A siman of five lines, and four discussions inside it: what is the nature of the prohibition of mention; what the Tur’s word אפילו teaches, according to the Taz; how far the responsibility of one who makes another swear extends; and whether one may wish a non-Jew that his god help him.

1. שורש האיסור — mention: a prohibition in its own right, or a fence around the oath?

Seif 1 says two things in one breath: one who swears is liable to lashes, and it is forbidden to mention. Is this one sentence or two? Everything that follows in the siman depends on it.

The verse, split in two by the braita Sanhedrin reads the first half of the verse as a prohibition of speech, and the second as a prohibition of undertaking:
« שֶׁלֹּא יֹאמַר אָדָם לַחֲבֵירוֹ ״שְׁמוֹר לִי בְּצַד עֲבוֹדָה זָרָה פְּלוֹנִית״ » (סנהדרין ס״ג ע״ב)

The ḥakira (א) Mention is a prohibition of its own, derived from לא תזכירו: the speech itself is at fault, and one does not ask whether it leads to an oath. (ב) Mention is only a fence around the oath: what is at stake is always the undertaking, and speech is forbidden only because it comes near it.
Nafka mina Three consequences, and the Rambam decides all three in the direction of (א). The penalty: if mention were a fence, it would carry no punishment — and indeed the Rambam writes that only the vow and the oath incur lashes. Purpose: if it were a fence, one would relax it where there is a real need; the Meḥaber writes on the contrary בין לצורך בין שלא לצורך. Seif 4: the permission of the written names is framed in terms of mentionמותר להזכיר — and not of oath; if (ב) were true, one would have to explain why the fence falls where the thing fenced remains.

שלא להשביע בשם אלילים של עובדי כוכבים ודיני הזכרת שמה. ובו ה׳ סעיפים:
הנודר או נשבע בשם אלילים הרי זה היה לוקה ואסור להזכירה בשמה בין לצורך בין שלא לצורך:

2. רבותת ה״אפילו״ — the Taz on the Tur, against the Beit Yosef’s difficulty

The Tur wrote a sentence, the Beit Yosef said it was badly turned, and the Taz showed that it said exactly what was needed. Between the three, the scope of the prohibition of mention is decided.

The Tur’s wording

Kushya — the Beit Yosef The Rosh had established that the prohibition holds in any case, the braita having taken “keep this for me” only as the ordinary way of things:
« וכתב הרא״ש לכאורה משמע דוקא בכה״ג אסור להזכיר אליל לצורך ומיהו נראה דבכל ענין אסור דקרא סתמא כתיב » (בית יוסף יו״ד קמ״ז)

But then, says the Beit Yosef, the Tur put his “even” in the wrong place:

What the Meḥaber did with the difficulty The Beit Yosef wrote what the Tur ought to have written: אסור להזכירה בשמה בחנם בין לצורך בין שלא לצורך. And that is word for word the formula the Meḥaber adopted in his seif 1:
« ואסור להזכירה בשמה בין לצורך בין שלא לצורך » (שו״ע יו״ד קמ״ז:א)
Nafka mina The Taz and the Meḥaber reach the same verdict by two roads. The Meḥaber removed the difficulty by changing the wording; the Taz resolved it while keeping the Tur’s. The difference shows in one case: a name pronounced only as a landmark, with no relation to worship — “keep this for me beside such-and-such an idol”. For the Meḥaber the case is covered by לצורך with no reasoning needed. For the Taz it is forbidden because the very use as a landmark נראה כמו שנותן בה ממש — it appears to grant it substance. The second reason reaches further than the first.

3. גרמא — the transgression in another’s mouth, and the Radbaz’s opening

Seif 3 forbids not what I say but what I cause to be said. It remains to know where this prohibition comes from — and the answer governs everything that follows about shituf.

The source: the second half of the verse The braita places the causing in the same half-verse as the vow, and the Beit Yosef gives the reading explicitly:
« אסור לאדם שיעשה שותפות עם העכו״ם שמא יתחייב לו שבועה ונשבע באליל שלו » (בית יוסף יו״ד קמ״ז)

The ḥakira (א) The prohibition of seif 3 is a case of לפני עור: I cause the non-Jew to stumble in a transgression that is his. (ב) It is a prohibition resting on me, derived from לא ישמע על פיך — that the idol’s oath not be heard through my doing, whatever the case may be for him.
Nafka mina It is immediate and it is the direct continuation of the reasoning: the case where the non-Jew is not warned about what he does. If (א), the prohibition falls — there is no blind man to trip. If (ב), it stands. The Beit Yosef reports way (א) in the name of Rabbenu Yeruḥam:

Rabbenu Tam: what has already begun

The Gemara forbids partnering with a non-Jew, lest one come to make him swear. Rabbenu Tam distinguishes the beginning from what follows: what is forbidden is entering the partnership; once partnered, one may take the oath so as not to lose one’s money.

« וכתבו התוס׳ והרא״ש בשם ר״ת שאם כבר נשתתף עמו מותר ליקח ממנו שבועה קודם שיפסיד ממונו » (בית יוסף יו״ד קמ״ז)
The Radbaz, via the Pitḥei Teshuvah: to rescue, without naming The opening he gives is narrow, and its narrowness is instructive: it is not the non-Jew’s oath he permits, it is the neutral request. The idol’s name must not leave my mouth — which is exactly reading (ב).

4. שיתוף — the Rama of Oraḥ Ḥayim 156 and the Noda BiYehudah

Seif 3 refers to Oraḥ Ḥayim 156, and the Shakh and the Ba’er Hetev do no more than repeat the reference. It is the Pitḥei Teshuvah who goes to look — and brings back one of the sharpest discussions among the Aḥaronim.

Teruts — the Pitḥei Teshuvah himself He grants the truth to the Noda BiYehudah, and refuses him the reading of the Rama: the distinction is between the oath that associates the Name of Heaven with something else — forbidden to a Jew by ובשמו תשבעו and not to a non-Jew — and worship rendered in association, where there is no difference at all between the two.

The debate is not beside the point: it decides between reading (א) and (ב) of the previous section. If the prohibition of seif 3 is לפני עור, everything depends on what the non-Jew is bound by; if it is לא ישמע על פיך, that changes nothing. And the Radbaz, who permits only the request without naming, stands on the second side.

5. אלהיך יהיה בעזרך — the Rama against the Taz, the Baḥ and the Shakh

This is the only place in the siman where the poskim part ways, and the maḥloket is not over a principle: it is over a word, and in fact over a suffix.

The Levush, and the Taz’s answer

The Levush defends the permission from seif 5 itself: one who speaks so is mocking, and mockery of the idol is permitted. The Taz rejects the argument on a point of fact — the effect of speech is measured not by the speaker’s intent but by what the hearer understands.

The Baḥ, the Shakh, the Ba’er Hetev — the line settled The Taz writes that he laid the matter before his father-in-law, and the Shakh reports the Baḥ’s verdict in an operative form: it is not the whole sentence that falls, it is the suffix.

Nafka mina It is entirely practical and turns on one word. אלהים יהיה בעזרך — permitted by all, since the word refers to the Blessed Name. אלהיך, “your god” — permitted for the Rama and the Levush, forbidden for the Taz, the Baḥ and the Shakh, who see in it מחזיק ידי עובדי אליל. As for יצליח מעשיך, it names no one, and the difficulty does not touch it.

6. ליצנותא דעבודה זרה — one verse for two permissions

A detail that is not a detail The Gemara proves the permission of mockery from the very words that seif 4 gives as its example of permitted names — כרע בל קרס נבו. Seifim 4 and 5 therefore rest on one verse: since the prophet could name Bel and Nebo in order to mock them, those names may be said, and mockery is permitted too.

7. יסוד הסימן — the prohibition is in the mouth, the permission is in Scripture

The whole siman reduces to one rule of reading. What is forbidden is what my mouth produces: the vow, the oath, the mention, and even the oath I cause another to utter. What is permitted is what Scripture has already said: the names it wrote, and the mockery of which the prophet gave the model. Seif 2 stands on the same side — a man’s name is a word of ordinary language, not a word of worship — save that one must not give it the dignity others give it. And that is why the siman’s one maḥloket arises precisely where one speaks without quoting and without mocking: אלהיך יהיה בעזרך, where the mouth produces a word that neither Scripture nor mockery covers.
