1. The axiom: two dangers in a single siman

The starting point:

This siman stands among the simanim of idolatry, and its first two seifim do not belong to them. What they guard is life — a razor held by a stranger. Only the third touches on worship: the forelock and the tonsure.

Hence the axiom: ask first which danger is at stake. If it is life, the ruling turns on what the other man believes — a crowded place, an important man. If it is worship, it turns on what the act is — three fingers, and the hand withdraws.

The reason for the first two seifim is not in the Mehaber; it is in the Tur and in the Rambam:

« אין מסתפרין מהעכו״ם שמא יהרגנו » (טור יו״ד קנ״ו)
« וְאָסוּר לְהִסְתַּפֵּר מֵהֶן בִּרְשׁוּת הַיָּחִיד שֶׁמָּא יַהַרְגֶנּוּ » (רמב״ם הלכות רוצח ושמירת נפש פרק י״ב הלכה י״א)
💡 The marker: neither seif 1 nor seif 2 contains the word עבודת כוכבים as its reason. The only reason written there is fear, and the only reason in seif 3 is worship.

2. The 3 reflex questions

1. Who cuts, and who is cut? A non-Jew cutting a Jew: seifim 1 and 2, danger. A Jew cutting a non-Jew: seif 3, worship.
2. Are we alone? In a crowded place, permitted (seif 1). One to one, no — unless he takes you for an important man. And being alone is already forbidden elsewhere, says the Shach, under the yichud of siman 153.
3. Razor or scissors? All of the Rama’s stringency bears on the razor. With scissors, injury is not common: the Shach, the Taz and the Baer Hetev all three write so.

What to retain — the halakhah is like the Sages: in a public place it is permitted. The stringency the Rama reports goes back to R. Meir; it comes from Tosafot, and the Beit Yosef had already written that they did not write it as a ruling but as a good practice.

⚠️ The pitfall — thinking the mirror is a condition added to the public place. The Beit Yosef writes the opposite: it is required only one to one, and it serves only to produce what real standing would produce by itself.

The consequence — the condition אם יש עמו אחר is no requirement of our seif: it is a reminder of the prohibition of being alone with a non-Jew, which holds in any case. The Taz, who does not write it, therefore permits nothing further.

7. The Rama’s gloss on seif 2: the Ran and the Semag

Two clauses, two different criteria, and this is deliberate.

« והר״ן חילק בענין אחר דבמקום שרגילין האנשים להסתכל במראה כמו הנשים מותר דתו ליכא משום לא ילבש גבר שמלת אשה » (בית יוסף יו״ד קנ״ו)
« ומיהו אינו אסור כ״א להתנאות דעבר משום לא ילבש גבר אבל להסתפר ולגלח ולראות במראה שלא יחבל בעצמו או משום מיחוש עינים ודאי מותר » (תוספות עבודה זרה כ״ט ע״א)

What to retain — the Rama’s first clause depends on the custom of the place (the Ran): where men use a mirror too, there is no longer a woman’s adornment. The second depends on the purpose of the act (the Semag): even where people are stringent, healing and cleaning the face are permitted. And the Rama concludes: וכן נהגו.

8. The 5 golden rules

  1. Two subjects, one siman. Seifim 1 and 2: guarding life. Seif 3: worship. The Rambam places them in two different treatises.
  2. The halakhah is like the Sages. In a crowded place it is permitted — ונהגו להקל כסברא ראשונה.
  3. All the Rama’s stringency lies in the word בתער. On scissors the apparatus is unanimous.
  4. Being one to one has two locks. Seif 1, and the yichud of siman 153 which the Shach recalls.
  5. The mirror produces an appearance. It adds no condition; it stands in for standing where standing is lacking.

9. Mnemonic — the three words of the siman

Three seifim, three words — in the order of the siman:

סַכָּנָה · מַרְאָה · בְּלוֹרִית

The danger, the mirror, the forelock. The first governs seif 1, the second seif 2, the third seif 3 — and each has its own measure: the crowd, the custom of the place, three fingers.

10. The 4 classic pitfalls, and the final flash card

  1. Thinking the siman belongs to the laws of idolatry. Its first two seifim belong to the guarding of life; the Rambam places them among the laws of homicide.
  2. Thinking the Rama’s stringency covers every haircut. It covers the razor, and nothing else.
  3. Thinking the Taz permits scissors one to one because he does not state the third-party condition. That condition comes from siman 153, which the Taz had no need to repeat.
  4. Thinking the lenient practice rests on the barber’s wage. The Shach rejects this: the Rama wrote כסברא ראשונה, and the first opinion speaks of a crowded place.
