דיני יריד מעובדי כוכבים. ובו ה׳ סעיפים:
עיר שעושים בה יריד ביום חגם והעובדי כוכבים מתקבצים מכמה מקומות והולכים שם לכבוד עבודת כוכבים מותר לילך חוצה לה ואסור ליכנס בתוכה היתה חוצה לה מותר ליכנס בתוכה ההולך ממקום למקום אסור לעבור בה אם הדרך מיוחד לה (דהיינו שאין עוברים מאותה עיר לעיר אחרת):

This siman is not decided in one movement, because it does not forbid one thing. Before any ruling one must know which of the three prohibitions is at issue — and each has its own reason, and therefore its own way out.

This double reason is no scholastic curiosity: it decides the case where the road passes through the festival town and continues beyond, yet remains the traveller’s only access to his destination. The Taz writes both readings and does not decide between them.

The test of the road

Two Acharonim set aside with one voice the reading that would place the test on the town of departure:

The practical test is therefore: does the road stop at the idol’s town, or continue beyond it? It continues — permitted. It stops — forbidden. The number of roads leaving his own town does not enter into it.

The Shakh rules with the Rosh and the Tur: the presence of Jews in the town does not suffice to permit an outsider to enter. But he adds his own view: where a minyan resides — even of youths and servants — it is called a community, and it is permitted. The Ba’er Hetev (ס״ק ג) carries both halves.

The courtyard of the cult

The point of agreement is written into the gloss itselfלכולי עלמא מותר — and is doubled by an attestation of custom: passing through a courtyard crossed by a road leading elsewhere. Above the law there remains the measure of piety: to keep away if another road just as short exists. The Shakh (ס״ק ה) notes that the first view holds even outside their festival day; the Shakh (ס״ק ו) states where the Rama drew the third from.

Danger to life — what this level does not decide

The Shakh reports both views without concluding here, and refers to two places where the matter is decided — siman 150 seif 3 and the end of siman 157. No page replaces a ruling on a case where life is at stake. It is a question for a Rav, at once.

The Taz notes that the Tur writes “for his own god” and wonders at it: that word would point to his cult, so why permit? He concludes that the Rama did well to drop it. The Bach, reported by the Shakh (ס״ק י), rules the same way: “for his own god” is forbidden.

The toll turned into idol-money by decree

The Maharik sets three cumulative conditions for permission: (1) the toll existed beforehand, (2) the Jews were not made to pay more on that account, (3) the money leaves, in law, the lord’s purse, to whom the toll belongs, not the taxpayer’s. The Shakh and the Ba’er Hetev both report him without reservation.

The penalty strikes the thing, not the man, and its measure follows that of the benefit improperly taken: where the prohibition arose from a waiver of toll, it is the value of that waiver that is lost, not the whole purchase. This is the Bach’s reading, which the Shakh (ס״ק ט) and the Ba’er Hetev (ס״ק ז) both report.

The siman’s line for our own time. Four authorities say the same thing by different routes: Rabbenu Yeruḥam, reported by the Beit Yosef, writes that already in his day it was not done for the idol; the gloss on seif 4 makes it the rule — וסתם יריד בזמן הזה מותר; the Shakh (ס״ק ז) extends it to everything — האידנא הכל שרי — in the name of the Rosh, the Tur and the other decisors; and the Bach, whom he quotes, goes as far as a fair held on their festival day itself, and as far as a toll paid to the priests.

And the siman’s one boundary, which the Taz sets and the Ba’er Hetev (ס״ק ח) copies:

What this boundary does not say. The Taz does not reopen the general prohibition of the fair; he removes from the permission a gathering presented as a place of pardon. The distinction is between a market and a pilgrimage, not between one date and another.

The Mehaber writes the seif without saying “on the return”; the gemara, the Tur and the Rambam all three say it, and the reason the Shakh gives — had he not sold, why would he have gone there? — holds only on the return. A correct reading of the seif restores that word.

8. מקרים בני זמננו — contemporary cases and summary

Case 1 — A large commercial fair on the date of a religious festival

An ordinary market: the gloss on seif 4 permits it, and the Shakh (ס״ק ז) with the Bach extends it even to the festival date. The question to ask remains the Taz’s (ס״ק ד): is the gathering presented as a place where pardon is obtained? If so, the permission does not cover it.

Case 2 — Free entry offered at the market

An exemption open to all: no prohibition (Bach in Shakh ס״ק ח, Shiltei HaGiborim in Taz ס״ק ב). A discount obtained by applying personally to the organiser of a cultic event: the Shakh forbids it as a benefit. An exemption conditioned on a cultic act: forbidden, even if open to all.

Case 3 — A surcharge “for the church” or “for the saint” asked at the counter

A vague formula, with no named destination: permitted, since he may give it to their poor (gloss on seif 4). An explicitly cultic destination, or a known one, or “for such-and-such a saint”: forbidden. The Bach, in the Shakh (ס״ק י), adds that “for his own god” suffices to forbid.

Case 4 — A tax part of which is assigned to a religious building

The Maharik, in the Shakh (ס״ק י״א) and the Ba’er Hetev (ס״ק י), permits it under the three conditions recalled above. Characterising a real fiscal arrangement is not a reading of texts: it is done with a Rav.

Case 5 — Entering a house of worship, or crossing its precinct

The Shakh (ס״ק א) reports from the Rambam the broadest formulation in the siman — the town, and all the more the building — and himself adds to it the case of one living under their rule. The gloss on seif 2 permits, by all views, crossing a courtyard through which a road runs, and attests the custom; it nonetheless advises keeping away if another road just as short is available. A concrete case is not settled here.
