1. שורש הסימן — what is ביטול: an act upon the object, or a declaration?

The Mehaber opens by saying who nullifies, not how. The how comes only at seif 6 and seif 7 — and the distance between them is the question of the entire siman.

The hakirah of the siman: what nullification effects

(א) A material act upon the object: the worshipped figure is damaged, hence it is no longer the figure that was worshipped — and the damage is what permits. (ב) A declaration of renunciation: the owner withdraws the divine title he had conferred, and the act is only the outward proof of that withdrawal.

Four seifim decide, and all point to (ב). Seif 10: worshippers who depart in peacetime nullify, having touched nothing. Seif 9: a landslide that crushes the statue does not nullify, though the material damage is total. Seif 11: a figure broken of itself is not nullified, for the same reason. And the Rama’s gloss at seif 7 goes the whole way — nullification by speech. What counts, therefore, is not the state of the object but the believer’s will; the act required in seif 7 is required only because it is the one reliable proof of that will, and it becomes indispensable again as soon as the speech is suspect — under duress.

Seif 2 lays down two conditions. The Beit Yosef notes that not all manuscripts have the second — and the whole dispute of the Acharonim is already contained there.

The Taz: the doublet is a cumulative requirement

The Taz adds the concrete case: one who bought and paid without the object reaching him — money acquires with a non-Jew, says the Tur at siman 132 — has not yet shut the door.

Three situations separate them. An object bought and paid for, still at the seller’s. For the Taz still nullifiable; for the Bach not. An object found before the owner despaired of recovering it — the finder has not acquired it. The Bach bars nullification, the Taz does not. A stolen object. The same split. And a fourth separates them further: accessories acquired by the Jew. Seif 2 permits them; the Bach forbids them once there has been acquisition. This is the only one of the four where the Bach contradicts the Mehaber’s own words head-on, and the Ba’er Hetev points it out.

3. גרוטאות — the Taz’s long analysis of the Tur

Seif 3 copies a beraita, but the Tur adds a clause — “they have already been acquired by him” — which contradicts the Talmud’s conclusion. The Taz devotes the siman’s longest ס״ק to that contradiction.

The Taz’s difficulty with the Tur
« ותימה הא מסקינן בגמרא דבכל גווני אין כאן קנין מכח מקח טעות רק שהחילוק מחמת [דמיחזי] שנקנה או לא » (ט״ז יו״ד קמ״ו ס״ק ד)

If the sale is void in all three cases, the buyer never acquired anything — and the Tur’s words, “they have already been acquired by him,” lose their sense.

Two answers the Taz rejects — the Bach, and the Perishah

The Taz’s answer — the measure of appearance is not what was acquired, but what would have been

What the Taz found is a scale: the concern for appearances is measured not by the acquisition that occurred — void in every case — but by the one that would have occurred had the buyer known. And one who merely pulled would have acquired nothing even knowingly, since nobody wishes to acquire a forbidden thing; one who paid and pulled, yes.

For the Taz the order of the acts is immaterial — pay then pull, or pull then pay — and the Shach says so explicitly at ס״ק ד. What matters is that both are present. For the Perishah, on the contrary, the Tur required both because he is unsure how a non-Jew acquires; one would then have to distinguish by era and place, and the Taz shows that this reading would make the Tur lenient where he is elsewhere stringent.

4. ירושת הגר — why the Sages were lenient, and how far

The convert who leaves the idols to his non-Jewish brother “wants them to endure”: he is waiting to receive their value. The Talmud asks this and answers with a reason that holds for him alone.

The son of an apostate who inherits together with a brother who remained an apostate: here the law of inheritance is biblical, the leniency lapses, and he may not say “take the idols and I the money.” A Jew partnered with a non-Jew in a trade that handles cult objects: he left nothing behind, there is no fear of his “returning to his corruption,” and the same leniency is denied him. The Beit Yosef adds, from the beraita, that in the partnership case the object has no remedy even by nullification.

5. מי בר ביטול — knowledge, duress, and the Ishmaelite

Seif 5 lists four extensions and four exclusions. Each turns on the same thing: nullification is the act of a believer who ceases to believe.

Difficulty — does duress really nullify?

If nullification is a declaration of renunciation, a man under compulsion renounces nothing. And the Rama, at seif 7, says precisely that under duress speech does not suffice. How can seif 5 admit nullification “even against his will”?

Answer — the two texts complete one another exactly

Seif 5 speaks of an act extracted by force, seif 7 of speech extracted by it. The material act stands whatever its author thinks: the figure is mutilated, and an idolater will not restore to godhood what he himself has damaged. Speech is worth only the sincerity credited to it, and duress removes that. The Rama says exactly this — under duress, an act upon the body is required.

The Tiferet LeMoshe’s reasoning is an inverted a fortiori: if the incapacity of the ger toshav and the Ishmaelite rested on the mere absence of worship, an apostate Jew — who does worship — would qualify. Yet seif 1 says “but a Jew,” without qualification. Two distinct disqualifications are therefore layered here: one from the absence of worship, the other from birth.

6. ביטול באמירה בעלמא — the Beit Yosef, the Darkhei Moshe, the Bach and the Shach

The Rama reports, in the name of the Mordechai and the Raavyah, that speech alone nullifies. The Beit Yosef is astonished the moment he meets the source — and his question travels through all the Acharonim.

To sell one’s idol is not merely to speak ill of it: it is to part with it for good, and for money. If that does not nullify — and seif 8 says it does not — how could mere speech?

First answer — the Darkhei Moshe, cited by the Taz

A sale says nothing about the seller’s belief: one sells even what one venerates, to someone who will venerate it. A word of nullification can mean only one thing.

The Bach answers by duress: the seller was forced — by the money. The sale is therefore a case of nullification under compulsion, which the Rama himself excludes at the end of his gloss.

What the Shach himself means by “mere speech”

That is a considerable restriction, and it is easy to miss. The Shach is not speaking of a man who says “I nullify it,” but of a man who declares his intention to perform the act — to cut off its ear or nose. The speech then counts as the promise of an act, not as a speech-act.

A non-Jewish owner asked, in writing or in person, to renounce the object. On the Darkhei Moshe’s view his clear declaration nullifies. On the Shach’s reading it nullifies only if it announces an act he agrees to perform. And on both views a declaration obtained under pressure is worthless — he must then lay his own hand on the object.

7. מכרה או משכנה — the Ran and the Taz against the Beit Yosef and the Shach

The argument is subtle: if the beraita needs to teach “he borrowed on it” separately, it is because its case might have been inferred from another — namely that selling does nullify. The Talmud’s own give-and-take therefore presupposes the position the Rambam adopts.

Second level: what is a pledge? The Ran against the Beit Yosef

הרהון is a pledge with a clause: “if I do not bring you the money by such a day, it is yours.” The Ran sees in it a sale on terms; the Beit Yosef sees a pledge, and nothing more.

The Taz’s difficulty with the Beit Yosef

Rebbi in the mishnah said “sold or pledged”; when the Talmud teaches that the Sages concede to him in the case of a Jewish goldsmith, they concede both his words — not only the first. The Beit Yosef creates a new dispute that nobody stated.

The Taz thereby reconciles mishnah and beraita: the mishnah speaks of a pledge with a forfeiture clause — hence a sale — while the beraita speaks of a plain loan on pledge. And he adds that the Beit Yosef himself, in the Kesef Mishneh, agreed with the Ran.

The distinction is sharp: a figure whose bulk survives and which has lost only a chip is not nullified, because its owner will go on worshipping it as it is; a figure broken entirely, which no layman can put back together, is nullified, because on seeing it so he gave it up.

The Bach against the Shach: do the Rif and the Rosh disagree?

The Shach, briefly, limits both obligations to the Land of Israel in the name of his teacher and the Perishah. The Taz finds this “astonishing”: the limitation, he says, can apply only to the duty to root out, and if it is written on “renaming,” it is a copyist’s error. The Nekudot HaKesef answer that there is no error, and the proof is in the Talmud: both duties come from the same verse, and the limiting phrase — מן המקום ההוא — governs them both alike.

Outside the Land of Israel, is a Jew bound to designate a place or object of worship by a name of contempt? For the Shach and the Nekudot HaKesef, no — the obligation is territorial. For the Taz, yes: only the active search is territorial, not the manner of naming. The duty to destroy what comes to hand is not at issue: seif 14 lays it down without restriction, and the Rambam writes it explicitly for every place.

10. יסוד הסימן — nullification lies not in the act but in what the act reveals

A single line runs through the fifteen seifim, and it explains the extensions as well as the refusals.

The foundation

Nothing that happens to the object nullifies: not the landslide of seif 9, not theft, not the breakage of seif 11, not the chipping of the altar in seif 12. And nothing the owner merely feels nullifies either: not spittle, not urine, not dragging, in seif 7. What nullifies is the single point where the two meet — an act the believer performs upon the object which can mean only one thing. Everything else follows. A believer is needed, hence not a minor nor an Ishmaelite (seif 5). It must be he, hence not a Jew, who never conferred anything (seif 1). It must still be possible, hence not after a Jew has acquired the object (seif 2). And the act must be unambiguous, hence not a sale (seif 8) nor a forced abandonment (seif 10). Where the meaning is certain without any act — the Rama’s speech at seif 7, the peacetime departure at seif 10 — nullification operates without one.

The practical consequence

Facing an object one wonders whether it was nullified, the question to ask is never “what damage did it sustain?” but “who did what, and could it mean only one thing?” That is why a statue found broken remains forbidden while a temple abandoned in peacetime is permitted, and it is the one thread that makes all fifteen seifim cohere.
