From the Mechaber’s ruling to the arbitration of the Shach, the Taz, the Baer Hetev,
the Pitchei Teshuva and the Nekudot HaKesef, down to today’s cases

⚠ Level notice :
This level is not “Daat HaRav”: the Shulchan Arukh HaRav
(Admur HaZaken) does not cover Yoreh De'ah, and so not Siman 142.
It is a level of practical ruling: what one does, and whom to ask.

How to read this level. Every statement is anchored either in the text of the Shulchan Arukh and its nossei kelim, or in a named and checkable posek (Tur, Beit Yosef, Rambam, Rashi, the gemara in Avodah Zarah, Pesachim, Beitzah, Chullin and Temurah). On Yoreh De'ah there is no Mishnah Berurah (which comments only on Orach Chaim) and no Shulchan Arukh HaRav (the Admur HaZaken did not write Yoreh De'ah). The Arukh HaShulchan is not cited: its text on this siman is not accessible to us, and one does not cite what one cannot verify. There remain, and they suffice: the Shach (34 ס״ק), the Taz (18 ס״ק), the Baer Hetev (27 ס״ק), the Pitchei Teshuva (3 ס״ק) and the Nekudot HaKesef (one entry). Where a question runs beyond the siman, this level says so and stops: halakha lema'asse goes through your Rav.
The whole siman is decided with two instruments, and the Mechaber gives both of them in the Rambam’s language.
Second measure — cause.
| Seif | The Mechaber’s ruling | What the nossei kelim make of it |
|---|---|---|
| א | Coal and ashes forbidden, flame permitted | Taz and Shach: the coal is forbidden even after the fact; the flame only when detached |
| ב | Slaughtering permitted; cutting and a dying animal forbidden | Shach: the dying animal is forbidden entire, with no redemption; cut meat requires redemption |
| ג | Garment woven with the shuttle forbidden; if mixed, redemption | Shach: without a mixture there is no redemption; and redeeming the shuttle never suffices |
| ד | Oven to be cooled; bread forbidden; embers raked out: permitted | Shach and Taz: in idolatry the last clause does not hold |
| ה | Vessels fired with forbidden wood: forbidden | Shach: because they are then used with no permitted cause |
| ו | Bread baked over the embers: permitted | Shach and Taz: forbidden in idolatry |
| ז | Pot with two kinds of wood: forbidden | Taz: even for the lenient view, because of shevach etzim |
| ח | Independent fledglings and the nest permitted; eggs and dependent fledglings forbidden | Shach: the reed does not permit what was not permitted |
| ט | Shade forbidden; passage according to the road | Taz: the shadow of the shadow too; Shach: running is not always required |
| י | Idol-house: inside and facing the entrance forbidden, behind permitted | Shach: the “some forbid” bears only on the opening of the seif |
Vegetables, field, cow: permitted | Shach and Taz: at the outset for the vegetables only |
Tree kept for the festival: forbidden | Shach: all the more if its priests sit beneath it |
Barren trees: forbidden | Shach: adornment, and standing there is already its use |
Bathhouse: permitted | The criterion is the use, not the form |
Listening and looking forbidden; the unintended permitted | Shach: smell too; and the permission has two edges |
The flame is permitted, but on a condition that practice makes narrow: it must be detached from its coal.
« פי׳ כשאין שם אלא השלהבת לחוד אבל אם השלהבת קשורה בגחלת פשיטא שאסור לחמם משלהבת טפי מגחלת גרידא » (ט״ז יו״ד קמ״ב ס״ק ג)The Pitchei Teshuva specifies that the severity depends on the origin of the prohibition — forbidden wood, or a coal offered as an offering:
The Baer Hetev concludes with them:
« ומ״מ בחדש דמותר כשיסיק אותו אח״כ היינו דוקא כשנותן עצים בתחלה וסתמא דמלתא מסיקין אותו תחלה ואח״כ נותנים שם הפת אבל אסור ליתן שם לכתחלה הפת ואח״כ יסיקוהו » (ש״ך יו״ד קמ״ב ס״ק י)Whatever was baked without cooling, the blaze opposite, is forbidden for benefit. Whatever was baked over the embers or in residual heat alone is permitted by the letter of the Mechaber; the Shach, the Taz and the Baer Hetev forbid it. In a real case, that is where one must ask a Rav.
ר״ן » (ש״ך יו״ד קמ״ב ס״ק כ״ה)For the field and the cow it is after the fact only — one does not deliberately manure a field this way:
And the Taz points to the Rama’s qualification for a beast fed this way all its life:
« אֲפִילּוּ לְמַאן דְּאָמַר ״זֶה וָזֶה גּוֹרֵם מוּתָּר״, קְדֵירָה — אֲסוּרָה, דְּהָא קַבְּלָה בִּישּׁוּלָא מִקַּמֵּי דְּנִיתֵּן עֵצִים דְּהֶיתֵּירָא » (פסחים כ״ז ע״א)And according to the Taz it does not apply either when the forbidden cause was indispensable — that is his reading of seifim 3, 4 and 5:
« משמע שכל שלא נתערב לא מהני הולכת הנאה ליה״מ וכן גבי פת בסעיף ד׳ » (ש״ך יו״ד קמ״ב ס״ק ח)And for a garment woven with the shuttle, redeeming the value of the shuttle never suffices: it is the whole garment:
« כתב הרז״ה שאין להתיר באכילה ע״י הולכת הנאה לים המלח אלא בהנאה לבד וה״ר יונה כתב דאפי׳ באכילה נמי שרי ולזה הסכים א״א הרא״ש ז״ל » (טור יו״ד קמ״ב)The Shach writes that the other loaves are permitted even for eating:
Cut meat, however, does require the redemption:
« זהו ל׳ רמב״ם ובגמ׳ אמרינן דאפילו בצל צלה אסור ופרש״י כל זמן שלא עברה מדת אורך הצל מדת גובה האילן הצל עב וחשוך ונקרא צלו ומכאן ואילך הצל דק וקלוש והוא צל צלו וכ״פ בטור ותמהו הר״ן והכ״מ בשם הרמב״ם על שלא אסר בצל צלה ולענין הלכה ודאי אסור שכן הוא תלמוד ערוך » (ט״ז יו״ד קמ״ב ס״ק י״ג)Passing beneath is permitted only where there is no other equally short road, and the Shach specifies that running is then not required:
« אפילו שלא במרוצה וכמ״ש בס״ק כ׳ והיינו דוקא בשאין לו דרך אחרת אבל ביש לו דרך אחרת אפילו היא גוזלת אסור אפילו לרוץ שם » (ש״ך יו״ד קמ״ב ס״ק כ״ג)What the Rama permits — passing through its shade and not beneath the tree — has its reason in the Taz:
The extent of the prohibition is every benefit:
And for a tree whose fruit is kept for the festival drink, the Shach draws the a fortiori:
« זוֹ עוֹמֶדֶת עַל פִּי הַבִּיב וְכׇל הָעָם מַשְׁתִּינִין לְפָנֶיהָ, לֹא נֶאֱמַר אֶלָּא ״אֱלֹהֵיהֶם״ — אֶת שֶׁנּוֹהֵג בּוֹ מִשּׁוּם אֱלוֹהַּ — אָסוּר, אֶת שֶׁאֵינוֹ נוֹהֵג בּוֹ מִשּׁוּם אֱלוֹהַּ — מוּתָּר » (עבודה זרה מ״ד ע״ב)And the seif’s closing reservation is Rabban Gamliel’s distinction:
But he narrows the object of the prohibition to an idol actually worshipped:
« פי׳ באלילים עצמן שנעבדו אסור להסתכל בהן לראות נויין אבל צורות שנעשו לנוי ולא לעבוד מבואר בתו׳ והרא״ש דמותר » (ש״ך יו״ד קמ״ב ס״ק ל״ג)And the Rama’s permission — what one does not intend — has two precise edges, which the Shach draws:
These cases are given for study, with the rule of the siman that governs them. Lema’asse, one asks a Rav.
| Case | The seif | What the siman says of it |
|---|---|---|
| Warming oneself or reading by the flame of an already burning devotional candle | א | Permitted in principle, but the Taz permits the flame only detached from its coal — which is rarely the case with a candle one watches burn. |
| Taking the melted wax or the ashes of such a candle | א | Forbidden: the ashes are the exception of the mishnah in Temurah, and the Taz forbids them even after the fact. |
| Using a cultic implement to demolish or destroy | ב | Permitted: מקלקל. Using it to repair or enhance falls under מתקן. |
| An object made by means of a cultic tool | ג | Forbidden for benefit if the tool was indispensable; if it has been mixed with others, the redemption applies. |
| Food cooked with fuel taken from a place of worship | ד, ו | Cool it, then reheat with permitted fuel. The letter of the Mechaber permits the residual heat; the Shach, the Taz and the Baer Hetev forbid it in idolatry. |
| A forbidden object mixed among permitted ones, no longer identifiable | ג, ד | Redemption by carrying the value to the Dead Sea; failing a mixture, sale to a non-Jew minus the value of the forbidden (Shach ס״ק ח). |
| The crop of a field treated with fertiliser of such provenance | י״א | Permitted after the fact; one does not do it at the outset (Shach ס״ק כ״ו, Taz ס״ק ט״ז). |
| An animal fed on fodder of such provenance | י״א | The same rule; with the Rama’s qualification for a beast so fed all its life (Taz ס״ק י״ז). |
| Passing beneath a tree planted before a house of worship | ט, י״ג | Forbidden where another equally short road exists; otherwise permitted, and the Shach ס״ק כ says running is not required. |
| Crossing the forecourt of a house of worship as a shortcut | י | Forbidden inside and facing the entrance within four amot; permitted behind; passage is permitted only if the road came first — and one view forbids in every case. |
| Entering a public building in which a cultic statue stands | י״ד | Permitted when the statue is there for adornment; forbidden if it is treated there as a deity. |
| Liturgical music of another cult heard in a public place | ט״ו | Listening is forbidden; hearing unintentionally, when one could turn away and takes no pleasure in it, falls under the Rama’s permission and the Shach ס״ק ל״ד. |
| Looking at a work depicting an idol, in a museum | ט״ו | The Shach ס״ק ל״ג distinguishes an idol actually worshipped, which it is forbidden to contemplate for its beauty, from figures made for adornment. |
| The question asked | The siman’s answer | Who gives it |
|---|---|---|
| Does substance remain? | Yes: forbidden. No: permitted | Mechaber, seif 1; Rambam AZ 7:10 |
| Is the coal forbidden after the fact?
| Is the flame always permitted? | Only detached from its coal | Taz
| Does the act damage? | Then there is no benefit | Mechaber, seif 2; Chullin 8a |
| The dying animal? | Forbidden entire, with no redemption | Shach ס״ק ו, with the Rambam |
| Residual heat and embers? | Permitted by the letter; forbidden in practice | Shach ס״ק י, Taz ס״ק ה and ח, Baer Hetev ס״ק י |
| Double cause? | Permitted after the fact; at the outset for the vegetables alone | Shach ס״ק כ״ה and כ״ו, Taz ס״ק ט״ז |
| Redemption? | Only after a mixture; otherwise sale minus the value | Shach ס״ק ח and ט |
| Passing beneath the asherah? | Only with no other road; running is not required | Shach ס״ק כ and כ״ג, Baer Hetev ס״ק י״ח |
| A bathhouse with a statue? | Permitted if it is there for adornment | Mechaber, seif 14; Avodah Zarah 44b |
| Music and the gaze? | Forbidden when one intends; permitted when one does not intend and takes no pleasure | Mechaber and Rama, seif 15; Shach ס״ק ל״ג and ל״ד |
