Siman 155 runs to three seifim — the Shulchan Arukh says so itself: ובו ג׳ סעיפים. It is not about medicine: it is about three relations a sick person may form with whatever heals him. In whose hands does he place his body? By what means does he consent to be treated? And of what substance is the remedy made? The first two questions belong to the laws of mortal danger; the third, to the laws of what the Torah forbids.

1. The text of the Mehaber — the three seifim

The siman reads in three movements, each answering a different question. (1) From whom does one accept treatment, and how far does the fear reach? (2) May a remedy be taken from what belongs to an idol? (3) May a remedy be made of what the Torah forbids?

Seif 1 — the healer: danger, expertise, payment, incantation

אם מותר להתרפאות מעובד כוכבים. ובו ג׳ סעיפים:

Title of the siman: whether one may be healed by a non-Jew; and it contains three seifim.

Every wound and every illness that carries danger — those for which one desecrates the Sabbath — one is not healed of them by a non-Jew who is not an expert recognised by the public (gloss: and all those who let blood are experts as regards bloodletting) (Tur and Beit Yosef in the name of Tosafot, the Rosh, the Hagahot Maimoniyot chapter 9, Rabbenu Yeruham, the Agudah and the Semag)for we fear bloodshed.

And even if it is doubtful whether he will live or die, one is not healed by him; but if he will certainly die, one is healed by him — for in this we take no account of a brief span of life.

And if he says “such a drug is good” or “such a drug is bad”, one may rely on him — provided one does not take that drug from his hand.

Gloss: (and some say that all this is forbidden only when the non-Jew acts for nothing; but if he acts for a fee it is permitted in every case, for he fears the loss of his wage) (Hagahot Ashri, chapter Ein Ma’amidin, from the Or Zarua) (and so the custom is to be lenient).

But if he comes to heal him by an incantation, it is permitted — provided he does not know that it mentions the name of idols; but if he knows that it mentions the name of idols, it is forbidden even if he knows he will certainly die. And if he is an apikoros, even a plain incantation is forbidden, for he certainly mentions the name of idols.

Seif 1 has not one subject but four. First when the question arises — a wound grave enough that one desecrates the Sabbath for it; then from whom one may nevertheless receive treatment — the publicly recognised expert; then how far the stringency reaches — as far as the doubt between life and death, and no further; then what remains permitted in every case — the advice, not the drug.

Seif 2 — the remedy taken from the water or the tree of an idol

עובד כוכבים שבא לרפאות את ישראל ואמר ליה קח ממים אלו או מאילן פלוני שהם של אלילים אסור אבל אם אמר לו קח ממים אלו או מאילן זה ולא הזכיר לו שם אלילי׳ אעפ״י שאין מאותם מים ואותו אילן מצויים אלא של אלילים מותר כיון שלא תלה הרפואה במה שהם אלילים ויש אוסרים גם בזה אפילו באומר לו הבא עלים סתם והביא לו מעצי אשרה:
A non-Jew who comes to heal a Jew and says to him “take of these waters” or “of such a tree”, which are of idols — it is forbidden. But if he said to him “take of these waters” or “of this tree” and did not mention the name of idols to him — even though no such waters and no such tree are to be found except those of idols — it is permitted, since he did not make the cure depend on their being of idols. And some forbid in this case too, even where he says to him “bring leaves” without more, and he brought him from the wood of an asherah.
Seif 2 no longer speaks of the healer but of the remedy. The non-Jew here is any non-Jew; what decides is what he says. If he names the idol, the Jew would be conceding that it heals. If he does not name it, water remains water — even if all the water in the region belongs to a temple.

Seif 3 — being healed with what the Torah forbids

With the other prohibitions, one is healed, in a place of danger, even in the manner of their enjoyment; and where there is no danger, in the manner of their enjoyment it is forbidden, and not in the manner of their enjoyment it is permitted — except for kilei hakerem and meat cooked in milk, which are forbidden even not in the manner of their enjoyment, save in a place of danger.

Gloss: and see above at siman 123. Some say that all prohibitions of benefit that are of rabbinic origin — it is permitted to be healed by them, even for a sick person who is not in danger (Ran, chapter Kol Sha’a, in the name of “some say”, and Rivash siman 45). And even libation wine, nowadays, it is permitted to be healed with it and to make a bath of it, although that is in the manner of its enjoyment; provided he does not eat or drink the forbidden thing, since there is no danger. And all the more is it permitted to sprinkle wine on a fire, which is permitted even to a healthy man, for smell is nothing (Arukh, klal 39). It is permitted to burn a sheretz or any other forbidden thing and to eat it as a remedy, even for a sick person not in danger — except the wood of idolatry (Arukh, klal 32). And every sick person who is fed a forbidden thing — the remedy must be known, or attested by an expert (ibid., klal 59). And one permits no forbidden thing to a sick person if he can effect the cure with a permitted thing as with the forbidden one, even though he must wait a little before finding the permitted one, since there is no danger in the matter (Beit Yosef and a responsum of the Rashba, end of siman 134).
Seif 3 changes chapter. It is no longer about a non-Jew at all, but about the substance of the remedy. Two axes govern it: is there danger or not; and is the substance taken in the manner of its enjoyment or not. Only two prohibitions escape this grid — kilei hakerem and meat cooked in milk.

2. Context — the mishnah, the sugya, the Tur and the Beit Yosef

Seif 1 comes from a mishnah of a few words and from the sugya that tries, three times, to say what it means. The mishnah distinguishes two kinds of treatment; the gemara asks which.

summary : one is healed by them with a healing of property, but not a healing of persons. — What is a healing of property and what is a healing of persons? If we say: healing of property is for a fee and healing of persons is for free — let the mishnah teach “one is healed by them for a fee but not for free”! Rather: healing of property is a matter without danger, healing of persons a matter that has danger. But Rav Yehudah said: even for the prick of the lancet we are not healed by them! Rather: healing of property is his animal, healing of persons his own body.
The sugya closes on a difficulty it does not resolve: the second answer — “a matter that has danger” — is set aside by Rav Yehudah, and the third replaces it. The Beit Yosef will show that Rabbenu Tam is not satisfied with this and holds both together, distinguishing three states rather than two. From this the Shakh’s dispute (ס״ק א) is born.

Two statements then fix the two limits which the seif repeats almost word for word — the expert, and the dying man:

summary : … with an expert physician, for when Rav Dimi came he said in the name of Rabbi Yochanan: if he was an expert recognised by the public, it is permitted. — Rabbah bar bar Chanah said in the name of Rabbi Yochanan: any wound for which one desecrates the Sabbath, one is not healed of it by them. — Doubtful whether he will live, doubtful whether he will die: one is not healed by them; certain to die: one is healed by them. — But there is a brief span of life here! — Of a brief span of life we take no account. — Objection: a man should neither deal nor trade with the minim, and one is not healed by them, even for a brief span of life.
The gemara thus sets two kinds of dying man against each other: the ordinary non-Jew, whose treatment is accepted because there is nothing left to lose; and the min, whose treatment is not accepted, because what is at stake there is not life. It is this second line that the seif takes up in ואם הוא אפיקורוס אפי׳ סתם לחש אסור שודאי מזכיר שם אלילים.

Seif 3, however, comes not from Avodah Zarah but from Pesachim, where the rule of the forbidden remedy is set out in two stages — the exception of idolatry, then the measure of what is “in the manner of enjoyment”:

« אָמַר רַבִּי יַעֲקֹב אָמַר רַבִּי יוֹחָנָן: בַּכֹּל מִתְרַפְּאִין, חוּץ מֵעֲצֵי אֲשֵׁירָה » (פסחים כ״ה ע״א)
« כִּי אֲתָא רָבִין אָמַר רַבִּי יוֹחָנָן: בַּכֹּל מִתְרַפְּאִין, חוּץ מֵעֲבוֹדָה זָרָה וְגִילּוּי עֲרָיוֹת » (פסחים כ״ה ע״א)

« אֲמַר לֵיהּ: הַאי אִישָּׁתָא צְמִירְתָּא נָמֵי כִּשְׁעַת הַסַּכָּנָה דָּמְיָא. אִיכָּא דְאָמְרִי, אֲמַר לֵיהּ: מִידֵּי דֶּרֶךְ הֲנָאָה קָא עָבֵידְנָא » (פסחים כ״ה ע״ב)
summary : Rabbi Yaakov said in the name of Rabbi Yochanan: one is healed with everything, except the wood of an asherah. What is the case? If there is danger — even the wood of an asherah should be allowed! and if there is no danger — even all the prohibitions of the Torah should not be! — When Ravin came he said in the name of Rabbi Yochanan: one is healed with everything except idolatry and forbidden unions [and bloodshed]. — Mar bar Rav Ashi found Ravina rubbing his daughter with orlah shoots. He said to him: say that the Sages permitted in a time of danger — outside a time of danger, did they say so? He answered: this burning fever too is like a time of danger; and some say he answered: am I doing anything in the manner of its enjoyment?

The Tur gives the rule of seif 1 with its reason, and adds two cases the Mehaber will not reproduce — the man close to the government, and the envious or hostile non-Jew:

summary : every wound and illness that carries danger, for which one desecrates the Sabbath, one is not healed by them: since they are suspected of bloodshed, he will certainly kill him without concern, for he can plead that the man was mortally ill. And likewise in a matter with neither illness nor danger, like the prick of the lancet, where a Jew let his blood and the place hurts him — he shall not be healed by him… The Rif permitted in this, and my lord and father the Rosh wrote like the first view. And in an illness whose cure requires a craft and which carries no danger, all agree one is healed by them. And all this where he is not an expert recognised by the public; but if he is, one is healed by him in every matter, for he will not damage his own standing. And a man close to the government may be healed by anyone, even by one who is not an expert, for that one fears to do him harm; and if the non-Jews are envious of him, or if he is his enemy, even one close to the government is forbidden, for the non-Jew gives his own life to harm him. And [as to the water and the tree] it is only where he tells him he has no cure except in these waters or from this tree, for then it appears that the Jew grants the idol a reality.

The Beit Yosef sets out Rabbenu Tam’s resolution — the one from which the whole of the Shakh’s discussion flows — then locates the rule in the Rambam, and reports the reading of the Hagahot Ashri on payment:

summary : Tosafot, the Rosh and the Ran wrote that Rabbenu Tam objected to this and concluded by maintaining both, for there are three cases: an illness with danger — one is not healed by them, since he does not fear and might damage his own standing; an illness without danger — one is healed by them, for were he to die they would attribute it to his ignorance and his practice would suffer; but Rav Yehudah speaks of one who is not ill at all, merely uncomfortable, like the prick of the lancet, and in such a case one is not healed by them. And so the Rambam ruled in the twelfth chapter of the laws of the murderer and the preservation of life. And it is written in the Hagahot Ashri: it seems to me that all this is said where he acts for nothing, but for a fee everything is permitted, for he fears the loss of his wage and will not kill him. And the Ramban wrote that in any case he shall not take that drug from him. And in the chapter Kol Sha’a it is said: one is healed with everything in a place of danger, except the wood of an asherah, and it is explained there that the other prohibitions of benefit are permitted even where there is no danger, provided he benefits from them otherwise than in the manner of their enjoyment. And the Rosh wrote that from the minim, even one who is an expert recognised by the public, one is not healed, even for a brief span of life, because heresy draws a man after it; but if the non-Jew comes to heal him with a plain incantation and he does not know whether he will mention an idol or not, it is permitted, and so it is in the Yerushalmi.

  1. Where does the prohibition of seif 1 come from? From a mishnah in Avodah Zarah and three statements of Rabbi Yochanan — the expert, the Sabbath-grade wound, and the dying man.
  2. What is feared? The Tur says it plainly: they are suspected of bloodshed, and a dying patient hands the killer a ready-made explanation.
  3. What nevertheless protects? The craft. A publicly recognised expert does not destroy his own standing; it is a calculation of interest, not of goodwill.
  4. Where does seif 3 come from? From Pesachim: one is healed with everything except idolatry, forbidden unions and bloodshed — and Ravina’s episode adds the measure of “the manner of enjoyment”.

3. The key concepts of this siman

מוּמְחֶה לָרַבִּיםthe expert recognised by the public. The one quality that lifts the prohibition of seif 1. The Shakh gives it the shortest definition in the siman — he is a craftsman, and a craftsman does not ruin his craft.
« שאינו מומחה לרבים. אבל מומחה דהיינו אומן לא מרע אומנתיה » (ש״ך יו״ד קנ״ה ס״ק ג)
רִיבְדָּא דְּכוּסִילְתָּאthe prick of the lancet. The lightest wound there is: what remains after bloodletting. It serves Rav Yehudah as a limiting case and, for Rabbenu Tam, as a third state — neither a dangerous illness nor an illness at all.
« וְהָאָמַר רַב יְהוּדָה: אֲפִילּוּ רִיבְדָּא דְּכוּסִילְתָּא לָא מִתַּסֵּינַן מִינַּיְיהו » (עבודה זרה כ״ז ע״א)
לֹא מַרַע אוּמָּנוּתֵיהּhe does not damage his own craft. The mainspring of the whole permission. It is not that the healer is good, but that he has something to lose. The Shakh (ס״ק א) shows the reverse: what happens when he has nothing to lose — the death will be put down to his time having come, or to enmity.

חַיֵּי שָׁעָהa brief span of life. The time left to a dying man. The gemara takes no account of it here — and the Taz (ס״ק ב) explains why it does elsewhere: in both cases one acts for his benefit.
« דלחיי שעה לא חיישינן בהא » (שו״ע יו״ד קנ״ה:א)
לַחַשׁthe incantation. A treatment by speech, not by substance. The Shakh (ס״ק ז) gives the reason in four words: there is no danger in it. What remains at stake, therefore, is not the body but what is named.
« בלחש מותר. שאין בו סכנה » (ש״ך יו״ד קנ״ה ס״ק ז)
אֶפִּיקוֹרוֹסthe apikoros. The one of whom the Rosh says, in the Shakh (ס״ק ח), that he is forbidden even as a recognised expert — because what is feared from him is not that he will kill but that he will draw one after him.

עֲצֵי אֲשֵׁירָהthe wood of an asherah. The one substance the gemara in Pesachim removes from “one is healed with everything” — and the Pit’hei Teshuva uses it as a yardstick: what holds of the asherah holds of any coercion to transgress.

סְתָם יֵינָםthe wine of a non-Jew. The Shakh (ס״ק ט״ז) removes the difficulty by a reason of fact, not of law: the non-Jews of his time are not idolaters, and the stringency of the Rashba and the Rivash addresses the regime of the Talmud.

The two tables are not read the same way. The first is governed by a calculation: what does the healer stand to lose? The second by a qualification: what is being done with the substance? That is why payment changes everything in the first and nothing in the second.

5. The Shakh, the Taz, the Baer Hetev and the Pit’hei Teshuva

Three seifim, and forty-two commentary entries: the Shakh has twenty, the Baer Hetev ten, the Pit’hei Teshuva nine, the Taz three. The disproportion is the most telling fact about the siman: a short text on a matter where people die.

The Shakh — twenty entries

That the Talmud speaks without distinction? On the contrary: the Talmud itself asks what a healing of property and a healing of persons are, and considers “for a fee / for free”; Rashi explains there that he does not kill because he fears the loss of his wage — proof that for the Talmud, for a fee, it is permitted. We are not dealing here with a non-Jew who hates him, but with any non-Jew: it is because they are suspected of bloodshed that it is forbidden, and whoever acts for a fee does not lose his wage. But it is plain, in our case, that it is forbidden to hand her over to them: first because this physician is suspected of bloodshed and does not damage his craft here — he will say she came with death already in view; and second because, in insisting that she not eat her own kosher meat, their intent is to make her transgress her religion, and any coercion to transgress is as idolatry itself, where one is killed rather than transgress; and just as one is not healed with the wood of an asherah, even by a proven remedy, so one is not healed by transgressing one’s religion.

ס״ק ב — in what must the physician be expert?

(ז) the Shemesh Tzedakah permitted, to a man with heart disease, a preparation containing vinegar made from a non-Jew’s wine — for several reasons, among them that heart disease may be a danger and that the vinegar is foul-tasting. (ח) Rabbi Akiva Eiger raises a doubt about a sick person not in danger who needed, on the Sabbath, fruit that had fallen that day. (ט) and see further the Emunat Shmuel and the Sha’arei Teshuva.
Four sets of commentaries, and one line runs through them all: what the healer stands to lose. The Shakh follows it through the sugya, the Baer Hetev abridges it, and the Chatam Sofer, two centuries later, uses it to say why that hospital must not receive that patient — for there, precisely, the physician has nothing to lose.

6. The Rambam — in which treatises are these rules codified?

The question is not one of curiosity: it says what each seif is. One would readily look for this siman in the laws of forbidden foods, since it deals with eating what is forbidden. It is not there. The Rambam distributes it among three treatises, and each gives the corresponding seif its true character.

Seif 1 — הלכות רוצח ושמירת נפש: the laws of the murderer and the preservation of life

The Beit Yosef refers to it expressly, and it is the only treatise reference he gives for this seif:

summary : it is forbidden to take a cure from a non-Jew, unless they have despaired of his living; and it is forbidden to be healed by an apikoros, even though they have despaired of him, lest one be drawn after him. And it is permitted to take from a non-Jew a cure for an animal, or for an external wound of the body, such as a poultice or a plaster; but if it were a dangerous wound it is forbidden to take from him. And any wound for which one desecrates the Sabbath, one is not healed of it by them.
The classification is the thesis. This is not a rule of kashrut, nor a rule of association: it is a rule of preserving life, from the same treatise as the duty to build a parapet on one’s roof. The Rambam adds two things the Mehaber does not reproduce: the permission for an animal and for an external wound — which is exactly the ריפוי ממון of the mishnah.

Seif 3 — הלכות יסודי התורה: the laws of the foundations of the Torah

Seif 3 reads almost word for word in the Rambam — but in chapter 5 of the foundations of the Torah, the chapter of יהרג ואל יעבור. It is therefore not a chapter about what one eats: it is a chapter about what one dies for. The Pit’hei Teshuva (ס״ק ו) himself refers there through the Mishneh LaMelech.

The incantation — הלכות עבודה זרה וחוקות הגויים: the laws of foreign worship

There remains the incantation, which seif 1 treats in three lines. It is neither a question of life nor a question of food: it is a question of foreign worship, and that is where the Rambam speaks of it — for a snakebite, and without granting it any efficacy:

Three seifim, three treatises: הלכות רוצח ושמירת נפש for the healer, הלכות יסודי התורה for the substance, הלכות עבודה זרה וחוקות הגויים for the incantation. And none of the three is הלכות מאכלות אסורות — what this siman governs is never kashrut.

7. Contemporary practical cases

Case 1 — A non-Jewish physician today

The seif removes the prohibition as soon as the healer is a מומחה לרבים, and the Shakh (ס״ק ג) defines it — a craftsman does not ruin his craft. The Rama adds two things: that practitioners of a given procedure are held expert in it, and that where there is payment בכל ענין מותר, וכן נהגו להקל. The Shakh (ס״ק ו) defends this last reading against the Maharshal and the Bach, and the Baer Hetev (ס״ק ג) records that he so concludes. But the characterisation of a real situation — a practitioner, a country, a health system — is never supplied by the text. A question for a Rav.

Case 2 — Advice on a treatment, given by the one who sells it

This is the finest distinction in seif 1, and it crosses the centuries without a wrinkle: the advice is reliable, the purchase is not. The Shakh (ס״ק ד) gives the reason for the first — he fears that others may be asked too — and (ס״ק ה) for the second: to make a sale a man lies, or worse. The Baer Hetev (ס״ק ב) joins the two in a single line.

Case 3 — A “treatment” by formula, prayer or invocation

The seif permits a plain incantation, because it exposes the body to nothing (Shakh ס״ק ז) — and forbids it as soon as one knows it names an idol, even if one knows one will die without it. This is the harshest clause in the siman, and it exactly reverses the rule of the dying man: where the body risks nothing, the stringency returns. The Rama adds that one does not learn the incantation either. The Rambam, for his part, treats the permitted incantation in the laws of foreign worship, and stresses that it avails nothing — it was permitted only to settle the patient’s mind.

Case 4 — A medicine containing a forbidden substance

The whole of seif 3 is here, and it reads in two successive questions, never in one. First: is there danger? If so, one is healed with all prohibitions, except the three the Rambam names. Second: where there is no danger, is the substance taken in the manner of its enjoyment? The Shakh (ס״ק י״ג) specifies that the permission of “not in the manner of enjoyment” holds only for the need of a cure, and only for prohibitions of benefit; and the Pit’hei Teshuva (ס״ק ו) reports the Mishneh LaMelech’s open question — is a food good in itself, swallowed without pleasure, “not in the manner of its enjoyment”? It was left in doubt.

Case 5 — The same remedy exists in a permitted form

The Rama’s gloss here closes every permission it has just opened, and it is the most operative clause of the siman for a reader today: אין מתירין שום דבר איסור לחולה אם יוכל לעשות הרפואה בהיתר — and that even if one must wait a little, since there is no danger in the matter. The final condition matters as much as the rule: it falls away where there is danger.

Case 6 — A patient who refuses to have a prohibition transgressed for him

The Pit’hei Teshuva (ס״ק ד) reports the Radbaz’s answer, and it is blunt: there is no piety in this; the patient is guilty of his own life, and he is fed by force. The same ס״ק gives the reverse rule for the patient’s own word — when it prevails over the physician’s and when it yields. These are the two texts in the siman that speak directly at the bedside.
None of these six cases is decided on a page. This siman touches health and sometimes life, and the Shulchan Arukh itself refers to an expert: צריכים שתהא הרפואה ידועה או על פי מומחה. What is read here are the sources; the decision is asked of a Rav — and the diagnosis, of a physician.

8. Summary of Siman 155

In one sentence: this siman never asks whether a thing heals, but always what one accepts in order to be healed — a man of whom one does not know what he has to lose, a speech of which one does not know what it names, a substance of which one knows what it is; and it answers each time with the same division: what puts life at stake yields before life, what puts faith at stake does not yield.
