1. The axiom: the siman does not ask whether, it asks how much

The starting point:

Siman 136 taught how to prevent a vessel from being compromised. Siman 137 presupposes the failure: the vessel is compromised, and kosher wine has been poured into it. The question is therefore no longer “is a seal needed?” but “how much did the wood retain, and what suffices to nullify it?”.

Hence the axiom: everything here is a quantity. A vessel’s peel, six volumes of water, sixty volumes of wine, twenty-four hours, twelve months. The only seif that measures nothing is the last — and it is precisely the one that says where the information needed for measuring cannot come from.

The basic status comes from a Mishnah, decided against Rabbi Meir: « נוֹדוֹת הַגּוֹיִם וְקַנְקַנֵּיהֶן, וְיַיִן שֶׁל יִשְׂרָאֵל כָּנוּס בָּהֶן — אֲסוּרִין, וְאִיסּוּרָן אִיסּוּר הֲנָאָה » (עבודה זרה כ״ט ע״ב)

The Beit Yosef says so without circumlocution: « בפרק אין מעמידין (עבודה זרה כט:) תנן נודות הנכרי וקנקניהם ויין של ישראל כנוס בהם אסורים ואיסורם איסור הנאה דר״מ וחכמים אומרים אין איסורם איסור הנאה וידוע דהלכה כחכמים » (בית יוסף יו״ד קל״ז)

💡 The landmark: before each clause, ask two things and only two — what is forbidden (the vessel? the wine? the פליטה?), and against what is it measured (the peel? the first wine? the whole vessel?). There is no other variable in the entire siman.

2. The 3 reflex questions

1. Which vessel? מכניסו לקיום — affected immediately (Rama). Otherwise, and if dry — twenty-four hours. And beyond twelve months — nothing.
2. Is there enough to nullify? Six volumes of water against the peel; or sixty of wine against what is forbidden. Mind what is set against it: the peel, or the first wine.
3. What is to be done with the vessel? Put wine in it again — no, without kashering (seif 5). Put water, beer, salt in it — yes, after rinsing (seif 4).

4. The status: forbidden to drink, permitted for benefit — and yet במשהו

⚖ The sentence that holds both ends

« שאני הכא דקודם שנבלע בכלי היה אסור בהנאה נמצא כשמתערב ביין שבקנקנים איסור הנאה מתערב אלא שלפי שלא נתערב בעין רק מפליטת הכלי אינו אוסר רק בשתייה » (ש״ך יו״ד קל״ז ס״ק ג) — the gravity comes from the origin (the prohibition was one of benefit, hence במשהו); the status comes from the mode of mixture (through the wall, hence drinking only).

The Ra’ah, for his part, reasons by symmetry and concludes to nullification in sixty: « אכן מדברי הרא״ה בב״ה דף קכ״ו ע״ב משמע להדיא דיין שנבלע בכלים אינו אוסר רק בס׳ כיון שאינו אוסר רק בשתייה » (ש״ך יו״ד קל״ז ס״ק ג)

How the Shach proves that the Mechaber holds במשהו: from seifim 2 and 3 themselves. In seif 2 he forbids without mentioning sixty; in seif 3 he requires sixty against the first wine and not against the peels alone. The Ba’er Hetev sums it up: « כ׳ בת״ה סי׳ ר״א דאין חילוק בין כלי עובד כוכבים ובין כלי ישראל שבלע יין נסך » (באר היטב יו״ד קל״ז ס״ק א)

⚠ The trap of the calculation. The very same vessel yields two opposite results according to what is known of it. With no information: the peel, and six volumes of water suffice. With certainty of a twenty-four-hour stay: the whole vessel, and the calculation becomes unworkable. The difference is not halakhic but documentary — and that is why seif 6 matters so much.

On this last point the Shach is categorical: « דאפילו אינן ב״י אוסרים דלא שייך נטל״פ אלא בתבשיל אבל לא בכלי היין דאדרבה כל שמתיישנים נ״ט לשבח » (ש״ך יו״ד קל״ז ס״ק י)

7. The vessel that was not rinsed: Shach against Taz

Shach — forbidden to drink once the wine has stood a full day: « משמע דה״ה כלים שאין מכניסין לקיום שנכשרים בהדחה כדלעיל סי׳ קל״ה אם לא הדיחן ונתן בהם יין אסור בשתייה כל ששהה בהן מעל״ע » (ש״ך יו״ד קל״ז ס״ק א)
Rabbenu Yeruḥam, reported by the Shach — if the vessel was dry, permitted; rinsing is required only a priori: « אבל רבינו ירוחם כ׳ דאם נתייבש ואח״כ נשתמש בו ישראל בלא הדחה מותר אלא שלכתחלה צריך הדחה » (ש״ך יו״ד קל״ז ס״ק א)

8. The winepress and the tap-hole

The Tur states the rule: « ויראה לי שאפי׳ כן אסור להוציא היין דרך נקבי הברזא שהנקב אסור והיין יוצא משם צלול מבלי תערובת החרצנים » (טור יו״ד קל״ז)

For the accomplished fact, the Shach gives the reason for the Rama’s leniency: « אלא הטעם הוא דהקליפה של הנקב בטל בס׳ דמה שיוצא דרך הנקב יש לעולם ס׳ נגד הקליפה דהא הרשב״א והטור גופיה לא אסרי אלא משום שהיין יוצא שם צלול ונאסר בכל שהוא אבל אם היה יוצא שם עם החרצנים וזגים היו מתירי׳ משום שיש ס׳ נגד קליפת הנקב וא״כ לדידן דקי״ל דסתם יינם בטל בס׳ אם כן בכל ענין שרי וזה ברור » (ש״ך יו״ד קל״ז ס״ק י״א)

9. The second wine: the Taz against the Nekudot HaKesef

The seif requires sixty in the second wine against the first — and the Shach gives the reason: « דכיון שהיין הראשון לא נאסר אלא בשתייה אינו אוסר בכל שהוא ריב״ש שם » (ש״ך יו״ד קל״ז ס״ק י״ב)

The Taz proposes a simpler calculation, drawn from our ruling in siman 134: « אבל לפי מה דקי״ל שם דבטל בס׳ אין אנו צריכין להוראה זאת אלא אם יש בין הכל דהיינו יין הראשון והשני ששים נגד קליפת הכלי האסור מותר הכל » (ט״ז יו״ד קל״ז ס״ק ו)

⚠ The Nekudot HaKesef’s objection, reported by the Ba’er Hetev: « ובנה״כ השיג עליו וכי דודאי צריך ביין הא׳ לחודיה ס׳ דאל״כ היין הא׳ נ״נ וצריך אחר כך ביין הב׳ ס׳ נגד כל היין הא׳ דע״כ לא ס״ל גבי יין ביין דלא נ״נ אלא מטעם דכיון דנאסר במשהו משא״כ היכא דנאסר מחמת שלא היה בו ס׳ והכי קי״ל לעיל סימן צ״ב ס״ד דאף לח בלח נ״נ אם לא במקום הפסד גדול עכ״ל » (באר היטב יו״ד קל״ז ס״ק ו)

The Shach, for his part, expressly rules out חתיכה נעשית נבילה here: « ולא אמרינן חתיכה נעשית נבילה כדלעיל סי׳ קל״ד ס״ק ט״ז » (ש״ך יו״ד קל״ז ס״ק י״ג) — and adds the consequence that is often forgotten: « ואם אין לבטל גם הכלים אסורים כאילו נתן יין של איסור בכלים כשרים » (ש״ך יו״ד קל״ז ס״ק י״ד)

10. Water, beer and salting: the siman’s one leniency

The sugya: « אִיבַּעְיָא לְהוּ: מַהוּ לִיתֵּן לְתוֹכוֹ שֵׁכָר? רַב נַחְמָן וְרַב יְהוּדָה אָסְרִי, וְרָבָא שָׁרֵי. רָבִינָא שְׁרָא לֵיהּ לְרַב חִיָּיא בְּרֵיהּ דְּרַב יִצְחָק לְמִירְמָא בֵּיהּ שִׁכְרָא, אֲזַל רְמָא בֵּיהּ חַמְרָא, וַאֲפִילּוּ הָכִי לָא חַשׁ לַהּ לְמִילְּתָא, אֲמַר: אַקְרַאי בְּעָלְמָא הוּא » (עבודה זרה ל״ג ע״ב)

The reason, in the Tur: « אף ע״פ שאסור ליתן בהם יין בכלי שנשתמש בהן הנכרי ביין מותר ליתן בהם מים ושכר ושאר כל מיני משקין לפי שהיין פוגם אותם » (טור יו״ד קל״ז)

11. Wine a second time, and the door of הפסד

The Mechaber is clear: without kashering, no. The Shach explains why the Rosh’s reasoning does not suffice here: « וכב״י ואע״פ שהרא״ש בתשו׳ התיר לפי שמתחלה נפלט בליעת הקנקן ביין ונתבטל היינו לדברי המתירין סתם יינם בס׳ וכבר כתבתי בסימן קל״ד דלא קי״ל אלא כדברי האומרים דאוסר במשהו ע״כ » (ש״ך יו״ד קל״ז ס״ק י״ח)

12. What cannot be measured: the word of a non-Jew

The Shach, in the name of the Rivash: « י״ל דהתם מיירי בדבר דלא אתחזק איסורא משא״כ הכא דודאי נשתמש בכלים אלו יין של איסור » (ש״ך יו״ד קל״ז ס״ק י״ט)

And the Beit Yosef, who refused to be lenient: « ולענין הלכה אע״פ שנראין דברי הר״ן מי יקל ראשו כנגד הנך רבוותא דאוסרים וכ״ש במקום שהר״ן לא רצה לסמוך על עצמו לעשות מעשה » (בית יוסף יו״ד קל״ז)

This seif is the condition of all the others. The siman’s measures presuppose that we know what happened in the vessel — and the siman ends by saying that this knowledge cannot come from there.

13. The 6 golden rules and the mnemonic “קליפה”

  1. The siman measures, it does not characterise. Every clause is a threshold.
  2. Quantity comes from the origin, status from the mode of mixture (ש״ך ס״ק ג).
  3. Three time thresholds: immediately, twenty-four hours, twelve months — three physical situations, not three opinions.
  4. One measures against a peel, except where it is known that the wine stood a full day (ש״ך ס״ק ט).
  5. Wine spoils what is not wine: hence the whole leniency of seif 4, and its limit — the occasional, not the regular.
  6. No measure dispenses with kashering for a further use with wine (seif 5).
ק קְלִיפָּה — against what does one measure? A peel, not the vessel.
ל לְפִי שָׁעָה — which vessel? A storage one: affected without delay.
י יָבֵשׁ — dry or moist? Residual moisture removes every threshold.
פ פְּלִיטָה — what mixed in is not wine: hence “drinking no, benefit yes”.
ה הֶכְשֵׁר — to put wine in again, there is no other way.

14. The 5 classic pitfalls and final recap

  1. Confusing “permitted for benefit” with “permitted”. The wine is not drunk; it is sold.
  2. Measuring the six volumes against the whole vessel. It is against the peel (ש״ך ס״ק ט) — unless it is known that the wine stood there a full day.
  3. Adding water in order to nullify. Permitted in advance, forbidden after the fact (ש״ך ס״ק ו).
  4. Extending the permission of seif 4 to permanent use. The Shach (ס״ק ט״ז) forbids it: the sugya speaks of an occasional use.
  5. Relying on a non-Jewish attestation. Seif 6 expressly refuses it.
