1. שורש הסימן — נהנה ומהנה: one prohibition, or two?
Siman 142 forbade deriving benefit from the idol; siman 143
forbids bringing benefit to it. The Tur links them with a “just as” — but this “just as” hides a question:
is the prohibition of benefiting the idol a corollary of the prohibition of benefiting from
it, or a prohibition in its own right?
The Gemara links the two by a kal vachomer — and by a case where one can escape neither
« וְרַבִּי יוֹחָנָן אָמַר: אֲפִילּוּ מְעוּטָּרוֹת בְּפֵירוֹת נָמֵי אָסוּר, קַל וָחוֹמֶר: נֶהֱנֶה — אָסוּר, מְהַנֶּה — לֹא כׇּל שֶׁכֵּן » (עבודה זרה י״ג ע״א)

The chakirah: where does the prohibition of מהנה come from?(א) It
derives from the prohibition of benefiting — that is Rabbi Yochanan’s kal vachomer: if receiving from
the idol is forbidden, giving to it is all the more so. On this branch, the prohibition is measured like the
first: by the benefit that circulates. (ב) It rests on the mitzvah to destroy the
idol — whoever provides it with something “wants it to endure”, and that is what is forbidden, regardless of
any value. The Beit Yosef reports this second path in the name of the Ramban:
« כתב רבינו ירוחם בשם הרמב״ן כיון דאמרינן מצוה לבטל אליל ומשמשיה ורוצה בקיומן אסור נראה שאפי׳ בחנם שאם אמר לו שמור אליל אסור » (בית יוסף יו״ד קמ״ג)
Nafka mina Guarding an idol for free. On (א), no benefit circulates, and nothing is
forbidden. On (ב), the Ramban forbids: the guardian “wants it to endure”. And the whole siman leans towards
(א) — which is why its six seifim never ask what one wants, but where what one gives goes.

Rashi, on the mishnah
« שהיה אחד מכותלי עבודת כוכבים והבית עצמו נעבד » (רש״י עבודה זרה מ״ז ע״א ד״ה מי שהיה)
And on the Gemara, when it objects that withdrawing “enlarges” the idol:
« ואנן תנן דאסור לבנות כותל להפסיק בינו ובין עבודת כוכבים לפי שבונהו לעבודת כוכבים » (רש״י עבודה זרה מ״ז ע״ב ד״ה והא בעי)
The Bach’s kushya Rashi writes “and the house itself is worshipped”. Is that not the
condition of the prohibition? If the house is not worshipped but merely houses an idol, building its wall is
not “benefiting the idol”. The Shach quotes the Bach word for word:
« והב״ח כתב וז״ל ומפרש במשנה פרק כל הצלמים מי שהיה ביתו סמוך לאליל נראה שאם לא היה הבית עצמו נעבד אלא שהעמידו בו עבודת כוכבים לא היה נקרא מהנה לעבודת כוכבים בבנין הכותל » (ש״ך יו״ד קמ״ג ס״ק א)
Terutz — the Shach: Rashi is not speaking of the condition of the prohibition, but of impurity
« משמע מדברי הט״ו שאפילו אין הבית עצמו נעבד אסור לבנות כותל להבית כיון שמהנה לאליל » (ש״ך יו״ד קמ״ג ס״ק א)

The mishnah continues: “its stones, its timber and its dust defile like a creeping creature; Rabbi Akiva says:
like a niddah”. Now only an idol itself defiles by carrying, not its appurtenances — the Gemara says
so explicitly for Rabbi Akiva. Rashi therefore had to assume that the house is worshipped for the end of the
mishnah to hold; he says nothing about the condition of the prohibition to build.
The Shach’s positive proof, from Rashi 16a. Rashi explains the permission of the בימוסיאות
by “appurtenance of an appurtenance”:
« בנין שאינו לצורך עבודת כוכבים … ומאי בימוס בימה של אבן אחת ומקריב זבחים דהוי תשמיש דתשמיש לעבודת כוכבים » (רש״י עבודה זרה ט״ז ע״א ד״ה בימוסיאות)
So the direct appurtenance of the idol is forbidden to build; and a house in which the idol is set up
is its direct appurtenance. The Shach thus turns the Bach’s argument round: it is precisely because the hall
is permitted as an appurtenance of an appurtenance that the wall of the house sheltering the idol is
forbidden —
« ולא ירדתי לסוף דעתו דאדרבה משם ראיה דהא דוקא בטרקלין דהוי תשמיש דתשמיש שרי רש״י הא לאו הכי לא ואם כן למה יהא מותר לבנות כותל לבית שמעמידין בה עבודת כוכבים » (ש״ך יו״ד קמ״ג ס״ק א)
Nafka mina A building which is not itself an object of worship, but which contains an idol.
According to the Bach, one may rebuild the party wall; according to the Shach, not — and the Baer Hetev (ס״ק א)
rules like the Shach: the Bach’s words “do not seem right at all”.
3. מחצה למחצה — the space, or the stones?
Two readings of “it is judged half and half”
The Bavli, as Rashi reads it, speaks of the space: the half of the wall
that is his counts towards the four cubits. The Yerushalmi, as the Ran reports it, speaks of the
stones: he takes half of them.
Rashi — the space counts, the stones do not
« אותו חלק של עבודת כוכבים אינו עולה לו בכניסת ד׳ אמות אבל חלקו עולה לו שאם היה עביו שתי אמות מונה האמה שלו וכונס עוד ג׳ אמות לתוך שלו » (רש״י עבודה זרה מ״ז ע״ב ד״ה נידון)

The Ran, through the Beit Yosef — the Yerushalmi, and a reservation

The Ran takes from the Yerushalmi that half the stones are permitted if he recognises them, and
adds on his own account that one may in any case sell one’s share. The Beit Yosef finds that the mishnah reads
like Rashi, and “hesitates to be strict” — while noting that the Rambam copied the Yerushalmi.
Chakirah: why are all the stones forbidden according to Rashi?(א) Because
אין ברירה: one cannot say retroactively “these were mine”. (ב)
Because the whole wall served the idol, and his share is absorbed in it as an appurtenance. Rashi’s wording —
“even his share, because there is no bererah” — decides for (א): the defect is one of
identification, not of status. Hence the Yerushalmi’s opening: when the stones are recognisable,
there is nothing left to decide.
Nafka mina — and the Rama decides it The Rama takes both: from the Tur, “if he cannot
recognise — everything is forbidden” (so if he recognises, his share is permitted); from the Ran, “he may sell
them his share wherever it is”. The Shach (ס״ק ג) and the Baer Hetev (ס״ק ב) recall Rashi’s calculation for the
space:
« וחלקו עולה לו שאם היה עביו של כותל ב׳ אמות מונה האמה שלו וכונס עוד ג׳ אמות לתוך שלו. רש״י והר״ן » (ש״ך יו״ד קמ״ג ס״ק ג)
אסור לבנות עם העובד כוכבים כיפה שמעמידים בה אלילים ואם עבר ובנה (אפי׳ עבודת כוכבים עצמה) (כל בו) שכרו מותר אבל בונה הוא לכתחילה הטרקלין או החצר שיש בה אותה הכיפה:
The Mechaber permits building the hall or the courtyard that
contains the vault. This permission rests on a reading of the mishnah — a beit or a dalet — and on
the category it involves.
The mishnah, and the two readings
« אֲבָל בּוֹנִין עִמָּהֶם בִּימוֹסְיָאוֹת וּבֵית מֶרְחֲצָאוֹת. הִגִּיעַ לְכִיפָּה שֶׁמַּעֲמִידִין בָּהּ עֲבוֹדָה זָרָה — אָסוּר לִבְנוֹת » (עבודה זרה ט״ז ע״א)
Rashi reads בימוסיאות, and explains:
« בנין שאינו לצורך עבודת כוכבים … ומאי בימוס בימה של אבן אחת ומקריב זבחים דהוי תשמיש דתשמיש לעבודת כוכבים » (רש״י עבודה זרה ט״ז ע״א ד״ה בימוסיאות)
Tosafot, in the name of Rabbenu Yitzchak, read דימוסיאות:
« לכך נראה לר״י כגירסת הערוך שפירש דימוסיאות בדל״ת והוא לשון מרחצאות » (תוספות עבודה זרה ט״ז ע״א ד״ה בימוסיאות)
Tosafot’s kushya on Rashi A בימוס is never called an “appurtenance of an appurtenance”: the
mishnah on 47b speaks of “the stone he hewed from the start for a bimos”, and the Gemara on 53b forbids the
bimosiaot of kings because the idol is set on them — it is a direct appurtenance. And even were it
only an appurtenance of an appurtenance:
« ועוד דנהי נמי שהוא משמש למשמשי עבודת כוכבים אמאי מותר לבנות עמהן וכי הוא סברא להתיר לבנות עמהן מקום שיקטירו עליו במחתה לעבודת כוכבים » (תוספות עבודה זרה ט״ז ע״א ד״ה בימוסיאות)
The Beit Yosef explains the Rambam, and the Taz draws the consequence
« ונראה שטעמו משום דמפרש הא דתנן בונה עמהם במסיאות דהיינו טרקלין או חצר שבו אותה כיפה וכן פרש״י דבמסיאות היינו בימה שמקריב עליה זבחים דהוי׳ תשמיש׳ דתשמיש לאליל » (בית יוסף יו״ד קמ״ג)
« כן פסק רש״י ורמב״ם במתניתין דקתני בונה עמהם בימוסיאות דהיינו מידי דהוה תשמיש דתשמיש לעבודת כוכבים והתוספות חולקים וגורסים בגמרא דימוסיאו׳ ופירושו מרחצאות וכ״פ הערוך והטור הביאו במסקנא אבל תשמיש דתשמיש לעבודת כוכבים אסור » (ט״ז יו״ד קמ״ג ס״ק ד)
Rashi and the Rambam hold the reading with a beit: what one builds with them is an appurtenance of an
appurtenance, hence permitted — and the Rambam deduces from it the hall and the courtyard. Rabbenu Yitzchak
holds the reading with a dalet, bathhouses: the mishnah then permits nothing that serves the idol,
even remotely.
The Taz, in three steps. First the astonishment:
« וע״כ תימה על הש״ע ורמ״א שלא חששו לפסוק לחומרא בפרט באיסור אליל שכ״פ מצינו שהחמירו בו טפי משאר איסורים והלא תראה בסוף סי׳ קל״ט שהחמירו למכור להם אפי׳ קלפי׳ ודיו ושאר חומרות ק״ו בן בנו של ק״ו הטרקלין השייך לכיפה של אליל » (ט״ז יו״ד קמ״ג ס״ק ד)
Then a restriction internal to the permission itself — the mishnah says “he builds with them”, and
the Rambam copied by the Mechaber opens the seif with “with the non-Jew”:
« ונ״ל עוד דאפי׳ לרש״י ורמב״ם אין היתר אלא דרך מסייע לחוד שהרי איתא במשנה בלשון זה בונה עמהם וכן הרמב״ם שהעתיק המחבר כאן כתב בריש הסעיף אסור לבנות עם העובדי כוכבים כו׳ ועלה קאמר אבל בונה כו׳ כלומר עמהם דוקא ומצינו כמה פעמים דמסייע אין בו ממש אבל לבנות הוא לבדו אסור לכ״ע » (ט״ז יו״ד קמ״ג ס״ק ד)
Finally the conduct:
« אבל למעשה ודאי ראוי לנו לפסוק כר״י שראה דברי רש״י וחלק עליהם ואליו תשמעון להרחיק מכיעור ודומה לו » (ט״ז יו״ד קמ״ג ס״ק ד)
And the Taz extends the vault to the windows (ס״ק ב). If one does not build the vault, one
does not cut the windows of the room where the idol stands either; and fear of enmity permits nothing here,
because one can decline:
« מכאן אסור לעשות חלונות לבית עבודת כוכבים דהיינו להחדר שהעבודת כוכבים בתוכו » (ט״ז יו״ד קמ״ג ס״ק ב)
« ואין להתיר משום איבה דכבר כתבו התוספות פ״ק דעבודת כוכבים (דף י״ט) לענין תכשיטין של אליל דאיכא לאשתמוטי למימר דאסור לנו למיעבד תכשיטין לאליל » (ט״ז יו״ד קמ״ג ס״ק ב)
Nafka mina A contractor who builds alone the wing of a building containing the vault:
forbidden even according to Rashi and the Rambam, says the Taz. In a team with them: permitted according to
the Mechaber, forbidden in practice according to the Taz — and the Baer Hetev (ס״ק ה) records this conclusion:
“forbid even assisting”.
5. שכרו מותר — the Rif against the Rambam, the Bach against the Rama
Chakirah: why is the wage for the idol itself permitted? Two propositions, and both are
needed. (א) The idol comes into being at the last hammer stroke, and that stroke is not worth a
perutah. (ב)ישנה לשכירות מתחלה ועד סוף — the wage accrues
progressively, so that everything before the last stroke was paid for an object that was not yet an idol.
Without (ב), the wage would be acquired in one block at the end, for a finished idol. Rashi says it:
« הלכך שרי דשכירות שאר מכושות לא מיתסר דההוא לאו שכר עבודת כוכבים הוא » (רש״י עבודה זרה י״ט ע״ב ד״ה לית ביה)
Tosafot’s kushya Even less than a perutah of an idol’s money is forbidden. So the last stroke
is worth something, and that something is mixed into the wage.
Terutz — Tosafot: for that stroke, the non-Jew would have deducted nothing
« וי״ל כיון דבשביל מכוש זה האחרון לא היה העובד כוכבים נותן ממנו משכירותו פחות א״כ אין לו עליו שכר עבודת כוכבים כלל » (תוספות עבודה זרה י״ט ע״ב ד״ה מכוש)
The Rif, the Tur and the Mechaber speak only of the vault
The Rambam writes the permission for the idol itself; the Rif, the Tur and the
Mechaber keep silent about it, and permit the wage only for the vault. The Rama, in the name of the Kol Bo,
restores the Gemara. The Bach attacks the Rama — and the Shach defends both.
The Rambam, in so many words

The Shach: what the Bach objected, and why his answer does not hold
« משמע מדברי הט״ו דדוקא כיפה אבל עבודת כוכבי׳ עצמה שכרה אסור וכ״נ דעת הרי״ף ותמה הב״ח דבש״ס (בעבודת כוכבים דף י״ט ע״ב) אמרין דאפי׳ עבודת כוכבים עצמה שכרה מותר » (ש״ך יו״ד קמ״ג ס״ק ד)
« ומה שתירץ הב״ח הוא תמוה לחלוק על הש״ס בסברא ומכל שכן שהתוס׳ תרצו קושייתו » (ש״ך יו״ד קמ״ג ס״ק ד)
The Shach defends the Rif from the Yerushalmi. In the Yerushalmi, Rabbi Mana disputes Rabbi
Eliezer regarding the vault itself — so Rabbi Eliezer was indeed speaking of the vault, and Rabbi
Yirmiyah’s okimta (“the idol itself”) does not hold; the Rif follows the Yerushalmi on this point, because
the Bavli does not contradict the Yerushalmi there, it interprets it:
« אכן נראה לי ליישב ברווח שדעת הרי״ף מדאמרינן בירושלמי הלכה ז׳ עבר ובנה רבי אליעזר אומר מותר אמר ר׳ מנא לא מסתברא כהדא סוברת דלא אסיר דהא חייד כל הדא כיפתא » (ש״ך יו״ד קמ״ג ס״ק ד)
« פירוש לא מסתבר כסברא זו דלא אסר אלא אפילו עבר ובנה שכרו אסור שהרי הוא משמח בעבודת כוכבים כל זמן שהכיפה קיים » (ש״ך יו״ד קמ״ג ס״ק ד)
But the Shach rules like the Rama, and says so plainly
« אבל הרא״ש והר״ן והתו׳ לשם פסקו כר׳ ירמיה וכ״פ הרמב״ם ספ״ז מהלכות עבודת כוכבים דין ה׳ והרשב״א בתה״א דף קל״ח ע״א וכן כ׳ הכלבו סימן צ״ז וזהו דעת הרב » (ש״ך יו״ד קמ״ג ס״ק ד)
« ותימה גדולה על הב״ח שהשיג על הרב כי אדרבה תמהתי למה כתב דין זה בשם הכלבו הלא ש״ס ערוך הוא ומבואר בגדולי הפוסקים הנ״ל » (ש״ך יו״ד קמ״ג ס״ק ד)
And he closes the Yerushalmi’s door that he had opened for the Rif:

The Pitchei Teshuva (ס״ק א) refers to this ס״ק and to the Shaar haMelekh for the question left open: why
did the Tur and the Mechaber omit Rabbi Yirmiyah?
« עיין ב״ח ובש״ך סק״ד הטעם למה השמיטו הטור והמחבר הא דר׳ ירמיה בש״ס דאפילו שכר עבודת כוכבים עצמה מותר » (פתחי תשובה יו״ד קמ״ג ס״ק א)
The Taz’s answer: they kept it quiet on purpose
« וכן כתבו כל הפוסקים רק הרי״ף והטור והש״ע לא הביאו להאי רבותא דאפילו אליל עצמה שרי השכר בדיעבד ונראה טעמם שלא רצו לגלות היתר זה כדי להרחיק את האדם מכיעור עבירה זו וכדרך שאמרו בפרק מי שהחשיך עוד אחרת אמרו ולא רצו לגלותה » (ט״ז יו״ד קמ״ג ס״ק ג)
It is not a divergence of ruling but of pedagogy: the permission exists, but one does not display it,
just as the Gemara itself “knew another and did not wish to reveal it”.
Nafka mina A craftsman who made, for a wage, the very object of worship. According to the Rif
as the Shach reads him, the wage is forbidden; according to the Rambam, the Rama, the Shach and the Taz,
permitted — but without teaching it in advance. Two positions, one piece of advice: do not get involved.

6. בטובה — Rashi, Rabbenu Tam, the Rambam, and Abaye’s two versions
Rashi (51b): paying a wage to the priests. Rabbenu
Tam (Tosafot 44b, Rosh): owing them a favour, even without paying. Rambam and Raavad
(through the Beit Yosef): verbal gratitude, “provided one does not pay”.
Rashi — and Rashi against Rashi

But on 44b, on the same mishnah, Rashi writes something else:

Rabbenu Tam’s kushyot on the “wage” reading The language, first: one would have said
בשכר ושלא בשכר. Next, if paying is forbidden because the idol gains, how would the one who, on 13a, permits
מהנה explain it? Finally, if others share the benefit, what difference does it make,
since the idol gains just as much?
« ולא נהירא לר״ת דלשון בטובה לא משמע הכי ואדרבה בשכר ושלא בשכר מיבעי ליה » (תוספות עבודה זרה מ״ד ע״ב ד״ה נהנין)
Terutz — Rabbenu Tam: it is about the favour one owes, not the money one gives
« פירש רש״י בטובה בשכר ולא נהירא לר״ת דא״כ בשכר ולא בשכר הוה ליה למימר » (רא״ש עבודה זרה פרק ד׳ סימן ב׳)
« ונראה שמותר לטחון ולאפות בתנור וריחים של כומרים שעושין בשכר ואין מחזיקין להן טובה. ועוד נראה דאפילו בשכר מותר כיון שאין התנור וריחים עומדים בחצר עבודת כוכבים » (רא״ש עבודה זרה פרק ד׳ סימן ב׳)
On this reading, grinding at the priest’s mill for payment is permitted: one owes him nothing.
The Rambam and the Raavad — verbal gratitude. The Beit Yosef reports the Raavad, and notes
that the Rambam follows him:
« אבל הראב״ד ז״ל פי׳ בטובה ושלא בטובה טובת דברים וטעמא דאסור בטובת דברי׳ כדי שלא ימשך אחריהם » (בית יוסף יו״ד קמ״ג)
« עֲבוֹדַת כּוֹכָבִים שֶׁהָיָה לָהּ מֶרְחָץ אוֹ גִּנָּה נֶהֱנִים בָּהֶם שֶׁלֹּא בְּטוֹבָה וְאֵין נֶהֱנִים בָּהֶם בְּטוֹבָה. הָיָה לָהּ וְלַאֲחֵרִים נֶהֱנִין בָּהֶן אֲפִלּוּ בְּטוֹבַת כֹּהֲנֶיהָ וּבִלְבַד שֶׁלֹּא יִתֵּן שָׂכָר » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י״ז
Chakirah: why is the Mechaber strict where the Rambam is lenient? The Mechaber forbids “even
if others share in the benefit with the priests”; the Rambam then permits “even with the favour of the
priests”. Two possible explanations. (א) It is a dispute about the versions: the
Mechaber follows Abaye’s second version, the Rambam the first. (ב) It is a consequence of
the reading of בטובה: if it is money, the idol really profits and one is strict; if it is a word, the
prohibition is rabbinic and one is lenient.
The Beit Yosef holds (א), the Shach holds (ב) — and they complement each other
« ופסק הרמב״ם בפ״ז מהלכות ע״ז כלישנא קמא דשרי באיכא אחרים בהדה אפילו בטובת כהנים וכבר נתן הר״ן טעם למה פסק כן והרי״ף והרא״ש כתבו שתי הלשונות ולא הכריעו ומשמע דמסתמא ס״ל דהלכה כלישנא בתרא וכ״פ הר״ן ז״ל וכ״נ שהוא דעת רבינו » (בית יוסף יו״ד קמ״ג)

« והרמב״ם פרק ז׳ דין י״ז לפי שמפרש בטובה בטובת דברים ובלבד שלא יתן שכר פסק לקולא דאם היה לה ולאחרים מותר דכיון דטובת דברים אינה אלא דרבנן אזלינן לקולא » (ש״ך יו״ד קמ״ג ס״ק ה)
The Beit Yosef explains the Mechaber’s choice by the rule of versions — the Rif and the Rosh reported both
without deciding, so the last prevails. The Shach explains why each chose his version: the Mechaber reads
בטובה like the Levush, as a wage; and a real wage is not permitted on a doubtful reading. The Rambam reads
verbal gratitude — a rabbinic prohibition — and goes to leniency.
The Ran, through the Beit Yosef: the fundamental objection, and a “middle” reading. If the
garden’s fruit is for sale and the idol profits from it, how can one permit, when זבינא
דרמי על אפיה is a seller’s profit? The Ran answers that the “favour” is only a slight advantage of
courtesy — and that fundamentally “there is no consecration for an idol”. And he reports another path, which
he judges “the right way according to our Gemara”:
« ואחרים פירשו דהאי טובת כהנים דאמרינן היינו כשהדמים נופלים לכיסן ולא לכיס של אליל כל כהאי גוונא לא מיתסר אלא מפני מראית העין ומשום הכי שרינן בשלה ושל אחרים וזה דרך נכון לפי גמרתנו » (בית יוסף יו״ד קמ״ג)
Nafka mina — the oven and the mill According to Rashi (and the Tur after him): forbidden to
grind and bake there, since one pays. According to Rabbenu Tam: permitted, since one owes no favour. The Taz
rules at the widest — whatever is forbidden with favour is forbidden both by paying and by owing a
favour:
« והרמב״ם כתב דבשכר גרע טפי ונראה דהכי קי״ל וכל שאסור בטובה אסור הן בנתינת שכר הן בהחזקת טובה » (ט״ז יו״ד קמ״ג ס״ק ה)
7. גבול הקולא — how far does the Rama’s door go?
Rabbenu Tam, through Tosafot and the Tur — the idol’s courtyard
« ועוד נראה לר״ת דמה שאנו אופין עתה בתנור של כומרים וטוחנין בריחים של מים שלהם ודאי ליכא למיחש דלא מיבעיא בשכר דשרי דאין אנו מחזיקין להם טובה אלא אפילו שלא בשכר נמי מותר כיון שאין התנור והריחים בבית העבודת כוכבים עצמו כמו הכא מרחץ של אפרודיטי » (תוספות עבודה זרה מ״ד ע״ב ד״ה נהנין)
« ועוד פי׳ ר״ת ואפי׳ לרש״י אם אין הריחים והתנור עומדים בחצר אליל עצמה מותר » (טור יו״ד קמ״ג)
It is this clause that the Rama sets up as a יש אומרים, and on which he concludes “one may rely on this to
be lenient”.
Rabbenu Yitzchak’s kushya, through the Tur Why the courtyard? If the garden is
dedicated to the idol and its fruit pays those who attend to it, distance changes nothing; and
conversely, a garden the priests bought themselves was never forbidden:
« והר״י כתב לאו דוקא בגינה העומדת לפניה כדברי ר״ת אלא אפי׳ רחוק לה כיון שהגינה נתונה לאליל ונותנין פירותיה לשכר המתעסקים בצרכה דהיינו הכומרים אסור ליהנות ממנה בשכר אבל גנות שקנו הכומרים מאיליהן לא מצינו איסור ליהנות מהם » (טור יו״ד קמ״ג)
The Mordechai, in the name of the Ravyah, shifts the criterion — no longer where
the garden is, but whether the profit would have reached the priest without this Jew:
« כתב המרדכי בשם אבי״ה דהא דאין נהנין בטובת הנאה כגון שלא היה בא לכהן שלה זה הריוח אלא ע״י זה אבל מה שאנו נותנים להם שכירות מקרקעות ולקנות פירות גנותיהם מותר שאם לא יקנה ישראל יש עכו״ם רבים שיקנו » (בית יוסף יו״ד קמ״ג)
And it is this limit that the Bach adopts, and that the Shach (ס״ק ז) and the Baer Hetev (ס״ק ח) report:
« והב״ח פסק להחמיר היכא דלא היה מגיע זה הריוח לכומרים אם לא ע״י ישראל זה שנותנו אבל אם לא היה קונה פירות אלו או רוחץ במרחץ היו באים עובדי כוכבים וקונים פירות ורוחצים במרחץ מותר » (ש״ך יו״ד קמ״ג ס״ק ז)
The Rashba, in a responsum: practice decides
« והרשב״א בתשובה סי׳ קס״ג כתב שאלת חק הכהני׳ שנוטלים מעשר הבציר … תשובה בכל כי הני פוק חזי מאי עמא דבר וכבר נהגו הכל להעלות מס כהניה מקרקעות ולוקחין פירות וירקות מהן » (בית יוסף יו״ד קמ״ג)
And Rabbenu Peretz distinguishes the idol’s property from the priests’ property:
« וה״ר פרץ כתב דדוקא גנה ומרחץ שהוא לשם אליל מיתסרא בטובת כהניה אבל דברים של כהנים עצמם שרי לשכור מהם א״נ מיירי כשהשכר לאליל » (בית יוסף יו״ד קמ״ג)
The Maharshal adds the opposite limit (Taz ס״ק ה). “Without favour” assumes that everyone
uses it thus; an exemption granted to an individual is a favour the idol does him:
« וכתב רש״ל דהך שלא בטובה פירושו שכל העולם נהנין ממנה שלא בטובה אבל אם מוחלין ליחיד אסור דאדרבה נהנה מעובד כוכבים שמהנה אותו כדלקמן סימן קמ״ט גבי מכס עכ״ל » (ט״ז יו״ד קמ״ג ס״ק ה)
Nafka mina Buying the fruit of an estate attached to a place of worship, situated outside its
precinct. According to the Rama: permitted. According to the Bach (Shach ס״ק ז): permitted only if other buyers
would exist anyway. According to the Maharshal: never at a personal favour price. Three limits that add up —
and that is how level 4 uses them.

8. מכס ומדינה — the fair, the shops and the city’s coffers
The Yerushalmi, as Tosafot and the Rosh cite it
« וגרס לקמן פרק רבי ישמעאל בירושלמי חלילין של עבודת כוכבים אסור לספוד בהן ואם היו מעלין שכר למדינה אע״ג שהן עושין לצורך עבודת כוכבים מותר לספוד בהן חנויות של עבודת כוכבים אסור לשכור מהם ואם היו מעלין שכר למדינה אע״ג שהן לצורך עבודת כוכבים מותר גנאין » (תוספות עבודה זרה מ״ד ע״ב ד״ה נהנין)

Kushya — the fair of 13a There, giving the tax is forbidden, and whoever buys from the merchant
who pays it is as though he gave it:
« כָּאן — בְּלוֹקֵחַ מִן הַתַּגָּר, דְּשָׁקְלִי מִיכְסָא מִינֵּיהּ » (עבודה זרה י״ג ע״א)
Why, here, do the rent and the tax become permitted as soon as they “fall to the city”?
Terutz — Tosafot and the Rosh: the fair’s tax funds the idol itself

The Tur takes it up, and the Rama engraves it twice in the siman: forbidden “to the needs of the idol
itself”, permitted “into the purse of the townspeople”.
The Taz’s kushya on this terutz Why was a distinction needed? At the fair, the idol gains
a lot — it is given money for nothing; here one buys, and the seller would have sold to a
non-Jew. The difference is obvious without any need to speak of the tax’s destination:
« ולכאורה יש להקשות מאי קשיא ליה ממכס דהתם נהנה הרבה האליל מהישראל שנותן לו מעות בחנם משא״כ כאן כשקונ׳ ממנו דגם לעובד כוכבים היה יכול למכור » (ט״ז יו״ד קמ״ג ס״ק ה)
The Taz’s terutz — the distinction is imposed anyway by seif 5
« יש לומר דבלאו הכי מוכח חילוק זה מההיא דסע״ה חנויות של אליל אסור לשכור ומזה קשה לר״ת אלא ע״כ צריך לחלק דהתם השכר לאליל עצמו ע״כ מתרץ גם גבי מכס כן דתרווייהו הם בירוש׳ » (ט״ז יו״ד קמ״ג ס״ק ה)
The shops of seif 5 are a case of purchase (one rents), and yet it is forbidden: so the argument “he
would have sold to someone else” is not enough, and one must indeed distinguish by the money’s destination —
to the idol, or to the priests and the city. Once this distinction is established for the shops, it holds for
the tax.
The Ran’s צ״ע, and the Tur’s implicit answer. The Ran was puzzled by the Yerushalmi: if it
permits the flutes and the shops “when the rent goes to the city, although they make of it the idol’s needs”,
then even a real profit of the idol would be permitted — and the Beit Yosef concluded that one does not rely
on the Yerushalmi:
« ומ״מ לענין דינא אין לסמוך על הירושלמי דכיון דבגמרא דילן תרי לישני נינהו קי״ל כמאן דמתני לה אסיפא דלישנא בתרא הוא ואפי׳ שלה ושל אחרים בטובת כהניה אסור » (בית יוסף יו״ד קמ״ג)
Yet the Rama rules by the Yerushalmi in seifim 5 and 6. The answer lies in the Tur’s reading: the money
does not reach the idol, it reaches the city, which “takes for itself what it collects” and supplies the idol
from its own purse —
« חנויות של אליל אסור לשכור מהם ואם מעלה שכר למדינה מותר לשכור מהם פי׳ שמעלה השכר למדינה ובני המדינה מספיקים צרכי אליל כיון שאין השכר מיוחד לכו״ם » (טור יו״ד קמ״ג)
On this reading, there is no profit of the idol to permit: the Jew paid the city, and that is all. The Ran’s
צ״ע concerned another reading of the Yerushalmi, in which the idol itself profits.
Nafka mina Rent paid to a public body which then maintains a cult. On the Ran’s reading, the
Yerushalmi would permit even a direct profit of the idol — unacceptable. On the reading of the Tur and the
Rama, it is permitted because the idol’s profit comes from the body, not from the Jew. The practical question
is therefore always the same: to whom was the money handed?
9. לעובדיה — the Levush against the Shach
Who are “its worshippers”?
The Levush reads: the attendants employed in the garden and the
bathhouse. The Shach, the Taz and the Baer Hetev read: the faithful who worship that idol.
« ור״ל העובדי כוכבים העובדים אותה העבודת כוכבים וכן פרש״י והר״ן והוא פשוט ודלא כהעט״ז שפירש למשרתיה שבגנה ומרחץ » (ש״ך יו״ד קמ״ג ס״ק ו)
« פירוש ההמון עם שעובדים אותו האליל » (ט״ז יו״ד קמ״ג ס״ק ו)
The difference is not slight: on the Levush’s reading, the permission “even with favour” would concern
employees of the idol, bringing it close to the priests; on the Shach’s, it concerns the crowd of the faithful
— and that is indeed what Abaye sets against the priests.
10. יסוד הסימן — למי הולך הממון
כלל הסימן :
כשם שאסור ליהנות מן האליל כך אסור לההנותו ; ואין ״מהנה״ נמדד ברצונו של אדם אלא במקום
שאליו מגיע הממון או המעשה. לאליל עצמו — כותלו, כיפתו, נויו, תקרובתו — אסור,

Three lines to take away.(1) The prohibition of מהנה is measured by
destination, not by intention — that is what separates the siman from the Ramban, and what makes its six seifim
questions about the path of money. (2) The wage is permitted because the idol comes into
being at the last stroke, and the wage accrues before; but the Rif, the Tur and the Mechaber kept it quiet, and
the Taz explains why. (3) On בטובה, the version of Abaye one retains depends on the meaning one
gives the word — money or word — and it was the Shach who saw it.
