How to read this level. Every statement is anchored either in the text of the Shulḥan Arukh and its nosei kelim, or in a named and verifiable posek (Tur, Beit Yosef, Rambam). On Yoreh De'ah there is no Mishna Berura — it comments only on Oraḥ Ḥayim — and no Shulḥan Arukh HaRav: the Admur HaZaken did not write Yoreh De'ah, and his name will therefore not appear here. The Nekudot HaKesef write nothing on this siman. The Arukh HaShulḥan is not cited: its text on this siman is not accessible to us, and one does not cite what one cannot verify. There remain, and they suffice: the Shakh (19 ס״ק), the Taz (9 ס״ק), the Baer Hetev (15 ס״ק) and the Pitḥei Teshuva (5 ס״ק). Where the question passes beyond the siman — and it often does, since this siman touches commercial law and neighbourliness — this level says so and stops: halakha in practice goes through your Rav.
A practical decision on this siman begins by identifying which of the four roots is at stake, because the leniencies of one never carry to another. This is the commonest error, and an easy one to make: “nowadays the custom has permitted” appears in the siman, but twice, in two places, and for two different things.

In practice. An article known to serve only the cult is not sold to someone known to employ it there — and this without limit of date or era, and not only to the officiant (Shakh ס״ק ב in the name of the Baḥ). Three things permit it: a quantity attesting resale, another use verified and not merely declared, or prior disqualification. In doubt about its destination, the Taz at ס״ק א says to incline to leniency. And if the article is not reserved for the cult, one sells it plainly — unless the buyer himself announced that he was buying it for the cult.
Here today’s halakha is decided, and the Shakh devotes two notes to it, ו and ז. The first says who is concerned; the second, why the question has changed its face.

In practice three lines, and they are not alike. א Before a non-Jew of today: custom permits, and the Shakh at ס״ק ז gives the reason — they are not idolaters, their intention goes to the Maker of heaven and earth, and the sons of Noaḥ are not warned on association. The Baer Hetev at ס״ק ה reports the same. But the Pitḥei Teshuva at ס״ק ב reports the Emunat Shmuel, who does not hold this permission to be clear — a בעל נפש will take account of it, as the Rama expressly writes. ב Before a Jew: nothing has changed, and the Shakh at ס״ק ו is categorical — the duty to keep him from sin stands, and his ability to buy elsewhere does nothing. ג Before a non-observant Jew: the Shakh ranks him with the non-Jew; the Ḥavot Yair, in Pitḥei Teshuva ס״ק ג, does not follow and writes that “the apostate too is commanded on לפני”. It is an open question, and it arises every day.
The seif ends with “nowadays the custom has permitted in everything”, and that line is the most misquoted in the siman.

In practice. The sale of an animal to a non-Jew is permitted, and the Shakh at ס״ק י״ב writes “such too is the Meḥaber’s view, and such is the custom”; on the second reason he gives, even buying in order to resell at a profit is permitted. But the same line adds two things. First, “a man of soul will reduce” — that is the Ran, and the Taz at ס״ק ה writes it too. Then, and this is no longer piety but a ruling: lending and hiring an animal to a non-Jew remain forbidden, and one must protest against those who do so. The reason has not aged: the lent beast remains the Jew’s, and he remains commanded on its Shabbat rest. The Shakh finally adds, in the name of the Sefer HaTeruma, that all this concerns only the impure beast: of a pure one it may be said that it is bought for slaughter.

In practice. The list of seif 5 is not closed: it is an example of what “carries harm to the public”, and it reaches raw material as well as buildings. It also reaches three recipients — the non-Jew, the Jew suspected of reselling to him, and the Jewish criminal — and the third remains fully current: the gemara stresses that he is included even if he does not kill, because in flight he will defend himself. Against this, seif 6 and the Shakh at ס״ק י״ג give the permission that prevails where it applies: selling to those who protect the city one lives in. The criterion to hold is the seif’s own, and it is narrow — “they are found protecting them, since they dwell in its midst”: it is the protection the seller himself enjoys that permits, not the buyer’s status.

In practice, four questions in this order. א Where? In the Land of Israel one sells a non-Jew neither house nor field, nor anything attached to the soil; one may rent a house, not a field. Outside the Land, everything is sold. That is seif 8, and the Shakh adds nothing because there is nothing to add. ב How many? Three dwellings at once in a Jewish quarter are forbidden, by sale as by rental — and the Shakh at ס״ק ט״ו specifies: outside the Land of Israel too. It is the one limb of the לא תחנם block that does not stop at the border, and the Taz at ס״ק ז gives the reason — danger to the Jews who live there. ג For what use? Renting for a dwelling is forbidden by the letter of seif 10; the Rama attests that custom permits it, and the Shakh at ס״ק י״ז gives the possible reasons. Selling for a dwelling is permitted wherever selling is permitted — Beit Yosef, Shakh ס״ק ט״ז, Baer Hetev ס״ק י״ב. ד And the other way? The Rama ends his gloss with what people forget: one who rents a house from a non-Jew must be stringent and not leave the owner’s cultic object there.

In practice. Seif 11’s prohibition is narrow and must be read to the end: it covers only a free gift to a non-Jew whom one does not know. The Taz at ס״ק ח gives the criterion: with one whom he knows it is no longer a gift but a kind of sale — he will repay the favour, or has already repaid it. The Tosefta cited by the Beit Yosef adds the friend and the neighbour. A present to a neighbour, a colleague, a customer, a tip, a courtesy: all of this falls outside the seif. The Shakh at ס״ק י״ח fixes who is meant — every non-Jew, including an Ishmaelite; excluding the גר תושב, to whom one may give, as the Rambam writes from the verse of the nevela. And the Pitḥei Teshuva at ס״ק א opens a question of another order: a present meant to bend a judge is no gift but a stumbling-block set before him.

In practice. Five acts are expressly permitted by seif 12: supporting their poor, visiting their sick, burying their dead, eulogizing them, consoling their mourners. The commonest question — must it accompany the same gesture towards Jews? — receives the same answer from the Shakh at ס״ק י״ט and the Taz at ס״ק ט, by two different roads: no, and such is the custom. The Baer Hetev at ס״ק ט״ו notes their agreement. Seif 13 adds that one does not keep their poor from the gleanings. Seif 14 forbids praise, including of mere appearance — but the same words, turned toward the Creator, are permitted, and the gemara gives the established blessing. The Rambam gives the reason: praise makes one cleave, and cleaving makes one learn.
Three questions, in this order: is the article reserved for that cult here? did the buyer say what it would serve? and can he obtain it elsewhere? If the three answers are “yes, yes, no”, this is seif 1 in its strict form. If the third is “yes”, the Rama permits and custom follows, with the Emunat Shmuel’s reservation in Pitḥei Teshuva ס״ק ב and the view of the בעל נפש the Rama himself names.
This is the case where the leniency of the whole siman does not apply. The Shakh at ס״ק ו writes that the stringent views speak precisely of this, “of a Jew whom he is obliged to keep from sin”, and cites the Rosh: it is no less than a Jewish child eating nevelot. His ability to buy elsewhere does not enter into it.
Seif 4 concerns the animal, and its reason is the Shabbat rest of a beast that remains mine. Sale is permitted; lending and hiring are not, and the Shakh at ס״ק י״ב and the Taz at ס״ק ה both write that one must protest. The possible extension to other property a Jew still owns and that will work on Shabbat is not treated in this siman: it is a question for one’s Rav, and it belongs to Oraḥ Ḥayim.
Outside the Land of Israel, sale is permitted, even for a dwelling — Beit Yosef, Shakh ס״ק ט״ז. Renting for a dwelling is permitted by the custom the Rama attests. Two limits do apply: three dwellings at once in a Jewish quarter are forbidden, even in the diaspora (Shakh ס״ק ט״ו); and in the Land of Israel, selling a house or field to a non-Jew remains forbidden under seif 8. Any real transaction on this last point requires a Rav: considerations enter that go beyond the siman.
This is the second half of the Rama’s gloss at seif 10, and it concerns the Jewish tenant: one should be stringent and not leave the owner’s cultic object in the dwelling. What may be done with it — remove it, cover it, ask the owner to take it away — is not in the siman, and is a question for a Rav.
What calls for a return, and what goes to a neighbour, a friend, a customer, does not fall under seif 11 — Taz ס״ק ח, and the Tosefta in the Beit Yosef. There remains the free gift to a stranger, which is forbidden, and the גר תושב, who is excepted. The case of a present given to bend an official decision is treated separately by the Pitḥei Teshuva at ס״ק א, and no longer falls under gifts at all.
Seif 12 expressly permits the five acts, and the Shakh at ס״ק י״ט writes that they do not depend on a parallel gesture towards Jews — and that such is the custom. The motive is named: the ways of peace. What this level does not treat, and what requires a Rav, are questions of entering a place of worship and taking part in a service: they do not belong to this siman.
Seif 14 forbids three degrees and permits one turn of phrase. What decides is not the sentence’s content but its direction: to state a creature’s beauty is forbidden, to thank the Creator for such a creature is permitted, and the gemara gives the wording. The Rambam explains why the first is forbidden — it attaches, and attachment makes one learn.
