1. שורש הסימן — two idols, two moments, and the brick set upright

Seif 1 lays down an asymmetry that nothing, at first sight, justifies: the idol of a non-Jew is forbidden the moment it is made, that of a Jew only once it has been served. The mishna states it, the gemara grounds it in verses, and the Taz refuses to let one look for its reason.

« עֲבוֹדָה זָרָה שֶׁל נׇכְרִי — אֲסוּרָה מִיָּד, וְשֶׁל יִשְׂרָאֵל — אֵין אֲסוּרָה עַד שֶׁתֵּיעָבֵד » (עבודה זרה נ״א ע״ב)

The gemara identifies the author of the mishna, and reveals that one tanna held exactly the reverse:

« מִכָּאן אָמְרוּ: עֲבוֹדָה זָרָה שֶׁל נׇכְרִי אֵינָהּ אֲסוּרָה עַד שֶׁתֵּיעָבֵד, וְשֶׁל יִשְׂרָאֵל אֲסוּרָה מִיָּד, דִּבְרֵי רַבִּי יִשְׁמָעֵאל » (עבודה זרה נ״א ע״ב)

Ḥakira: what forbids the object — the status it receives, or theact performed upon it? (א) Status: as soon as a thing is made a god (חלות שם אלוה), it is forbidden, and worship is only one way among others of conferring that name upon it. (ב) Act: it is the service rendered to the object that forbids it, and the making is only a preparation. Rabbi Yishmael and Rabbi Akiva do not each take one branch — each applies one to the non-Jew and the other to the Jew, in opposite senses. The halakha follows Rabbi Akiva: for the non-Jew (א), for the Jew (ב).

For each of the two the gemara gives its verse — and it is out of these two verses that the Taz will make, at ס״ק א, the opening line of his commentary:

« מִשֶּׁפִּסְּלוֹ נַעֲשֶׂה אֱלוֹהַּ » (עבודה זרה נ״ב ע״א)

What the Taz refuses: the reason. One would be tempted to explain the asymmetry — the non-Jew holds his statue to be a god as soon as he has finished it, the Jew attaches himself to it only if he serves it. The Taz cuts this short:
« ואין לדרוש לטעמיה דקראי אלא גזירת המלך הם דישראל אינו אוסר עד שיעבוד » (ט״ז יו״ד קל״ט ס״ק א)

The refusal is not laziness: it is the premise of the whole following section on the apostate. If the rule depended on a reason, one could extend it by analogy; if it is a decree, one does not extend it beyond the words of the verses.

The appurtenances, for their part, know no such asymmetry — and the gemara says so in passing, in a question of Rav Hamnuna:

« בֵּין לְרַבִּי יִשְׁמָעֵאל וּבֵין לְרַבִּי עֲקִיבָא מְשַׁמְּשֵׁי עֲבוֹדָה זָרָה הֵן, וּמְשַׁמְּשֵׁי עֲבוֹדָה זָרָה אֵין אֲסוּרִין עַד שֶׁיֵּעָבֵדוּ » (עבודה זרה נ״ב ע״א)

Kushia: is a brick set upright by a Jew an idol of a Jew, or of a non-Jew? The Rama adds to seif 1: a Jew set a brick upright in order to bow to it, did not do so, and a non-Jew bowed to it. On (ב), an idol of a Jew is forbidden only by his own worship — and here it is the non-Jew who served it. On (א), the brick was never “made a god” by any carving. Whence, then, the prohibition?
« יִשְׂרָאֵל שֶׁזָּקַף לְבֵינָה, גַּלִּיא דַּעְתֵּיהּ דְּנִיחָא לֵיהּ בַּעֲבוֹדָה זָרָה, וְכִי אֲתָא גּוֹי וּפְלַח לַהּ, שְׁלִיחוּתָא דִּידֵיהּ קָעָבֵיד » (עבודה זרה נ״ג ע״ב)
Terutz: the worship of the non-Jew is the Jew’s own, by agency. Setting the brick upright is not carving it, but it is disclosing a will; the non-Jew who bows to it carries out the Jew’s errand. The brick is therefore indeed an idol of a Jew that has been served — and, like every idol of a Jew, it has no annulment. The Shakh states this precisely, and sets its exact limit:
« אבל זקף עובד כוכבים לבינה אחרת משל ישראל והשתחוה לה אינה נאסרת דשמא לא ניחא ליה אלא בזו שזקף » (ש״ך יו״ד קל״ט ס״ק א)

The agency extends only to what the Jew himself designated. And the gemara leaves open the question of the egg, whose setting upright is not visible:

« לְבֵינָה הוּא דְּמִינַּכְרָא זְקִיפָתָהּ, אֲבָל בֵּיצָה — לָא? אוֹ דִּלְמָא לָא שְׁנָא? תֵּיקוּ » (עבודה זרה מ״ו ע״א)
« וְכֵן אִם זָקַף בֵּיצָה וּבָא עוֹבֵד כּוֹכָבִים וְהִשְׁתַּחֲוָה לָהּ אֲסָרָהּ » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ח׳ הלכה ג׳)
Nafka mina An object belonging to a Jew, which he himself prepared for worship, and which a non-Jew served in his place. On (ב) taken alone one would have said: an idol of a Jew not served by him, therefore permitted. The gemara answers by agency, and the Shakh draws the double consequence: forbidden, and without annulment — the non-Jew who served it is not its owner.

2. ישראל מומר — the Taz against the Derisha, and the Nekoudot HaKessef against the Taz

This is the one ma’hloket of the siman where the Shakh answers the Taz with a single line of the Nekoudot HaKessef, and it is born directly of the refusal of the reason, in the preceding section.

« ודבר פשוט נ״ל דאפי׳ ישראל מומר לעבודת כוכבי׳ נקרא ישראל ודינו עד שיעבוד דאע״פ שחטא ישראל הוא כדאיתא בהרבה דוכתי וכן לענין ביטול שאין יכול לבטל אליל כמו ישראל » (ט״ז יו״ד קל״ט ס״ק א)

The Taz knows the opposite has been held, and he says against whom he writes:

« ודלא כמ״ש בדרישה בהג״ה סי׳ קמ״ה דישראל מומר לעבודת כוכבים דינו כעובד כוכבים דהא ילפינן לה כאן מקראי דעשה הבדל בין עובד כוכבי׳ לישראל » (ט״ז יו״ד קל״ט ס״ק א)
The structure of the argument. The Derisha reasons from the reason : one who serves idols is, for this matter, an idolater — his idol is a god as soon as he has made it. The Taz reasons from the source : the verses distinguish “their gods” from “what he sets in secret”, and the deciding word is ישראל, which the apostate has not lost (אע״פ שחטא ישראל הוא). Two consequences follow from a single principle: his idol is forbidden only once served, and he cannot annul an idol, no more than any other Jew.

The Nekoudot HaKessef do not dispute the reasoning; they set a text against it:

Kushia upon the objection. The Rambam says לכל דבריו — “in all his matters”. But the Taz did not deny that the apostate is treated as an idolater; he denied that he had ceased to be called a Jew where a verse says “Jew”. The question is therefore whether the Rambam’s לכל דבריו bears also upon rules founded on a decree of name, or only on those that follow a man’s conduct.
Two possible readings of the Nekoudot HaKessef. (א) The Shakh holds that לכל דבריו is without exception, and that the “reason” of the Derisha is in truth the position of the Rambam: it is because he is like an idolater that his statue is a god as soon as it is made. (ב) The Shakh does no more than point out that the Taz presented as a דבר פשוט what has against it a Rishon of the first rank — whence the ע״ש, “go and see”, without deciding. The Baer Hetev, who reports both texts one after the other, does not decide either:

Nafka mina Two cases, and they do not run in the same direction. First case: a statue made by an apostate, never served — on the Taz it is permitted, on the Derisha forbidden. The stringency here is on the side of the Derisha. Second case: an idol of a non-Jew, annulled by an apostate — on the Taz the annulment is worth nothing, and the object remains forbidden; on the Derisha it holds. Here the stringency is on the side of the Taz. A shita that makes the apostate a “non-Jew” is lenient in one case and stringent in the other: the sign that we are not before a humra, but before a definition.

3. תקרובת אין לה ביטול — why the offering is graver than the god

Seif 2 says something that ought to surprise: the idol of a non-Jew can be annulled, but what has been offered to it never can. The subordinate is weaker than the thing itself; how can the offering be stronger?

« אליל של ישראל אין לה ביטול אבל של עובד כוכבים ותשמישיה ונויה יש להם ביטול ותקרובתה אין לה ביטול » (שו״ע יו״ד קל״ט:ב)

The source is a tradition of Rav, and it rests upon a comparison with a corpse:

« מָה מֵת אֵין לוֹ בְּטִילָה לְעוֹלָם, אַף תִּקְרוֹבֶת עֲבוֹדָה זָרָה אֵין לָהּ בְּטִילָה לְעוֹלָם » (עבודה זרה נ׳ ע״א)

The Taz gives, for each of the three clauses of the seif, its verse — and he does not stop there:

« דכתיב לא תטע לך אשרה אצל המזבח מה מזבח טעון גניזה אף עובד כוכבים טעון גניזה ושל עובד כוכבים כתיב בה פסילי אלהיהם משמע שיכול לפסול אלוה שלו » (ט״ז יו״ד קל״ט ס״ק ג)
Ḥakira: does annulment remove a name, or does it express a renunciation ? (א) It removes a name: the object was “god”, it is so no longer, and everything that hung on that name falls with it. (ב) It expresses a renunciation: the owner has shown that he no longer holds the object sacred, and the prohibition — which followed his thought — ceases with it. On (ב), one does not see why the offering should be an exception: the priest who throws out the remains of the sacrifice renounces them as much as he renounces a shattered statue. On (א), the offering never bore the name of god — it therefore has nothing to lose by an annulment.

Terutz of the Taz: annulment acts upon what depends on wholeness. The idol and its ornament hang upon their entirety : one worships what is whole, one adorns with what is beautiful; mutilated, the object has lost what made it serve, and the thought that bound it to worship departs. The offering never hung on that — one offers a paltry thing, ugly, of no value. Mutilating it takes from it nothing it ever had; the prohibition therefore has nothing to fall by. This is branch (א), and the Taz formulates it in terms of that upon which thought fixes itself.

The Rambam states the rule without the reason, but he places the same word — לעולם — upon the idol of a Jew and upon the offering, and it is that juxtaposition the Taz explained:

« וְתִקְרֹבֶת עֲבוֹדַת כּוֹכָבִים אֵינָהּ בְּטֵלָה לְעוֹלָם » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ח׳ הלכה ט׳)
« כְּשֶׁבָּאוּ לְיָדֵינוּ וְהֵן נוֹהֲגִין בָּהֶם אֱלֹהוּת, אֲבָל אִם בִּטְּלוּם הֲרֵי אֵלּוּ מֻתָּרִין » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ח׳ הלכה ח׳)

יסוד הביטול מסלק שם — ואין הוא מסלק אלא ממה שהיה תלוי בשלימותו. האליל ונויו תלויים בשלימותם, ובטלים ; התקרובת אינה תלויה בכלום, ואין לה ביטול לעולם.

4. כעין פנים וכדרך עבודתה — two questions that seif 3 does not separate

Seif 3 repeats three times חייב ולא נאסר, and once אינו חייב ולא נאסר. It therefore mingles two questions — is the man liable? is the object forbidden? — whose answers do not coincide. It is the Ran who separated them, and the Taz who reported him.

Everything begins from two traditions of Rav, the second of which adds to the first the fate of the object:

« אָמַר רַב יְהוּדָה אָמַר רַב: עֲבוֹדָה זָרָה שֶׁעוֹבְדִין אוֹתָהּ בְּמַקֵּל, שָׁבַר מַקֵּל בְּפָנֶיהָ — חַיָּיב, זָרַק מַקֵּל בְּפָנֶיהָ — פָּטוּר » (עבודה זרה נ׳ ע״ב)
« אָמַר רַב נַחְמָן אָמַר רַבָּה בַּר אֲבוּהּ אָמַר רַב: עֲבוֹדָה זָרָה שֶׁעוֹבְדִין אוֹתָהּ בְּמַקֵּל, שָׁבַר מַקֵּל בְּפָנֶיהָ — חַיָּיב וְנֶאֱסֶרֶת, זָרַק מַקֵּל לְפָנֶיהָ — חַיָּיב וְאֵינָהּ נֶאֱסֶרֶת » (עבודה זרה נ״א ע״א)
Kushia of Rava: if breaking resembles slaughtering, throwing resembles sprinkling. Both are gestures of the Temple; why does the one forbid the stick and the other not?

Terutz: the resemblance to the Temple is a resemblance of result, not of gesture. Slaughtering breaks; sprinkling scatters. A broken stick is broken — the result is there. A thrown stick remains a stick — the gesture is there, the result is not. That is why the Rambam adds, to the letter of the gemara, the phrase שהרי המקל כמו שהוא והדם מתפזר.

There remains the underlying question: why does throwing the stick make one liable, if it does not make the object forbidden? The Ran answers by separating what seif 3 had mingled:

« כתב הר״ן לענין חיובא חדא מתרתי מחייב או כעין פנים ונפקא לן מזובח לאלהים יחרם או כדרך עבודתה ונפקא לן מאיכה יעבדו אבל לגבי איסור תקרובת לעולם אינו חייב אלא כעין פנים דנפקא מאשר חלב זבחימו » (ט״ז יו״ד קל״ט ס״ק ז)

Ḥakira: is the prohibition of the offering a consequence of worship, or a category of its own? (א) Consequence: everything by which an idol has been served becomes its offering — and then what makes one liable ought to make it forbidden. (ב) Category: “offering” is a name defined by the Torah (אשר חלב זבחימו), which addresses what resembles the sacrifices — and an act may be worship without producing an offering. The Ran chooses (ב), and it is the only way to read חייב ואינה נאסרת : two verses make one liable, only one forbids the object.

The last line is not in the Mehaber: it is the Shakh who adds it, following the Ran, and who identifies it with the tradition of Rav Naḥman:

Rashi, on the case of the broken stick, says in one sentence why both answers are here affirmative — and it is the only case in the table where they are:

« המקל בין שעבודתה בשבירה בין שאין עבודתה בשבירה הויא עבודה להתחייב והויא תקרובת ליאסר כדאמרן דכעין זביחה היא » (רש״י עבודה זרה נ״א ע״א ד״ה שבר מקל לפניה חייב ונאסרת)
Nafka mina An idol served by throwing objects before it — the case of Markulis, in section 7. On (א), every object thrown would be an offering with no possible annulment. On (ב), the thrown object is not an offering — there is no זריקה משתברת — and this is precisely the difficulty Rava raises against Rav Naḥman: “then by what are the stones of Markulis forbidden?” Rav’s answer — נעשה כמגדל עבודה זרה — confirms (ב): they are forbidden as an idol, not as an offering.

5. שבירת מקל בלא עבודת מקל — the Shakh reads the Tur otherwise than the Beit Yossef does

One word of the Tur is at issue. The Beit Yossef sees an omission in it and completes it; the Shakh sees a shita in it, and has defended it elsewhere.

The Tur writes, of the stick broken before an idol that is not served with a stick:

« אבל אם אין עובדין אותה במקל כלל ושבר המקל לפניה לא נאסר » (טור יו״ד קל״ט)

Only לא נאסר — nothing about the man. The Beit Yossef completes it:

« אלא שבמ״ש אבל אם אין עובדין אותה במקל כלל ושבר המקל לפניה לא נאסר יש קיצור שהו״ל לכתוב אינו חייב ואינו נאסר » (בית יוסף יו״ד קל״ט)

And the Mehaber, in the Shulḥan Arukh, writes what he said ought to have been written:

« אבל אם אין עובדים אותה במקל כלל ושיבר מקל לפניה אינו חייב ולא נאסר » (שו״ע יו״ד קל״ט:ג)
Kushia of the Shakh: the Tur omitted nothing. He wrote לא נאסר because that was all he meant to say — and as to the man, his position is the reverse of what the Beit Yossef ascribes to him:
« לטעמיה אזיל שכתב כן לדעת הטור ואחריו נמשכו הפרישה והב״ח אבל בספרי כתבתי דדעת הטור דלענין חיובא אע״פ שאין עובדים אותה כלל במקל חייב ולא נאסר וכדעת האחרים שהביא הר״ן » (ש״ך יו״ד קל״ט ס״ק ד)

“The others whom the Ran reports”: those who read the tradition of Rav Naḥman as bearing likewise upon an idol served by shaking the stick — and who deduce that the mention of worship with a stick was not a condition:

The Shakh’s reversal. The gemara says “an idol that is served with a stick”. For Rashi and the Beit Yossef, that is the condition of חיוב in the case of the broken stick: without worship by stick, breaking is nothing. For the Shakh — and the Raavad — it is the rebuta of the case of the thrown stick: even where it is served with a stick, throwing does not make one liable. Breaking the stick, however, makes one liable everywhere, because breaking is כעין זביחה for every idol in the world — exactly as slaughtering a beast makes one liable before any idol. The Tur therefore spoke only of the object: לא נאסר, because the object is forbidden only where the act is also its own manner of being served.

And from this reading the Shakh draws the Tur’s consistency in the next seif — the locust:

6. שחט לפניה חגב — the Rambam whom the Shakh ranges with Rabbi Yehuda

Seif 4 holds in a single line, and the Shakh devotes to it his longest ס״ק. What is at stake is the reading of the Rambam — and the Shakh turns it against the Beit Yossef, the Kesef Mishneh and the Migdal Oz together.

« שחט לפניה חגב נאסר אפי׳ אין דרך לעובדה בחגב כלל » (שו״ע יו״ד קל״ט:ד)

The gemara had proposed to see in the locust a ma’hloket of tannaim, then gave that up:

« לֵימָא כְּתַנָּאֵי: שָׁחַט לָהּ חָגָב — רַבִּי יְהוּדָה מְחַיֵּיב, וַחֲכָמִים פּוֹטְרִים » (עבודה זרה נ״א ע״א)

The Beit Yossef explains the Tur’s psak, and notes the Rambam in one line:

Kushia of the Shakh: it is not the Mehaber’s way to omit the Rambam. He did so here; why?

The Shakh’s reading: the Rambam follows Rabbi Yehuda, and not the Sages. The Shakh sets out from the gemara itself. If the baraita of the locust spoke of an idol not served by a locust at all, the gemara could have answered the first objection: “Rav speaks even according to the Sages, and the Sages exempt only where it is not its manner.” It did not do so. Therefore the baraita speaks of an idol served by the locust, in some way other than slaughtering — and it is there that Rabbi Yehuda holds liable and the Sages exempt. Where the idol has nothing to do with a locust, Rabbi Yehuda himself exempts: the locust is no better than a blemished beast, whose exemption the gemara derives from a verse. This is exactly what the Rambam says by placing the locust and the blemished beast side by side.

According to the Mehaber the locust is forbidden whatever this idol’s relation to locusts may be; according to the Shakh, if the idol is never served by a locust, all exempt — and what is exempt is permitted. The Baer Hetev records the divergence for the practitioner:

What sections 5 and 6 have in common. In both, the Shakh reads a text — the Tur, the Rambam — against the Beit Yossef’s reading, and in both he does so by the same key: the gemara did not answer what it could have answered, therefore it did not think so. On the stick, the result is that the Tur holds liable more broadly than the Mehaber; on the locust, that the Rambam exempts more broadly than the Mehaber. The two corrections pull in opposite directions, and that is the sign that they come not from a bias but from a method.

7. גדר התקרובת — the act, or the place?

Seifim 5 to 7 say where the object is found; but the underlying question is what makes an offering. The Tur and the Rambam do not answer it in the same way, and the difference bears upon everything that comes out of a place of worship.

« אָמַר רַב אַסִּי בַּר חִיָּיא: כׇּל שֶׁהוּא לִפְנִים מִן הַקִּלְקְלִין, אֲפִילּוּ מַיִם וּמֶלַח אָסוּר. חוּץ לְקִלְקְלִין — דָּבָר שֶׁל נוֹי אָסוּר, שֶׁאֵינוֹ שֶׁל נוֹי מוּתָּר » (עבודה זרה נ״א ע״ב)
Ḥakira: is the offering made by an act of offering, or byentry into the place of worship? (א) The act: the object must have been offered in the manner of the Temple — כעין פנים — ; and the place is only an indication that this act took place. (ב) The place: to bring a thing into the space of worship is to offer it; the place is not an indication, it is the act.

The Tur holds (א), and the Beit Yossef makes precise the sense of his phrase שאנו תולין — not “we presume a little was poured out”, but “to bring it in is to offer it”:

« אע״פ שברור לנו שלא נסכו מהיין ולא הקטירו מהסלת והשמן אסור משום דאמרינן הכניסו לפנים מן הקילקלין זו היא הקרבתו » (בית יוסף יו״ד קל״ט)

But the Tur maintains the condition כעין פנים : what is not offered in the Temple is no offering, even inside. The Rambam does not maintain it:

How the Beit Yossef makes the Rambam hold together with the mishna. The mishna permits what is found upon the idol’s head in a contemptuous manner; Rav Assi forbids all that is within the curtain, even water and salt. For the Rambam the mishna speaks of the outside ; inside, everything found there was brought in only as an offering or as an appurtenance, and the manner in which it is found changes nothing — someone else may have moved it. And the Tur? The Beit Yossef observes that he does not read the Rambam so, otherwise he would have cited him at seif 7 as well.

Seif 6 marks the boundary of (ב): the object on its way has not yet entered, and the mishna ofEin Maamidin permits it:

« בָּשָׂר הַנִּכְנָס לַעֲבוֹדָה זָרָה — מוּתָּר, וְהַיּוֹצֵא — אָסוּר, מִפְּנֵי שֶׁהוּא כְּזִבְחֵי מֵתִים, דִּבְרֵי רַבִּי עֲקִיבָא » (עבודה זרה כ״ט ע״ב)

And Peor and Markulis are the boundary in the other direction: no curtain, because their worship is itself an act of contempt; therefore the outside is as the inside.

The exact reach of the Ba’h’s stringency. It does not say that the Rambam is the halakha. It says that, upon a doubt of fact — דשמא נכנסו —, a position that makes the object forbidden with no possible annulment weighs more than a position that permits it after annulment, because error in the one direction is reparable and in the other it is not. It is a stringency of בעל נפש, and the Shakh so styles it: level 4 makes of it its line.
יסוד לטור — התקרובת נעשית במעשה, והמקום אינו אלא ראיה למעשה ; ולרמב״ם — המקום עצמו הוא ההקרבה, וכל הנמצא בפנים תקרובת. ובספק אם נכנס — בעל נפש יחמיר, שאין לתקרובת ביטול.

8. נרות של שעוה — seif 9 and seif 12 do not say the same thing

Seif 9 permits candles sold or pledged, “since he extinguished them for his own need”. Seif 12 makes the sale itself an annulment, and reports its denial only as a יש אומרים. The Shakh sees the tension and leaves it open; the Taz resolves it.

First, why is the candle an ornament and not an offering — since kindling was indeed done in the Temple? The Ran explains it, and the Beit Yossef reports him:

« נרות של שעוה שמדליקין לפני אליל מסתברא דלא מתסרי משום תקרובת אלא משום נויין דאע״ג דהואי הדלקה במקדש מ״מ לא הוו דבר המשתבר דליהוי כעין זביחה או כעין פנים הילכך בביטול סגי להו » (בית יוסף יו״ד קל״ט)

The Tosafot reach the same point by a mima nafshakh which makes the question of no consequence:

« ושמעינן מהכא דהני נרות של שעוה שמביאין דורון לעבודת כוכבים ומדליקין בפניהם ומשכיבן הכומר מכרם או נתנם לישראל מותר בהנאה ממה נפשך » (תוספות עבודה זרה נ׳ ע״א ד״ה בעינן כעין פנים וליכא)

The Tur then gives two positions on what annuls — the extinguishing, or the transfer:

« וה״ר יונה כתב אפילו אם כבן על דעת לחזור ולהדליקן הוי ביטול אבל כבו מעצמן לא הוי ביטול אבל אם משכנן לישראל או מכרן הוי ביטול כיון דלאו אליל עצמם הן » (טור יו״ד קל״ט)

Kushia of the Shakh: did the Mehaber contradict himself from one seif to the next? At seif 9, the clause דכיון שכיבן לצורך עצמו implies that without a deliberate extinguishing the sale would not suffice — that is Rashi. At seif 12, the sale suffices — that is the Ramban —, and Rashi is now no more than a יש אומרים.

Terutz of the Taz: at seif 9 the sale is not the annulment — it is the proof. of it. What annuls a candle is extinguishing it so as not to rekindle it. Now extinguishing is a mute gesture; one does not know, seeing a candle put out, whether the priest blew it out for the night or for good. The sale says so. It therefore effects nothing of itself, and that is why even he who at seif 12 denies the sale any value as an annulment concedes it here:

(א) An act: to sell is to divest oneself, and to divest oneself of an object of worship is to renounce it — Rabbenu Yona, the Ramban, the first opinion of seif 12. (ב) A sign: the sale renounces nothing of itself — it merely reveals the intention behind another gesture, the extinguishing — this is seif 9 as the Taz reads it, and it is compatible with Rashi. The Taz builds seif 9 upon (ב) and leaves seif 12 to (א): these are not two contradictory rulings, but two distinct mechanisms, the first of which holds even for one who denies the second.

Finally the Taz settles a difficulty internal to the Beit Yossef — who seems to refuse the gift to a Jew while yet reporting the Ran who allows it — by a distinction of words:

9. מלבושים וכלים — the ornament of the priests, the goblet and the censer

Seifim 11 and 12 put one question to two objects: what the priest wears, and what he holds. In both cases the answer depends on what is called serving the idol.

« מלבושים שלובשים הכהנים כשנכנסים לבית אלילים נוי שלהם הן ולא נוי של אלילים ואפילו ביטול אינם צריכים ויש מי שמצריך ביטול » (שו״ע יו״ד קל״ט:יא)

The Beit Yossef lines up the Rishonim on both sides:

(א) By whom it adorns: an ornament of the idol is what adorns it, the idol itself; what adorns the priest adorns him — and it matters little where he wears it. (ב) By its use: what is worn only for worship belongs to the order of worship, and shares in the idol. The reason the Raavya reports in the name of Rabbenu Gershom decides for (א) by a fact: the priest goes out in these garments before kings — they are therefore not reserved for worship. The Rama, for his part, sets the limit of (א): that with which one clothes the idol itself is an ornament in the full sense.

Seif 12 is broader in the Shulḥan Arukh than in the Tur: the Tur named the goblet, the Mehaber writes “the vessels he holds in his hand”:

« והגביע שאוחז הכומר בידו והמחתה שמקטיר בה משמשיה הן וצריכין ביטול » (טור יו״ד קל״ט)
« כלים שאוחז בידו והמחתה שמקטיר בה משמשיה הם וצריכים ביטול » (שו״ע יו״ד קל״ט:יב)
Kushia: is the goblet really an appurtenance? The Tosafot and the Mordekhai concede this only of the censer — because incense is burned in it before the idol — and permit the goblet; the sages of France, reported by the Ramban in the Ran, permitted silver goblets. The Tur and the Mehaber forbid them. On what ground?

What the second reason reveals. Those who permit do not deny that the goblet serves the offering; they deny that what is in the goblet is still an offering — because the idol is no longer fed, as the Mordekhai had said of the priests’ loaves (seif 8). The ma’hloket of seif 12 is therefore not about the object, but about the nature of the rite contemporary with those Rishonim: an offering in the sense of the Temple, or a ceremony without a recipient. The Mehaber wrote “the vessels he holds in his hand” so as not to decide object by object, and to make the rule general: what the priest holds during the worship serves it.

Seif 13 closes the series with a prohibition of another order — no longer the prohibition of benefit, but repugnance. Its source is a question left unanswered:

« בָּעֵי רֵישׁ לָקִישׁ: הַמִּשְׁתַּחֲוֶה לַדֶּקֶל, לוּלָבוֹ מַהוּ לְמִצְוָה? » (עבודה זרה מ״ז ע״א)
« וכתב עוד רבינו מאיר פסק תכשיטי כהני האליל דמותרים מ״מ לדבר מצוה לציין טלית אין נכון לעשות כן » (בית יוסף יו״ד קל״ט)
« וכן אפילו ללמוד בהן אסור. הר״ף בהג״ה תשב״ץ סימן תי״ז » (ש״ך יו״ד קל״ט ס״ק ח)
Nafka mina A priest’s mantle, never laid upon the idol. On (א) and on the Mehaber it is permitted without annulment; on the Mordekhai one is needed. But whichever is followed, seif 13 closes the same door upon it: it will become neither a tallit nor any object of mitzva, משום דמאיסי. And the Shakh extends the repugnance as far as the light one studies by — which shows that מאיס does not address the object of mitzva alone, but everything that puts another’s worship into the service of Torah.

10. ספרי עובדי כוכבים — writing, selling, lending, binding

The last two seifim leave the idol for the hand of the Jew : what he does with the books of another’s worship. Nearly every rule there is reported as a יש מי שאומר, and it is the Rama who, on the sale, piles up three opinions before concluding.

The source of seif 14 is in the Hagahot Maimoniot, and the Beit Yossef reports it with its reason — the same מאיס as seif 13:

« וכתבו עוד ההגהות לא יכתוב ישראל על הספרים של האליל אא״כ מחקם שלא יהיה רישומן ניכר משום דמאיסי ובשם רי״ח שמעתי שאפי׳ מחק ספרי האליל עד שאין רישומן ניכר אפ״ה לא יכתוב עליהם דברי תפלות ותחנונים דאין קטיגור נעשה סניגור » (בית יוסף יו״ד קל״ט)
Ḥakira: does the repugnance attach to the material, or to the memory ? (א) To the material: so long as the old writing is recognizable, the parchment is marked; erased, it is neutral — this is the first rule of seif 14. (ב) To the memory: the parchment has served, and nothing erases that; one does not make an advocate of what once accused — this is the second opinion, which refuses prayers even on an erased page, and which extends its refusal only to prayers, because it is there that the contrast between accuser and advocate is sharpest.

On the sale, the Mehaber reports the permissive opinion, from the Shibbolei haLeket:

« וכתוב בשבלי הלקט ספרים של עכו״ם עובדי אלילים שנשתקעו ביד ישראל הרב רבינו אלעזר לא היה תופס איסור למכרם » (בית יוסף יו״ד קל״ט)

The Rama sets against it the Tosafot, who lay down the foundation of the prohibition — לפני עור — and derive from it that even a sale to a layman is forbidden:

« והכי נמי ספרי׳ פסולים הראוים לתיפלה בבית עבודת כוכבים אסור למכור להם לכומרים דעובר משום לפני עור ואף לעובד כוכבים שאינו כומר אסור דבודאי יתננו או ימכרנו לכומר » (תוספות עבודה זרה י״ד ע״ב ד״ה חצב קשבא)

The Shakh broadens the object itself, in the name of Rabbenu Yeruḥam — Bibles translated for their use are books of worship:

« וכ׳ רבינו ירוחם ני״ז ח״ה דהוא הדין ספרי הכ״ד של עובדי כוכבים הכתובים בלשון לע״ז או שאר לשונות שלהן אסור למכור להן כי מי שהעתיקן להם שינה בלשונו כדי לפקרם ולחזק אמונתם » (ש״ך יו״ד קל״ט ס״ק ט)
Kushia: if the reason is לפני עור, what of paper and ink? The Rama reports stringent authorities who forbid selling them even the parchment and ink to write their books. But blank parchment is not a book of worship; the buyer may do anything with it.
« וכ׳ הב״ח דאין איסור בדבר אלא נכון ליזהר וכן כתב מהרש״ל בביאורי סמ״ג וכתב ד״מ סימן קכ״א דאינו אלא בידוע שרוצה לכתוב ספר דתם אבל סתמא שרי » (ש״ך יו״ד קל״ט ס״ק י״א)
Terutz: the measure of לפני עור is the certainty of the use. The Darkhei Moshe, reported by the Shakh, holds exactly the line of the Tosafot: they forbade the sale to a layman because בודאי he will give the book to the priest; the Darkhei Moshe forbids the parchment only where it is בידוע that it will serve for their book. It is the same rule: the prohibition follows certainty, not possibility. Without certainty, the Ba’h and the Maharshal see only a precaution — נכון ליזהר.

The last two rules — lending for building, and binding — come the one from Rabbi Eliezer of Metz, the other from Rabbi Avigdor:

Nafka mina A bookbinder to whom a book of worship is brought. On the sale, the Rama left three opinions and a blessing for the stringent; on the binding, the Mehaber leaves but one — אין לקשור — and he joins to it two clauses the sale does not have: the exception of the registers of judges and scribes, which are not cultic, and the clause of enmity, which does not permit but commands one toslip away. It is a sharper prohibition than that of the sale, and a more explicit way out: because to bind is to make with one’s own hands a book of worship, whereas to sell is to hand over what already exists.
The line of the whole siman, in one sentence. Four objects, two owners, fifteen seifim — and, at the end, a bookbinder who slips away. The siman begins with what the idol communicates to what surrounds it, and ends with what the Jew communicates to another’s worship by his hand. Between the two, the same question returns under every case: has the object been made a god, served as a god, or only brought near — and the answer decides everything, because it decides the one thing that counts at seif 2: can it still be annulled.
