📑 Plan of the synthesis
- The axiom: three fears, not one
- The 3 reflex questions
- Master table — the four seifim clause by clause
- The animal: the leniency of place, and the animal that was subjected
- The bath: four positions and one objection
- The woman: what nothing loosens
- The road: right, left, the ascent, the answer
- The Rambam: two treatises, and why
- The apparatus at a glance
- Golden rules, mnemonic, pitfalls and flash card
1. The axiom: three fears, not one
The starting point:
The mishnah in Avodah Zarah lays down not one prohibition but three, each with its own reason: רביעה for the animal, עריות for the woman, שפיכות דמים for the man. The Shulchan Arukh makes four seifim of them, and the Rambam two treatises.
Hence the axiom: a leniency bearing on one of the three fears says nothing about the other two. That is why the clause of place in seif 1 — ובמקומות שאינם חשודים בה — is not read into seif 2 or seif 4.
The source, as the mishnah puts it:
| The fear | The seif | What loosens |
Seif 1 — the animal | A place where it is punished |
Seif 1, gloss — the child | Nothing is written |
Seifim 2 and 3 — the man, the road | Practices, not a leniency |
Seif 3, gloss — the bath | Four views, no received ruling |
Seif 4 — the woman | Neither number nor wives |
💡 The marker: the word of the siman is not איסור but יחוד — and its title says so.
2. The 3 reflex questions
1. Which fear is it? An animal → bestiality, and the clause of place applies. A man → bloodshed. A woman → licentiousness. A child → heresy per the Rama, something else per the Rambam.
▼
2. Is this a situation of seclusion, or mere proximity? The siman speaks of יחוד. Seif 3 does not ask one to flee the road: it asks one to stand differently on it.
▼
3. Is the point settled, or only laid out? The bath is not — four views, and the Ba’er Hetev does not conclude. Nor is the animal that was subjected, as regards lekhatchilah. In both cases: a question for one’s Rav.
3. Master table — the four seifim clause by clause
| Seif | The clause | The verdict | The reason |
Permitted | the clause of place |
Permitted (gloss) | disputed by the Taz |
Forbidden | nothing loosens |
4. The animal: the leniency of place, and the animal that was subjected
The seif forbids and permits in the same sentence. The leniency is not an exception: it is the Mehaber’s choice between two Rishonim.
What the seif keeps and what it sets aside
It keeps the Ran’s leniency — the one that depends on the place — and not Rabbenu Tam’s, which would have held everywhere. The Rashba, reported by the Maggid Mishneh, says the same as the Ran.
Then comes the question the seif does not ask: and if one transgressed?
| The question | The answer, and by whom |
| Is the animal that was subjected forbidden for eating? | No — Taz ס״ק א; and “whoever taught the prohibition erred” |
| May one slaughter it a priori to eat it? | Beit Yaakov: no, sell it instead — Pit’hei Teshuvah |
| Or must it be slaughtered at once? | Yad Eliyahu: it is a mitzvah — Pit’hei Teshuvah |
| Is its hide fit for sacred objects? | Yad Eliyahu: no, down to the straps |
| Is there a strict view on the substance? | The Ba’er Hetev notes a responsum of the Bach that so inclines |
5. The bath: four positions and one objection
| Who | The reason for the prohibition | The consequence |
The clothing custom of the place | Forbidden where one goes without breeches; permitted if the Jew came in first |
Ritual purity | Forbidden within four cubits even clothed; permitted beyond |
Ritual purity — and it has ceased | Permitted today; abstention is only a measure of piety |
Modesty — the fear of improper thought | Forbidden as soon as nakedness is visible, even having come in first; permitted if covered |
| נקודות הכסף | None: the Taz’s proof is contested | “ואין דבריו נכונים בזה” |
Do not decide from any one of these texts. The Ba’er Hetev, the standard digest, reports the Taz and then the Shakh and stops there. On so ordinary a practice, the absence of a conclusion is itself the information: the question arises afresh, and it is put to one’s Rav.
6. The woman: what nothing loosens
| The situation | Among Jews | With a non-Jew |
| One man, his wife present | Permitted | Forbidden |
| Several upright men, without their wives | Permitted | Forbidden |
| Several, licentious, with their wives | Permitted (Taz ס״ק ד) | Forbidden |
| An important woman, close to the government | — | Forbidden — Shakh
| Seclusion with non-Jewish women | — | Permitted — Shakh ס״ק ג, with a reservation |
The Shakh does not hide his own hesitation on the last point: ויש לפקפק בזה לפירש״י. A reservation written by the author himself is worth more than a borrowed certainty.
7. The road: right, left, the ascent, the answer
He carries a sword → on my right. The sword is girded on his left: my right hand is thus near it.
▼
He carries a stick → on my left (gloss). The stick is held in his right hand.
▼
Ascent or descent → I stay above; and even so, somewhat to my right (Ran).
▼
“Where are you going?” → I lengthen the road, as Jacob to Esau.
A divergence the seif does not flag
The baraita has two views: the first Tanna says always to the right, Rabbi Yishmael distinguishes by weapon. The seif and the gloss follow Rabbi Yishmael; the Rambam follows the first Tanna, and the Beit Yosef alone says so.
8. The Rambam: two treatises, and why
| The material | The treatise | The governing fear |
| The animal in the inns |
| The child entrusted |
| A Jewish woman’s seclusion |
| A man’s seclusion |
| The road practices |
Two substantive differences from the Shulchan Arukh. (1) The reason for the child: משכב זכור in the Rambam, מינות in the Rama, after the Tur. (2) One’s place on the road: without distinction in the Rambam, with distinction in the seif.
9. The apparatus at a glance
| Author | Entries | What it bears on |
| ש״ך | 4 | א: the bath (the longest) · ב, ג, ד: the woman |
| ט״ז | 4 | א: the animal that was subjected (the longest) · ב: right and left · ג: the bath · ד: number and wives |
3 | It digests the Taz and then the Shakh, and concludes nowhere |
1 | Three responsa on the animal that was subjected |
1 | One objection to the Taz on the bath, in a single line |
Note: the two longest entries in the whole siman — Shakh ס״ק א and Taz ס״ק א — bear on questions that neither the Mehaber nor the Rama writes: the regime of purity at the bath, and the animal’s status after the fact.
10. Golden rules, mnemonic, pitfalls and flash card
The 5 golden rules
- Three fears, not one. Bestiality, bloodshed, licentiousness — and the mishnah names them separately.
- The clause of place holds for the animal only. It is written in seif 1 and nowhere else.
- Seif 3 does not say to flee: it says where to stand. Right, left, above, and an answer longer than one’s actual route.
- The bath is not settled. Four positions, and the Ba’er Hetev adopts none of them.
- Seif 4 is the firmest. What would suffice among Jews — number, or wives — does not suffice here.
Mnemonic — the word
י — יִחוּד : the subject of the siman, and its title
ח — חֲשׁוּדִים : three suspicions, three seifim
ו — וּבִמְקוֹמוֹת שֶׁאֵינָם חֲשׁוּדִים : the clause of place — and it holds for the animal alone
ד — דֶּרֶךְ : the road: right, left, above, and the answer
The 4 classic pitfalls
- Extending the clause of place to the whole siman. It bears on one fear, not on a relationship.
- Summarising the Taz on the bath in a word. He eases on purity and tightens on modesty, in the same ס״ק.
- Conflating the two Jewish leniencies in seif 4. Number holds only for upright men; the wives suffice even alone (Taz
- Thinking the Rambam follows the seif on the road. He rules like the first Tanna, and the Beit Yosef notes it.
| Seif | In one line |
| 1 | One does not leave an animal in their inns nor with their shepherd, for fear of bestiality; but where this is punished it is permitted. Gloss: one does not entrust them a child for the book or a craft. |
| 2 | A Jew does not seclude himself with them, for fear of bloodshed. |
| 3 | On the road: the sword to the right, the stick to the left, the Jew above, never bowing, and a lengthened destination. Gloss: the bath where they bathe naked, unless the Jew was already there. |
| 4 | A Jewish woman does not seclude herself with a non-Jew, even if they are many and their wives are present. |
Flash card.
