This level puts in order what the siman requires in practice. It does not rest on the Shulḥan Arukh HaRav — the Admur HaZaken did not write a Yoreh De‘ah — but on the Shakh, the Taz and the Ba’er Hetev, each cited in its place.

This page sets out the halakha as the poskim of this siman fixed it. It does not replace a Rav’s ruling: for application to a real situation, consult your Rav.

1. שורש הדין — the root: a prohibition of appearance, and its way out

What the siman forbids No act of worship at all. Three ordinary gestures, made impossible by the place: bending, picking up, drinking. The reason is written each time, and it is always the same — נראה כמשתחוה, נראה כמנשק. What follows for practice is decisive: there is never anything to renounce, there is a posture to change.

2. ד׳ אמות — the distance of seif 1

What is fixed Four cubits, and the Meḥaber makes it a mitzvah, not a mere precaution. The Beit Yosef refers the whole siman to the braita of the first chapter of Avodah Zarah; the measure itself is the one Rav Ḥisda gives in the same tractate, on the verse הרחק מעליה דרכך.

3. שלא לשחות — not to bend, and what one does instead

« ישב לו קוץ ברגלו בפני אלילים או נתפזרו לו מעות לפניה לא ישוח להסיר הקוץ וליטול המעות » (שו״ע יו״ד ק״נ:ב)

Three permitted postures, written in the text To sit; to turn one’s back to the idol; to turn one’s side to it. Only then, to pick up. The Rambam gives only one — to sit — and the Tur gives the braita’s general formula: if he does not appear to be bowing, as when he places himself sideways, it is permitted. The Meḥaber joined them.

4. אפילו אין רואה — the prohibition holds with no witness

What this changes, and what it does not It hardens nothing: the permitted gesture stays exactly that of seif 2. It only shuts one door — the one that would let a person tell himself that, no one being there to look, he may bend. The Shakh writes expressly that even if no man sees him, it is forbidden, and the Ba’er Hetev repeats it in shorter form.

5. פרצופות — the figured fountain: Taz and Shakh

« פרצופות המקלחות מים בפני אלילים לא יניח פיו על פיהם וישתה מפני שנראה כמנשק לאלילים » (שו״ע יו״ד ק״נ:ג)

The Taz: stringency even with no idol

« בטור לא כתוב האי בפני אלילים אלא כתוב שם בכרכין וכ״ה בגמ׳ שלנו » (ט״ז יו״ד ק״נ ס״ק א)

The line of psak Before an idol, the prohibition is the Meḥaber’s, undisputed. Outside of before an idol — an ornamental figure, a town fountain — the two commentators diverge: the Shakh, in the Baḥ’s name, permits and holds stringency meritorious; the Taz writes ויש להחמיר, and that is the word the Ba’er Hetev keeps and passes on under the Taz’s name. Practice is therefore settled thus: the Taz’s stringency is the indicated conduct, without one who relies on the Shakh being left without support.

6. הגהות הרמ״א — danger, dignitaries, and the conclusion

(1) Danger
« י״א דכל שאינו אסור אלא מפני מראית העין כגון בדין זה אם יש סכנה בדבר כגון אם ימות אם לא ישתה מותר לשתות ואין בזה משום יהרג ואל יעבור » (שו״ע יו״ד ק״נ:ג)
The exact scope The Rama lays down a rule of classification: what is forbidden only by appearance does not belong to the three transgressions before which one lets himself be killed. It is a rule of category, not a general permission; it says nothing about what is forbidden for another reason, and here it targets “this ruling” — the fountain.
(2) The dignitaries
« שרים או כהנים שיש להם צורת עבודת כוכבים בבגדיהם או שנושאים צורת חמה לפניהם כדרך הגמונים » (שו״ע יו״ד ק״נ:ג)

(3) The lenient view, and the conclusion

What this gives in practice The Rama decides himself, and his conclusion is the siman’s line of psak: וטוב להחמיר כסברא הראשונה. Before a dignitary bearing a cultic image one does not bow and does not uncover — and yet one need not affront him: the Rama himself indicates the way, the same as that of seif 2, but displaced in time — to rise, or to uncover, before his arrival.

8. מקרים בני זמננו — contemporary cases

An object dropped in a place of worship, or before a devotional statue Seif 2 applies as written. One does not give up the object: one sits, or turns one’s back or side, then picks it up. And one does not tell oneself the place is empty — the Shakh wrote that the prohibition holds even if no one sees.
An ornamental fountain with a human face, in a public square This is the Taz’s exact case. Before an idol, the prohibition is the Meḥaber’s. Elsewhere, the Taz requires stringency after the Tur’s version, and the Ba’er Hetev reports him; the Shakh, in the Baḥ’s name, permits and praises the stringent. In practice one does not drink mouth to mouth at such fountains.
A place of worship met on the road Seif 1: four cubits of distance, and the Meḥaber makes it a mitzvah. The siman speaks neither of entering nor of looking; it speaks of the distance of the road.
An official ceremony where one must rise or uncover The Rama’s second gloss, after the Terumat HaDeshen, targets only the case where the dignitary bears on himself, or before him, a cultic image. The indicated conduct is to rise or to uncover before his arrival. The Rama reports the lenient view, then concludes that it is good to be stringent like the first.
Thirst, and nothing else to drink The Rama’s first gloss: where the only reason is appearance and there is mortal danger, one drinks. One must see that the gloss bears on a case of real danger, not on discomfort.

9. מה שאין הסימן מכריע — what this siman does not decide

Two points remain out of this siman’s reach, and it is better to name them. (1) The case of the spring flowing before an idol: the braita gives it, the Tur takes it up with the phrase ואפילו אי מאית אי לא שתי, and the Beit Yosef notes that it is not explicit in the braita but inferred from it. The Meḥaber did not take it up in our siman; one therefore cannot read his view into it. (2) The divergence between that phrase of the Tur and the Rama’s first gloss: the two texts do not speak of the same gesture — the Tur forbids bending in order to drink, the Rama permits drinking when there is mortal danger — and the siman does not arbitrate between them.
A reminder: the Shulḥan Arukh HaRav does not cover Yoreh De‘ah — the Admur HaZaken did not write it. This Level 4 is a level of psak, resting on the Shakh, the Taz and the Ba’er Hetev. The Pitḥei Teshuvah and the Nekudot HaKesef do not comment on this siman.
