1. The axiom: the transfer, the echo, the limit

The starting point:

This siman does not forbid trade; it fears a sentence. The non-Jew, holding in his hand what he holds from us, will go on his festival day and thank his idol for it. The whole siman is the measure of the distance needed for that sentence not to be said.

The object — הֲנָאָה. Something passes from us to him: goods, a lent article, money, a gift, a greeting, presence.

The fear — הוֹדָאָה. It is not the transfer that is forbidden but its echo: the acknowledgement he will render for it to his idol. Hence the prohibition depends on the day, on the person, and on the age.

The limit — אֵיבָה. Where abstention would create enmity, the prohibition yields — but it only yields, it does not vanish.

Hence the axiom: before each case ask first what passes, then what he will say of it, then what would happen if one refused.

2. The 5 reflex questions

  1. Will the gain last until his festival? A durable object or money: yes. Vegetables, a cooked dish: no — and then one may sell, not buy.
  2. Is it a benefit or a rescue? Collecting a debt that was about to be lost enriches nobody: כמציל מידם.
  3. Is the day fixed and common? Annual and kept by the whole community: the siman applies. Otherwise — Shach sk 4, seif 7 — it does not.
  4. Does he really adhere to it? One who follows by custom or honour, without believing, falls outside the siman (seif 8); one known not to serve idols also falls outside it (seif 5).
  5. Would refusal create enmity? If so, the prohibition yields — but only to its measure, and the בעל נפש closes again what enmity had opened.

5. The gift one cannot destroy — the Taz alone against three

Seif 5 assumes one can destroy the gift before his eyes. When one cannot, four authorities answer, and three say the same thing.

Psak

Three voices out of four, including the Baer Hetev which is the practical digest, hold that one does not benefit from the gift. That is the position to follow, and lema’asse the question is put to a Rav.

6. The greeting — the word, the language and the order

Three questions arise on seifim 9 and 10, and they are not answered together.

7. The 5 golden rules

  1. The reason is single. Everything the siman forbids, it forbids because the non-Jew will go and thank his idol. One engine, twelve applications.
  2. What counts is what remains in hand. Not the value, not the nature of the bargain: the duration. That is the Raavad’s question, which the Rambam applies both ways.
  3. A rescue is not a benefit. And its measure is read in the state of the world, not in the form of the instrument — hence the Shach and the Pitchei Teshuva.
  4. The decree reaches only the fixed, common and acknowledged day. Remove regularity, community or adherence, and it no longer applies.
  5. Enmity suspends, it does not abolish. It always leaves a remainder to do: not to benefit, to keep away, to send on the eve.

הֲנָאָהwhat passes. Goods, a lent article, money, a gift, a greeting, presence. If nothing passes, there is nothing to forbid.

Three words, in that order, and the twelve seifim fall into place.

9. The 5 classic pitfalls

1. Thinking seif 12 erases the siman. It does not erase it: the Shach writes expressly that seif 9 remains forbidden today, and the Rama closes with the בעל נפש what enmity had opened.
2. Confusing the three days with the festival day. The three days are “themselves, without their festival”: four days in all in Eretz Israel. And the gain made during the three days is permitted after the fact, that of the day itself is not.
3. Thinking that selling and buying follow the same rule. The Mechaber follows the Rambam: the durable is forbidden both ways, but the perishable may be sold and not bought. Rashi and Rabbenu Tam each give another map — that is the machloket of §4.
4. Taking the “far away” of seif 11 for a condition. The Taz writes that it is an emphasis: if even from afar the outward journey is forbidden, all the more so from nearby.
5. Thinking seif 10 depends on the festival. It does not: the Shach writes in sk 8 that the prohibition of doubling holds even outside his festival day, and the Rambam filed it in another chapter.
