serious is it?” but “what exactly is known about the vessel?”. If it is a storage vessel: the wine is affected without delay. If it is not and was dry: count the twenty-four hours. If it is known that stam yeinam stood in it a full day: the calculation changes scale. And if nothing is known, seif 6 governs — the gap will not be filled by a declaration.

2. פסק המחבר והרמ״א — the map of the six seifim

Siman 137 has six seifim — that is the count announced by the heading (ובו ו׳ סעיפים) and the real count of the text. The Rama intervenes in seif 1 (three times) and in seif 2.

3. מעמד היין — forbidden to drink, permitted for benefit

The source of the status, and it is settled. The Mishnah sets Rabbi Meir against the Sages; the Beit Yosef recalls, in opening the siman, that the halakha follows the Sages:
« בפרק אין מעמידין (עבודה זרה כט:) תנן נודות הנכרי וקנקניהם ויין של ישראל כנוס בהם אסורים ואיסורם איסור הנאה דר״מ וחכמים אומרים אין איסורם איסור הנאה וידוע דהלכה כחכמים » (בית יוסף יו״ד קל״ז)
Lema'asse. “Permitted for benefit” is not a theoretical formula: it means the batch may be sold, including to a non-Jew, and that its value is not lost. That is the first thing to say to a producer, before any calculation — and it often changes the nature of the question being asked.

4. שיעורי הזמן — מיד, מעת לעת, י״ב חדש

Three thresholds, three physical situations

These are not three opinions: they are three states of the vessel, and the Taz gives each in one line.

« דגזרו עליו אפילו לפי שעה » (ט״ז יו״ד קל״ז ס״ק ב)
« דצונן לא מפליט בפחות מזה » (ט״ז יו״ד קל״ז ס״ק ג)

👈 The clause that is forgotten: residual moisture

The Rama adds two words — והוא יבש — and the Shach draws the converse case from them: a vessel still moist does not wait twenty-four hours.

« אבל אם היה בו טופח על מנת להטפיח אוסר המתערב עמו כדלעיל סי׳ קכ״ו ב״י » (ש״ך יו״ד קל״ז ס״ק ד)

And the vessel that rinsing would have sufficed to clear?

The Shach is strict; the Taz is lenient; the Ba’er Hetev leaves both positions open, and indicates what one may rely on.

« משמע דה״ה כלים שאין מכניסין לקיום שנכשרים בהדחה כדלעיל סי׳ קל״ה אם לא הדיחן ונתן בהם יין אסור בשתייה כל ששהה בהן מעל״ע » (ש״ך יו״ד קל״ז ס״ק א)

Lema'asse. For a utensil whose restoration required only a rinsing — a cup, a decanter, a funnel — and which was not rinsed: the Taz permits after the fact, and the Ba’er Hetev writes that one loses nothing by relying on the lenient in a rabbinic matter. For a vat or a cask, which are storage vessels, that leniency does not apply: there the wine is affected without delay.

5. שיעור הבליעה — כדי קליפה, and when it no longer holds

ואם היה ביין מעורב קיתון של מים אם יש במים ששה פעמים כנגד קליפת הקנקן מותר אפילו בשתייה

What one counts against. Not the vessel: the thickness it actually absorbed. The Shach gives its measure, and it is concrete:
« שאין היין נבלע אלא כדי קליפה שמקלפים העץ ברהיטני (כדלעיל סי׳ קל״ה סי״ג) רשב״א ומביאו ב״י וריב״ש סי׳ קל״ג » (ש״ך יו״ד קל״ז ס״ק ט)

The opposing position, and the Shach’s synthesis

The Bach, in the name of Rabbenu Tam and the Rosh, requires sixty against the whole vessel in a storage vessel. The Shach decides by the distinction of כבוש.

« מיהו כתב הב״ח דלר״ת והרא״ש בכלי שמכניסו לקיום בולע יותר מכדי קליפה וצריך ס׳ כנגד כולו ע״כ » (ש״ך יו״ד קל״ז ס״ק ט)
« אבל בידוע שעמד בו מעל״ע הרי נעשה כבוש וכבר נתבאר בסימן ס״ט ס״ק ס׳ ובסימן צ״ח ס״ק י״ג דכבישה אוסר כל הכלי » (ש״ך יו״ד קל״ז ס״ק ט)

And a more lenient view among the Acharonim. The Pitchei Teshuva reports the Chacham Tzvi, who refuses to go beyond the peel in any case:
« ועי׳ בתשובת ח״צ סימן ע״ה שמתיר בכל ענין דאין אוסר יותר מכדי קליפה » (פתחי תשובה יו״ד קל״ז ס״ק א)
Lema'asse. The practical line is the Shach’s, and it depends on what is known: with no information about the length of the stay, one counts against the peel, and six volumes of water — or sixty of liquid — are amply reached; if it is established that stam yeinam stood there twenty-four hours in a storage vessel, the Shach requires sixty against the whole vessel, which in practice is never reached. The Chacham Tzvi does not follow that stringency, and a Rav may take that into account where a substantial loss is at stake.

6. הגת והברזא — the siman’s most operational ma’hloket

אם דרך ענבים בגת של עובד כוכבים שלא הכשירו מותר שהרי החרצנים והזגים יש בהם ס׳ כנגד קליפת הגת אבל אסור להוציא היין דרך נקב שהיין של עובד כוכבים יורד בו שהנקב אסור והיין היוצא משם צלול מבלי תערובות החרצנים

May one draw off through the usual outlet?

The Bach and the Shach: yes. The Beit Yosef and the Taz: no, so long as another way exists. It is one of the few points in the block where the practical course differs according to the authority followed.

« והב״ח השיג עליו שאין זה מבטל איסור לכתחלה כיון שאין כוונתו אלא להוציא יין ולא כדי לבטל האיסור שבנקב » (ש״ך יו״ד קל״ז ס״ק ז)

👈 And if one already drew off that way?

The Rama permits all the wine, and the Shach gives the underlying reason: what comes out through the hole always carries sixty against the hole’s peel.

« אלא הטעם הוא דהקליפה של הנקב בטל בס׳ דמה שיוצא דרך הנקב יש לעולם ס׳ נגד הקליפה דהא הרשב״א והטור גופיה לא אסרי אלא משום שהיין יוצא שם צלול ונאסר בכל שהוא אבל אם היה יוצא שם עם החרצנים וזגים היו מתירי׳ משום שיש ס׳ נגד קליפת הנקב וא״כ לדידן דקי״ל דסתם יינם בטל בס׳ אם כן בכל ענין שרי וזה ברור » (ש״ך יו״ד קל״ז ס״ק י״א)
Lema'asse. Where it is possible to draw off otherwise — a high valve, a pump, a new opening — that is the course to recommend: it satisfies the Taz and costs nothing. Where it is not possible, the Shach, following the Bach, permits. And if it has already been done, there is no argument: the wine remains permitted.

7. היין השני — the calculation of seif 3

אם יש ביין השני ס׳ כיין הראשון הכל מותר אפי׳ בשתייה ואם יש ביין השני מים כדי שיעור ששה חלקים כנגד קליפות האסורים ג״כ מותר הכל בשתייה ואע״פ שלא היה מים ביין הראשון

Why sixty, and against what. The Shach gives the reason in one line: the first wine is forbidden only for drinking, so it does not forbid in the least quantity but by taste.
« דכיון שהיין הראשון לא נאסר אלא בשתייה אינו אוסר בכל שהוא ריב״ש שם » (ש״ך יו״ד קל״ז ס״ק י״ב)

The Taz proposes a simpler calculation — and the Nekudot HaKesef objects

For the Taz, since we hold that stam yeinam is nullified in sixty, it is enough that the whole make sixty against the peel. For the Nekudot HaKesef, sixty is first required in the first wine itself.

« אבל לפי מה דקי״ל שם דבטל בס׳ אין אנו צריכין להוראה זאת אלא אם יש בין הכל דהיינו יין הראשון והשני ששים נגד קליפת הכלי האסור מותר הכל » (ט״ז יו״ד קל״ז ס״ק ו)

👈 The consequence that is forgotten

The Shach (ס״ק י״ד) warns: if nullification does not occur, it is not only the wines that are affected — the kosher jars are too.

« ואם אין לבטל גם הכלים אסורים כאילו נתן יין של איסור בכלים כשרים » (ש״ך יו״ד קל״ז ס״ק י״ד)
Lema'asse. This is the typical case of a blend. Two calculations coexist, and they do not give the same result when the first batch is large. A Rav will decide which to apply; what he needs is the exact volumes, the presence or absence of water, and what is known of the length of the stay in the original vessel.

8. שאר משקים ומליחה — the one leniency, and its limit

כלים האסורים מחמת יין של עובד כוכבים מותר ליתן לתוכם בין מים בין שכר בין שאר משקים ובלבד שידיח בתחלה לחלוחי היין שעל פני הכלים וכן מותר למלוח בהם

The reason, and it is simple. Wine spoils what is not wine; and a spoiling taste does not forbid. The Shach reports it in the name of the decisors:
« מפני שמבטלין טעם היין כ״כ הפוסקים » (ש״ך יו״ד קל״ז ס״ק ט״ו)

Two limits, and they do not bear on the same variable

The Shach limits frequency; the Taz sets aside the limit of time.

« ולא גזרי׳ משקין אטו יין משום דאקראי בעלמא הוא ש״ס ולפ״ז אסור ליתן בהם משקין דרך קבע » (ש״ך יו״ד קל״ז ס״ק ט״ז)
« נ״ל פשוט אפילו אם המשקין נשתהים שם מעל״ע מותר דהא הטור כתב הטעם כיון שהיין פוגם אותם ואע״ג דבשאר דוכתי קיימא לן נותן טעם לפגם אסור לכתחלה שאני הכא דנבלע בצונן » (ט״ז יו״ד קל״ז ס״ק ז)

👈 Salting

The Bach forbids it; the Shach and the Taz uphold the Mechaber. The Ba’er Hetev records the debate and its conclusion.

« והב״ח חולק על זה ופסק דלכתחלה אסור למלוח כדלעיל סימן ק״ה סי״ב וגם בדיעבד אסור אם נכבש בתוכו יום שלם אבל הש״ך השיג עליו דמסתמא יש ס׳ נגד פליטת הכלי שלא בלע רק כ״ק ויין נקלש טעמו בשאר משקין וכ״ש במליח וכן פסק הט״ז דהעיקר כדעת המחבר דמותר אפילו לכתחלה למלוח בהן » (באר היטב יו״ד קל״ז ס״ק ח)
Lema'asse. A forbidden cask or vat may serve for water, beer or other liquids after a simple rinsing of the surface — but the Shach forbids making that vessel’s use regular, precisely because the Gemara’s permission rested on the occasional character of the act. Salting in them is permitted according to the Mechaber, the Shach and the Taz.

9. יין פעם שנייה — seif 5, and the door of הפסד

אם נתן יין בכלי אסור לא נתיר לתת בו יין פעם אחרת עד שיכשירנו

Why nullification undergone does not ground nullification willed. The Shach sets aside the Rosh’s reasoning, and gives the reason:
« וכב״י ואע״פ שהרא״ש בתשו׳ התיר לפי שמתחלה נפלט בליעת הקנקן ביין ונתבטל היינו לדברי המתירין סתם יינם בס׳ וכבר כתבתי בסימן קל״ד דלא קי״ל אלא כדברי האומרים דאוסר במשהו ע״כ » (ש״ך יו״ד קל״ז ס״ק י״ח)
« ואפשר דמיירי בשעת הדחק והפסד שצריך לכלים ואם לא יתן לכלים אלו יהא לו הפסד בדבר » (ש״ך יו״ד קל״ז ס״ק י״ח)
« כתב הש״ך מיהו בשעת הדחק והפסד שצריך לכלים ואם לא יתן לכלים אלו יהא לו הפסד בדבר שרי » (באר היטב יו״ד קל״ז ס״ק ט)
Lema'asse. The rule is clear: a vessel that has served in this way receives no more wine before kashering (siman 135 for the modes). The one opening is the Shach’s — בשעת הדחק והפסד, where there is no other vessel and a real loss is at stake. That is exactly the kind of circumstance to put to a Rav, not to decide alone.

10. נאמנות — seif 6, and what follows from it

Why the general rule does not operate. A non-Jew speaking innocently is sometimes believed for a rabbinic prohibition; here he is not, and the Shach says exactly why:
« י״ל דהתם מיירי בדבר דלא אתחזק איסורא משא״כ הכא דודאי נשתמש בכלים אלו יין של איסור » (ש״ך יו״ד קל״ז ס״ק י״ט)
« כ׳ הש״ך אע״ג דקי״ל דעובד כוכבים נאמן מסל״ת באיסור דרבנן כמ״ש בסי׳ צ״ח ס״א י״ל דהתם מיירי בדבר דלא איתחזק איסורא משא״כ הכא דודאי נשתמש בכלים אלו יין של איסור » (באר היטב יו״ד קל״ז ס״ק י)
The Beit Yosef had already refused to be lenient, even though the Ran inclined that way:
« ולענין הלכה אע״פ שנראין דברי הר״ן מי יקל ראשו כנגד הנך רבוותא דאוסרים וכ״ש במקום שהר״ן לא רצה לסמוך על עצמו לעשות מעשה » (בית יוסף יו״ד קל״ז)
Lema'asse. This is the most directly applicable clause of the siman: a kashering attestation resting on the word of non-Jewish staff is worth nothing for this siman. The whole apparatus of measures that precedes presupposes reliable information; seif 6 says where it cannot come from, and the siman refers to siman 122 for the usual conduct.

11. מקרים בני זמננו

👈 Case 1 — An unkashered vat that received kosher wine

Status: אסור בשתייה ומותר בהנאה — the batch is not lost, it is no longer drinkable. A storage vessel: affected without delay (רמ״א). Otherwise and dry: after twenty-four hours (ש״ך ס״ק ה).

👈 Case 2 — Water is added

Six volumes against the peel permit even for drinking (שו״ע קל״ז:א) — but only if the water was not added in order to nullify (ש״ך ס״ק ו). Adding water in advance, as a precaution, is permitted.

👈 Case 3 — The cask assigned to water or beer

Permitted after rinsing (שו״ע קל״ז:ד), but not as regular use (ש״ך ס״ק ט״ז). The Taz (ס״ק ז) makes clear that the length of the stay is not itself an obstacle.

👈 Case 4 — The metal vat

The Pitchei Teshuva reports the Shev Yaakov, for whom the rule of the spoiled taste holds only for wood and earthenware; in a metal vessel, the wine itself is spoiled.

👈 Case 5 — Distilled spirits

This is the contemporary question par excellence, and the Pitchei Teshuva treats it directly in the name of the Noda BiYehuda: the permission of seif 4 does not transfer as it stands to a still that has been used to distil stam yeinam.

👈 Case 6 — “The supplier attests that the vat was kashered”

Seif 6 excludes it (שו״ע קל״ז:ו; ש״ך ס״ק י״ט). A useful attestation must rest on supervision, not on a declaration.

The point this level will not decide. The actual volumes, the exact nature of the material, the length of the stay and whether or not a substantial loss is involved together make up a concrete case. This level says what siman 137 measures and how; it does not say whether this batch is permitted. That belongs to the certifying body and to your Rav.

And finally, the one rule that holds lema'asse. This level sets out the ruling of the sources; it does not replace a decision. A volume, a material, a length of time and a financial stake make up a concrete case, and a concrete case is decided with a Rav — which is what the Shach and the Taz themselves do, distinguishing each time what is known from what is supposed.
