Nothing the siman forbids is an act of worship. One must therefore say what this prohibition is made of — and the answer decides the Shakh’s question, the Taz’s and the Rama’s.

The Rambam gives the scale Before our three cases he lists the acts of honour rendered to the idol, and notes that they do not carry lashes, not being explicit:
« הַמְגַפֵּף עֲבוֹדַת כּוֹכָבִים וְהַמְנַשֵּׁק לָהּ וְהַמְכַבֵּד וְהַמְרַבֵּץ לְפָנֶיהָ » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ג׳ הלכה ו׳)
« וְאַף עַל פִּי כֵן אֵינוֹ לוֹקֶה עַל אַחַת מֵהֶן לְפִי שֶׁאֵינָן בְּפֵרוּשׁ » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ג׳ הלכה ו׳)
The ḥakira (א) What is forbidden is the form the body takes: a back bent before an idol is the image of a prostration, whether or not anyone is there to see it. The prohibition attaches to the act. (ב) What is forbidden is the misunderstanding that may arise in a bystander’s eye. The prohibition attaches to the witness.
Nafka mina It is immediate: the deserted place. On (ב), the absence of any witness should lift the prohibition; on (א), it should not. The Shakh decides for (א), and writes it plainly — we shall read it in a moment. A second consequence lies in the Meḥaber’s solution: if sitting or turning suffices, then what is targeted is indeed a posture, not a state of mind or an intention.

The braita attaches to each of its cases the same permission: ואם אינו נראה — מותר. The Gemara asks what those two words mean, and its answer is the key to the siman.

Kushya How can a prohibition grounded in what others see hold where there is nobody? To say the prohibition applies in the innermost chambers seems to strip מראית העין of its very object.
Teruts — the two “nirè” are not the same The Gemara has already separated the two senses: “he is not seen” is not “he does not look like one bowing”. It is the second that permits, not the first. The Shakh therefore only draws the consequence of the Gemara’s answer: since the permission depends on posture, it cannot depend on a bystander’s presence. A man alone before an idol, bent over, has the forbidden posture — and the absence of a witness does not change it.
Nafka mina The Shakh himself refers to two places in Oraḥ Ḥayim where the rule of חדרי חדרים is discussed. Here its scope is narrow and clear: it does not widen the prohibition — the permitted gesture stays exactly the same — it only forbids relying on solitude. The Ba’er Hetev abridges him keeping precisely that.

Seif 3 exists in two versions, and they do not cover the same field. The Taz compares them and decides; the Shakh, on the same page, draws from the same Baḥ the opposite conclusion.

Two readings of the Baḥ

Both commentators invoke the same Baḥ. The Taz takes from him that there is a divergence among the Rishonim, and concludes for stringency. The Shakh takes from him the permission, with stringency merely praised.

Nafka mina An ornamental fountain with a human face, in a town, with no idol before it. For the Taz — the version of the Tur and the Gemara — drinking from it mouth to mouth is forbidden, and one must be stringent. For the Shakh in the Baḥ’s name, it is permitted, and one who abstains earns a blessing. The Ba’er Hetev reports the Taz under his name, without further ruling.

5. סכנה — the Tur against the Rama, and what the Meḥaber did not take up

The braita counted four cases; the Meḥaber took up only three. The one he leaves — the spring — is precisely the one where the Tur writes a phrase that the Rama’s first gloss appears to contradict. The texts must be set side by side before we say what separates them.

The Rama’s first gloss

What the two texts say, and what they do not The two do not bear on the same gesture. The Tur speaks of the spring: what he forbids is bending in order to drink — and bending is never the only way to drink, the braita itself having given the way out, ואם אינו נראה — מותר, which the Tur reports a few words earlier. The Rama speaks of “this ruling”, that is, of the figured fountains, where the forbidden gesture is placing one’s mouth on theirs, and where the case supposed is a man who would die for want of drinking. The Meḥaber, for his part, did not take up the case of the spring, and our siman therefore does not decide it. It must be said thus and no further: the siman fixes the rule of appearance and the limit danger sets to it, not the arbitration between these two formulations.
What the Rama does fix, by contrast, is clear and worth retaining: a prohibition whose only ground is appearance does not enter the three cardinal transgressions. ואין בזה משום יהרג ואל יעבור — the phrase is his, and it is what gives the whole category its place on the scale.

The reasoning, and its internal proof The Rama refers explicitly to seif 2 — כמו שנתפזרו מעותיו — and that reference is the argument itself: the solution for dignitaries is the solution of the scattered coins, displaced in time instead of in space. There one changed posture; here one changes moment. The gesture remains, the coincidence disappears.

Nafka mina The lenient view reasons from what everyone knows: no one takes this salute for an act of worship, since the non-Jews themselves direct it only to the officer. That is exactly the argument the Rama’s first gloss would make decisive if the prohibition hung on misunderstanding — for there is none. Yet the Rama concludes וטוב להחמיר, and the Shakh’s line at ס״ק א reappears: in this siman what is targeted is not misunderstanding but the form of the gesture.

7. יסוד הסימן — the prohibition is in the form, the permission is in the posture

Siman 150 has but one sentence, and it repeats it three times: what resembles an act of worship is forbidden, and what no longer resembles it is permitted. It requires neither intention, nor witness, nor awareness — the Shakh said it in the shortest way by writing that even with no one to see, it is forbidden. From this everything else follows: the solution is always a posture (to sit, to turn, to drink otherwise, to rise beforehand), never a renunciation; the Taz’s extension to figures with no idol before them makes sense, since it is the form and not the place that is at issue; and the Rama’s limit makes sense too, since a prohibition of form, however serious, is not worth a life.
