1. שני חששות — why the two directions of the siman do not answer each other

The siman looks symmetrical: a non-Jewish woman with a Jewish woman, a Jewish woman with a non-Jewish woman. But the mishnah gives each direction a distinct reason, and from there everything diverges — conditions in one case, enmity in the other.

The mishnah: one reason written, one reason unspoken It explains the second direction and leaves the first without a motive — the baraita will supply it.

Chakira: does the siman regulate one relationship, or two distinct dangers? (א) One relationship. Then the two directions should answer each other, and what permits here should ease there. (ב) Two dangers. Then each has its own regime: the first is treated by supervision, since a supervised danger is no longer a danger; the second by compensation, since one does not supervise what a child will become. The rest of the siman shows it is the second branch: seif 1 speaks only of conditions of presence, and seif 2 only of pay, professional standing and day.
Proof in the Rambam: two written reasons, a single halakhah The Rambam joins the two directions in a single halakhah, yet writes two different reasons — one for each direction. It is the clearest formulation of the asymmetry.

Nafka mina (1) Enmity. It eases the second direction and does not touch the first: no source permits a non-Jewish woman to deliver alone in order to avoid offence. (2) Supervision. It permits the first direction and does nothing for the second: a third party’s presence changes nothing of what a child will become. (3) Pay. It is decisive in the second, and does not appear in the first.
A detail of drafting confirms the reading: the Mehaber writes neither of the two reasons. The Tur writes the first — מפני שחשודה על שפיכות דמים — and the Beit Yosef reports the second from the mishnah. The seif keeps only conditions and permissions, with no motive: it is a text of rules, not of explanations.

עובדת כוכבים לא תיילד לישראלית בינה לבינה ואפילו אם היא מומחית וכן לא תניק לבן ישראל בביתה ואפילו אחרים עומדים על גבה אבל בבית ישראל מותרת ליילד ולהניק אם אחרים עומדים על גבה או יוצאים ונכנסים והוא שלא יניחנו עמה לבדו בלילה:

The seif writes, for delivery, בינה לבינה; and for nursing, בביתה. Two formulas for two acts: should one infer two regimes?

Kashya Read literally, delivery would require only the presence of others, and nursing only the place. Yet the end of the seif joins both for both: אבל בבית ישראל מותרת ליילד ולהניק אם אחרים עומדים על גבה.

The Taz’s answer: both conditions hold for both acts His answer is a remark of fact, not of law: if the seif does not mention the domain for delivery, it is because a woman ordinarily gives birth at home — so the case does not arise. Nursing, however, commonly happens elsewhere, and had to be written.

3. יוצאים ונכנסים — the Taz against the Nekudot HaKesef, and the Beit Yosef’s silence

The seif permits discontinuous presence — coming in and going out. It remains to know how far: does this leniency hold outside a Jewish house too? Two Acharonim answer, and their disagreement bears less on the halakhah than on what the Tosafot meant.

The Tosafot, as the Taz reports them The Tosafot’s case is concrete: a Jewish woman leaves the city and leaves her child with a nurse. What they require then is a Jewish woman who comes and goes — and they add a time limit for the night.

The Taz’s kashya on the Beit Yosef If the Tosafot ease where the Rosh is strict, the Beit Yosef ought to have reported both — and he reported only the Rosh.

Two answers from the Nekudot HaKesef, in one line The first denies the divergence: the Tosafot would already be speaking of a Jewish house. The second grants it and neutralises it: the Beit Yosef follows the Rosh, so he need not report a view he does not adopt.

Chakira: what exactly does “coming and going” guarantee? (א) Effective supervision. Then it must be frequent enough to cover the moment of danger, and the place matters little. (ב) Fear in the one supervised. Then what counts is not coverage but uncertainty — דודאי מרתתא, writes the Rosh in the Beit Yosef — and the domain becomes a factor, since one does not fear the same way at home and in another’s house. The Taz’s position presupposes the second branch; the Tosafot’s, as he reads them, the first.
Nafka mina (1) A child entrusted outside a Jewish house, with frequent visits: permitted on the Taz’s reading of the Tosafot, forbidden per the Rosh and the Beit Yosef. (2) The night: forbidden in every case, and the seif says so separately. (3) Supervision by an indirect means: the chakira decides — useful if fear is what counts, useless if coverage is.

4. מומחית — the Shakh’s צ״ע, and the Pit’hei Teshuvah’s answer

In the next siman an expert physician is permitted because he would not ruin his own reputation. Here an expert midwife remains forbidden. The question is classic, and its answer took three generations to settle.

The Beit Yosef’s answer, taken up by the Taz Stillbirths are frequent: her reputation would therefore not be damaged, and the physician’s reasoning does not apply.

The Shakh’s kashya — twofold First a source: the Yerushalmi expressly places the wise midwife on the same footing as the skilled physician. Then an argument from silence: no decisor wrote that an expert would be forbidden. He concludes with וצ״ע.

The Beit Yaakov’s answer, reported by the Pit’hei Teshuvah He distinguishes two kinds of expertise: one that covers only midwifery, and one that extends to other fields. The first does not protect, since a stillbirth does not dent it; the second does, and that is what the Yerushalmi speaks of. He leans on the Tosafot in Avodah Zarah.

Yesod: it is not competence that protects, but what it has to lose The whole discussion presupposes one principle: safety comes not from skill but from interest. A practitioner is reliable because failure would cost him. From this everything follows: narrow expertise costs nothing in a field where failure is commonplace; broad expertise does. And from this follows the Beit Yaakov’s second addition: an important woman is permitted, for the same reason that an important man may be treated.

Enmity appears three times in the sugya, and is accepted once. The ground of refusal is the same each time — an excuse is available — and it is that ground one must hold, not the conclusion.

Where it permits: delivery for pay The contradiction is raised by the Gemara itself, and Rav Yosef resolves it by enmity.

Yesod: enmity is measured by the refusal, not by the service What the sugya establishes is not that rendering service avoids hostility, but that refusing creates it — and only when the refusal looks like a refusal. Where a credible excuse is available, there is nothing to fear, and the lever falls. That is exactly what the Rashba draws for the non-professional midwife: she can say she is not skilled.

The Chatam Sofer’s shift: when the excuse becomes impossible The Pit’hei Teshuvah reports a case where the profession is regulated by the authorities. The Chatam Sofer permits there, and his reason deserves to be seen: it is not enmity — since other practitioners exist, refusal would give no offence. So it is the Rashba’s reasoning inverted: where the excuse holds, one permits not despite the absence of enmity, but because the underlying fear has fallen away.

Nafka mina — and they are grave (1) Shabbat: forbidden by the seif, and the Chatam Sofer distinguishes what in a delivery involves no forbidden labour. (2) Cutting the cord: a labour forbidden by the Torah, to be entrusted in his view to a non-Jewish woman present. (3) A danger to life arising from the enmity itself: he then permits more. These three lines are not read as a ruling on a page — they are put to a Rav.

The seif gives no reason. That is not an oversight: it is the Shulchan Arukh’s way, writing rules and leaving the motives to the Beit Yosef. But the consequence is real — a reader with only the seif could not know why enmity permits in one case and not in the other.

A difference of wording between the Rambam and the seif The Rambam writes ומיניקה את בנה ברשותה — the domain, and nothing else. The seif requires the domain and the presence. The Beit Yosef shows where the second requirement comes from: from the Rosh, and from a reading of the mishnah that makes the first clause carry what the second does not say. The Taz systematises it; the Nekudot HaKesef defend it.
Closing nafka mina And a last one, which the siman does not raise but the Beit Yosef notes: what if the nurse gives the child what he should not eat? The Beit Yosef reports three views, and this is a question distinct from the siman — it belongs to education and dietary prohibitions, not to fear for life.
