1. The axiom: three questions, three regimes
The starting point:
Three seifim, and none is measured as the other two are. Seif 1 is settled by a calculation — what does the healer stand to lose? Seif 2 by a speech — did he name the idol? Seif 3 by a qualification — is there danger, and is the substance taken in the manner of its enjoyment?
Hence the axiom: this siman never asks whether a thing heals, it asks what one accepts in order to be healed.
The mishnah, and the measure the seif retains:

💡 The marker: the word of seif 1 is not רפואה but מומחה; that of seif 2 is not מים but הזכיר; that of seif 3 is not איסור but הנאתן.
2. The 3 reflex questions
1. What is at issue — a man, a speech, or a substance? The healer is seif 1. What he points to as the remedy is seif 2. What the remedy is made of is seif 3. The three questions never mix.

2. Is there danger? In seif 1, danger triggers the stringency — it is the Sabbath-grade wound. In seif 3, it lifts it. The same word works in reverse in the two seifim, and that is the siman’s chief trap.

3. Is there a permitted route? The Rama’s gloss asks this last and it governs everything: nothing forbidden is permitted if the cure can be effected with a permitted thing — so long as there is no danger.

4. The healer: the calculation of what he stands to lose

The Shakh (ס״ק א) gives both camps, and the Baer Hetev (ס״ק א) sums them up. The Rama, by his gloss on bloodletting, removes almost all the ground from the dispute — but not its principle.
5. The brief span of life: the doubt stricter than the certainty
Do not read this rule as contempt for the life that remains. Tosafot, in the Taz, ground it on the opposite: here and there עבדינן לטובתו, we act for his benefit. In Yoma, doing nothing kills him; here, abstaining kills him. We abandon the certain death and take the doubt.
And the proof that it is no contempt: the min, where the rule reverses.
6. Payment: the Rama, the Maharshal, and the Shakh’s defence

And the incantation, in seif 1, is settled by the same criterion read backwards: it is because one does not know what is named that the ordinary case is permitted.

The Mishneh LaMelech leaves a question open — is a food good in itself, swallowed without pleasure, “outside the manner of enjoyment”? He does not decide. The Noda BiYehudah settles the conduct: where there is no danger, one does not swallow a Torah prohibition as a cure.
9. Rabbinic prohibitions and wine nowadays
What the gloss opens, and what it closes
It opens: rabbinic prohibitions of benefit may be used for healing even without danger, and even in the manner of enjoyment. It closes three times: the mouth stays shut (ובלבד שלא יאכל וישתה האיסור), the remedy must be known or attested by an expert, and the permitted route is sought first. The Shakh (ס״ק י״ז) adds a fourth limit: the bath is for a sick person, not for a healthy one.
10. Golden rules, mnemonic, pitfalls and flash-card
The 5 golden rules
- “Danger” does not mean the same thing in seifim 1 and 3. In seif 1 it aggravates; in seif 3 it eases.
- What protects is not goodness but interest. Expertise, payment, reputation — three forms of one idea.
- The doubt is stricter than the certainty, because the rule follows what benefits the patient, not the intensity of the risk.
- In seif 2 what decides is speech — and the Bach, through the Shakh, adds what it lets be understood.
- Nothing forbidden is permitted while a permitted route remains open, and while there is no danger. That is the gloss’s last line, and it governs the whole siman.
Mnemonic — the word רְפוּאָה
ר — רוֹפֵא מוּמְחֶה לָרַבִּים : the recognised expert is outside the prohibition
פ — פַּרְנָסָה : what he has to lose — the wage, the reputation
ו — וַדַּאי מֵת מִתְרַפְּאִין : and the doubt, no — the rule follows what benefits the patient
א — אֱלִילִים : did he name the idol, or let it be understood?
ה — הֲנָאָתָן : in the manner of enjoyment, or not
The 4 classic pitfalls
- Thinking the siman is about kashrut. The Rambam places it in the laws of preserving life and in the foundations of the Torah, never in forbidden foods.
- Thinking certain death is treated more strictly than doubt. It is the reverse, and the Taz (ס״ק ב) explains why.
- Thinking “outside the manner of enjoyment” permits everything. The Shakh (ס״ק י״ג) sets two limits: only for a cure, and only for prohibitions of benefit.
- Forgetting the gloss’s last line. Every permission of seif 3 gives way before the existence of a permitted route — so long as there is no danger.
