Siman 142 said that it is forbidden to benefit from an idol and its appurtenances. Siman 143 turns the sentence round: it is forbidden also to bring benefit to it — כשם שאסור ליהנות מאליל כך אסור לההנותם, as the Tur opens. Six seifim spell out the rule: a wall one does not rebuild, a vault one does not build, a garden and a bathhouse one may use on certain conditions, flutes, shops and a tax. And one question returns each time, and decides everything: where does the money go?

1. The Mechaber’s text — the 6 seifim

The siman has six seifim, which is the count announced by its heading (ובו ו׳ סעיפים). Seif 1 deals with the party wall that collapses; seif 2, with the vault in which the idol is set up and with the wage of the one who built it; seif 3, with the garden and the bathhouse that belong to the idol; seifim 4, 5 and 6, with three cases taken from the Yerushalmi — the flutes, the shops and the tax.

Seif 1 — The party wall that collapses

שלא לבנות ביתו סמוך לבית עבודת כוכבים ובאיזה אופן מותר ליהנות מעבודת כוכבים. ובו ו׳ סעיפים:

Heading of the siman: not to build one’s house adjoining a house of idolatry, and in what way it is permitted to benefit from an idol; and it contains six seifim.

One whose house adjoined a house of idols, and it collapsed — he is forbidden to rebuild it. What should he do? He withdraws into his own ground and builds; and that empty space he fills with thorns or excrement, so as not to enlarge the house of idols.

If the wall belonged to him and to the idol, it is judged half and half: his share is permitted for benefit, and the idol’sgloss of the Rama: is forbidden; and if he cannot recognise [his stones] (Tur) — everything is forbidden for benefit: its stones, its timber and its ashes.

Gloss of the Rama: however, he may sell them his share, wherever it is (Ran, chapter Kol haTzelamim).
Two words govern the seif: “he withdraws”. To rebuild the wall where it stood would be to build a wall for the house of idols — to bring it benefit. The solution is not to give up one’s house but to move back four cubits (Shach ס״ק ב) and to make the vacated space useless to the neighbour: thorns or refuse, “so as not to enlarge the house of idols”. And if the wall was shared, his own half counts towards the four cubits (Shach ס״ק ג).

Seif 2 — The vault, the wage, and the hall

אסור לבנות עם העובד כוכבים כיפה שמעמידים בה אלילים ואם עבר ובנה (אפי׳ עבודת כוכבים עצמה) (כל בו) שכרו מותר אבל בונה הוא לכתחילה הטרקלין או החצר שיש בה אותה הכיפה:
It is forbidden to build together with the non-Jew the vault in which idols are set up; and if he transgressed and built itgloss of the Rama: even the idol itself (Kol Bo) — his wage is permitted. But he may build from the outset the hall or the courtyard in which that vault stands.
Three circles, three answers. The vault in which the idol is set up: forbidden to build. The wage already earned: permitted — and the Rama adds, from the Gemara, that this holds even for the idol itself, because the object only becomes an idol at the last hammer stroke, which is not worth a perutah (Taz ס״ק ג). The hall or courtyard containing the vault: permitted from the outset according to the Mechaber, who follows Rashi and the Rambam — but the Taz (ס״ק ד) asks that one refrain from it in practice.

Seif 3 — The idol’s garden and bathhouse: “with favour” or “without favour”

If the idol had a garden or a bathhouse, and the benefit that comes from them goes to the priests: it is permitted to use them “without favour” and forbidden to use them “with favour”, even if others share in that benefit with the priests. And if the benefit that comes from them goes not to the priests but to its worshippers, it is permitted to use them even “with favour”, even if the garden and the bathhouse belong to the idol alone (so it appears from the Tur, according to Rashi).

Gloss of the Rama: and some say that it is forbidden to use it, when the benefit goes to the priests, only when they stand in the courtyard of the idol itself; but when they do not stand before it, even though the benefit that comes from them goes to the priests, it is permitted to use it — unless the benefit is for the idol itself; and one may rely on this to be lenient (Tur in the name of Rabbenu Tam; Tosafot f. 44; Rosh and Mordechai in the name of Rabbenu Tam).
Everything hangs on one word: בטובה. For Rashi, to use “with favour” means to pay the priests; for Rabbenu Tam, it means to be beholden to them, to owe them a favour — even without paying. The Mechaber follows Rashi (and the Shach ס״ק ה explains why he is strict: even if others share the benefit, forbidden); the Rama opens Rabbenu Tam’s door: as soon as the bathhouse or garden is not in the very courtyard of the idol, one may be lenient.

Seif 4 — The flutes

Seif 5 — The shops

Shops of idols: it is forbidden to rent them. Gloss of the Rama: and if the rent falls to the city, and it is they who buy its needs, it is permitted (Tur and the poskim, from the Yerushalmi).

Seif 6 — The tax collectors

גבאים שנוטלים מכס לאלילים אסור ליתן להם: הגה וכן בכאן אינו אסור אלא כשנופל השכר לצרכי עבודת כוכבים עצמה אבל כשנופל לכיס בני המדינה אע״פ שהם קונים צרכי עבודת כוכבים שרי. (טור):
Collectors who take a tax for idols: it is forbidden to give them. Gloss of the Rama: and here too it is forbidden only when the proceeds fall to the needs of the idol itself; but when they fall into the purse of the townspeople, even though they buy the idol’s needs, it is permitted (Tur).
Seifim 4, 5 and 6 come from a single passage of the Yerushalmi, and they obey a single rule, which the Rama writes twice: forbidden when the money goes to the idol itself, permitted when it falls into the city’s coffers — even if the city then funds the idol. The Tur gives the reason: what the city gives the idol, it gives from its own purse; the Jew paid only the city.

2. Context — where each piece of the siman comes from

Seif 1 is a mishnah of the chapter Kol haTzelamim, and the Gemara explains the solution of the “thorns”:

« מִי שֶׁהָיָה בֵּיתוֹ סָמוּךְ לַעֲבוֹדָה זָרָה, וְנָפַל — אָסוּר לִבְנוֹתוֹ. כֵּיצַד יַעֲשֶׂה? כּוֹנֵס בְּתוֹךְ שֶׁלּוֹ אַרְבַּע אַמּוֹת וּבוֹנֶה » (עבודה זרה מ״ז ע״א)
summary: one whose house adjoined an idol, and it collapsed — he is forbidden to rebuild it. What should he do? He withdraws four cubits into his own ground, and builds.

Seif 2 comes from a mishnah in the first chapter, and from the Gemara that comments on it regarding the wage:

« אֲבָל בּוֹנִין עִמָּהֶם בִּימוֹסְיָאוֹת וּבֵית מֶרְחֲצָאוֹת. הִגִּיעַ לְכִיפָּה שֶׁמַּעֲמִידִין בָּהּ עֲבוֹדָה זָרָה — אָסוּר לִבְנוֹת » (עבודה זרה ט״ז ע״א)
« הִגִּיעַ לַכִּיפָּה מָקוֹם שֶׁמַּעֲמִידִין בָּהּ עֲבוֹדָה זָרָה. אָמַר רַבִּי אֶלְעָזָר אָמַר רַבִּי יוֹחָנָן: אִם בָּנָה — שְׂכָרוֹ מוּתָּר. פְּשִׁיטָא! מְשַׁמְּשֵׁי עֲבוֹדָה זָרָה הֵן, וּמְשַׁמְּשֵׁי עֲבוֹדָה זָרָה, בֵּין לְרַבִּי יִשְׁמָעֵאל בֵּין לְרַבִּי עֲקִיבָא, אֵינָן אֲסוּרִין עַד שִׁיעְבְּדוּ » (עבודה זרה י״ט ע״ב)

Obviously! They are appurtenances of an idol, and appurtenances only become forbidden once they have been used.

It is this “obviously” that produces the Rama’s clause: the Gemara concludes that the teaching concerns the wage for the idol itself, and gives the reason — the last hammer stroke is not worth a perutah, and the wage accrues as the work goes on:

« אֶלָּא אָמַר רַבָּה בַּר עוּלָּא: לֹא נִצְרְכָה אֶלָּא בְּמַכּוֹשׁ אַחֲרוֹן. עֲבוֹדָה זָרָה מַאן קָא גָרֵים לַהּ? גְּמַר מְלָאכָה, וְאֵימַת הָוְיָא גְּמַר מְלָאכָה? בְּמַכּוֹשׁ אַחֲרוֹן. מַכּוֹשׁ אַחֲרוֹן לֵית בֵּיהּ שָׁוֶה פְּרוּטָה. אַלְמָא קָסָבַר, יֶשְׁנָהּ לִשְׂכִירוּת מִתְּחִלָּה וְעַד סוֹף » (עבודה זרה י״ט ע״ב)

Seif 3 is a mishnah of the chapter Rabbi Yishmael, and the word בטובה is explained there by Abaye:

« עֲבוֹדָה זָרָה שֶׁהָיָה לָהּ גִּינָּה אוֹ מֶרְחָץ — נֶהֱנִין מֵהֶן שֶׁלֹּא בְּטוֹבָה, וְאֵין נֶהֱנִין מֵהֶן בְּטוֹבָה. הָיָה שֶׁלָּהּ וְשֶׁל אֲחֵרִים — נֶהֱנִין מֵהֶן בֵּין בְּטוֹבָה וּבֵין שֶׁלֹּא בְּטוֹבָה » (עבודה זרה נ״א ע״ב)

The Rambam spreads these laws over three chapters of Hilkhot Avodat Kokhavim. First the wall:

« מִי שֶׁהָיָה בֵּיתוֹ סָמוּךְ לַעֲבוֹדַת כּוֹכָבִים וְנָפַל אָסוּר לִבְנוֹתוֹ. כֵּיצַד יַעֲשֶׂה. כּוֹנֵס לְתוֹךְ שֶׁלּוֹ וּבוֹנֶה וְאוֹתוֹ הָרֶוַח מְמַלְּאֵהוּ קוֹצִים אוֹ צוֹאָה. כְּדֵי שֶׁלֹּא יַרְחִיב לְבֵית עֲבוֹדַת כּוֹכָבִים. הָיָה הַכֹּתֶל שֶׁלּוֹ וְשֶׁל עֲבוֹדַת כּוֹכָבִים יִדּוֹן מֶחֱצָה לְמֶחֱצָה, מֶחֱצָה שֶׁלּוֹ מֻתָּר בַּהֲנָאָה וְשֶׁל עֲבוֹדַת כּוֹכָבִים הַכּל אָסוּר בַּהֲנָאָה. אֲבָנָיו עֵצָיו וַעֲפָרוֹ הַכּל אָסוּר בַּהֲנָאָה » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ח׳ הלכה ה׳

Then the vault and the hall — this is the wording the Mechaber copies word for word in seif 2:

« אָסוּר לִבְנוֹת עִם הָעוֹבְדֵי כּוֹכָבִים כִּפָּה שֶׁמַּעֲמִידִים בָּהּ עֲבוֹדַת כּוֹכָבִים. וְאִם עָבַר וּבָנָה שְׂכָרוֹ מֻתָּר. אֲבָל בּוֹנֶה הוּא לְכַתְּחִלָּה הַטְּרַקְלִין אוֹ הֶחָצֵר שֶׁיֵּשׁ בָּהּ אוֹתָהּ הַכִּפָּה » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ט׳ הלכה י״א

And the garden and the bathhouse — where the Rambam rules differently from the Mechaber when others share the benefit with the priests:

The Tur, finally, opens the siman with the principle that governs it, and the Mechaber follows him almost word for word:

« כשם שאסור ליהנות מאליל כך אסור לההנותם לפיכך מי שביתו סמוך לאליל ונפל אסור לבנותו שמהנה לה לבנות לה כותל כיצד יעשה כונס לתוך שלו ד׳ אמות ובונה » (טור יו״ד קמ״ג)

3. The key concepts of this siman

נֶהֱנֶה · מְהַנֶּהto benefit, and to bring benefit. The first prohibition is that of siman 142: deriving benefit from an idol. The second is that of siman 143: bringing benefit to it. The Gemara (13a) links them by a kal vachomer — if benefiting is forbidden, bringing benefit is all the more so.
כּוֹנֵס לְתוֹךְ שֶׁלּוֹhe withdraws into his own ground. By four cubits, the mishnah specifies (Shach ס״ק ב). The Mechaber does not state the number, but assumes it. And if the wall was shared, his half of its thickness counts towards those four cubits (Shach ס״ק ג).
קוֹצִים אוֹ צוֹאָהthorns or excrement. The Gemara’s two solutions (47b) so that the vacated space does not benefit the idol: make it a latrine, or fence it with briars. Either suffices.
מֶחֱצָה לְמֶחֱצָהhalf and half. The fate of the party wall. His share is permitted; the idol’s, forbidden; and when the stones cannot be told apart, everything is forbidden — אין ברירה, there is no retroactive selection (Rashi 47b).
כִּפָּהthe vault. The place in a building where the idol is set up — Rashi explains it by the custom of placing a statue in the bathhouses. It is a direct appurtenance of the idol: one does not build it.
תַּשְׁמִישׁ דְּתַשְׁמִישׁthe appurtenance of the appurtenance. The hall or courtyard containing the vault: it serves what serves the idol. Rashi and the Rambam permit building it; Rabbenu Yitzchak (Tosafot) forbids it, and the Taz follows him in practice.
מַכּוֹשׁ אַחֲרוֹןthe last hammer stroke. What completes the idol — and therefore what brings it into being. It is not worth a perutah; and since ישנה לשכירות מתחלה ועד סוף — the wage accrues from beginning to end — the builder was paid for lawful work.
בְּטוֹבָה · שֶׁלֹּא בְּטוֹבָהwith favour · without favour. The word of seif 3. Rashi: paying the priests. Rabbenu Tam: owing them a favour. Rambam and Raavad: verbal gratitude. Three readings, three different rulings for the priest’s mill and oven.
כֹּהֲנִים · עוֹבְדֶיהָthe priests · its worshippers. Abaye’s dividing line: the benefit that goes to the priests is the one that matters; the one that goes to the ordinary faithful (Taz ס״ק ו: “the mass of those who worship that idol”) is permitted, even “with favour”.
מֶכֶסthe tax. The levy of the fair or of the collector. Forbidden when it funds the idol, its ornaments and its offerings; permitted when it falls into the city’s coffers — even if the city, for its part, maintains the cult.

4. The table of beneficiaries

The whole siman comes down to one question: who benefits from what the Jew does or pays?

Read the first column: the idol, the priests, the faithful, the city. The closer the money comes to the idol, the sharper the prohibition; the further it moves away, the more the siman opens. It is the same idea that moves the wall back four cubits and permits the municipal tax.

5. The Shach, the Taz, the Baer Hetev and the Pitchei Teshuva

The apparatus of this siman is measured: 7 ס״ק in the Shach, 6 in the Taz, 8 in the Baer Hetev, 1 in the Pitchei Teshuva; and the Nekudot HaKesef does not comment on it. But two of these ס״ק — the first and the fourth of the Shach — are long discussions with the Bach, and that is where the reading of the siman is decided.

The Shach

ס״ק א — the wall is forbidden even if the house itself is not worshipped

« משמע מדברי הט״ו שאפילו אין הבית עצמו נעבד אסור לבנות כותל להבית כיון שמהנה לאליל » (ש״ך יו״ד קמ״ג ס״ק א)
summary: it follows from the Tur and the Shulchan Arukh that even if the house itself is not worshipped, it is forbidden to build a wall for that house, since one brings benefit to the idol.
« והב״ח כתב וז״ל ומפרש במשנה פרק כל הצלמים מי שהיה ביתו סמוך לאליל נראה שאם לא היה הבית עצמו נעבד אלא שהעמידו בו עבודת כוכבים לא היה נקרא מהנה לעבודת כוכבים בבנין הכותל » (ש״ך יו״ד קמ״ג ס״ק א)
summary: the Bach had written that it seems that, if the house itself was not worshipped but an idol had merely been placed in it, building the wall would not be called “bringing benefit to the idol”. The Shach refutes him at length: Rashi spoke of a “worshipped house” only to explain the impurity “like a niddah” of Rabbi Akiva.

The Taz

ס״ק ב — from the vault to the windows

ס״ק ג — why the wage is permitted even for the idol itself

ס״ק ו — the Maharshal, and the Shach on verbal gratitude

The Pitchei Teshuva

A single entry on this siman, and it refers back to the question of the wage:

summary: see the Bach and the Shach ס״ק ד, for the reason why the Tur and the Mechaber omitted Rabbi Yirmiyah’s teaching in the Gemara — that even the wage for the idol itself is permitted; and see the Shaar haMelekh, Ishut ch. 5 h. 20, who is astonished at them.

6. The Rama’s glosses

On seif 1 — “forbidden; and if he cannot recognise”

The Mechaber said “his share is permitted for benefit”; the Rama completes it from the Tur: the idol’s share is forbidden, and if one cannot recognise its stones, everything is forbidden. The Tur writes it thus:

« וחלקו מן העצים והאבנים אם מכירן מותרין ואם לאו הכל אסור ובאותם ד׳ אמות שהרחיק יעשה בהם דברים שלא תהנה מהם האליל ואם אינו רשאי ימלאנה קוצים » (טור יו״ד קמ״ג)
summary: his share of timber and stones, if he recognises them, is permitted; otherwise everything is forbidden; and in those four cubits by which he withdrew, he shall do things from which the idol derives no benefit, and if he cannot, he fills them with thorns.

On seif 1 — “he may sell them his share”

This gloss comes from the Ran, whom the Beit Yosef quotes with his reservation: the Yerushalmi reads “half and half” as a division of the stones; the Ran adds that in any case one may sell one’s share; and the Beit Yosef “hesitates to be strict” — but the Rama retains the permission to sell:

« וכתב הר״ן אבל בירושלמי פירשו דמאי דאמרינן נדון מחצה על מחצה היינו לומר שחצי הכותל מותר ונוטל מחצה בעצים ובאבנים ומיהו ה״מ במכיר האבנים שכנגדו אבל כשאינו מכירו הכל אסור דאין ברירה ומיהו מסתברא דמותר למכור לו חלקו בכל מקום שהוא » (בית יוסף יו״ד קמ״ג)

On seif 2 — “even the idol itself”

The Mechaber speaks only of the vault; the Rama, in the name of the Kol Bo, extends the permission of the wage to the idol itself. The Shach (ס״ק ד) shows that this is the Gemara itself (19b), followed by the Rosh, the Ran, Tosafot, the Rambam and the Rashba — and the Rambam writes it in so many words:

« הָעוֹשֶׂה עֲבוֹדַת כּוֹכָבִים לַאֲחֵרִים אַף עַל פִּי שֶׁהוּא לוֹקֶה שְׂכָרוֹ מֻתָּר וַאֲפִלּוּ עֲשָׂאָהּ לְעוֹבֵד כּוֹכָבִים שֶׁהִיא אֲסוּרָה מִיָּד. מִפְּנֵי שֶׁאֵינָהּ נֶאֱסֶרֶת עַד שֶׁתִּגָּמֵר וּמַכּוֹשׁ אַחֲרוֹן שֶׁגּוֹמְרָהּ אֵין בּוֹ שְׁוֵה פְּרוּטָה » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה ה׳
summary: one who makes an idol for others, although he is liable to lashes, his wage is permitted — even if he made it for a non-Jew, for whom it is forbidden immediately —, because it is not forbidden until it is completed, and the last hammer stroke that completes it is not worth a perutah.

On seif 3 — the idol’s courtyard

This is the weightiest gloss of the siman: the Rama cites Rabbenu Tam, for whom the prohibition of the bathhouse and the garden holds only in the very courtyard of the idol, and concludes ויש לסמוך על זה להקל. Tosafot say it about the ovens and mills of their day:

« ועוד נראה לר״ת דמה שאנו אופין עתה בתנור של כומרים וטוחנין בריחים של מים שלהם ודאי ליכא למיחש דלא מיבעיא בשכר דשרי דאין אנו מחזיקין להם טובה אלא אפילו שלא בשכר נמי מותר כיון שאין התנור והריחים בבית העבודת כוכבים עצמו כמו הכא מרחץ של אפרודיטי » (תוספות עבודה זרה מ״ד ע״ב ד״ה נהנין)
summary: and it further seems to Rabbenu Tam that, when we nowadays bake in the priests’ oven and grind at their water mills, there is certainly nothing to fear: not only when paying — for we owe them no favour — but even without paying, since the oven and the mill are not in the house of idolatry itself, unlike the bathhouse of Aphrodite.

On seifim 5 and 6 — “if the rent falls to the city”

Two twin glosses, from the Yerushalmi and the Tur: what falls into the city’s coffers is permitted, even if the city then funds the cult. The Tur gives the mechanism:

« וגבאין של אליל אסור ליתן להם ואם היו מעלין שכר למדינה אע״פ שגובין לאליל מותר ליתן להם פירוש שבני המדינה לוקחין לעצמן מה שגובין ומספיקין צרכי האליל מותר כיון שאם ירצו יקחו לעצמן כל מה שגבו ומה שנותנין לאליל כאילו נתנו מכיסן » (טור יו״ד קמ״ג)
summary: the idol’s collectors, it is forbidden to give them; but if they pay the proceeds to the city, although they collect for the idol, it is permitted to give them — that is, the townspeople take for themselves what they collect and supply the idol’s needs: permitted, since, if they wished, they would keep everything, and what they give to the idol is as if they gave it from their own purse.
The Rama’s glosses all pull in the same direction: they specify where the boundary runs — between his share and the idol’s, between the vault and the idol, between the idol’s courtyard and the rest, between the cult’s coffers and the city’s. The Mechaber lays down the prohibition; the Rama draws its edges.

7. Contemporary cases

A reservation first. Whether a given contemporary place of worship falls under the laws of עבודת כוכבים in the sense of this siman is a question in its own right, which this level does not decide: it goes through a Rav. The cases below show how the siman reasons, not what it decides in each situation.

Case 1 — A party wall with a place of worship

This is seif 1. Rebuilding the shared wall means building a wall for the house of idolatry. The siman’s solution is to move back and not to leave the space to the neighbour. And the Shach (ס״ק א) stresses that the rule holds even if the building is not itself “worshipped”: it is enough that an idol is set up in it.

Case 2 — A contractor on a building site

Seif 2 distinguishes three zones. The very room in which the idol stands — forbidden, and the Taz (ס״ק ב) adds even the windows of that room. The wage for work already done — permitted. The rest of the building — permitted according to the Mechaber, but the Taz (ס״ק ד) asks that one refrain, and at the very least never build alone.

Case 3 — Premises rented to a religious institution

This is seif 5, and the Rama’s gloss gives the test: where does the rent go? If it directly funds the cult — forbidden. If it falls into a general fund (a city, a public body) which, for its part, maintains the cult — permitted. What matters is not the money’s final use, but to whom the Jew handed it.

Case 4 — Buying the produce of a religious estate

This is seif 3 with its three readings of בטובה. The Rama permits when the garden is not in the idol’s courtyard; the Bach (Shach ס״ק ז) adds the condition that other buyers would exist anyway; and the Rashba, cited by the Beit Yosef, invokes established practice — פוק חזי מאי עמא דבר.

Case 5 — An entrance fee, a tax

This is seif 6. Siman 149 will return to it for the fair; here the criterion is already set: a tax that feeds the cult itself is forbidden; a municipal tax is not. And the Maharshal (Taz ס״ק ה) adds the opposite limit: not to accept a personal exemption from the cult, for then it is the idol that “does a favour”.

8. Summary of Siman 143

In one sentence: just as it is forbidden to benefit from an idol, it is forbidden to bring it benefit; and to know whether one brings it benefit, the siman always asks the same question — where does what I do, or what I pay, go?
