Halakha lema'asse — the practical ruling

How to read this level. Every statement is anchored either in the text of the Shulchan Arukh and its nosei kelim, or in a named and checkable posek (Tur, Beit Yosef, Rambam). On Yoreh De'ah there is no Mishna Berura — it comments only on Orach Chaim — and no Shulchan Arukh HaRav: the Admur HaZaken did not write Yoreh De'ah, so his name will not appear here. The Arukh HaShulchan is not cited: his text on this siman is not accessible to us, and one does not quote what one cannot verify. What remains is enough: the Shakh (24 ס״ק), the Taz (8 ס״ק), the Ba’er Hetev (19 ס״ק), the Pitchei Teshuva (3 ס״ק) and the Nekudot HaKesef — a single entry, answering the Taz on public waters. Where the question runs beyond the siman, this level says so and stops: halakha lema'asse goes through your Rav.

1. שורש הפסק — the hand, not the worship

The practical question is never “was this object worshipped?”. It is: did the hand of man make it for worship, or act upon it for worship? If the answer is no to both, the object stays permitted in benefit, whatever the worship was — and that is the first line of the siman. If the answer is yes, one must still know what the hand did: everything, an addition, or a mere gesture.
The Mehaber’s rule comes word for word from the Rambam; the Taz supplies the verse, and the Rambam also draws from it the exception of the plating.

What this changes for you. Faced with an object used in worship, do not first ask what was done with it but what it is: the work of a hand, or a thing of the world. A rock, a spring, a self-grown tree, an animal do not become idols because people bowed before them. But whatever man fixed, added or did to them for worship follows another regime, and this is where the siman becomes exact.

2. פסק המחבר — the map of the nine seifim

Siman 145 has nine seifim — the count announced in the heading (ובו ט׳ סעיפים) and the actual count of the text. The Rama glosses it four times — at seifim 2, 3, 4 and 8; the one at seif 3 has two parts.

The loosened stones: the Mehaber permits, four Rishonim forbid

The gemara leaves the question between two amoraim without saying which one permits. The Rambam, the Tur and the Mehaber permit; the Ran, the Ramah, Rabbenu Yeruḥam and the Raavad forbid, since a Torah doubt is decided stringently.

The Shakh’s decision The Bavli does not know which of the two permits; the Yerushalmi says it expressly, and Rabbi Yoḥanan — named there as the one who forbids — is its author: he could not err about his own position. The doubt falls, and the halakha follows Ḥizkiya who permits. In passing the Shakh sets aside the answers of the Baḥ and the Kesef Mishneh.

What does “loosened” mean? The Kesef Mishneh: not entirely torn away, since no hand lifted them. The Taz: entirely torn away, provided it was not by a human hand — like water a wave detaches. The Ba’er Hetev takes the Taz.

The water: what “public” means

The Mehaber writes “the rivers and the public springs”. The Shakh, with the Levush, teaches that the word restricts nothing for ordinary use: the reason is that the water is attached to the ground, and a private spring is just as attached. The distinction between public and private water bears only on the libations of the altar. But detached water is forbidden, even public.

The Taz’s question The chapter רבי ישמעאל asks why the water of an individual should be forbidden, since it is attached, and answers: he drew it with his hand. So attached water of an individual is not forbidden either — and the poskim who write “public” are difficult. The Taz answers that the word bears on libations, where public water is not forbidden even for the altar.

The Nekudot HaKesef’s answer There is no difficulty: “public” is not restrictive, or else teaches that even public water is permitted only in a spring, attached. And what the Taz seemed to imply — that detached public water would be permitted — no posek wrote: the halakha follows Reish Lakish, for whom detached water is forbidden even when public. Finally the Nekudot HaKesef offer a second path, tying the rule to seif 8: no one forbids what is not his.

Lema'asse. What nature made and man never touched does not become forbidden by the worship offered to it. The practical line of the siman is the Mehaber’s, held by the Shakh. But as soon as the hand takes — a stone lifted, water drawn — one leaves seif 1: the case goes to a Rav.

4. ציפוי, משמשים ותקרובת — what becomes forbidden around what stays permitted

Three things stand around a permitted mountain, and they do not share one regime. The plating — the gold and silver fixed to it — is forbidden by the verse, even unworshipped. The accessories are, says the Rama, like the plating. The offering is not forbidden — because the verse forbidding an offering was said of Peor, which was detached from the ground.

“Not forbidden” — in what respect? The Shakh, with the Levush, specifies that the mountain’s offering is not forbidden in benefit — but in eating it certainly is. And he adds that at siman 4, where one intends to worship, the offering is forbidden even in benefit; he notes that the wording of Rabbenu Yeruḥam and the Rama here does not suggest so.

Lema'asse. A rock or spring that stays permitted does not permit what was fixed to it. Applied metal, plaques, objects fastened to the place and serving the worship are forbidden in benefit, and the Rambam writes that one is liable for the least amount. What was laid down as an offering before a mountain is not forbidden in benefit per the Rama — but remains forbidden in eating per the Shakh, who refers to siman 4 where the intent to worship was present. Do not rely on this distinction without a Rav.

5. בית ואבן — making, renewing, or merely placing

Why the house, unlike the tree? Because its stones and beams were detached before being joined to the ground, and “detached then reattached” counts as detached. And why must the house itself be worshipped? Because had it only housed the idol it would be a mere accessory, and an accessory is forbidden only once used.

Who built it — and the question of the apostate

The seif speaks of a house built by a non-Jew: built by a Jew, it is forbidden only once worshipped (siman 139). But if a non-Jew built it for worship and sold it to a Jew, it becomes a Jew’s idol and can no longer be nullified. There remains the apostate: the Hagahat Derisha treats him as a non-Jew, and the Nekudot HaKesef — cited by the Ba’er Hetev at siman 139 — agree; the Taz opposes this sharply. The dispute stays open.

What is removed, and who removes it

The seif says נוטל מה שחידש without saying whom it means. The Ran proves it from nullification: were it a non-Jew, the least would suffice — as with the ashera from which one takes a stick. So it is the Jew, who must remove everything since nothing is nullified in his hands.

Taking the idol out: for a moment, or for good

If the house was not designated for the idol, removal suffices: even by a Jew, even if he means to bring it back. If it was, the Rama requires a removal amounting to nullification — and the Beit Yosef, followed by the Shakh and the Ba’er Hetev, adds that a non-Jew must be the one to remove it. And if the house is a Jew’s idol-accessory, no nullification ever works.

Lema'asse. A building or a stone that served worship is judged by three questions, not one: what were they made for, what was added to them, and whose were they. A house built to be worshipped by non-Jews and bought as such by a Jew can no longer be nullified (Shakh ס״ק ח). The case of the apostate is not settled between the Taz and the Derisha, and it is not settled here: bring it to your Rav.

6. אילן ואשרה — the planted tree, the pruned tree, the sheltering tree

Three trees, three regimes. Planted to be worshipped: this is the ashera, forbidden from the planting, even without prostration — provided a non-Jew planted it; planted by a Jew, the tree is forbidden only once worshipped. Pruned or grafted for worship: only the new shoots are forbidden. Bearing the idol beneath its branches: permitted once it is removed — and the Shakh, in the Ran’s name, specifies that the seif speaks only of a tree planted expressly for that; otherwise it need not even be removed, the tree being attached to the ground.

Lema'asse. A tree before which people bow is not an ashera; the ashera is the tree planted for that. So before a tree honoured with worship the practical question is: since when, and who planted it. And fruit picked after the worship is not fruit picked before. Such distinctions are rarely posed alone: they are posed with a Rav.

7. קרקע ובעלי חיים — when the hand has acted

Dug ground: is prostration still required?

The Tur writes expressly והשתחוה לו אח״כ: the digging alone does not suffice. The Beit Yosef reads the opposite in the Rambam — dug for worship, the ground is forbidden at once. The Shakh reports the divergence and refers to the Perisha and the Baḥ without deciding; the Ba’er Hetev follows. The Mehaber writes like the Rambam: he does not mention prostration.

The animal: what forbids it, and who can forbid it

Two rules cross. An act, however small, forbids: one organ, and even half an organ per the Shakh, in the name of the gemara, Rashi and the Tosafot. But no one forbids what is not his: another’s animal does not become forbidden by a Jew’s hand — not even by a complete slaughter, says the Shakh with Rashi, the Ran and the Rosh, against Rabbenu Tam. Three exceptions: the non-Jew, the apostate, and one who was warned and accepted the warning.

The Pitchei Teshuva’s reservation The Pitchei Teshuva notes that the Shakh and the Levush, at siman 2, do not accept that one organ suffices: in their view slaughtering for an idol forbids only from a little of the oesophagus or the majority of the windpipe. The Nekudot HaKesef refuted them there and accepted the Baḥ’s answer — siman 2 does not speak of a heretic attached to the worship (מין האדוק). The Bekhor Shor offers another reconciliation: the smallest act forbids only where one said he was acting for worship; for a silent intention, a full slaughter is required.

Lema'asse. Meat slaughtered during an idolatrous festival: the question is not only whether the animal was “offered”, but who held the knife, whose the animal was, and what was said. The Pitchei Teshuva shows that the measure of the act is not closed between the Shakh, the Baḥ and the Bekhor Shor. This is a case for a Rav, not for a reading.

8. חליפין וחליפי חליפין — what one receives in exchange for an idol

The animal not forbidden by prostration is forbidden by exchange: given for an idol, it takes its place. The Shakh specifies the case — a Jew had idols and bartered them to non-Jews for animals — and refers to simanim 132 and 144, where the same subject is seen from the side of the price.

The exchange of the exchange: the Tur permits, the Rambam and the Ran forbid

Two tannaim divide, and two verses. The Beit Yosef gives the Tur two reasons to permit: the prohibition is only rabbinic and its doubt is resolved leniently; and because two verses teaching the same thing do not teach, which is our rule. The Shakh adds that on this view all exchanges of exchanges of an idol are permitted — the animal is mentioned only for continuity with the opening of the seif. The Mehaber writes the permission first, then ויש אוסרים גם בזה: he does not shut the door.

Lema'asse. What one receives directly for an idol is forbidden, without dispute. What one then receives for that is the subject of a dispute the Mehaber leaves open, reporting the forbidding view after the permitting one. One therefore does not conclude a practical permission from here: the case goes to a Rav, together with simanim 132 and 144 to which the Shakh refers.

9. מקרים בני זמננו — contemporary cases

A place of non-Jewish devotion around a rock or a spring. The rock and the water, as long as they are attached to the ground, stay permitted in benefit: this is the first line of seif 1, and the Shakh explains that “public” adds no condition. But plaques and gilding fixed upon them are forbidden (seif 2), and so are objects fastened to the place that serve the worship, the Rama treating them as plating.

👈 Case 2 — Water drawn from a venerated spring

Water drawn from a spring where worship is offered, put into a vessel, and worshipped there. Once detached it no longer enjoys the protection of attachment: it is forbidden even if it came from public water — the position of the Shakh, the Levush and the Nekudot HaKesef, who expressly reject the opposite reading one might draw from the Taz.

👈 Case 3 — A place of worship bought up

A building raised by non-Jews so that the building itself be the object of worship is forbidden in benefit from its construction; sold as such to a Jew without prior nullification, it becomes a Jew’s idol and can no longer be nullified (Shakh ס״ק ח, Beit Yosef). If, however, it only sheltered statues, it is an accessory, and the regime is that of the end of seif 3: everything depends on designation. Which of the two one is facing is not a question of reading.

👈 Case 4 — Decorations added to an ordinary building

A dwelling plastered, painted or carved for worship. Only the addition is forbidden: נוטל מה שחידש, and the rest of the building is permitted. A Jew must remove the whole of what was added, since nothing is nullified in his hands; a non-Jew nullifies by marring only part of it (Shakh ס״ק י״א and ס״ק י״ז, Taz ס״ק ח, Ba’er Hetev ס״ק ח and ס״ק י״ג).

👈 Case 5 — The garden tree under which a statue was placed

A cult statue was set under a tree. While it stands there the tree is forbidden; removed, it returns to permission, for it is not the tree that is worshipped (seif 6). And the Shakh, in the Ran’s name, adds that the seif speaks only of a tree planted expressly to bear it; if it was not, it did not even need to be freed, being attached to the ground.

👈 Case 6 — An animal slaughtered at an idolatrous festival

A non-Jew who slaughters for the idol forbids the animal by a minimal act — one organ, and even half of one, per the Shakh — and he forbids even an animal that is not his. A Jew does not: neither by a minor act nor by a full slaughter — unless he is an apostate, or was warned and accepted the warning. The Pitchei Teshuva reports that the measure of the act is still debated.

👈 Case 7 — What one receives in exchange

A cult object given in exchange for something else: what one receives is forbidden, like the idol itself. What one would then obtain for that item is the exchange of the exchange: permitted per the Tur, forbidden per the Rambam and the Ran, and the Mehaber closes the siman with ויש אוסרים גם בזה. The Shakh refers to simanim 132 and 144.

The point this level will not decide. This siman begins after a thing has been recognised as an object of worship, and it does not say what is one. Whether a museum statue, a decorative image, a disused building fall under idolatry is the matter of simanim 139 and 141, and of your Rav. This level says what siman 145 does with a worshipped thing; it does not say what is worshipped.

Verifiable sources

The rule of the psak, in one line. לא העבודה אוסרת אלא היד — it is not the worship that forbids, it is the hand. Where it made, all is forbidden; where it added, the addition alone; where it only acted, the object itself, and only if it is his.

And finally, the one rule that holds lema'asse. This level sets out the ruling of the sources; it does not replace a decision. A thing, a hand, an owner and a moment make a concrete case, and a concrete case is decided with a Rav — who will begin with the question this siman assumes settled: is this object an idol?
