Halakha lema'asse — the practical psak

From the Mehaber’s psak and the Rama’s gloss to the rulings of the Shakh, the Taz,
the Pitchei Teshuva, the Baer Hetev and the Nekudot HaKesef

Subject:

⚠ Level notice:
This level is not “Daat HaRav”: the Shulchan Arukh HaRav
(the Alter Rebbe) does not cover Yoreh De'ah, hence not Siman 141.
It is a level of practical psak: what one does, and whom one asks.

How to read this level. Every statement here rests either on the text of the Shulchan Arukh and its nossei kelim, or on a named and checkable posek (Rambam, the Gemara in Avodah Zarah and Rosh Hashanah). In Yoreh De'ah there is no Mishna Berura (which comments only on Orach Chaim) and no Shulchan Arukh HaRav (the Alter Rebbe did not write Yoreh De'ah). The Arukh HaShulchan is not cited: its text on this siman is not accessible to us, and one does not quote what one cannot verify. What remains is more than enough: the Shakh (36 ס״ק), the Taz (15 ס״ק), the Pitchei Teshuva (15 ס״ק), the Baer Hetev (26 ס״ק) and the Nekudot HaKesef (two entries). Where a question runs past the siman, this level says so and stops: halakha lema'asse goes through your Rav.

One object, three questions that do not answer one another. This siman never asks “is this figure an idol?” It asks first who holds it and how it came to be there. To find it is a doubt of idolatry, settled by presumptions: the place, the emblem in the hand, the standing of the vessel (seifim 1–3). To make it is a Torah prohibition drawn from a verse, independent of any actual worship: one may make neither the servants on high nor the likeness in which He shows Himself to the prophets (seif 4). To keep what another made is a rabbinic prohibition of suspicion, and it has its exits (seifim 4–5). Confusing these three regimes is the mistake the Shakh pins by name on the Levush.
The three founding texts, in the order the siman uses them: the mishna of the chapter כל הצלמים for the image found, the verse in its twofold reading for what one may not make, and the baraita of the ring for what one may not keep.
And the Rambam, whose language the Mehaber copies in seif 1, states the presumption as a rule and not as a doubt:
What this changes for you. Faced with a figure, never begin by judging it beautiful or ugly, old or new. Ask: am I finding it, making it, or keeping it? The three answers come from different seifim, do not carry the same weight, and do not have the same exits.

Siman 141 has eight seifim — the count announced by the heading (ובו ח׳ סעיפים) and the actual count of the text on Sefaria. The Rama glosses four times: at seif 1, twice at seif 3, and at seif 4; seif 7 closes with his two words of custom.

SeifWhoPsak (anchored in the text)
1Mehaber · Rambam · RamaAn image found: forbidden in villages, permitted in towns; at the town gate with an emblem in hand, forbidden. A figure people bow to needs annulment; a pendant worn as a keepsake is not a צלם.
2MehaberFragments thrown away — permitted, even of idols; a hand or a foot standing on its base — forbidden.
3Mehaber · RamaSun, moon, dragon on a vessel: honoured forbidden, lowly permitted; two views where the figure is certainly worshipped, and the custom follows the first. Nowadays: benefit permitted, keeping forbidden. The dragon may be made but not kept.
4Mehaber · RamaForbidden to make the four faces together, angels, a man alone — even for decoration; forbidden to keep them. Found: permitted, except sun and moon. Raised only — except the heavenly bodies, forbidden even sunken. Study permits; a public place permits keeping.
5MehaberA ring with a human seal: raised, one seals with it but does not wear it; sunken, one wears it but does not seal with it. Sealed by a non-Jew, it is not kept.
6MehaberAnimals, birds, fish, trees and plants: permitted to make, even in relief.
7Mehaber (יש מי שאומר) · RamaOnly a complete figure is meant; a head alone or a body without a head carries no prohibition, neither in finding nor in making — and that is the custom.
8MehaberNo replica of the Heikhal, the Ulam, the Azara, the Table, the Menorah. Five, six or eight branches: permitted; seven of metal: forbidden, even without cups, even low.

The text of the seif, and its logic

The Mehaber lays down two opposite presumptions, then an exception that cuts across both: in villages images are not made for decoration; in towns they are; but at the town gate, with an emblem in the hand, the presumption of decoration falls everywhere.

First practical question: and if one is in doubt? The Mehaber writes דסתמא on one side and דודאי on the other. The Shakh reads the asymmetry as deliberate: to permit, one must know for certain that the figure was made for decoration.
The Taz reaches the same verdict by another route — that of the presumption of prohibition:
Second question: which figure? The Tur speaks of a human figure; the Bach infers that only a man is meant. The Shakh and the Taz refuse: here the Mehaber copies the Rambam, and the Rambam says הצורה without restriction — any figure known to be worshipped.
Third question: and nowadays? The Shakh does not mechanically transpose the map of villages and towns. He gives a criterion, and it is the one that governs every contemporary application of the seif:
Lema'asse. A figure that is found is permitted only if one knows it was made for decoration; doubt remains forbidden (Shakh ס״ק א, Baer Hetev ס״ק א). The emblem in the hand — staff, bird, orb, sword, crown, ring — forbids any figure, not only a man (Shakh ס״ק ג, Taz ס״ק א). And today geography no longer decides: what the object itself shows decides (Shakh ס״ק ד). So a concrete case — a statue brought back from a trip, an antique-shop find — is put to a Rav with an exact description of what one sees on it.

The Rama’s gloss adds two cases the Mehaber had not raised — and today they are the more frequent of the two. A figure people bow to: that is a צלם in the full sense, and it requires a proper annulment (siman 146). An object hung on the neck as a keepsake: it is not one.
The Shakh at once narrows the pendant’s permission. It holds only where one knows that no one bowed to it; otherwise it is no better than an honoured vessel of seif 3. And on the object of worship itself, the honoured/lowly distinction does not apply at all.
The Pitchei Teshuva brings a concrete application of the same logic from the Pri Tevua, about spoons engraved with figures — and turns it, through the Ran cited in the Shakh, into a ספק ספיקא:
Lema'asse. An object people bow to is not made permitted by being found: it needs annulment, and the annulment of an idol is a regulated act, treated in siman 146 — not a decision one takes alone. A medal, a cross or a figurine received as a keepsake is permitted if one knows nobody bowed to it (Shakh ס״ק ו); if that is unknown, it is no better than a figured ornament, and the question stands.

The seif, and the precise point where the Shakh departs from it

The Mehaber permits fragments — including those of a certain idol — and forbids only a limb resting on its base, because it no longer looks like a fragment but like a piece made that way from the start. The Shakh accepts the ruling yet writes that the Rambam is the primary view, and points out an internal contradiction in the Shulchan Arukh.

Why fragments are permitted: one assumes the non-Jew broke the image, and breaking it by hand counts as annulment. The concern of siman 146 — an idol broken of itself remains forbidden — does not apply here, because an owner guards his idol.
The Taz adds Rashi’s answer — breaking of itself is not common, and one follows the majority — and explains what “standing on its base” means:
The Shakh’s reservation, and why it carries weight. He does not merely say he prefers the Rambam: he shows that the Mehaber himself copied the Rambam in siman 146:11, where he forbids fragments of an idol. Two passages by the same author contradict each other, and the Shakh ends with וצ״ע.
Lema'asse. Shards of plaster or stone found in a dump, in a scrap heap, on a building site: the Mehaber permits them, and that is the ruling of the seif. But once one knows the piece comes from an idol actually worshipped, the Shakh (ס״ק ז) holds the Rambam to be the primary view and forbids, and his objection from siman 146 was never answered: such a case goes to a Rav. And a fragment reworked to stand — a hand, a foot, a bust on a base — is forbidden by the seif itself, without dispute.

Three figures, two grades of vessel, and a third term the Shakh adds

The seif speaks only of the sun, the moon and the dragon. The dividing line is the standing of the object: what is honoured was surely made for worship, what is lowly was made only for decoration. The Shakh adds the case the seif omits — a vessel neither honoured nor lowly.

What “the figure of the sun” means — and this is decisive. The Rama explains that these are the talisman-makers’ figures, such as a crowned king on a chariot; and the Shakh infers that a plain disc is not included when one finds it. But he immediately shuts the door: to make or to keep the disc itself remains forbidden.
The grey zone, and the Shakh’s edge: a middling vessel is forbidden, because the permission for the lowly rested on a certainty it lacks. And on the list of honoured objects, the Shakh notes that the Mehaber reported none of the Tur’s lenient readings — a sign that he rules strictly.
The Pitchei Teshuva on coins — for the Mehaber lists them among the lowly objects, and modern practice touches them daily:
The seif’s two views, and what the custom kept. First view: if one knows that these vessels were not worshipped, even honoured ones are permitted. Second view: a figure certainly worshipped forbids even a lowly vessel. The Rama rules like the first — then reports stringent opinions, which the Shakh refutes without ceremony.
Lema'asse. A vessel found bearing one of these figures: if it is everyday ware — a pot, a glass, a copper coin — it is permitted; if it is precious — silk, jewellery, a ring — it is forbidden; if it is in between, the Shakh (ס״ק י) forbids. And nowadays, when these figures are not worshipped, the Rama permits benefit from them when found but not keeping them at home — keeping remains forbidden on account of suspicion; and the Shakh (ס״ק י״ז) rejects the extra stringency for want of a source. An old silver coin is an open case: the Knesset Yehezkel counts it among honoured objects (Pitchei Teshuva ס״ק ד). To be put to a Rav.

The dragon is the only case in the siman where making is permitted and keeping is forbidden. The reversal is instructive: the prohibition on making comes from the verse, which targets the servants of heaven; the prohibition on keeping comes from suspicion, which targets what people worship. The dragon flies in the air without being in heaven — hence it may be made; it is worshipped — hence it may not be kept.
The Taz gives the reason for the prohibition on keeping, and draws from it a consequence the Shakh confirms: here, sunken form saves nothing.
The difficulty the Shakh leaves open. In seif 7 the Mehaber writes that only a complete figure is forbidden — for a man and for a dragon, in making as in finding. Yet the dragon would be permitted to make even complete. The Shakh suggests limiting the clause to the man alone, then admits that Tosafot and the Mordechai say the opposite, and the Semag more so.
Lema'asse. A dragon may be drawn, carved, embroidered — that is the Rama, and the Shakh (ס״ק י״ח) gives the reason in the name of the Maharshal. But one does not keep it at home, even nowadays (Shakh ס״ק י״ט), and even sunken (Taz ס״ק ו, Baer Hetev ס״ק י״ד) — because the concern here is not that I might make a servant of heaven, but that the object may already have been worshipped. And on a complete dragon the Shakh himself concludes

Here presumption no longer operates: it is a verse

Seifim 1–3 weighed probabilities. Seif 4 changes register: there is nothing left to weigh. A Jew makes neither the four faces together, nor seraphim, ofanim and ministering angels, nor the figure of a man alone — and doing it for decoration changes nothing.

Two derashot in one verse, and the Shakh names them one after the other: אתי — “with me”, my servants; אותי — “me”, the likeness in which He shows Himself to the prophets, that is, man.
Why two derashot, if a man alone is already forbidden? The Taz answers, and his answer has a clear practical consequence: if one wishes to repair a forbidden piece, removing the human face is not enough; the four faces are forbidden as a set. The Nekudot HaKesef correct a remark of the Taz on this point.
Three of the Shakh’s precisions that make up the whole practice. First, making for decoration and making for a non-Jew are the same — the verse concerns the act. Second, telling a non-Jew to make them is likewise forbidden: אמירה לעובד כוכבים שבות, even outside Shabbat. Third, what one finds remains permitted for benefit — but not for keeping.
Lema'asse. Do not make, and do not have made: no angel, no seraph, no complete human figure in relief, no sun, moon or stars. Ordering the piece from a non-Jewish craftsman circumvents nothing (Shakh ס״ק כ״ג, Baer Hetev ס״ק י״ז). What you find already made you may benefit from — sell it, trade it — but you do not leave it in your house (Shakh ס״ק כ״ד, Taz ס״ק י). And a forbidden piece is not repaired by erasing the human face alone (Taz ס״ק ז).

The rule, its exception, and the misreading to avoid

The Mehaber restricts the prohibition of seif 4 to raised work: what is woven into cloth or painted on a wall is permitted. One family of figures escapes the restriction — sun, moon and stars — because in the firmament they too appear sunken.

The misreading, named. The Levush had tied the raised/sunken axis to the found/made axis: what is forbidden when found would be forbidden even sunken. The Shakh dismantles the link — they are two independent axes — and in passing establishes that painting counts as sunken, and that only a truly complete figure is meant.
And yet the Taz does not follow the permission. The Ramban holds that whatever is forbidden by the Torah — the four faces, the angels, the heavenly bodies, man — is forbidden raised and sunken alike; the Tur and the Ran conclude so. The Taz is surprised the Mehaber does not bring this view, and lays down the practical rule.
The Pitchei Teshuva applies all this to real places — a solar window, a wall painting, an ark curtain, the doors of the Aron Hakodesh — and his severity grows where the place is holy:
Lema'asse. A human face painted, embroidered, printed or photographed does not have the status of a raised figure: the Mehaber permits it, and the Shakh (ס״ק כ״ה) explains that painting counts as sunken. But for what the Torah forbids, the Taz (ס״ק י״ב) and the Baer Hetev (ס״ק י״ט) write that אין להקל כלל against the Ramban — so one makes no angel, no sun, moon or star, even flat. An incomplete figure, a profile, a sketched outline, does not fall under the prohibition (Shakh ס״ק כ״ה). And for a synagogue the question is no longer only relief: the Pitchei Teshuva (ס״ק ג, ס״ק ח) holds that a place of prayer is more exposed to suspicion than a private house, and requires erasing. No decision about a communal building is taken without the community’s Rav.

Suspicion has exits — and they are not interchangeable. Study opens both leaves: it permits making and keeping, even in relief. A public place opens only one: one may keep there, one may not make there. And even there, Rabbenu Yeruḥam adds that the thing is unseemly.
The source of the study permission is the baraita in Rosh Hashanah and Avodah Zarah, about the moon figures Rabban Gamliel showed the witnesses:
The Nekudot HaKesef use that very exit to defend the machzorim illustrated with the twelve signs, of which the Taz disapproved:
Lema'asse. An anatomical model, an astronomy chart, a study maquette: permitted to make and to keep, with no reservation about relief (seif 4, Shakh ס״ק כ״ו). A figure in a place open to the public — a community hall, a lobby — may stand there if another made it, but one does not make it there, and the Shakh recalls that a respectable person abstains (ס״ק כ״ז). The Shakh adds that with two people already there is no suspicion. Machzor illustrations are defended by the Nekudot HaKesef; a synagogue building falls back under the Pitchei Teshuva of the previous section.

One ring, two crossed prohibitions. If the seal is raised, the ring itself is a figure one keeps — forbidden to wear; but the impression it leaves is sunken, so sealing is permitted. If the seal is sunken, the reverse: one may wear it, but each impression produces a raised figure.
The Shakh restates the mechanism and extends the rule of section 8: neither does one tell a non-Jew to seal with a sunken ring, because the instruction counts as the act.
And the Pitchei Teshuva brings all this back to ordinary practice — for a seal is not pressed on silk but on paper, and paper is not an honoured object:
Lema'asse. A signet ring, a seal or a stamp bearing a complete human face in relief is neither worn nor kept — but one may use it to seal (seif 5, Shakh ס״ק כ״ח, Baer Hetev ס״ק כ״א). The same object engraved sunken may be worn, and the accepted practice of sealing a letter with it comes from the Tiferet LeMoshe, cited by the Pitchei Teshuva (ס״ק ט): paper counts as a lowly object. Sealing on a precious material is another matter. And the seif adds that a ring a non-Jew sealed for you is likewise not kept.

What the Torah never forbade

After four seifim of stringency, two seifim of permission — and they must be read as firmly as the others. Beasts, birds, fish, trees and plants may be made without reservation, even in relief. And an incomplete figure is not included at all.

The question of the lion and the zodiac signs. The Bach objected: the lion and the bull are signs, hence heavenly bodies, hence forbidden. The Shakh answers from fact — nobody ever took care about this — and then from law: it is the twelve together that are forbidden, like the four faces.
Seif 7 and its challenge. A head without a body, a body without a head: no prohibition, neither in finding nor in making, and the Rama adds that this is the custom. But the Shakh showed in section 7 that Tosafot, the Mordechai and the Semag think otherwise, and the Pitchei Teshuva brings two voices that refuse to rely on this custom.
The Amsterdam case, reported by the Sheilat Yaavetz: a man had a silver medal struck with his own likeness, head and bust in relief. The Yaavetz sees a double prohibition in it, and rejects the argument that coins are lowly objects.
Lema'asse. To sculpt a horse, a fish, a tree, a lion: permitted, even fully in the round (seif 6, Shakh ס״ק ל׳ in the name of the Rashba). To make the twelve signs together: that is where the Shakh sets the limit. An incomplete human figure — bust, head, outline — is not covered by seif 7, and that is the custom; but the Shakh (ס״ק ל״ב) writes that one who is strict will be blessed, and the Shelah preferred not to follow the custom (Pitchei Teshuva ס״ק י״א). Having a medal struck or a bust cast with one’s own face in relief is precisely the case the Sheilat Yaavetz forbids (Pitchei Teshuva ס״ק י). Finally, the Taz and the Baer Hetev cite Rabbenu Elyakim: one does not paint these figures in a synagogue, lest one appear to bow to them.

A prohibition of another family

The last seif no longer speaks of idolatry at all. It forbids reproducing the Temple and its vessels: the Sanctuary at its measurements, the portico, the courtyard, the Table, the Menorah. The reason is neither doubt nor suspicion — it is that these objects are not copied.

The two exits the Shakh leaves open, and they are narrow: change a dimension, or change the material. What invalidated the Menorah in the Temple — wood, earthenware — is what permits it here.
And the point people always think they can get around: what does not invalidate the Temple Menorah does not exempt its replica. Without cups, knobs or flowers, lower than eighteen tefachim: it remains forbidden.
The Pitchei Teshuva closes three further exits — the argument from the First Temple’s dimensions, the arrangement of the branches, and the cups:
Lema'asse. A seven-branched Menorah of metal is not made, at any height, with or without cups (seif 8, Shakh ס״ק ל״ו). Arranging the six branches in a circle, a triangle or a square changes nothing according to the Bekhor Shor, and the Pitchei Teshuva (ס״ק י״ד) concludes stringently because it is a Torah prohibition. The remedy lies elsewhere: five, six or eight branches, or wood and earthenware (Shakh ס״ק ל״ה, Baer Hetev ס״ק כ״ו). A Temple model changes one measurement (Shakh ס״ק ל״ג) — and one does not work out that calculation alone. And if a non-Jew made the house or the vessel, the Tiferet LeMoshe permits living in it and using it (Pitchei Teshuva ס״ק י״ב): here too, as everywhere in the siman, it is the making that was forbidden before the use.

👈 Case 1 — The museum statue, and the one brought home

A statue on display in a museum is neither made nor kept by you: you find it. Seif 1 then asks neither its age nor its beauty, but what it shows — an emblem in the hand, a posture of worship, an altar base. The Shakh (ס״ק ד) writes that today geography no longer decides: הכל לפי ענין. And if a doubt remains, the Shakh (ס״ק א) and the Baer Hetev (ס״ק א) forbid the doubt. Bringing the piece home adds the question of keeping, which is a different question.

👈 Case 2 — The medal and the collector’s coin

A coin is listed by the Mehaber among lowly objects, hence permitted even when figured. But the Pitchei Teshuva (ס״ק ד) cites the Knesset Yehezkel: silver is honoured, copper is lowly. And if it is you who has a medal struck with a human face in relief, you are no longer in seif 3 but in seif 4 — that is the Amsterdam case, which the Sheilat Yaavetz forbids twice over (Pitchei Teshuva ס״ק י).

👈 Case 3 — The doll, the figurine, the bust

A doll is a complete human figure, in relief. The letter of seif 4 covers it, and the Shakh (ס״ק כ״ה) defines the complete figure: two eyes, a whole nose, the entire body. Two reliefs exist: seif 7 permits what is incomplete — and many schematic figurines are — and the study permission covers teaching material. A child’s toy is a concrete case: describe it to your Rav rather than ruling on a category.

👈 Case 4 — The sun in a logo, a sign, a window

A solar disc that one finds is permitted (Shakh ס״ק ח), but drawing it is not: the Shakh writes that making or keeping the disc is forbidden, and the Pitchei Teshuva (ס״ק ג) brings the Chatam Sofer’s responsum about a synagogue with a round window shaped like the sun, with rays in relief — he concludes that it must be removed. A solar logo is no graphic trifle; it falls under seif 4.

👈 Case 5 — The synagogue’s paintings and windows

Three texts cross here. The Shakh (ס״ק כ״ה): painting counts as sunken, hence permitted for what is not Torah-forbidden. The Taz (ס״ק י״ד) and the Baer Hetev (ס״ק כ״ג), in the name of Rabbenu Elyakim: one does not paint these figures in a synagogue. The Pitchei Teshuva (ס״ק ח), in the name of the Divrei Yosef: in a place of prayer one does not rely on the public-place permission, and it must be erased. A synagogue decoration project is decided with the community’s Rav, not from a general principle.

👈 Case 6 — The seven-branched Menorah

It is the object people most want, and seif 8 refuses it most plainly. Seven branches of metal: forbidden, even without cups or knobs, even low (Shakh ס״ק ל״ו). Arranging them in a circle or a square saves nothing according to the Bekhor Shor, and the Pitchei Teshuva (ס״ק י״ד) concludes stringently. What is permitted: five, six or eight branches — or wood and earthenware, invalid in the Temple and permitted here (Shakh ס״ק ל״ה).

👈 Case 7 — The signet ring, the stamp, the signature

A seal bearing a complete human face: in relief, one neither wears nor keeps it, but one may seal with it (seif 5). Sunken, one wears it, and sealing a letter is the accepted practice, because paper counts as a lowly object (Pitchei Teshuva ס״ק ט). Telling a non-Jew to seal in your place circumvents nothing (Shakh ס״ק כ״ט).

The point this level will not settle. This siman assumes settled a question it never asks: what non-Jews today actually worship, and what they no longer worship. The Shakh (ס״ק ד) explicitly makes this a question of fact, to be judged case by case, and the Rama rests the whole permission of our time upon it. This level sets out the psak; it does not judge the facts for you, and it does not replace your Rav.

Begin by describing to him what you see, without concluding: that is exactly what this siman asks of whoever finds a figure.
