1. The axiom: three prohibitions, three reasons

The starting point:

This siman states not one rule but three, and none follows from another. (1) A road is forbidden — because it marks out the man who takes it (Rashi), or because it serves him (Rambam). (2) A seller is forbidden — because the toll he pays goes to the cult. (3) A trading partner is forbidden — because the money he carries may be an idol’s price.

Hence the axiom: before answering, ask which of the three prohibitions is at issue. Each has its own way out, and none of the three opens the other two.

💡 The marker: ואסור ליכנס concerns a place; אסור מן התגר concerns a man who pays; אסור לישא וליתן concerns a man carrying money. Three prohibitions, three objects.

2. The 3 reflex questions

1. Is this about going somewhere? Then: does the road lead anywhere else? And who is this man — traveller, townsman, caravan? (seifim 1 and 2)
2. Is this about buying? Then: does the seller pay a toll, and where does the toll go? To the idols — forbidden; to priests who eat it — permitted (seifim 3 and 4)
3. Is this about dealing with someone coming back from there? Then: is he a Jew or a non-Jew? Of a Jew we presume the sale of an idol; of a non-Jew we presume nothing (seif 5)

4. The reason for the prohibition: Rashi against the Rambam

The Taz sets the two readings side by side, and it is he who must be read to hold them together:

« אבל המעיין ברמב״ם יראה מבואר שיש לו פי׳ אחר במשנה זו » (ט״ז יו״ד קמ״ט ס״ק א)

The case where the two readings part: a road that passes through the festival town and continues beyond, but is the traveller’s only access to his destination. Rashi permits; the Rambam, as the Taz reads him, forbids. Do not reason from one to the other.

5. “From that town”: the Bach against the Shakh and the Taz

7. Danger to life: the Rashba against the Ran

This point is not settled on a revision page. The Shakh reports both views and refers to two places where the question is decided — siman 150 seif 3 and the end of siman 157. A real case goes to a Rav, without delay.

8. נהנה ומהנה — and the measure of the penalty

« וע״כ תימה על הטור שכתב נמצא נהנה שמניח המכס שלא כדעת רש״י ותוספות » (ט״ז יו״ד קמ״ט ס״ק ב)

The siman’s line for today

Three texts converge: Rabbenu Yeruḥam in the Beit Yosef, the gloss on seif 4, and the Shakh (ס״ק ז) with the Bach. An ordinary fair is not taken to be an idolatrous festival, and the custom of attending has become settled.

The boundary, and it is the only one in the siman, is the Taz’s (ס״ק ד):

« נ״ל פשוט שאין בכלל זה במקום ששם מתקבצים עובדי כוכבים הרבה ואומרים ששם מוחלים להם עונותיהם שזה ודאי לשם אליל הוא ואסור לשאת ולתת עמהם שם » (ט״ז יו״ד קמ״ט ס״ק ד)
Do not mistake this boundary for a general reservation. The Taz does not reopen the prohibition of the fair: he removes from the permission the case of a gathering presented as a place of pardon.

10. Golden rules, mnemonic, pitfalls and flash card

The 5 golden rules

  1. The road, not the town. Seif 1 forbids a road that leads nowhere else, not a place in itself.
  2. The seller, not the goods. Seif 3 distinguishes not what one buys but from whom.
  3. The penalty strikes the thing, not the man. Cattle maimed, clothing left to rot, metal to the Dead Sea — and, per the Shakh (ס״ק ט), to the value of the benefit.
  4. Seif 4 is a reversal, not an exception. Once the toll no longer goes to the cult, the reason of seif 3 disappears.
  5. Seif 5 belongs to siman 144. It is not the fair that forbids, but the idol’s price in a Jew’s hand.
Mnemonic — the word יריד
ייְחִידוּת הַדֶּרֶךְ: the road that belongs to it alone (seif 1)
ררַק אַכְסְנַאי: only the passing traveller is meant (seif 2)
ייַד הַתַּגָּר: the merchant’s hand, which pays the toll (seif 3)
דדְּמֵי אֱלִילִים: the price of idols, on the way back (seif 5)

And over the four, seif 4: האידנא.

The 4 classic pitfalls

  1. Thinking seif 1 forbids the town. It forbids entering when the road announces it; the same town is permitted to its own resident.
  2. Reading “from that town” as the town of departure. That is the reading the Shakh and the Taz both set aside.
  3. Taking the gloss’s three views on the courtyard for one rule. They do not answer the same question, and the point of agreement is written out.
  4. Extending seif 5’s permission to a Jew known to have sold. The Shakh (ס״ק י״ג) closes the door: there it is siman 144 that speaks.
