1. The axiom: מהנה is measured by where the money goes

The starting point:

Siman 142 forbids benefiting from the idol. Siman 143 forbids providing benefit to it — מהנה. The Gemara ties the two together with a kal va-ḥomer, and the Tur opens the siman with that very “just as”.

Hence the axiom, valid for all six seifim: do not ask what you feel, ask where what you give ends up. To the idol itself — its wall, its dome, its adornment, its tax — forbidden. To its priests — forbidden with a favour, with the openings the Rama provides. To its worshippers — permitted, even with a favour. To the town treasury — permitted.

The source of the kal va-ḥomer, and the case in which one can escape neither side:

The Tur makes it the first sentence of the siman:

« כשם שאסור ליהנות מאליל כך אסור לההנותם לפיכך מי שביתו סמוך לאליל ונפל אסור לבנותו שמהנה לה לבנות לה כותל כיצד יעשה כונס לתוך שלו ד׳ אמות ובונה » (טור יו״ד קמ״ג)

And a second route, which the Beit Yosef brings in the name of the Ramban: the prohibition would rest on the mitzvah of destroying the idol, so that even guarding it for free would be forbidden. The siman never follows that route: it never asks what a person wants, but where what he gives ends up.

2. The 3 reflex questions

1. Who receives? The idol itself — its wall, its dome, its adornment, its tax: forbidden. Its priests: go to 2. Its worshippers, or the town treasury: permitted.
2. Is it “with a favour”? Without a favour — everyone enjoys it on the same terms: permitted. With a favour — one pays the priests or owes them something: forbidden according to the Mehaber. But the Rama permits when the property does not stand in the idol’s courtyard, “and one may rely on this to be lenient”.
3. Before or after? Ab initio: one does not build, does not cut windows, does not rent. After the fact: the wage is permitted — for the dome according to all, and for the idol itself according to the Rama, the Shach and the Taz, who add that the permission is not taught in advance.

4. The wall that collapses — ד׳ אמות and מחצה למחצה

The withdrawal is four cubits, and the Shach recalls it because the Mehaber left it out:

« ד׳ אמות כן הוא במשנה וטור ופוסקים » (ש״ך יו״ד קמ״ג ס״ק ב)

And what does one put in the space left free? The Gemara objects that withdrawing “enlarges” the idol, and answers by making the space unusable:

« וְהָא קָא מַרְוַוח לַעֲבוֹדָה זָרָה! אָמַר רַב חֲנִינָא מִסּוּרָא: דְּעָבֵד לֵיהּ בֵּית הַכִּסֵּא » (עבודה זרה מ״ז ע״ב)
« דְּעָבֵד לֵיהּ לְתִינוֹקוֹת. אִי נָמֵי, דְּגָדַיר לֵיהּ בְּהִיזְמֵי וְהִיגֵי » (עבודה זרה מ״ז ע״ב)

There remains the half of the wall. The Bavli, as Rashi reads it, speaks of space: his half counts towards the four cubits, but the stones are all forbidden, since one cannot say which were his.

« אותו חלק של עבודת כוכבים אינו עולה לו בכניסת ד׳ אמות אבל חלקו עולה לו שאם היה עביו שתי אמות מונה האמה שלו וכונס עוד ג׳ אמות לתוך שלו » (רש״י עבודה זרה מ״ז ע״ב ד״ה נידון)

The Yerushalmi, as the Ran reports it, speaks of the stones: he takes half of them, if he can identify them — and the Beit Yosef, who is reluctant to rely on this leniency, notes that the Rambam nonetheless copied it.

« וכתב הר״ן אבל בירושלמי פירשו דמאי דאמרינן נדון מחצה על מחצה היינו לומר שחצי הכותל מותר ונוטל מחצה בעצים ובאבנים ומיהו ה״מ במכיר האבנים שכנגדו אבל כשאינו מכירו הכל אסור דאין ברירה ומיהו מסתברא דמותר למכור לו חלקו בכל מקום שהוא » (בית יוסף יו״ד קמ״ג)

The Rama rules by taking both clauses: the Tur’s — if he cannot identify them, all is forbidden — and the Ran’s — he may sell his share. The Shach and the Ba’er Hetev recall Rashi’s reckoning for the space.

« וחלקו מן העצים והאבנים אם מכירן מותרין ואם לאו הכל אסור ובאותם ד׳ אמות שהרחיק יעשה בהם דברים שלא תהנה מהם האליל ואם אינו רשאי ימלאנה קוצים » (טור יו״ד קמ״ג)
« וחלקו עולה לו שאם היה עביו של כותל ב׳ אמות מונה האמה שלו וכונס עוד ג׳ אמות לתוך שלו. רש״י והר״ן » (ש״ך יו״ד קמ״ג ס״ק ג)

And an underlying question, developed at Level 2: must the house itself be worshipped for rebuilding its wall to be forbidden? The Bach thought so; the Shach and the Ba’er Hetev refute him.

« משמע מדברי הט״ו שאפילו אין הבית עצמו נעבד אסור לבנות כותל להבית כיון שמהנה לאליל » (ש״ך יו״ד קמ״ג ס״ק א)

⚖ What to retain

The wall is not rebuilt; one withdraws four cubits and makes the space unusable. The half that is his counts towards the withdrawal; the stones are forbidden if he cannot identify them. And he may always sell them his share.

5. The dome, the hall and the wage

The mishnah permits building בימוסיאות with them and forbids the dome. Everything turns on the reading of the word — a ב or a ד — and on the category it entails.

« אֲבָל בּוֹנִין עִמָּהֶם בִּימוֹסְיָאוֹת וּבֵית מֶרְחֲצָאוֹת. הִגִּיעַ לְכִיפָּה שֶׁמַּעֲמִידִין בָּהּ עֲבוֹדָה זָרָה — אָסוּר לִבְנוֹת » (עבודה זרה ט״ז ע״א)

Rashi reads בימוסיאות, a platform on which sacrifices are offered: an appurtenance of an appurtenance, therefore permitted. From this the Rambam, copied by the Mehaber, derives the permission of the hall and the courtyard.

« בנין שאינו לצורך עבודת כוכבים … ומאי בימוס בימה של אבן אחת ומקריב זבחים דהוי תשמיש דתשמיש לעבודת כוכבים » (רש״י עבודה זרה ט״ז ע״א ד״ה בימוסיאות)

Rabbenu Yitzhak reads דימוסיאות, bathhouses — and then the mishnah permits nothing that serves the idol, even at a distance.

« לכך נראה לר״י כגירסת הערוך שפירש דימוסיאות בדל״ת והוא לשון מרחצאות » (תוספות עבודה זרה ט״ז ע״א ד״ה בימוסיאות)

The Taz is astonished that the Mehaber and the Rama did not rule stringently, restricts the permission to assistance alone, and concludes for practice:

« כן פסק רש״י ורמב״ם במתניתין דקתני בונה עמהם בימוסיאות דהיינו מידי דהוה תשמיש דתשמיש לעבודת כוכבים והתוספות חולקים וגורסים בגמרא דימוסיאו׳ ופירושו מרחצאות וכ״פ הערוך והטור הביאו במסקנא אבל תשמיש דתשמיש לעבודת כוכבים אסור » (ט״ז יו״ד קמ״ג ס״ק ד)
« ונ״ל עוד דאפי׳ לרש״י ורמב״ם אין היתר אלא דרך מסייע לחוד שהרי איתא במשנה בלשון זה בונה עמהם וכן הרמב״ם שהעתיק המחבר כאן כתב בריש הסעיף אסור לבנות עם העובדי כוכבים כו׳ ועלה קאמר אבל בונה כו׳ כלומר עמהם דוקא ומצינו כמה פעמים דמסייע אין בו ממש אבל לבנות הוא לבדו אסור לכ״ע » (ט״ז יו״ד קמ״ג ס״ק ד)

The Ba’er Hetev records that conclusion:

« כ׳ הט״ז ונראה דאין להתיר אלא דרך מסייע לחוד שיהא בונה עמהם אבל לבנות הוא לבדו אסור לכ״ע וכל זה להלכה אבל למעשה ודאי ראוי להחמיר ולהרחיק מהכיעור ודומה לו לאסור אף במסייע להם » (באר היטב יו״ד קמ״ג ס״ק ה)

And the Taz extends the dome to the windows of the room in which the idol stands, with fear of hostility changing nothing here:

« מכאן אסור לעשות חלונות לבית עבודת כוכבים דהיינו להחדר שהעבודת כוכבים בתוכו » (ט״ז יו״ד קמ״ג ס״ק ב)
« ואין להתיר משום איבה דכבר כתבו התוספות פ״ק דעבודת כוכבים (דף י״ט) לענין תכשיטין של אליל דאיכא לאשתמוטי למימר דאסור לנו למיעבד תכשיטין לאליל » (ט״ז יו״ד קמ״ג ס״ק ב)

There remains the wage. The idol comes into being only at the last hammer-blow, which is not worth a perutah, and the wage is acquired throughout:

« אֶלָּא אָמַר רַבָּה בַּר עוּלָּא: לֹא נִצְרְכָה אֶלָּא בְּמַכּוֹשׁ אַחֲרוֹן. עֲבוֹדָה זָרָה מַאן קָא גָרֵים לַהּ? גְּמַר מְלָאכָה, וְאֵימַת הָוְיָא גְּמַר מְלָאכָה? בְּמַכּוֹשׁ אַחֲרוֹן. מַכּוֹשׁ אַחֲרוֹן לֵית בֵּיהּ שָׁוֶה פְּרוּטָה. אַלְמָא קָסָבַר, יֶשְׁנָהּ לִשְׂכִירוּת מִתְּחִלָּה וְעַד סוֹף » (עבודה זרה י״ט ע״ב)

The Rambam states it as law; the Rif, the Tur and the Mehaber write it only for the dome, and it is the Rama who restores the Gemara in the name of the Kol Bo. The Shach vindicates both, then rules like the Rama; the Taz explains the silence of the earlier authorities; the Pitḥei Teshuva refers to the question that remains open.

⚖ What to retain

Ab initio: the dome, never; windows for the idol’s room, never; the hall and the courtyard are permitted by the Mehaber but the Taz advises keeping away, and building alone is forbidden according to all. After the fact: the wage is permitted — for the dome according to all, and for the idol itself according to the Rama, the Shach and the Taz.

6. בטובה — the three readings and the Rama’s opening

The word בטובה governs the whole of seif 3, and it is read in three ways.

The Shach explains why each chose his version: the Mehaber reads a wage, and one does not permit an actual payment on a doubtful reading; the Rambam reads words, a rabbinic prohibition, and goes to leniency.

« משמע דהיינו כהמפרשי׳ השכר וכ״כ עט״ז ולכך פסק לחומרא דאפי׳ יש לאחרים חלק בטובה עם הכהנים אסור » (ש״ך יו״ד קמ״ג ס״ק ה)
« והרמב״ם פרק ז׳ דין י״ז לפי שמפרש בטובה בטובת דברים ובלבד שלא יתן שכר פסק לקולא דאם היה לה ולאחרים מותר דכיון דטובת דברים אינה אלא דרבנן אזלינן לקולא » (ש״ך יו״ד קמ״ג ס״ק ה)

And the Taz broadens the prohibition instead of choosing: whatever is forbidden with a favour is forbidden both by paying and by owing a favour.

« והרמב״ם כתב דבשכר גרע טפי ונראה דהכי קי״ל וכל שאסור בטובה אסור הן בנתינת שכר הן בהחזקת טובה » (ט״ז יו״ד קמ״ג ס״ק ה)

Then comes the Rama’s opening, drawn from Rabbenu Tam through the Tur: outside the idol’s courtyard it is permitted.

« ועוד פי׳ ר״ת ואפי׳ לרש״י אם אין הריחים והתנור עומדים בחצר אליל עצמה מותר » (טור יו״ד קמ״ג)
« וי״א שאין אסור ליהנות ממנה אם הטובה באה לכהני׳ אלא כשהם עומדים בחצר עבודת כוכבים עצמה אבל כשאין עומדין לפניה אע״פ שהטובה היוצאת מהם היא לכהנים מותר ליהנות ממנה אם לא שהטובה לעבודת כוכבים עצמה ויש לסמוך על זה להקל » (שו״ע יו״ד קמ״ג:ג)

Three limits tighten it. Rabbenu Yitzhak: distance is not the criterion, the destination of the income is. The Mordechai in the name of the Ravyah, then the Bach: only if other buyers would have come anyway. The Maharshal: never a personal preferential price.

« והר״י כתב לאו דוקא בגינה העומדת לפניה כדברי ר״ת אלא אפי׳ רחוק לה כיון שהגינה נתונה לאליל ונותנין פירותיה לשכר המתעסקים בצרכה דהיינו הכומרים אסור ליהנות ממנה בשכר אבל גנות שקנו הכומרים מאיליהן לא מצינו איסור ליהנות מהם » (טור יו״ד קמ״ג)
« כתב המרדכי בשם אבי״ה דהא דאין נהנין בטובת הנאה כגון שלא היה בא לכהן שלה זה הריוח אלא ע״י זה אבל מה שאנו נותנים להם שכירות מקרקעות ולקנות פירות גנותיהם מותר שאם לא יקנה ישראל יש עכו״ם רבים שיקנו » (בית יוסף יו״ד קמ״ג)
« והב״ח פסק להחמיר היכא דלא היה מגיע זה הריוח לכומרים אם לא ע״י ישראל זה שנותנו אבל אם לא היה קונה פירות אלו או רוחץ במרחץ היו באים עובדי כוכבים וקונים פירות ורוחצים במרחץ מותר » (ש״ך יו״ד קמ״ג ס״ק ז)
« וכתב רש״ל דהך שלא בטובה פירושו שכל העולם נהנין ממנה שלא בטובה אבל אם מוחלין ליחיד אסור דאדרבה נהנה מעובד כוכבים שמהנה אותו כדלקמן סימן קמ״ט גבי מכס עכ״ל » (ט״ז יו״ד קמ״ג ס״ק ה)

Finally לעובדיה: the Shach and the Taz read “the mass of the faithful who worship it”, against the Levush who read “the servants of the garden and the bathhouse”.

« ור״ל העובדי כוכבים העובדים אותה העבודת כוכבים וכן פרש״י והר״ן והוא פשוט ודלא כהעט״ז שפירש למשרתיה שבגנה ומרחץ » (ש״ך יו״ד קמ״ג ס״ק ו)

⚖ What to retain

To the priests: forbidden with a favour according to the Mehaber; permitted outside the idol’s courtyard according to the Rama, on whom one may rely, unless the favour goes to the idol itself. To the worshippers: permitted, even with a favour. And the Bach tightens it: only if the profit would have reached the priests without this Jew.

7. The town treasury — flutes, shops and tax

The last three seifim come from a single Yerushalmi, which the Beit Yosef locates:

« חלילין של אליל אסור לספוד בהן חנויות של אליל אסור לשכור מהם וכו׳ ירושלמי ותוספתא בפרק רבי ישמעאל » (בית יוסף יו״ד קמ״ג)

And the Tur gives the reading that permits: the money does not reach the idol, it reaches the town, and the town then provides from its own purse.

« חנויות של אליל אסור לשכור מהם ואם מעלה שכר למדינה מותר לשכור מהם פי׳ שמעלה השכר למדינה ובני המדינה מספיקים צרכי אליל כיון שאין השכר מיוחד לכו״ם » (טור יו״ד קמ״ג)
« וגבאין של אליל אסור ליתן להם ואם היו מעלין שכר למדינה אע״פ שגובין לאליל מותר ליתן להם פירוש שבני המדינה לוקחין לעצמן מה שגובין ומספיקין צרכי האליל מותר כיון שאם ירצו יקחו לעצמן כל מה שגבו ומה שנותנין לאליל כאילו נתנו מכיסן » (טור יו״ד קמ״ג)

A difficulty remains, and the Taz raises it: at the fair of עבודה זרה י״ג ע״א the tax is forbidden, and one who buys from the merchant on whom it is levied is as though he gave it.

« כָּאן — בְּלוֹקֵחַ מִן הַתַּגָּר, דְּשָׁקְלִי מִיכְסָא מִינֵּיהּ » (עבודה זרה י״ג ע״א)

Tosafot and the Rosh distinguish: there the tax funds the idol itself, here it only benefits the priests.

« ולא דמי ליריד של עובדי כוכבים דאסרנא לעיל פ״ק (עבודה זרה דף יג.) אליבא דרבי יוחנן דאמר נהנה אסור מהנה לא כ״ש דהתם עושין מן המכס צרכי עבודת כוכבים אבל הכא אין עושין אלא הנאת הכומרים » (תוספות עבודה זרה מ״ד ע״ב ד״ה נהנין)
« דהתם מיירי שהמכס הוא לצורך עבודת כוכבים ונויה ותקרובתה. אבל האידנא אינו אלא חוק הכומרים והנאתן ואין עושין מהן צרכי עבודת כוכבים » (רא״ש עבודה זרה פרק ד׳ סימן ב׳)

The Taz objects that the distinction looked unnecessary — at the fair one gives for nothing, here one buys — and then shows that it is forced upon us anyway, by the shops of seif 5:

« ולכאורה יש להקשות מאי קשיא ליה ממכס דהתם נהנה הרבה האליל מהישראל שנותן לו מעות בחנם משא״כ כאן כשקונ׳ ממנו דגם לעובד כוכבים היה יכול למכור » (ט״ז יו״ד קמ״ג ס״ק ה)
« יש לומר דבלאו הכי מוכח חילוק זה מההיא דסע״ה חנויות של אליל אסור לשכור ומזה קשה לר״ת אלא ע״כ צריך לחלק דהתם השכר לאליל עצמו ע״כ מתרץ גם גבי מכס כן דתרווייהו הם בירוש׳ » (ט״ז יו״ד קמ״ג ס״ק ה)

⚖ What to retain

The question is never “does this rent serve a cult?” but “to whom did I hand it?”. Handed to the idol or to its needs: forbidden. Handed to a common treasury which then provides as it pleases: permitted — this is the Rama, twice, in seifim 5 and 6.

8. The 5 golden rules

  1. Providing is forbidden just as benefiting is. That is Rabbi Yoḥanan’s kal va-ḥomer and the Tur’s first sentence; the six seifim are only its particulars.
  2. The destination decides the law. To the idol: forbidden. To the priests: forbidden with a favour. To the worshippers: permitted. To the town: permitted.
  3. One withdraws, one does not rebuild. ד׳ אמות, the space made unusable, the permitted half and the stones forbidden for want of identifying them.
  4. Ab initio and after the fact are not the same. One does not build the dome; but if one has built, the wage is permitted — and the Taz explains why the earlier authorities did not disclose it.
  5. The Rama opens, three Aḥaronim tighten. Outside the courtyard: permitted (Rama); only if others would buy anyway (Bach); never at a personal preferential price (Maharshal); and never when the favour goes to the idol itself.

9. Mnemonic — the aid « מהנה »

מ מָקוֹם — the destination — where does the money go? the whole siman is in that question.
ה הַכִּיפָּה — the dome — one does not build it; but if one has built, the wage is permitted.
נ נֶהֱנִין שֶׁלֹּא בְּטוֹבָה — the garden and the bathhouse — without a favour: permitted; with the priests’ favour: forbidden, except outside the courtyard (Rama).
ה הַמְּדִינָה — the town — flutes, shops, tax: what falls into the common treasury is permitted.

10. The 4 classic pitfalls and the closing flash card

  1. Thinking the prohibition turns on intention. It does not: the siman never asks what one wants, but where what one gives ends up. The Ramban’s route — “he wants it to endure” — is reported by the Beit Yosef and not adopted here.
  2. Confusing half the wall with half the stones. The half that is his counts towards the four cubits (Rashi, Shach ס״ק ג); the stones are forbidden if he cannot identify them (Rama, from the Tur).
  3. Reading “his wage is permitted” as a permission to build. It is an after-the-fact ruling, and the Taz says the Rif, the Tur and the Mehaber suppressed it deliberately.
  4. Reading the Rama’s opening without its limits. It does not apply when the favour goes to the idol itself; and the Bach and the Maharshal tighten it further.
