1. שורש הסימן — the coal and the flame: absence of substance, or absence of decree?

The siman opens on a division that looks self-evident: the coal is forbidden, the flame is permitted. But the gemara and the Rambam do not give the same reason for it, and three rulings of the siman depend on that disagreement of reasons.

The beraita, and the reason the gemara itself gives
« גַּחֶלֶת שֶׁל עֲבוֹדָה זָרָה — אֲסוּרָה, וְשַׁלְהֶבֶת — מוּתֶּרֶת » (ביצה ל״ט ע״א)
The gemara at once asks why the flame of hekdesh remains forbidden, and answers from repugnance:
« מַאי שְׁנָא שַׁלְהֶבֶת עֲבוֹדָה זָרָה דְּשַׁרְיָא, וּמַאי שְׁנָא דְּהֶקְדֵּשׁ דַּאֲסִירָא? עֲבוֹדָה זָרָה, דִּמְאִיסָה וּבְדִילִי אִינָשֵׁי מִינַּהּ — לָא גְּזַרוּ בַּהּ רַבָּנַן » (ביצה ל״ט ע״א)
The Rambam gives a different reason He speaks neither of repugnance nor of decree, but of the absence of substance:
« עֲבוֹדַת כּוֹכָבִים אוֹ אֲשֵׁרָה שֶׁנִּשְׂרְפָה אֶפְרָהּ אָסוּר בַּהֲנָאָה. וְגַחֶלֶת שֶׁל עֲבוֹדַת כּוֹכָבִים אֲסוּרָה וְהַשַּׁלְהֶבֶת מֻתֶּרֶת מִפְּנֵי שֶׁאֵין בָּהּ מַמָּשׁ » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י׳
And the Beit Yosef adds, for the ashes, the mishnah in Temurah, where the asherah is the exception:
« ומ״ש דאפרה נמי אסור בסוף תמורה (לד.) כל הנשרפים אפרם מותר חוץ מאפר אשירה » (בית יוסף יו״ד קמ״ב)
The chakira: why is the flame permitted? (א) Because it is not the idol — it has no substance, there is nothing there that comes from the asherah. The prohibition never reached it; this is a criterion of being. (ב) Because the Sages did not decree upon it — the idol is repugnant, people keep away of themselves, and there was no need to add a gezeirah as for hekdesh. On this reading the flame really would be a benefit coming from the idol, and only the decree is missing; this is a criterion of decree.
Nafka mina First, a flame attached to its coal. The Taz forbids it expressly:
« פי׳ כשאין שם אלא השלהבת לחוד אבל אם השלהבת קשורה בגחלת פשיטא שאסור לחמם משלהבת טפי מגחלת גרידא » (ט״ז יו״ד קמ״ב ס״ק ג)
Under (א) this is easily understood: what one benefits from there is the coal, which has substance. Under (ב) one would have to say that the repugnance no longer helps once the coal is present. Second, the small and the large. If the prohibition rests on a decree, the extent of the benefit ought to matter; the Taz refuses the distinction and anchors it in a verse:
« והיתר דשלהבת הוא לפי שאין בה ממש ונראה פשוט דבגחלת אפילו עוממות ואינם לוחשות אסור כיון שיש שם ממש ול״ש הנאה רבה או זוטא דהא כתיב לא ידבק בידך מאומה » (ט״ז יו״ד קמ״ב ס״ק ג)
Third, who burnt the idol. The Taz restricts the seif to a Jew:
« פירוש ישראל אבל עובד כוכבים ששרפה ביטלה » (ט״ז יו״ד קמ״ב ס״ק א)
And the Shach, discussing the ashes, sets up precisely the case where a Jew has burnt it, and says why it is graver:
« מ״מ בשרפה ישראל גרע דחיישינן דלמא יגביה הישראל ויקנה אותה בהגבהה ואח״כ יבטלה וה״ל אליל ביד ישראל דלא בטלה » (ש״ך יו״ד קמ״ב ס״ק ב)
Teruts: the two reasons are not disputing the same question. The gemara in Beitzah answers mai shna hekdesh — why is hekdesh stricter? — and its answer is a matter of decree. The Rambam writes the ruling without the comparison, and gives its intrinsic reason. The two hold together if we say: the flame is not the thing itself, and therefore only a gezeirah could have forbidden it — a gezeirah made for hekdesh and not for the idol. Then (א) explains why a gezeirah was needed, and (ב) why it was not made.

2. גחלת בדיעבד — the Taz against the Beit Yosef, and the Pitchei Teshuva’s division

Seif 1 forbids the coal and seif 6 permits bread baked over coals. The Beit Yosef resolves this by a distinction of degree; the Taz refuses and speaks of a prohibition of the Torah. This is the first great dispute of the siman, and it decides everything that follows.

The Beit Yosef’s question upon himself He states the contradiction plainly, and answers by a distinction of degree:
« וק״ל דכיון דגחלת של אליל אסורה כמו שנתבאר בסימן זה אמאי שרינן בבישלה ע״ג גחלים וצ״ל דכי אמרינן אסורה היינו לכתחלה דוקא » (בית יוסף יו״ד קמ״ב)
The Taz rejects that distinction. For him the prohibition of the coal is not a precaution but a Torah prohibition, drawn from lo yidbak beyadekha — and he names the Beit Yosef and the Bach:
« נראה לי אפילו דיעבד אסור » (ט״ז יו״ד קמ״ב ס״ק ב)
« אלא ברור דאיסור דאורייתא יש בגחלת משום לא ידבק כדפירש״י וא״כ אפילו דיעבד אסור והב״י כתב מכח קושיא בסי׳ זה דדוקא לכתחלה אסור בגחלת וכתב עליו מו״ח ז״ל שכן הוא פשוט ולע״ד לא דקו בזה כלל » (ט״ז יו״ד קמ״ב ס״ק ב)
He returns to it in ס״ק ח, and draws the consequence for the cooking itself:
« וכבר הוכחנו בתחילת הסימן דאינו כן אלא איסור גמור יש בגחלת של עבודת כוכבים ואפילו דיעבד ואפי׳ עוממות משום לא ידבק בידך וגו׳ » (ט״ז יו״ד קמ״ב ס״ק ח)
« ה״נ ודאי כ״ש דאסור בבישול ע״ג גחלים של עבודת כוכבים כן נראה לע״ד » (ט״ז יו״ד קמ״ב ס״ק ח)
The Shach stands with the Taz, and goes further. He does not permit the oven’s heat either:
« אלא ודאי גחלת של אליל אפילו בדיעבד אסור » (ש״ך יו״ד קמ״ב ס״ק י)
« אבל לפע״ד אפילו בחומו של תנור או ע״ג גחלים אסר הרמב״ם הכא באליל ודוקא בערלה שאפר׳ וגחלתה וכן חומו מותר חילק כן משא״כ באליל » (ש״ך יו״ד קמ״ב ס״ק י)
The Baer Hetev records both and gives them as the halakha:
« וכ״כ הש״ך בס״ק י׳ דאף בדיעבד אסור אם נהנה מגחלתה » (באר היטב יו״ד קמ״ב ס״ק ב)
« ומסקנתו דלא כהמחבר אלא דגחלת של עבודת כוכבים אפי׳ בדיעבד אסורה וכ״פ הט״ז דאפי׳ בתנור ישן וגרף ממנו את כל האש ובישל או אפה בחומו של תנור אסור אף בדיעבד » (באר היטב יו״ד קמ״ב ס״ק י)
The Pitchei Teshuva divides differently — and his division saves both. Everything depends on where the coal’s prohibition came from: from wood already forbidden, or from a coal offered as such:
« ולכן העלה דאף המחבר לא אמר אלא דווקא בגחלת הבא מעצי עבודת כוכבים או מעצי אשירה כמו שדקדק בש״ע כאן וכן מ״ש בב״י מיירי ג״כ בהכי אבל אם נאסרו בעודן גחלת כגון שעשאו תקרובת עבודת כוכבים בהא ודאי מודה דאסור מדאורייתא » (פתחי תשובה יו״ד קמ״ב ס״ק ב)
On this reading the Beit Yosef speaks of the derived coal — where the prohibition is rabbinic, and the distinction of degree suffices; the Taz speaks of the case where the coal itself is the object of worship — where the prohibition is biblical, and after the fact saves nothing. In passing, the Pitchei Teshuva notes a source the Taz did not cite:
« עבה״ט בשם ט״ז ועי׳ בספר שער המלך פ״ו מהלכות עבודת כוכבים שכתב דכן מבואר בהרא״ש פרק בתרא דביצה ותימה על הט״ז שלא הביאו » (פתחי תשובה יו״ד קמ״ב ס״ק א)

3. ש״ך ס״ק י — the Rambam’s language transposed from orlah to idolatry

This is the longest entry in the siman and the key to reading it. The printed text itself warns that seifim 5, 6 and 7 are the Rambam’s language written for orlah. The Shach asks whether that language can bear being carried over into idolatry — and answers that it cannot.

The question, put without softness The Shach opens by saying that the text as it stands cannot be fitted together:
« באמת דברי הטור והמחבר ושאר פוסקים צריכין נגר להולמן » (ש״ך יו״ד קמ״ב ס״ק י)
Then he gives the reason: if the idol’s coal is forbidden, how could the bread baked upon it be permitted?
« אבל בעצי אליל שגחליה ואפרה אסורים איך יהא מותר בבישול ע״ג גחלים ובתנור חדש הא כולה גורם דאיסורא הוא ועצי איסור עדיין לא הלכו להם » (ש״ך יו״ד קמ״ב ס״ק י)
« וא״כ באליל נמי דקי״ל שוחק וזורה לרוח וכמ״ש הט״ו בסי׳ קמ״ז ואפרן נמי אסור וכמו שכתב הטור בסע״א בסימן זה א״כ אפי׳ עוממות יהא אסור משום דכל שהגחלים אסורים ה״ל שבח עצים בפת ואסור אפי׳ למ״ד זוז״ג מותר » (ש״ך יו״ד קמ״ב ס״ק י)
The original sugya — and it speaks of orlah
« תַּנּוּר שֶׁהִסִּיקוֹ בִּקְלִיפֵּי עׇרְלָה אוֹ בְּקַשִּׁין שֶׁל כִּלְאֵי הַכֶּרֶם, חָדָשׁ — יוּתַּץ, יָשָׁן — יוּצַן » (פסחים כ״ו ע״ב)
« אָפָה בּוֹ אֶת הַפַּת, רַבִּי אוֹמֵר: הַפַּת אֲסוּרָה, וַחֲכָמִים אוֹמְרִים: הַפַּת מוּתֶּרֶת. בִּישְּׁלָהּ עַל גַּבֵּי גֶּחָלִים — דִּבְרֵי הַכֹּל מוּתָּר » (פסחים כ״ו ע״ב)
The contradictory beraita, and its resolution by the two tannaim:
« וְהָא תַּנְיָא: בֵּין חָדָשׁ וּבֵין יָשָׁן יוּצַן! לָא קַשְׁיָא: הָא — רַבִּי, וְהָא — רַבָּנַן » (פסחים כ״ו ע״ב)
There too is the condition of the avukah, which will become the Rama’s gloss on seif 4:
« אָמַר רַב פָּפָּא: כְּשֶׁאֲבוּקָה כְּנֶגְדּוֹ » (פסחים כ״ז ע״א)
and the dispute over dying and glowing embers:
« חַד אָמַר: לֹא שָׁנוּ אֶלָּא גֶּחָלִים עוֹמְמוֹת, אֲבָל גֶּחָלִים לוֹחֲשׁוֹת — אֲסוּרִין, וְחַד אָמַר: אֲפִילּוּ גֶּחָלִים לוֹחֲשׁוֹת נָמֵי מוּתָּרִין » (פסחים כ״ז ע״א)
The Shach’s teruts — found long afterward, in the Tosefta of Orlah. The Tosefta states the rule for orlah, and then sets asherah wood apart. That is exactly the distinction he was looking for:
« שוב מצאתי אחר זמן רב בתוספתא פ״ק דערלה תנור שהסיקו בקליפי ערלה אם חדש יותץ אם ישן יוצן אפה ובשל בגחלי׳ מותר אפה בכולם (כלו׳ בכל איסורי הנאה שהוזכר שם) מותר חוץ מעצי אשרה עכ״ל מזה ראיה ברורה למה שכתבתי » (ש״ך יו״ד קמ״ב ס״ק י)
Hence his two conclusions, which overturn the flat reading of seifim 4 and 6:
« אלא ודאי גחלת של אליל אפילו בדיעבד אסור » (ש״ך יו״ד קמ״ב ס״ק י)
« אבל לפע״ד אפילו בחומו של תנור או ע״ג גחלים אסר הרמב״ם הכא באליל ודוקא בערלה שאפר׳ וגחלתה וכן חומו מותר חילק כן משא״כ באליל » (ש״ך יו״ד קמ״ב ס״ק י)
The Shach’s nafka minot The order of the acts — in a new oven it is not enough that permitted wood came afterward; it must have been put in before the bread:
« ומ״מ בחדש דמותר כשיסיק אותו אח״כ היינו דוקא כשנותן עצים בתחלה וסתמא דמלתא מסיקין אותו תחלה ואח״כ נותנים שם הפת אבל אסור ליתן שם לכתחלה הפת ואח״כ יסיקוהו » (ש״ך יו״ד קמ״ב ס״ק י)
The status of the other loaves — once the redemption is made they return to being permitted, even for eating:
« ומ״ש ושאר כל הככרות מותרים משמע אפילו באכילה » (ש״ך יו״ד קמ״ב ס״ק י)
And why cooling the oven suffices although a double cause is forbidden at the outset:
« ומה״ט יוצן משום דלכתחלה מיהא זוז״ג אסור מ״מ בתנור חשוב כדיעבד כיון שהיה צריך לנתצו » (ש״ך יו״ד קמ״ב ס״ק י)
The Taz reaches the same point by another road. He explains why the Tur omitted the rulings of seifim 6 and 7 altogether:
« ונראה דמ״ה לא הביא הטור דינים אלו שזכר המחבר בסעיף ו׳ ז׳ אף ע״פ שהם תלמוד ערוך לפי שאין כאן נפקא מינה מהם דכאן בעבודת כוכבים זה וזה גורם באמת אסור אפילו בתנור ובתלמוד הם אמורים לענין ערלה » (ט״ז יו״ד קמ״ב ס״ק י)
and he had already, in ס״ק ה, rejected the permission of the oven’s heat in idolatry:
« כבר כתבתי שלפי ע״ד אף בלא זה אסור וכן מה שכ׳ הש״ע בסמוך גרף וכו׳ דזה אינו בעבודת כוכבים אלא בערלה ושאר איסורים » (ט״ז יו״ד קמ״ב ס״ק ה)
The Baer Hetev records their agreement:
« וגם הט״ז הסכים לזה לדינא דיש לאסור בעבודת כוכבים אפילו בחומו של תנור או ע״ג גחלים » (באר היטב יו״ד קמ״ב ס״ק ח)
Can the Rambam be defended? The Taz looks for his reason, and finds it in the idea that a new oven is not yet an object of benefit until a second act has come:
« ונראה טעם הרמב״ם דלא שייך נגמר באיסור אלא באין צורך אחר זה לשום תיקון כההיא דפת שנאפה בעצי איסור וכרכר משא״כ בתנור חדש שנגמר בעצי איסור מכל מקום אין האדם נהנה ממנו עד שיבוא מעשה שני שיאפה הפת בעצי היתר » (ט״ז יו״ד קמ״ב ס״ק ה)
but he immediately runs into the vessels of seif 5 and the pot of seif 7:
« ותימא מ״ש מקערות וכוסות דסעיף ה׳ דהויין אסורים בהנאה וכן קשה מקדירה בסעיף ז׳ ע״כ צ״ל דהרמב״ם לא התיר בגרפו אלא בתנור ישן » (ט״ז יו״ד קמ״ב ס״ק ו)
The Shach answers the same question more precisely, and his answer is the gemara’s:
« הטעם דבקערות וכוסות משתמשין אח״כ בלא גורם היתר וקדרה נמי אע״פ שא״א לבשל בה בלא עצים מ״מ הדרך ליתן בה מים ובשר ואח״כ שופתה על האש וא״כ משתמש בה בלא גורם היתר הכי איתא בש״ס » (ש״ך יו״ד קמ״ב ס״ק י״א)
« לכך נראה דתנור עדיף כיון דלאחר שגרפו עצי האיסור הלכו להן דאין איסור בעצים רק כשאבוקה כנגדן אם כן החום נחשב להיתר משא״כ בקערות » (ש״ך יו״ד קמ״ב ס״ק י״א)
and the Taz gives yet another, distinguishing small pottery from cooking pots:
« שבאלו משתמשים בלא צירוף היתר מה שאין כן בתנור חדש וציננו וחוזר ומסיקו » (ט״ז יו״ד קמ״ב ס״ק ז)
« ונראה דהרמב״ם מיירי כאן מקדירות קטנות ששותין מהן מ״ה נקטיה בהדי כוסות וצלוחיות אבל אותן שמבשלין בהן ה״ל כמו תנור חדש דאמרינן בו יוצן » (ט״ז יו״ד קמ״ב ס״ק ז)

4. ט״ז ס״ק ד — the indispensable cause, and the reply of the Nekudot HaKesef

Seif 11 holds that a double cause permits; seifim 3, 4 and 5 forbid things that look like double causes. The Taz draws from this a new rule for idolatry; the Shach, in the Nekudot HaKesef, answers him that these are not double causes at all.

The starting point: the mishnah and the gemara
« נָטַל מִמֶּנָּה עֵצִים — אֲסוּרִין בַּהֲנָאָה. הִסִּיק בָּהֶן אֶת הַתַּנּוּר, אִם חָדָשׁ — יוּתַּץ, וְאִם יָשָׁן — יוּצַן. אָפָה בּוֹ אֶת הַפַּת — אֲסוּרָה בַּהֲנָאָה » (עבודה זרה מ״ט ע״ב)
« נָטַל הֵימֶנָּה כַּרְכֵּור — אָסוּר בַּהֲנָאָה. אָרַג בּוֹ אֶת הַבֶּגֶד — אָסוּר בַּהֲנָאָה » (עבודה זרה מ״ט ע״ב)
The gemara explains why both cases were needed — and that explanation will be the hinge of the whole discussion:
« דְּאִי אַשְׁמְעִינַן קַמַּיְיתָא, בְּהָא קָאָמַר רַבִּי אֱלִיעֶזֶר, מִשּׁוּם דִּבְעִידָּנָא דְּקָא גָמְרָה פַּת קָלֵי לַהּ אִיסּוּרָא, אֲבָל כַּרְכֵּור דְּאִיתֵיהּ לְאִיסּוּרָא בְּעֵינֵיהּ, אֵימָא מוֹדֵי לְרַבָּנַן » (עבודה זרה מ״ט ע״ב)
And on the other side, the field and the cow, where the halakha follows Rabbi Yose:
« שָׂדֶה שֶׁנִּזְדַּבְּלָה בְּזֶבֶל עֲבוֹדָה זָרָה, וְכֵן פָּרָה שֶׁנִּתְפַּטְּמָה בְּכַרְשִׁינֵי עֲבוֹדָה זָרָה, תָּנֵי חֲדָא: שָׂדֶה תִּזָּרַע, פָּרָה תִּשָּׁחֵט, וְתַנְיָא אִידַּךְ: שָׂדֶה תָּבוֹר, וּפָרָה תִּרְזֶה » (עבודה זרה מ״ט ע״א)
« לְדִידִי, זֶה וָזֶה גּוֹרֵם מוּתָּר » (עבודה זרה מ״ט ע״א)
« אָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: הֲלָכָה כְּרַבִּי יוֹסֵי. הָהוּא גִּינְּתָא דְּאִיזְדַּבַּל בְּזִבְלָא דַּעֲבוֹדָה זָרָה, שְׁלַח רַב עַמְרָם קַמֵּיהּ דְּרַב יוֹסֵף. אֲמַר לֵיהּ: הָכִי אָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: הֲלָכָה כְּרַבִּי יוֹסֵי » (עבודה זרה מ״ט ע״א)
The Rambam makes a general rule of it, which the Mechaber copies in seif 11:
« וְכָל שֶׁדָּבָר אָסוּר וְדָבָר מֻתָּר גּוֹרְמִין לוֹ הֲרֵי זֶה מֻתָּר בְּכָל מָקוֹם » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י״ד
and the Tur recalls the restriction that goes with it:
« אבל אנן קיימא לן זה וזה גורם מותר בדיעבד אבל לכתחלה אסור לעשות ע״י זה וזה גורם » (טור יו״ד קמ״ב)
The chakira: what is זה וזה גורם? (א) A statement about causation: when a result has two causes, it cannot be attributed to the forbidden one, since it could equally be attributed to the other. Therefore, where the forbidden cause was indispensable, there never were two causes, and the rule simply does not apply. (ב) A measure of leniency: the result did come from the prohibition, but it is treated lightly because the prohibition did not act alone. Then the question becomes whether idolatry, graver than other prohibitions, deserves that leniency.
The Taz takes (ב) — and excludes idolatry from the leniency. His entry opens with a sentence one does not often read from his pen:
« לפי הנראה לע״ד דהרב בעל הש״ע לא יצא ידי כל חובת העיון בדינים אלו » (ט״ז יו״ד קמ״ב ס״ק ד)
His thesis, in the same entry:
« דכל מה שיש הכרח אל האיסור וא״א זולתו או אע״פ שיש ג״כ גורם דהיתר אסור בעבודת כוכבים מ״ה בתנור חדש שנגמר בעצי איסור ובפת שנאפה בעצי איסור בתנור ישן שא״א לפת להיות נאפה בלא עצים וכן בגד א״א להיעשות בלא כרכור על כן אסורים משא״כ בגינתא דאזדבל בזבל דעבודת כוכבים דהזבל משביח הקרקע » (ט״ז יו״ד קמ״ב ס״ק ד)
and his conclusion, built on the Rosh, the Ramah and the Rambam:

He forestalls the objection from the gemara’s tzrichuta about the shuttle:
« ואע״ג דאמרינן בגמרא בצריכותא דכרכור דאיתא לאיסורא בעיניה מכל מקום אין זה מקרי יש שבח דתרי מילי נינהו » (ט״ז יו״ד קמ״ב ס״ק ד)
and he faults the Rama for following the Beit Yosef without looking closely:
« ורמ״א שהגיה בעוד שהאבוקה כנגדו נמשך אחר דברי ב״י ולא שת לבו לדקדק במה שזכרנו » (ט״ז יו״ד קמ״ב ס״ק ד)
But the Beit Yosef had already rejected that road. Of the Ramah, who forbade the bread and the garment even for the lenient view, he writes:
« איני יודע טעם לדברי הרמ״ה בזה דהא בענין גינתא דאזדבלא בזבל דאליל אסיקנא בפרק כל הצלמים (עבודה זרה מט.) דהלכה כמ״ד זה וזה גורם מותר » (בית יוסף יו״ד קמ״ב)
The Tur brings the Ramah and the Rosh without ruling against them:
« והרמ״ה כתב אפילו למ״ד זה וזה גורם מותר הכא גבי אליל הפת שנאפה בעצי איסור והבגד שנארג בכרכר של אליל אסורים וכן יראה מדברי א״א הרא״ש ז״ל שהביא המשנה לפסק הלכה » (טור יו״ד קמ״ב)
The reply of the Nekudot HaKesef — that is, of the Shach — takes (א). It is brief and sharp: the cases from which the Taz draws his rule are not double causes but single causes; they prove nothing about the leniency.
« האריך בדברים שאין בהן ממש דהדבר פשוט דכרכר דמתני׳ היינו בחד גורם » (נקודות הכסף יו״ד קמ״ב)

On this reading, the shuttle of seif 3 and the bread of seif 4 are forbidden not because idolatry is graver, but because there was only one cause: without the shuttle, no garment; without the wood, no baking. And the field, the cow and the vegetables of seif 11 are permitted because there really were two.

At the outset or after the fact. Here Shach and Taz agree: a double cause permits only after the fact, and the vegetables are the exception:

5. הפדיון — Rashi against the Ri, the Razah against Rabbenu Yonah

When the forbidden loaf has been mixed among others, one carries the value of what is forbidden to the Dead Sea. Three questions arise at once: is a mixture required, what exactly is carried, and is what has been permitted permitted for eating too?

The mishnah, and the halakha
« נִתְעָרְבָה בַּאֲחֵרוֹת — כּוּלָּן אֲסוּרוֹת בַּהֲנָאָה, רַבִּי אֱלִיעֶזֶר אוֹמֵר: יוֹלִיךְ הֲנָאָה לְיָם הַמֶּלַח, אָמְרוּ לוֹ: אֵין פִּדְיוֹן לַעֲבוֹדָה זָרָה » (עבודה זרה מ״ט ע״ב)
Despite the Sages’ answer, the gemara rules like Rabbi Eliezer:
« אָמַר רַב חִיָּיא בְּרֵיהּ דְּרַבָּה בַּר נַחְמָנִי אָמַר רַב חִסְדָּא אָמַר זְעֵירִי: הֲלָכָה כְּרַבִּי אֱלִיעֶזֶר » (עבודה זרה מ״ט ע״ב)
and discusses how far the redemption reaches:

Rashi against the Ri — two questions at once. The Tur brings them one after the other: must the bread have been mixed, and does one carry the value of the wood or of the loaf?

The Shach follows the Ri on the first question and makes a rule of it:

and he extends it to the shuttle, where he is stricter still:
« כלומר כל הבגד דאפי׳ כשנתערב לא מהני הולכת הנאת הכרכר ליה״מ » (ש״ך יו״ד קמ״ב ס״ק ט)
The Razah against Rabbenu Yonah — how far the redemption permits.
« כתב הרז״ה שאין להתיר באכילה ע״י הולכת הנאה לים המלח אלא בהנאה לבד וה״ר יונה כתב דאפי׳ באכילה נמי שרי ולזה הסכים א״א הרא״ש ז״ל » (טור יו״ד קמ״ב)
The Shach writes that the other loaves return to being permitted even for eating:
« ומ״ש ושאר כל הככרות מותרים משמע אפילו באכילה » (ש״ך יו״ד קמ״ב ס״ק י)
The way out that the Shach opens alongside the redemption. Where the redemption cannot operate for want of a mixture, he proposes selling to a non-Jew minus the value of what is forbidden — and explains its mechanism:
« דיכול למכור הבגד והפת לעובד כוכבים חוץ מדמי איסור שבו כשהעובד כוכבים יחתוך הבגד והפת לפני הישראל בענין שא״א שימכרנו שוב לישראל אחר » (ש״ך יו״ד קמ״ב ס״ק ח)
« כל זמן שלא נתערב ויש כאן איסור אליל בבגד או בפת אין פדיון לאליל אבל כשמוכרו לעובד כוכבים חוץ מדמי איסור שבו דאין לו שום הנאה בעולם מאליל והאיסור עצמו אינו בידו מותר » (ש״ך יו״ד קמ״ב ס״ק ח)
Why the redemption has nothing to do with the double cause. The Sages object ein pidyon la‘avodah zarah; and if a redemption nevertheless exists, it is because it does not claim to redeem the idol but to separate from it the benefit one would draw. That is why it requires a mixture: without a mixture the forbidden object is still there and identifiable, and there is nothing to separate — which is exactly what the Shach says in the second half of his ס״ק ח.

6. הסכין — מקלקל ומתקן, and the dying animal

Seif 2 turns on a pair of words — damaging and improving — and it reverses twice: by the state of the animal, and by the manner of the cutting. The Shach adds a second prohibition that the Mechaber had not named.

The beraita, with its reason in the text
« סַכִּין שֶׁל עֲבוֹדָה זָרָה מוּתָּר לִשְׁחוֹט בָּהּ, וְאָסוּר לַחְתּוֹךְ בָּהּ בָּשָׂר. מוּתָּר לִשְׁחוֹט בָּהּ – מְקַלְקֵל הוּא, וְאָסוּר לַחְתּוֹךְ בָּהּ בָּשָׂר – מְתַקֵּן הוּא » (חולין ח׳ ע״א)
and the reversal, immediately after:
« פְּעָמִים שֶׁהַשּׁוֹחֵט אָסוּר – בִּמְסוּכֶּנֶת, וּמְחַתֵּךְ מוּתָּר – בְּאַטְמֵי דְּקָיְימָן לְקוּרְבָּנָא » (חולין ח׳ ע״א)
The Rambam makes it the ruling of seif 2:

and the Shach cites Rashi’s reason, which is strictly economic:

The second prohibition, which the Shach adds. The Mechaber permits the slaughter because one is damaging; but a knife absorbs from what it has cut, and that prohibition stands:
« מיירי שהוא ישן ולא לבנו מאיסור שבו והלכך אע״פ שמטעם משמשי אליל מותר לשחוט בו אפילו לכתחלה כיון שהוא מקלקל אפ״ה מטעם געולי עובדי כוכבים אסור לשחוט בו לכתחלה » (ש״ך יו״ד קמ״ב ס״ק ג)
This is why the Rama’s gloss about a new or scoured knife is necessary, and the Shach specifies its condition:
« וכגון שחתך בה בקעת לאליל דאל״כ תשמישי אליל אינם אסורים עד שישתמשו בהן » (ש״ך יו״ד קמ״ב ס״ק ה)
How far does the prohibition of the dying animal reach? The Beit Yosef puts the question as an open doubt — is the animal comparable to the new oven and the bread, or not? — and inclines to permit after the fact:

but he notes that the Rambam is stricter:

The Shach rules with the Rambam, and even withholds the redemption:

7. האשרה — the nest, the shade, and the shadow of the shadow

Three reasons have been given for forbidding the eggs of the nest, and they do not overlap. Then comes the shade, where the Rambam — whose language the Mechaber copies — omits a ruling that the gemara states, and the Taz restores it.

The nest
« קֵן שֶׁבְּרֹאשׁ הָאִילָן שֶׁל הֶקְדֵּשׁ — לֹא נֶהֱנִין וְלֹא מוֹעֲלִין, בְּרֹאשָׁהּ שֶׁל אֲשֵׁרָה — יַתִּיז בְּקָנֶה » (עבודה זרה מ״ב ע״ב)
The gemara distinguishes the nest, built of twigs brought from elsewhere:
« הָכָא בְּמַאי עָסְקִינַן? כְּגוֹן דְּאַיְיתַי עֵצִים מֵעָלְמָא, וְקִינְּתָהּ בָּהֶן » (עבודה זרה מ״ב ע״ב)
from the eggs and the fledglings, according to whether they still need their mother:

Three reasons for one ruling. The Beit Yosef sets them side by side: Rashi speaks of a decree, the Rambam of a base, the Raavad of growth:
« ופירש״י דטעמא דביצים ואפרוחים שצריכין לאמן אסורים היינו מפני שצריכים לאילן וגזור בהו רבנן כעל אילן עצמו. והרמב״ם כתב שהטעם מפני שהאשרה כמו בסיס להם והראב״ד כתב שהטעם מפני שהם כגידולי האשרה » (בית יוסף יו״ד קמ״ב)
The Shach takes up two of them:

and the Rambam’s wording is the one the Mechaber copied:
« וְהָאֶפְרוֹחִים וְהַבֵּיצִים שֶׁצְּרִיכִין לְאִמָּן אֲסוּרִין שֶׁהֲרֵי הָאֲשֵׁרָה כְּמוֹ בָּסִיס לָהֶן » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י״ב
The Taz proposes the reason of immobility:
« כיון שהם אינם מזיזים משם לכך גזרו עליהם כעל האילן עצמו » (ט״ז יו״ד קמ״ב ס״ק י״א)
Nafka mina — the Rama’s reed. The Rama permits knocking the fledglings down with a reed rather than climbing. The Taz explains why climbing is a benefit:
« לפי שנהנה ממנה שהיא לו במקום סולם » (ט״ז יו״ד קמ״ב ס״ק י״ב)
and the Shach specifies that the reed rescues only what was already permitted:
« פי׳ אפילו באותן שאין צריכין לאמן לא יעלה על האשרה כו׳ וכן מבואר בטור ומינה דבאותן שעדיין צריכין לאמן אפי׳ כשמתיז בקנה והן נופלין אסור » (ש״ך יו״ד קמ״ב ס״ק ט״ז)
He adds why the nest’s twigs are not asherah wood:

The shade
« לֹא יֵשֵׁב בְּצִילָּהּ, וְאִם יָשַׁב — טָהוֹר, וְלֹא יַעֲבוֹר תַּחְתֶּיהָ, וְאִם עָבַר — טָמֵא. הָיְתָה גּוֹזֶלֶת אֶת הָרַבִּים וְעָבַר תַּחְתֶּיהָ — טָהוֹר » (עבודה זרה מ״ח ע״ב)
The gemara goes down as far as the shadow of the shadow:
« לֹא נִצְרְכָא אֶלָּא לְצֵל צִילָּהּ » (עבודה זרה מ״ח ע״ב)
and Rashi says what that second shadow is:
« שחרית וערבית שצל ארוך לכל דבר מאד וכל זמן שלא עברה מדת אורך הצל את מדת גובה קומת האילן הצל עב וחשוך מכאן ואילך הצל דק וקלוש והיא צל צלו » (רש״י עבודה זרה מ״ח ע״ב)
The Rambam did not forbid the shadow of the shadow — and he permitted that of the branches.
« הָאֲשֵׁרָה בֵּין שֶׁהָיְתָה נֶעֱבֶדֶת בֵּין שֶׁהָיְתָה עֲבוֹדַת כּוֹכָבִים מֻנַּחַת תַּחְתֶּיהָ אָסוּר לֵישֵׁב בְּצֵל קוֹמָתָהּ. וּמֻתָּר לֵישֵׁב בְּצֵל הַשָּׂרִיגִים וְהֶעָלִים שֶׁלָּהּ » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י״א
The Beit Yosef raises the difficulty from the Yerushalmi and from our sugya:
« ותמה הר״ן עליו שאין פירושו בצל צלה מסכים עם הירושלמי וראוי לסמוך על הירושלמי בזה ועוד שפסק בצל צלה דמותר ובסוגיין משמע דאסור » (בית יוסף יו״ד קמ״ב)
and the Taz rules against the Rambam on this point, because the gemara is explicit:
« זהו ל׳ רמב״ם ובגמ׳ אמרינן דאפילו בצל צלה אסור ופרש״י כל זמן שלא עברה מדת אורך הצל מדת גובה האילן הצל עב וחשוך ונקרא צלו ומכאן ואילך הצל דק וקלוש והוא צל צלו וכ״פ בטור ותמהו הר״ן והכ״מ בשם הרמב״ם על שלא אסר בצל צלה ולענין הלכה ודאי אסור שכן הוא תלמוד ערוך » (ט״ז יו״ד קמ״ב ס״ק י״ג)
Passing beneath, and running. The gemara resolves the contradiction by the existence of another road:
« וְלָא פְּלִיגִי, הָא דְּאִיכָּא דִּירְכָּא אַחֲרִינָא, הָא דְּלֵיכָּא דִּירְכָּא אַחֲרִינָא » (עבודה זרה מ״ח ע״ב)
then reports Rav Sheshet’s word to his attendant:

The Tur draws from this a rule of conduct for a man of standing:
« ואפ״ה ירחיק אדם חשוב מהכיעור והדומה לו וכשעובר תחתיה ימהר לרוץ בכל מה שיוכל » (טור יו״ד קמ״ב)
but the Beit Yosef observes that the Rif, the Rosh and the Rambam did not adopt that distinction:

The Shach draws two precise limits from it, which the Baer Hetev repeats:
« עיין בש״ס דמשמע דוקא בגוזלת מותר אם אין לו דרך אחרת וכן משמע בר׳ ירוחם ני״ז ח״ה וגם משמע בש״ס ור׳ ירוחם שם דהיכא דאין לו דרך אחרת אינו צריך לרוץ » (ש״ך יו״ד קמ״ב ס״ק כ)
« אפילו שלא במרוצה וכמ״ש בס״ק כ׳ והיינו דוקא בשאין לו דרך אחרת אבל ביש לו דרך אחרת אפילו היא גוזלת אסור אפילו לרוץ שם » (ש״ך יו״ד קמ״ב ס״ק כ״ג)

What the Rama permits, and what the seif still forbids. The Rama permits passing through its shade, not beneath the tree. The source is the Ran, brought by the Beit Yosef:
« כתב הר״ן שם מסתברא דלעבור בצלה שרי דמדקתני רישא לא ישב וסיפא לא יעבור משמע דבצלה ישיבה דוקא הוא דאסור אבל לעבור דרך שם שרי » (בית יוסף יו״ד קמ״ב)
The Taz gives the reason — the prohibition of sitting turns on duration, that of passing beneath on proximity itself:
« דאף ישיבה אין בהאיסור מדינא כיון דלא מכוין אלא שמא ישהה בישיבה ואתי לכווני על כן העבר׳ בעלמא מותר אבל תחתיה אסור מחמת טומאת אלילים » (ט״ז יו״ד קמ״ב ס״ק י״ד)
and the Shach recalls that even a very long shadow is still “its shade”:

Finally he specifies which asherah the seif is speaking of:

8. צל הבית, אילני סרק, המרחץ והמבט

Four rulings at the end of the siman, and in each of them a division: between the tree and the house, between adornment and offering, between divinity and decoration, and between hearing and listening.

Why the shade of the house differs from that of the tree. The Taz gives the reason, and shows where the “some forbid” at the end of seif 10 comes from:

The Beit Yosef had brought both views in the same terms:
« והתוס׳ כתבו אמתני׳ דלא ישב בצלה לא דמי לצלו של היכל דסתם היכל לתוכו עשוי אבל אשרה עשוי לצל א״נ חומרא דאליל שאני ע״כ וברמזים כתוב צל בית של אליל יש אוסרים ויש מתירין » (בית יוסף יו״ד קמ״ב)
and the Shach reads the “some forbid” as bearing on the opening of the seif alone:
« ארישא קאי פי׳ דאסרו אפילו בבית לישב בצל שלאחריו דסבירא ליה דצל אשרה ובית הכל שוה אבל באינך גווני אין מי שאוסר » (ש״ך יו״ד קמ״ב ס״ק כ״ד)
The four amot have their own reason:
« היינו משום דמצוה להתרחק מאלילים ד׳ אמות וכדלקמן ר״ס ק״נ » (ש״ך יו״ד קמ״ב ס״ק כ״א)
« פי׳ לישב בצלו לפי שאינו עשוי לצל דאילו לעבור אפילו בצל אשרה שרי כמ״ש הרב » (ש״ך יו״ד קמ״ב ס״ק כ״ב)
The barren trees — offering or adornment? The Tur brings both views and rules:
« ואילני סרק שרגילים ליטע בפני אליל שלהם י״א שהן מותרין שאין עובדין אותם ולא לנוי נטעו לה אלא שמחוקי העכו״ם הוא לעבוד באותן אילנות והוו כעין תקרובת אליל ונטיעתן זו היא תקרובתן ובתקרובת כזה אינו נאסר כיון שאינו כעין פנים וי״א דלא גרע מנוי אליל ואסור והכי מסתבר » (טור יו״ד קמ״ב)
The Shach gives the key to the ruling: an adornment is forbidden only once used, and standing before the idol is itself its use:
« פי׳ ומסתמא אמרינן דנעשו לשם נוי ואע״ג דנוי אלילים אינן אסורים עד שישתמשו וכדלעיל ר״ס קל״ט זהו שעומדים בפני אלילים הוי תשמישן » (ש״ך יו״ד קמ״ב ס״ק כ״ח)
The Beit Yosef had brought the Rashba to the contrary:
« כתוב באו״ח בשם הרשב״א על אילני סרק שנוטעים בפתחי עכו״ם מותר לישב בצלן ואין בהם משום נוי עכו״ם » (בית יוסף יו״ד קמ״ב)
and the Taz declines to follow him:
« ע״כ נראה דאפילו לישב בצילה אסור ואע״ג דכתב ב״י בספר בדק הבית בשם רשב״א דמותר לישב בצלן דלא הוה אלא תקרובת עכ״ל לא קי״ל כן » (ט״ז יו״ד קמ״ב ס״ק י״ח)
Finally the Shach specifies the extent of the prohibition:
« פי׳ לישב בצלן וכן כל דבר הנאה שבעולם » (ש״ך יו״ד קמ״ב ס״ק כ״ט)
The bathhouse — the criterion is the use, not the form
« אֲנִי לֹא בָּאתִי בִּגְבוּלָהּ, הִיא בָּאָה בִּגְבוּלִי. אֵין אוֹמְרִים: נַעֲשָׂה מֶרְחָץ נוֹי לְאַפְרוֹדִיטֵי, אֶלָּא אוֹמֵר: נַעֲשָׂה אַפְרוֹדִיטֵי נוֹי לַמֶּרְחָץ » (עבודה זרה מ״ד ע״ב)

The Mechaber copies the Rambam’s language:
« מֶרְחָץ שֶׁיֵּשׁ בָּהּ עֲבוֹדַת כּוֹכָבִים מֻתָּר לִרְחֹץ בָּהּ מִפְּנֵי שֶׁהִיא נַעֲשֵׂית שָׁם לְנוֹי וְלֹא לְעָבְדָהּ » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י״ח
The Shach notes where the idol stands, and finds the seif’s wording awkward:
« בטור ורש״י כ׳ שאליל עומדת בחצרה » (ש״ך יו״ד קמ״ב ס״ק ל)
« הלשון מגומגם דמה ענין הכתוב למ״ש שהיא נעשית לשם נוי דאפילו היתה נעשה לעובדה היה מותר מטעם הכתוב ונ״ל להגיה ועוד שנא׳ וכו׳ » (ש״ך יו״ד קמ״ב ס״ק ל״א)
« ואפשר דה״ק מאן מוכח דנעשית לנוי ולא לעובדה שנאמר כו׳ » (ש״ך יו״ד קמ״ב ס״ק ל״א)
The gaze and the hearing. The source of seif 15 is Rabbenu Yeruham, cited by the Beit Yosef, with the principle kol umareh ein bahem me‘ilah aval issur yesh bahem:
« כתב רבינו ירוחם (ני״ז ח״ה) אסור לשמוע כלי שיר של אליל או להסתכל בנוי אליל כיון שנהנה בראיה כך מוכח בפרק כ״ש (כו.) מההיא דא״ר שמעון בן פזי קול ומראה אין בהם מעילה אבל איסור יש בהם » (בית יוסף יו״ד קמ״ב)
The Rosh adds a qualification to it:
« וכתב הרא״ש ז״ל נראה דבעשויה לאליל הוא אע״פ שלא נעבדה עדיין אבל לנוי מותר » (בית יוסף יו״ד קמ״ב)
which the Shach takes up and generalises:
« פי׳ באלילים עצמן שנעבדו אסור להסתכל בהן לראות נויין אבל צורות שנעשו לנוי ולא לעבוד מבואר בתו׳ והרא״ש דמותר » (ש״ך יו״ד קמ״ב ס״ק ל״ג)
He extends the prohibition to smell as well:
« וכן להריח בריח של אלילים וכדמוכח בפ׳ כל שעה (פסחים דף כ״ה ע״ב) » (ש״ך יו״ד קמ״ב ס״ק ל״ב)
Then he disputes the Rama’s attribution — the source is an explicit gemara, not a late gloss:
« זהו ש״ס ערוך בפ׳ כל שעה (פסחים דף כ״ה ע״ב) ופסקוה הרי״ף והרא״ש והר״ן שם והרמב״ם פרק י״ב מהמ״א דין י״ב ולא ידעתי למה כתבו הרב בשם הגהות ריא״ז » (ש״ך יו״ד קמ״ב ס״ק ל״ד)
and he sets the permission on both its edges, which are exactly the axes of the sugya in Pesachim:

9. יסוד הסימן — ממש, גורם, כוונה

All of the above gathers into three axes, and the great disputes of the siman all arrange themselves on one of them.

First axis — ממש. The prohibition of a thing follows it so long as substance of it remains. The coal and the ashes have substance, the flame has none. This is the axis of seif 1, and on it turns the dispute of the Taz and the Beit Yosef: if the prohibition is of the Torah, no quantity and no after the fact lightens it; if it is a decree, both count. The Pitchei Teshuva’s division amounts to saying that both regimes exist, according to where the prohibition came from.
Second axis — גורם. A thing is forbidden not because the prohibition touched it, but because the prohibition made it. Hence the double cause, and hence too its two limits: it requires that both causes acted together (seif 7), and that neither was indispensable (seifim 3 and 4, according to the Taz). The dispute of the Taz and the Nekudot HaKesef is not a disagreement about a leniency: it is a disagreement about what “two causes” means.
Third axis — כוונה. At the two ends of the siman, the same idea in two forms. In seif 2 what decides is not the act but its effect — damaging or improving. In seif 15 what decides is not the effect but the intention — listening or merely hearing. Between them, seif 14 says that even the status of the object depends on how one treats it: et shenoheg bo mishum eloha assur. Idolatry is the one Torah prohibition that a person’s gaze can make and unmake.
Summary of the disputes
  1. Is there a Torah prohibition in the coal? Taz and Shach: yes, even after the fact. Beit Yosef: at the outset only. Pitchei Teshuva: both, according to the origin.
  2. Can the Rambam’s language be carried from orlah to idolatry? The Mechaber carried it; the Shach (ס״ק י) and the Taz (ס״ק ה, ח, י) hold that it cannot be.
  3. Does a double cause apply in idolatry? Taz: no, once the prohibition was indispensable. Nekudot HaKesef: the question does not arise, these are not double causes.
  4. Does the redemption require a mixture? Rashi: no. The Ri, and the Shach after him: yes.
  5. What is carried to the Dead Sea? Rashi: the value of the wood. The Ri: that of the whole loaf.
  6. Does the redemption permit eating? Razah: no. Rabbenu Yonah and the Rosh: yes.
  7. Is the whole dying animal forbidden? Rosh and Beit Yosef: a doubt, and permitted after the fact. Rambam and Shach: forbidden entire, with no redemption.
  8. Is the shadow of the shadow forbidden? Rambam: he does not forbid it. Taz, with the Ran and the Kesef Mishneh: forbidden, since the gemara is explicit.
  9. The barren trees? The Tur’s first view permits them (an offering not after the Temple pattern); the second, adopted by the Tur and by the Mechaber, forbids them as adornment.
