1. 1. שורש הסימן — suspicion or benefit?

The siman opens with a prohibition of place, and nothing is harder than a prohibition of place: of what exactly is a man guilty in walking? Two Rishonim answer differently, and it is the Taz who sets the two answers side by side.

The mishnah, and Rashi’s reading as reported by the Tur The mishnah states the rule without giving its reason; Rashi, as the Tur reports him, gives it:
« מַהוּ לֵילֵךְ לְשָׁם? בִּזְמַן שֶׁהַדֶּרֶךְ מְיוּחֶדֶת לְאוֹתוֹ מָקוֹם — אָסוּר, וְאִם הָיָה יָכוֹל לְהַלֵּךְ בָּהּ לְמָקוֹם אַחֵר — מוּתָּר » (עבודה זרה י״א ע״ב)

The Rambam’s reading, and what the Taz draws from it The Rambam states the rule otherwise, and the Taz notes that he has “another explanation of this mishnah”:

Ḥakirah: is the prohibition of the road about what one appears to be doing, or about what one receives? (א) חשדא — a prohibition of appearance. The man has taken nothing from anyone; it is another’s eye that forbids. Such a prohibition depends entirely on what his presence suggests, and falls as soon as another explanation is available. (ב) הנאה — a prohibition of benefit. To pass through this town is to use a road that exists only because of it; the man receives something from it. This prohibition depends not on the eye but on his need of it.
Practical consequence A road that passes through the festival town and continues to another town, but is the traveller’s only access to his destination. On Rashi’s view: the road is not the town’s alone, no one will suspect him — permitted. On the Rambam as the Taz reads him: he has no other road, and so uses this one — forbidden. It is the Taz himself who writes both halves of this opposition.
The Taz’s difficulty with the Rama’s gloss The Taz does not stop there. If the Mehaber, writing after the Rambam, understands the prohibition as one of benefit, then the gloss דהיינו שאין עוברים מאותה עיר לעיר אחרת — which belongs to Rashi’s reading — ought not to have been added to this seif. That is a difficulty with the Rama, and the Taz states it plainly.
« וא״כ גם המחבר ש״ע שכתב אסור לעבור בה ה״נ כוונתו כן שאסור לו ליהנות בהליכתו דרך שם » (ט״ז יו״ד קמ״ט ס״ק א)
« ואם כן לא היה ליה לרמ״א לכתוב על זה דהיינו שאין עוברין כו׳ שזה שייך לפי פירוש רש״י » (ט״ז יו״ד קמ״ט ס״ק א)

And the Taz raises a further difficulty with the Mehaber’s own wording:

« אלא שיש לעיין למה כתב בעל הש״ע והוא מדברי הרמב״ם ההולך ממקום למקו׳ למה נקט בכה״ג » (ט״ז יו״ד קמ״ט ס״ק א)
The siman therefore has two possible foundations, and the Mehaber names neither. The first explains the whole of seif 2 — traveller, townsman and caravan differ only in what may be thought of them. The second explains why the Rambam speaks of “another road” where the mishnah spoke of “another place”. To hold both is to hold the siman.

2. 2. מאותה העיר — which town does the gloss mean?

The gloss on seif 1 runs to six words, and two Acharonim write that the Bach read them backwards. The question is not one of erudition: it decides which way one looks at the map.

The text of the gloss The Mehaber states the rule, and the gloss makes it precise:

« דהיינו שאין עוברים מאותה עיר לעיר אחרת » (שו״ע יו״ד קמ״ט:א)
The Shakh’s reading The Shakh begins by setting aside the reading he holds to be wrong, then states his own:
« כלומר דל״ת שמהעיר שיצא אינו אלא דרך אחד אבל כשיש בדרך שיצא מהעיר שני דרכים שרי » (ש״ך יו״ד קמ״ט ס״ק ג)
« אלא ר״ל שאין עוברים מאותה העיר שבה האליל לעיר אחרת אבל כשעוברים משם והלאה שרי » (ש״ך יו״ד קמ״ט ס״ק ג)

The Taz’s reading The Taz says the same and names the Bach — his father-in-law — to contradict him:
« וכן מבואר בפי׳ רש״י במתניתין וז״ל שאין דרך יוצא מאותה העיר לילך לעיר אחרת ודרך הכבוש מכאן לאותה העיר מיוחד לאותה העיר לבדה » (ט״ז יו״ד קמ״ט ס״ק א)
« אבל מו״ח ז״ל פי׳ דהאי מאותה העיר שכתב רמ״א היינו ממקום שיצא » (ט״ז יו״ד קמ״ט ס״ק א)

Difficulty — what the Bach had understood The Bach read “from that town” as the town the traveller sets out from. The rule then became: if only one road leaves my town and it leads to the festival town, it is forbidden. The Shakh objects that this is not the question at all — it does not turn on the number of roads at the start; and the Taz objects that it contradicts the very premise of the case: we are speaking of a man who is certainly going to the festival town.
Resolution — the reading of the Shakh and the Taz “From that town” means the idol’s town, and the test is what lies beyond it: if the road stops there, forbidden; if it continues, permitted. The Shakh supports this from Rashi, the Ran, the Perishah and the Hasagot of the Raavad; the Taz from Rashi, the Ran, the Perishah and the Raavad likewise.
Practical consequence A man leaves a town from which a single road runs, passing through the festival town and continuing beyond. On the Bach’s view: forbidden — one road at the outset. On the Shakh and the Taz: permitted — the road continues beyond the festival town. The case is an ordinary one, and the two readings part company sharply within it.
The Shakh, unusually, writes that he has not grasped the bottom of the Bach’s view; the Taz, more measured, says only that it is not exact. Two sons-in-law of the same rabbinic world here correct the same book, on the same evidence, and the Ba’er Hetev (ס״ק ב) records their agreement.

3. 3. חצר של עבודת כוכבים — the three views of the gloss

The Mehaber’s seif 2 runs to one line; the gloss that follows is the longest in the siman, and it arranges three views in an order that is not accidental.

First view — the Rashba: the courtyard is like the town
« חצר של עבודת כוכבים י״א דדינו כעיר של עבודת כוכבים » (רמ״א יו״ד קמ״ט:ב)
Second view — Rabbenu Yonah and the Rosh: outside their gatherings it is permitted
« ובזמן שאין העובדי כוכבים מתקבצים שם לתרפותן מותר ליכנס שם » (רמ״א יו״ד קמ״ט:ב)
Third view — the prohibition rests on the absence of a thoroughfare
« וי״א דבכל ענין אסור אם אין דרך עובר בו למקום אחר » (רמ״א יו״ד קמ״ט:ב)
« אבל כשדרך עובר בו למקום אחר לכולי עלמא מותר וכן המנהג פשוט לילך דרך אותו חצר למקום אחר » (רמ״א יו״ד קמ״ט:ב)

Finally the measure of piety, which is not a law:

« ומ״מ מדת חסידות הוא להתרחק מלילך בו אם יש לו דרך אחרת קצר כמוהו » (רמ״א יו״ד קמ״ט:ב)
Ḥakirah: do these three views answer the same question? They do not — and that is what makes the gloss legible. The first speaks of place: the courtyard is an annexe of the temple, hence a town in miniature. The second speaks of time: outside the gathering there is nothing to fear. The third speaks of road: what forbids is not the courtyard but the fact that one has no other business there. The Shakh (ס״ק ו) states where the Rama drew it from:
« זה למד הרב בד״מ מעיר » (ש״ך יו״ד קמ״ט ס״ק ו)

The Shakh adds that the first view holds even outside their festival day:

« ואפילו שלא ביום האיד. פרישה וב״ח » (ש״ך יו״ד קמ״ט ס״ק ה)
Practical consequence A courtyard of a house of worship crossed by a public thoroughfare, on an ordinary day. First view, with the Shakh’s qualification (ס״ק ה): forbidden, like the town, and even outside the festival. Second view: permitted, since they are not gathering. Third view: permitted, since a road runs through — and the gloss adds that in that case all agree it is permitted, and such is the widespread custom. There remains the measure of piety, if another road just as short exists.
The gloss here does what it rarely does: it reports three views, marks the point at which they meet, attests the custom, and adds a pious practice that binds no one. The four sentences are not of one rank, and reading them as a single rule would be the error of the siman.

4. 4. פיקוח נפש — the Rashba against the Ran

The Tur reports from the Rashba an extension that stops the reader: even to save a life. The Shakh reports it in turn, then the Ran’s answer, and notes that the Rama ruled elsewhere.

The Ran’s answer The Ran distinguishes the two cases, and the Shakh gives it in full:
« אבל הר״ן חולק דבסכנת נפשות שרי דלא דמי למעיין דנראה כעובד משא״כ הכא שאינו נראה אלא כהולך לעבוד » (ש״ך יו״ד קמ״ט ס״ק ב)
« ואפשר עוד דאף במעיין היכא דאיכא סכנה ודאי שרי כיון שאינו אלא משום מראות העין » (ש״ך יו״ד קמ״ט ס״ק ב)
Difficulty — why does the Rashba compare it to the spring? Because the gemara teaches, of a spring whose water runs before an idol, that one does not drink from it even at the cost of one’s life — since drinking there resembles an act of worship. The Rashba infers that appearance outweighs even life.
Resolution — the Ran’s distinction The comparison does not hold: at the spring the man appears to be worshipping; here he appears only to be going to worship. The appearance of an act and the appearance of an intention do not weigh the same. The Ran adds that even at the spring, in certain danger, it may well be permitted — since the whole matter there is one of appearance.
Practical consequence The Shakh does not merely report: he refers to two places where the question is decided — seif 3 of siman 150 and the end of siman 157. That, and not here, is where a decision is to be sought.

The Ba’er Hetev (ס״ק ד) sums up the two views without preferring either, and joins both cross-references. This level sets out a dispute; it does not decide one. A case in which a life is at stake goes to a Rav, at once.

5. 5. נהנה ומהנה — the Taz against the Tur

The baraita sets the Jew before two outcomes and names both in a word. The Tur takes one of them to explain the parenthesis of seif 3; the Taz shows that Rashi and the Tosafot had taken the other.

The Taz’s difficulty with the Tur

The Taz’s resolution — two situations not to be confused The Taz distinguishes the gemara’s case from the seif’s. In the gemara the waiver is offered to whoever performs the act: the Jew leaves without paying, having asked nothing, and deceives those who take him for a devotee — so he draws nothing from the cult. At the fair of the seif, by contrast, he asks for the toll to be waived and obtains it individually: there he does derive a benefit and owes them a favour.
« ולע״ד נראה דדוקא באותו ענין שנקט בגמרא שכל מי שיניח העטרה יניחו לו המכס ונמצא שאינו צריך לבקש מהם שיניחו לו המכס רק מעצמו הוא הולך בלא מכס » (ט״ז יו״ד קמ״ט ס״ק ב)

And the Taz adds an observation bearing on his own day:

« וכתוב בשלטי הגבורים דבמקום שמניחין המכס סתם לכל אדם כמו שעושים היום לירידים שלנו שעושין חירות לכל אדם בשוק אינו נראה כנהנה מעבודת כוכבים » (ט״ז יו״ד קמ״ט ס״ק ב)
Practical consequence An exemption granted to all in the market, as against a waiver obtained by approaching the organiser. The Shiltei HaGiborim, quoted by the Taz, sets the first aside; the Bach, quoted by the Shakh (ס״ק ח), rules the same way, and states the converse reservation: an exemption open to all but conditioned on a ritual act remains forbidden.
« שהרי נהנה שמנחת לו המכס. טור והר״ן. ופסק הב״ח דהיינו דוקא ביחידים אבל כשעושים חירות לכל אדם בשוה אין בזה איסור » (ש״ך יו״ד קמ״ט ס״ק ח)

The Shakh (ס״ק ט) draws from all this a consequence of measure: if the prohibition arises from his having derived benefit from the waiver, it is not the whole purchase that must be destroyed but the value of the benefit.

6. 6. דבר האבוד והאידנא — the Rosh, the Ran, the Bach and the Shakh

Seif 3 permits going to the fair; but seif 1 forbade entering the town on their festival day. The Rosh resolves the tension by a notion foreign to the siman: loss.

The Ran’s restriction
« וכתב הר״ן דהיינו דוקא בדברים שצריך להם לעצמו אבל להשתכר בהן לא דהנאת ריוח לא מקרי דבר האבוד » (ש״ך יו״ד קמ״ט ס״ק ז)
Difficulty — why should a loss permit what seif 1 forbids? Because it is not the same prohibition. Seif 1 forbids entering, on grounds of appearance; seif 3 forbids buying from the merchant, on grounds of the toll. The Rosh speaks of the first prohibition and not the second: a man who would find the article only at the fair suffers a loss, and loss lifts the prohibition of appearance — not that of the toll.

The Ran’s distinction sharpens it further: an article one needs for oneself is a loss; goods one would resell at a profit are not.

And the Shakh covers all of it in a sentence:

« מיהו כל זה מדינא אבל האידנא הכל שרי כמ״ש הרא״ש וטור ושאר פוסקים דלאו עובדי עבודת כוכבים הן » (ש״ך יו״ד קמ״ט ס״ק ז)

The Bach goes further still, and the Shakh reports him:

« וכ״כ הב״ח ס״ס זה דהאידנא אין חוששין לשום דבר ונהגו היתר אף ביריד ביום אידם ואפילו נותנים מכס לכומרים » (ש״ך יו״ד קמ״ט ס״ק ז)
« וסתם יריד בזמן הזה מותר דסתמא לאו לעבודת כוכבים הוא » (רמ״א יו״ד קמ״ט:ד)

Foundation — three layers, not to be confused The strict law forbids the fair on the festival day; the Rosh permits it on grounds of loss; the Ran restricts that permission; and above all of it the state of affairs — האידנא — makes the question moot, because those in question are not idolaters. The gloss on seif 4 says the same in turn, and the Taz (ס״ק ד) sets the one boundary.

7. 7. יסוד הסימן — three prohibitions and three doors out

כלל הסימן :
שלושה איסורים בסימן, ואינם ממין אחד. ואסור ליכנס בתוכה — איסור דרך, ומחלוקת ראשונים בטעמו : חשדא לרש״י, הנאה לרמב״ם כפי שהביא הט״ז ; ולפיכך אכסנאי אסור ובן עיר מותר, שאין האיסור בגוף המקום אלא במה שנראה. אבל הלוקח שם מן התגר אסור — איסור מוכר, ומשום מהנה עבודת כוכבים בלשון הרמב״ם ; ולפיכך כשהמכס לכהנים ואוכלים אותו — מותר. אסור לישא וליתן עמו — איסור שותף, ומשום דמי אלילים ביד ישראל ; והוא דין סימן קמ״ד. ולכל אחד פתח יציאה משלו : לראשון דרך אחרת, לשני מכס ההולך למקום אחר, ולשלישי אי־הידיעה. ומעל כולם — האידנא.
Three lines to take away. (1) Seif 1 forbids not a place but a road, and two Rishonim give two reasons for it which the Taz sets face to face. (2) Seif 3 forbids not goods but a seller, and the measure of the penalty follows the measure of the benefit (Shakh ס״ק ט). (3) Seif 5 is not a rule of this siman: it is siman 144 that speaks there, and the Shakh (ס״ק י״ג) says so expressly.
