1. שורש איסור העמדת בהמה — “before the blind”, or a circumstantial safeguard?

Seif 1 forbids, then permits — in the same breath and with no transition. Such a structure is rare, and it comes from a choice the Beit Yosef sets out: two Rishonim permit, for two incompatible reasons, and the Mehaber writes only one of them.

The Taz: the prohibition is a “before the blind” The Taz does not comment on the fear; he seeks its legal qualification. His answer rests on the fact that the non-Jew himself is warned against bestiality:

Rabbenu Tam: the mishnah is not the halakhah The Tur reports a general leniency, which the Beit Yosef grounds in the sugya: our mishnah follows Rabbi Eliezer, and we rule like the Sages.

Chakira: is the leniency of seif 1 a leniency of law, or a leniency of fact? (א) Of law. According to Rabbenu Tam, the mishnah itself is not the halakhah: we rule like the Sages, who do not fear bestiality — and then the leniency holds everywhere, regardless of local mores. (ב) Of fact. According to the Ran, the mishnah is the halakhah, but it addresses a reality: where bestiality is punished the fear has no object — and the leniency holds only there.
The Mehaber decides, and it is legible in the very words The seif does not say “and nowadays it is permitted”, nor “and the halakhah is not like this mishnah”. It writes a clause of place — and its words are almost identical to the Ran’s:

Nafka mina (1) An indeterminate place. According to Rabbenu Tam, permitted; according to the Ran the doubt remains — אי נמי בסתם עכו״ם — and the seif follows the Ran. (2) The shepherd. The seif joins the shepherd to the inn under the same clause: were the leniency one of law, there would be no room to distinguish; being one of fact, it covers both at once. (3) Extension to the other seifim. A leniency of law about bestiality says nothing about murder or licentiousness; nor does one of fact — but it invites the same question for them, and the siman does not ask it.
The Rambam, for his part, knows no such leniency: he writes the prohibition without a clause, and adds ואפילו זכרים אצל זכרים ונקבות אצל נקבות. The Beit Yosef notes that the Maggid Mishneh, on that very chapter, nevertheless reports the Rashba — that is, the leniency of place entered the Rambam’s commentary, not his text.

2. בהמה שנרבעה — does the accomplished act change the animal’s status?

This is the longest entry in the whole apparatus of the siman, and the question is written neither in the seif nor in the gloss: it is born of the prohibition itself. If one transgressed and left the animal, what of it?

Kashya If the seif forbids placing the animal, does the prohibition bear on the act or on its result? The difference is not theoretical: the mishnah in Bava Kama, the Tosafot in Zevachim and the Gemara in Temurah appear to say that an animal that was mounted is forbidden for eating.
The Taz’s answer: the prohibition bears on the act, and on it alone His reasoning has two stages. First the qualification: לפני עור — a prohibition aimed at the one who places, not at the animal. Then the refutation of the contrary sources: what they forbid depends on the animal’s conclusion of judgment, and there is no conclusion of judgment nowadays.

The Pit’hei Teshuvah: this is not one question but three He separates what the Taz had left together. (a) Is the animal permitted? — yes, all agree. (b) May it be slaughtered a priori for food? — the Beit Yaakov says no and advises selling it; the Yad Eliyahu says it is a mitzvah to slaughter it at once. (c) Is its hide fit for sacred objects? — the Yad Eliyahu says not, down to the straps.

Three practices on one page — sell it, slaughter it at once, or abstain a priori — and none disputes the underlying leniency. That is the mark of a disagreement about lekhatchilah, not bediavad: the kind that is not settled by reading, but by asking one’s Rav.

3. המרחץ — purity, thought, or custom: four readings of one gloss

The Rama’s gloss is brief and its source is the Mordekhi. But the Mordekhi forbade for one reason, the Rama distinguishes for another, and the Acharonim agree neither on the reason nor on the distinction. Four positions are legible in these two lines.

(1) The Rama: the distinction rests on clothing, and on who came in first He lays down two clauses in one gloss: the place where one goes without breeches, and the Jew already inside.
« במקום שנהגו לילך במרחץ בלא מכנסיים אסור לילך למרחץ שרוחצים בו עובדי כוכבים ערומים » (רמ״א יו״ד קנ״ג:ג)

(2) The Bach: the reason is purity, hence the distance The Bach objects to the Rama, and his objection is methodical: were the reason clothing, the Mordekhi would not have permitted at four cubits.

(3) The Shakh: the reason was purity — and it has ceased The Shakh grants the Bach the reason, then draws the conclusion the Bach did not draw: what grounded the prohibition no longer exists. He first defends the Rama from the Darkhei Moshe, then goes beyond them both.
« ואין אנו נוהגים להחמיר בזמן הזה ואפשר דלא אסור אלא בימיהם שהיו רגילין לילך בלא מכנסיי׳ כמ״ש האגודה פ׳ מקום שנהגו אבל האידנא לית לן בה » (ש״ך יו״ד קנ״ג ס״ק א)

(4) The Taz: purity has ceased, but modesty remains The Taz follows the Shakh on the first point and reverses him on the second: the Mordekhi’s prohibition no longer applies, but another prohibition takes its place, depending neither on breeches nor on order of entry.

Chakira: what is the object of the bathhouse prohibition? (א) A safeguard of ritual purity. This is the reading of the Mordekhi and Pirkei de-Rabbi Eliezer, held by both the Bach and the Shakh. It is dated: it falls with the regime of purity. (ב) A safeguard of modesty. This is the Taz’s reading: the danger is improper thought, and it is permanent. (ג) A custom of separation. This is the Rama’s implicit reading, indexing the rule on the clothing habits of a place — hence variable but not abolished.
The Nekudot HaKesef’s kashya on the Taz They do not deny the fear of improper thought: they deny that the Taz’s sources carry it. The Mordekhi and Pirkei de-Rabbi Eliezer speak of purity; one cannot draw a prohibition of modesty from them.
« רוצה להוכיח דאסור לרחוץ במרחץ שהעובדי כוכבים רוחצי׳ בו ערומים ואין דבריו נכונים בזה » (נקודות הכסף יו״ד קנ״ג)
Nafka mina (1) The Jew who came in first. The Rama permits, the Taz forbids, the Shakh permits a fortiori. (2) The distance. Decisive for the Bach, irrelevant for the Rama and the Taz. (3) Covered nakedness. The Taz then permits בכל גווני — which, in practice, turns his own ס״ק into a broad leniency wherever modesty is preserved. (4) The measure of piety. That is the residue in the Shakh, and it does not have the force of a prohibition.
Does the Ba’er Hetev decide? No — and his silence is the most useful datum in the siman: he reports the Taz, then the Shakh, in that order, and stops. On so daily a practice, that means there is no received ruling, and the question arises afresh each time.

4. אשה חשובה — Rashi against Rabbenu Yitzchak, Rav Idi against Rabbi Yirmeya

Seif 4 is categorical and admits no exception. Yet the Gemara discusses one: the important woman. How can the Mehaber say nothing of it? That is what the Beit Yosef sets out, and what the Shakh sums up in three words.

The sugya: two answers to one objection The mishnah gives the woman a reason of her own — licentiousness — although murder would have sufficed. The Gemara asks why, and two Amoraim answer differently.
« וְלֹא תִּתְיַיחֵד אִשָּׁה עִמָּהֶן, מִפְּנֵי שֶׁחֲשׁוּדִין עַל הָעֲרָיוֹת » (עבודה זרה כ״ב ע״א)

Chakira: which fear does the “important woman” remove? (א) Rabbi Yirmeya. It removes murder: they are afraid of her. Licentiousness therefore remains, which is why the mishnah had to write it. (ב) Rav Idi. It is not her importance that removes murder but her condition — אשה כלי זיינה עליה. Importance then serves elsewhere. The Gemara itself gives the practical difference: an important woman among men, and a non-important woman among women.
Rashi and Rabbenu Yitzchak as the Tur reports them The Tur sets the two explanations one after the other — and the difference is total: for one, the important woman is permitted; for the other, no woman is.

Kashya: the Rosh rules like Rav Idi; does the seif rule like Rashi? The Beit Yosef reports the Rosh’s ruling, then observes that the Rif omitted everything and that the Rambam wrote the prohibition without distinction. The seif does as they do — but following Rashi and following the Rosh do not give the same halakhah for the important woman.

The Shakh decides in two ס״ק, and in two directions In ס״ק ב he closes the door on the important woman — in the name of the Beit Yosef according to Rashi, the Rif and the Rambam. In ס״ק ג he opens it for seclusion with women, while himself noting that this remains difficult according to Rashi.

(2) Seclusion with non-Jewish women: permitted per the Shakh, difficult per Rashi. (3) Number and wives: among Jews either suffices; with a non-Jew neither does. And the Taz spells out what the Beit Yosef left implicit — that the two Jewish leniencies are not of equal force:

Seif 3 looks descriptive, almost practical. Yet it settles a tannaitic dispute, and settles it differently from the Rambam. The Beit Yosef alone says so.

Yesod: the Tur’s reasoning makes the disagreement intelligible The Tur does not state a convention: he gives the mechanics — the sword is worn on the left, the stick held in the right hand, and in both cases the Jew’s hand must be on the side of the weapon. The first Tanna holds a single rule: presumably because standing on the right protects against attack as such, independently of the weapon.

Nafka mina (1) A non-Jew armed with a stick: to the left per the seif and the gloss, to the right per the Rambam. (2) A non-Jew with no visible weapon: the seif is silent, the Rambam covers the case. (3) The Rama adds a third layer in the Ran’s name: even on the ascent one places him somewhat to the right — that is, the two rules combine rather than replace each other.

שלושה חששות בסימן אחד: רביעה, שפיכות דמים, עריות. ואין ההיתר של אחד מהם היתר לחברו.

This is the principle that makes the siman legible, and it can be checked in the Mishneh Torah: the Rambam did not gather this material in one place. He distributed it according to the fear, and the distribution is exactly that of the mishnah.

A disagreement of reason about the child, and it is not slight The Rambam files the clause about the child with the animal, and for the same reason — מפני שכולן חשודין על משכב זכור. The Tur, whom the Rama follows, gives an entirely different reason — דמשכי ליה למינות. Two reasons, two regimes: the first tracks the mores of a place as the animal does; the second does not track them at all, since it bears on the teaching itself.

Closing nafka mina Does the clause of place in seif 1 — ובמקומות שאינם חשודים בה — extend to handing over a child? On the Rambam’s reason one would have to say so, since it is the same fear as for the animal. On the reason of the Tur and the Rama, no: heresy is not a matter of policing, and no local punishment removes it. The Shulchan Arukh, by placing the clause of place before the gloss and not after, leaves the question open — and it is a question for one’s Rav.
