How to read this level. This is the gravest siman in this section, and the only one where this level never concludes. Every statement here is anchored in the text of the Shulchan Arukh, in a named nosei kelim, or in a verifiable posek. On Yoreh De’ah there is no Mishnah Berurah — it comments only on Orach Chaim — and no Shulchan Arukh HaRav: the Alter Rebbe did not write Yoreh De’ah, and his name will therefore not appear here. The Nekudot HaKesef write nothing on this siman. The Arukh HaShulchan is not cited: his text on this siman is not accessible to us, and one does not cite what one cannot verify. There remain the Shakh (19 ס״ק), the Taz (11 ס״ק), the Ba’er Hetev (15 ס״ק) and the Pit’hei Teshuva (18 ס״ק). No line of this page is a practical instruction. The questions of this siman go to a Rav; where a life is at stake, they go to the authorities and emergency services as well.
Any practical reading of this siman begins with one question: does the case fall under the general regime or under the regime of the three transgressions. The two share no parameter, and carrying a leniency from one to the other is the error the nosei kelim correct most often.

And lema’aseh — ask your Rav. Knowing on which side of this line a real situation falls is not an act of reading: it is a qualification, and it belongs to the Rav. This page does not perform it.

And lema’aseh — ask your Rav. The text is given in full so that nothing that follows is read apart from it. It is not by itself a basis for decision: the nosei kelim shift several of its clauses, and the qualification of a real case is not in it.

Three leniencies within one regime: one acted upon without acting, the commandment of לפני עור, and a case the gloss removes from the category of גילוי עריות. Each is in turn bounded by the Shakh — the third holds, at ס״ק י״ד, only of an unmarried woman.

The Shakh follows the Rambam and makes לא תקרבו an actual negative commandment; he at once bounds its reach to what is done דרך חיבת ביאה, and excludes a rabbinic ervah. The Noda BiYehuda sets the same bound in general terms, and points to a tension between two ס״ק of the Shakh.
And lema’aseh — ask your Rav. What is set out here is the state of the positions, not a set of instructions. None of the cases in this paragraph can be recognised from a page: knowing them belongs to a question put to a Rav, and, where life or bodily integrity is at issue, to the competent authorities.

The Ba’er Hetev repeats the Shakh’s formula as it stands: this is the position set out, and it widens the seif’s field considerably.
« ולכאורה נראה דדוקא ישראל ולא גרים כדאיתא במסכת סוטה דף כ״ו ע״א דבני ישראל משמע למעוטי גרים » (פתחי תשובה יו״ד קנ״ז ס״ק ז)
Does the man himself count among the ten? Do women join? Converts? The Pit’hei Teshuva refers to siman 2, inclines and then retracts. On this point the siman supplies no answer.
And lema’aseh — ask your Rav. The count flips the entire regime, and it cannot be determined from a text: it depends on facts — who knows, what will become known, and within what time. The question goes to the Rav.

The dial does not merely lighten: it makes stringency itself forbidden. This is Rabbenu Yeruham’s position, cited by the Shakh and repeated verbatim by the Ba’er Hetev.

The Ba’ch and the Perishah differ, and the Shakh does not decide between them: he adds only that where the hour requires it, all concede.
And lema’aseh — ask your Rav. Establishing what the one who compels wants is a question of fact, and the siman makes both the prohibition and the permission depend on it. This page judges none of it. It goes to the Rav.

The first condition concerns the decree’s target: it must aim at Israel as such. The second concerns its object: a negative commandment. A general measure, or a decree that merely prevents fulfilment, does not meet the definition.

The Shakh and the Taz both reject the Ba’ch’s thesis, but their reasons do not coincide: the Taz rejects it from the Rambam’s text, the Shakh from the rule of doubt in matters of life. The Ba’er Hetev reports both at ס״ק ד.
And lema’aseh — ask your Rav. To qualify a period as a שעת הגזרה is not for a reader, and the siman itself surrounds it with two conditions. This page sets out the conditions; it says of no period that it meets them.

Two different things. The first is a rule: a fifth for a positive commandment. The second is a question left in צ״ע, with an inclination — and an inclination is not a decision.
« ועיין בסוף ספר תיבת גומא חקירה ד׳ שכתב דבל״ת שאין בו מעשה כמו להניח חמץ שלא יבער וכדומה י״ל דאין מחויב לבזבז ממונו » (פתחי תשובה יו״ד קנ״ז ס״ק ד)
« והשיב דודאי חייב ניתן כל ממונו ואפילו היכא דאיכא איסורי דרבנן » (פתחי תשובה יו״ד קנ״ז ס״ק ד)
The Teivat Goma distinguishes a negative commandment that requires an act from one that does not; the Radbaz, at the other end, writes that one gives all his money to find permitted food, down to the rabbinic prohibition. The positions reported do not converge, and the Pit’hei Teshuva does not reduce them.
And lema’aseh — ask your Rav. The proportion — everything, a fifth, nothing — depends on the kind of commandment, on the risk, and on facts the page does not know; and on the limb in danger the question is expressly left open. It goes to the Rav.

The Mehaber writes רשאי; the Rambam, the Beit Yosef, the Ramban and the Ba’ch write מתחייב בנפשו; the Hagahot Ashri leave the question in צ״ע. The Ba’er Hetev sums it up in one line: some decisors disagree.

The only thing the Shakh gives as a conclusion is a way of instructing: according to the case, and according to what one discerns of the man’s intent. The second quotation belongs to a distinct discussion, which the Shakh reports in the name of the Hagahot Semak, and he notes at once that some dispute it.
And lema’aseh — ask your Rav. This is the only question in the siman whose answer is written as a hora’ah — an instruction given to a man, in his case, by one who sees his intent. A page can neither give it nor prepare it. It goes to the Rav.
This is the weightiest matter in the siman, and it is also where the Rambam himself wrote a clause to prevent his ruling from serving as a rule. What follows is a presentation of the positions in their order — nothing more.

The Rama brings both views without deciding between them. The second is the Rambam’s, who follows Resh Lakish against Rabbi Yohanan — and the Beit Yosef notes that this runs against the ordinary principle.

The Taz adopts the restrictive view, and reads the Yerushalmi’s story as a reproach bearing not on the outcome but on the agent. He then extends the stringency: where one does not hand over, one hands over to nothing — not to death, not to suffering, not to a loss of money.

The Rambam writes that one does not instruct so in advance; the Darkhei Moshe, via the Shakh, adds the duty of having exhausted every side; and the Noda BiYehuda, in the concrete case put to him, writes that one must at the very least protest against whoever wishes to hand over with his own hands.

The limb offered for another’s life, the woman already profaned, and the taking in of one who might have to be handed over. On the first the Radbaz answers, on the second the Dagul MeRevava objects, on the third the Beit Yaakov reads the Rambam’s clause in a way that makes it preventive.
And lema’aseh — ask your Rav. On this matter the page stops here and goes no further. The Rambam wrote that one does not instruct so in advance; the Shakh wrote that one must first have exhausted every side; the Taz wrote that the one who decided by himself was rebuked. No real situation is handled from a text, and this one least of all: it goes to a Rav, and, where a life is at stake, to the authorities.

The first bound reverses the permission when the decree bears precisely on the garment. The second is written in the gloss itself: outside a place of danger none of this is permitted — and the Shakh specifies that money is not a place of danger.

The Maharshal reserves the double-meaning phrase for a תלמיד חכם; the Beit Yaakov, via the Pit’hei Teshuva, confines that reservation to one who has the means to pay.

The Mehaber permits; the Rama brings a view that forbids at the hour of the decree; and the Taz observes that according to the view cited at siman 155 there would be ground to forbid here too. This seif is therefore not a simple permission, and it is read together with simanim ק״נ · 150 and קנ״ה · 155.
And lema’aseh — ask your Rav. These two seifim touch on what a man says about himself and on what he does to save himself; the Rama’s gloss attaches to them a condition — a place of danger — that nothing in a page allows one to establish. The question goes to the Rav.
