Seif 1 states a rule, excepts three transgressions from it, then varies the rule by three dials — and applies none of them to the three. Before any discussion of detail one must know what produces this asymmetry, for the whole siman flows from it.
« נִימְנוּ וְגָמְרוּ בַּעֲלִיַּת בֵּית נַתְּזָה בְּלוֹד, כׇּל עֲבֵירוֹת שֶׁבַּתּוֹרָה אִם אוֹמְרִין לָאָדָם ״עֲבוֹר וְאַל תֵּהָרֵג״ – יַעֲבוֹר וְאַל יֵהָרֵג, חוּץ מֵעֲבוֹדָה זָרָה וְגִילּוּי עֲרָיוֹת וּשְׁפִיכוּת דָּמִים » (סנהדרין ע״ד ע״א)
« לֹא שָׁנוּ אֶלָּא שֶׁלֹּא בִּשְׁעַת הַשְּׁמָד, אֲבָל בִּשְׁעַת הַשְּׁמָד, אֲפִילּוּ מִצְוָה קַלָּה – יֵהָרֵג וְאַל יַעֲבוֹר » (סנהדרין ע״ד ע״א)
« אֲפִילּוּ שֶׁלֹּא בִּשְׁעַת הַשְּׁמָד, לֹא אָמְרוּ אֶלָּא בְּצִינְעָא, אֲבָל בְּפַרְהֶסְיָא אֲפִילּוּ מִצְוָה קַלָּה – יֵהָרֵג וְאַל יַעֲבוֹר » (סנהדרין ע״ד ע״א)
The two statements of רב דימי and רבין do not bear on the three transgressions: they bear on the rest. They extend severity to what was not severe, and do not touch what already was.
« דטעמא משום דהני לאו משום חלול השם הוא דאסירי אלא מפני חומר עצמן הלכך בכל ענין אסירי » (בית יוסף יו״ד קנ״ז)
One line, and it explains the whole seif. The three transgressions are forbidden not as a desecration of the Name but for their own gravity.
(א) Compulsion removes imputation: the act remains what it is, but the man does not answer for it, because וחי בהם withdraws the mitzvah from his case. Then what decides is the act’s value for those who see it — hence the weight of the public, the intent and the hour. (ב) Compulsion removes nothing: some acts remain out of reach whatever the circumstances, because their gravity is not measured by what they signify. The siman does not choose between them: it applies (א) to the generality of commandments and (ב) to the three.
Four. Privacy. Decisive on (א), of no effect on (ב). The persecutor’s intent. Likewise. What borders the prohibition. On (א) there is no reason to extend — the desecration lies in the visible gesture; on (ב) the extension is natural, and that is what the Rama’s gloss does. And the exception of לפני עור, which is intelligible only on (ב): it leaves the rule because the gesture is not the act itself, not because it is less seen.

ג. מי שנתחייב מיתה מותר לברוח לבית עבודת כוכבים ולהציל את עצמו (וי״א דבשעת הגזרה אסור (כל בו) ועיין לעיל סימן ק״נ):
The Mehaber writes that one who wishes to let himself be killed where the law tells him to transgress is permitted. The Rambam, cited by the Rama in that very gloss, writes that he answers with his life. The contradiction is frontal, and the Shakh opens with it at the siman’s first ס״ק.
« וְאִם מֵת וְלֹא עָבַר הֲרֵי זֶה מִתְחַיֵּב בְּנַפְשׁו » (רמב״ם הלכות יסודי התורה פרק ה׳ הלכה א)
« כָּל מִי שֶׁנֶּאֱמַר בּוֹ יַעֲבֹר וְאַל יֵהָרֵג וְנֶהֱרַג וְלֹא עָבַר הֲרֵי זֶה מִתְחַיֵּב בְּנַפְשׁו » (רמב״ם הלכות יסודי התורה פרק ה׳ הלכה ד)
The Rambam leaves no room: he writes it at the end of הלכה א׳ and repeats it at the opening of הלכה ד׳.
« והב״ח פסק כהרמב״ם דכל מי שדינו לעבור ואל יהרג ונהרג ולא עבר ה״ז מתחייב בנפשו וכן דעת הב״י » (ש״ך יו״ד קנ״ז ס״ק א)

The Shakh does not merely report: he ranges the authorities. And he adds that the Hagahot Ashri, in the name of the Mahari’ch, leave the question in צ״ע — which forbids treating the word רשאי as settled.
« והיה נראה דבפלוגתא דרבוותא אזלינן לקולא באיסור סכנת נפשות כדאמרינן בעלמא ספק נפשות להקל » (ש״ך יו״ד קנ״ז ס״ק א)
If the great ones differ and a life is at stake, the ordinary rule is clear: one goes to leniency. Here, leniency would be to forbid him to let himself be killed.
« אמנם י״ל הכא דלענין קדוש השם שלא הקפידה התורה על איבוד נפשות מישראל לא ילפינן לה משאר ספיקות דלית בהו משום קידוש השם » (ש״ך יו״ד קנ״ז ס״ק א)
« ונראה דלפי הענין ושרואין אנו כוונתו מורין לו » (ש״ך יו״ד קנ״ז ס״ק א)
The argument from doubt assumes that the Torah always weighs lives the same way. The Terumat HaDeshen answers that in the matter of קידוש השם it does not, so the parallel fails. But his conclusion is not a rule: it refers back to the case and to the man’s intent, as one discerns it.
« אבל אם אינו מכוין אלא להנאת עצמו אסור להחמיר ונקרא חובל בעצמו וצריך לעבור ואל יהרג » (ש״ך יו״ד קנ״ז ס״ק ב)
« דאם הוא אדם גדול וחסיד וירא שמים ורואה שהדור פרוץ בכך רשאי לקדש השם ולמסור עצמו אפילו על מצוה קלה » (ש״ך יו״ד קנ״ז ס״ק ב)
ס״ק ב closes the permission from below and opens it from above. From below: absent an intent of apostasy in the persecutor, letting oneself be killed is not piety. From above: a great man, in a generation loose on that very point, may do so even for a light mitzvah. Neither is a rule of general reach; one is a prohibition, the other an exception of person.
The seif writes “before ten of Israel”; it says neither what “before” requires nor who counts among the ten. The Gemara gives the number, the Shakh strips the word of its material sense, and the Pit’hei Teshuva leaves three questions open.
« אֵין פַּרְהֶסְיָא פְּחוּתָה מֵעֲשָׂרָה בְּנֵי אָדָם » (סנהדרין ע״ד ע״ב)
« אָתְיָא ״תּוֹךְ״ ״תּוֹךְ״ – כְּתִיב הָכָא: ״וְנִקְדַּשְׁתִּי בְּתוֹךְ בְּנֵי יִשְׂרָאֵל״, וּכְתִיב הָתָם: ״הִבָּדְלוּ מִתּוֹךְ הָעֵדָה הַזֹּאת״. מָה לְהַלָּן עֲשָׂרָה וְכוּלְּהוּ יִשְׂרָאֵל, אַף כָּאן עֲשָׂרָה וְכוּלְּהוּ יִשְׂרָאֵל » (סנהדרין ע״ד ע״ב)
The question of רבי ירמיה — nine Jews and one gentile — is settled by the גזרה שוה: ten, and all of Israel.
« דוקא ואין ר״ל בפניהם ממש אלא שיודעין מהעבירה והכי מוכח בש״ס ופוסקים גבי והא אסתר פרהסיא הוה » (ש״ך יו״ד קנ״ז ס״ק ד)
His proof is taken from the sugya itself: the question about Esther assumes her case was a פרהסיא, though no one was present. It is therefore knowledge, not sight, that constitutes the public.
« ולכאורה נראה דדוקא ישראל ולא גרים כדאיתא במסכת סוטה דף כ״ו ע״א דבני ישראל משמע למעוטי גרים » (פתחי תשובה יו״ד קנ״ז ס״ק ז)
« והכא כתיב ונקדשתי בתוך בני ישראל ושמא גם הכא יש איזה ריבוי » (פתחי תשובה יו״ד קנ״ז ס״ק ז)
Does the man himself enter the ten? Do women join, or does בני ישראל exclude them? And converts? On the third he inclines to exclude, then retracts in the same sentence.
The count is not a procedural detail: it decides the entire regime. Below ten, a transgression other than the three is treated as private — and the seif says expressly יעבור ואל יהרג. Above it, the case flips. Hence the weight of the Shakh’s measure: it brings into the count situations in which no one is watching.
The Gemara sets a fact against the rule: Esther. Two amoraim answer, and their answers do not coincide. The siman uses both, at two distinct places in the Rama’s gloss — and the Shakh at ס״ק ט builds a substantial objection upon it.
« וְהָא אֶסְתֵּר פַּרְהֶסְיָא הֲוַאי? אָמַר אַבָּיֵי: אֶסְתֵּר קַרְקַע עוֹלָם הָיְתָה » (סנהדרין ע״ד ע״ב)
« רָבָא אָמַר: הֲנָאַת עַצְמָן שָׁאנֵי » (סנהדרין ע״ד ע״ב)
« גּוֹי דְּאָמַר לֵיהּ לְהַאי יִשְׂרָאֵל, ״קְטוֹל אַסְפַּסְתָּא בְּשַׁבְּתָא וּשְׁדִי לְחֵיוָתָא, וְאִי לָא קָטֵילְנָא לָךְ״ – לִיקְטוֹל וְלָא לִקְטְלֵיהּ. ״שְׁדִי לְנַהְרָא״ – לִיקְטְלֵיהּ וְלָא לִיקְטוֹל. מַאי טַעְמָא? לְעַבּוֹרֵי מִילְּתָא קָא בָּעֵי » (סנהדרין ע״ד ע״ב)
Rava’s answer holds for all transgressions and introduces the dial of intent; Abaye’s holds only for one acted upon. The case of the fodder cut on Shabbat shows Rava’s dial at work: the same act is permitted if it feeds the animals, forbidden if it is to be thrown into the river — for then the sole aim is to make him transgress.

The first clause is Rava’s answer, and it bounds the ordinary transgressions. The second is Abaye’s, and it bounds the three — that is, where Rava’s dial does not operate.

Rabbenu Yeruham confines to privacy the exemption of one acted upon. The Shakh objects that the question of the public belongs to the sugya’s first stage; once the answer of קרקע עולם is given, it holds in public too.
« ואפשר סבירא ליה לרבינו ירוחם דרבא דמשני התם הנאת עצמו שאני פליג אאביי » (ש״ך יו״ד קנ״ז ס״ק ט)
« וגם הרי״ף הביא פירוקא דאביי ודרבא אלמא ס״ל דתרוייהו קושטא נינהו לדינא » (ש״ך יו״ד קנ״ז ס״ק ט)
One could save Rabbenu Yeruham by holding Rava to contradict Abaye. The Shakh answers on formal ground: the Rif brings both answers, so he holds both to be true in law — and so do the Rosh and the Ran.
Two answers to one question are not two views. The sugya may need both because they do not cover the same ground: one removes imputation where there is no act, the other where there is no intent of apostasy. Seif 1 uses them in just that way, at two places with no apparent link.
The seif’s parenthesis — על ישראל לבדם — and the question whether the hour of the decree also cancels the dial of intent. The Ba’ch says yes; the Shakh and the Taz say no, each by a different road.
« וְכָל הַדְּבָרִים הָאֵלּוּ שֶׁלֹּא בִּשְׁעַת הַגְּזֵרָה אֲבָל בִּשְׁעַת הַגְּזֵרָה וְהוּא שֶׁיַּעֲמֹד מֶלֶךְ רָשָׁע כִּנְבוּכַדְנֶצַּר וַחֲבֵרָיו וְיִגְזֹר גְּזֵרָה עַל יִשְׂרָאֵל לְבַטֵּל דָּתָם אוֹ מִצְוָה מִן הַמִּצְוֹת » (רמב״ם הלכות יסודי התורה פרק ה׳ הלכה ג)
The definition already contains the intent: a king who rises to abolish their religion. The Taz seizes on it against the Ba’ch.
« והב״ח פסק דבשעת הגזרה אפי׳ לא מכוון להנאת עצמו יהרג ואל יעבור » (ש״ך יו״ד קנ״ז ס״ק ז)
« אבל אם לא נתכוין אלא להנאתו אפילו בשעת השמד שרי כיון שהוא בשאר מצות כמו שמותר בפרהסיא דפרהסיא ושמד שווין לכל דבר » (ט״ז יו״ד קנ״ז ס״ק ג)
The Ba’ch holds that the hour of the decree is weightier than the public. The Taz holds that they are equivalent in every respect — and that the dial of intent therefore operates in both.
« ובשעת השמד אפי׳ על מנהג בעלמא שנהגו אם באים להעביר עליה יהרג ועל יעבור » (טור יו״ד קנ״ז)
The Tur places the distinction of intent before the clause of the decree and does not repeat it after. The Ba’ch infers that it does not apply there.
« ולא דק דבהדיא כתב הטור עצמו ברמזים פרק בן סורר החילוק הזה גם אשעת שמד » (ט״ז יו״ד קנ״ז ס״ק ג)
« ולכן י״ל דספק נפשות להקל ועיין בפסקי מהרא״י סי׳ ר״ג » (ש״ך יו״ד קנ״ז ס״ק ז)
The Taz answers from the text: the Tur himself writes this distinction elsewhere for the hour of the decree. The Shakh answers from doubt: lives are at issue. The two answers are not equivalent — the Taz’s stands even for one who does not reason from doubt here.
« אבל אם הגזרה היא על כל מדינת מלכותו אע״פ שהישראלים בכלל לאו שעת השמד מיקרי » (ש״ך יו״ד קנ״ז ס״ק ו)
The bound of ס״ק ו is independent of the dispute, and in practice it is the weightiest: it requires that the decree target Israel as such. A general measure that strikes Jews as it strikes everyone is not, in these terms, a שעת השמד.
The Rama’s gloss introduces a distinction neither the Gemara nor the Mehaber had made: that of the positive commandment. It rests on a line of reasoning of the Ran, and the Taz sums it up in one line.
« ודוקא אם רוצים להעבירו במצות לא תעשה אבל אם גזרו גזרה שלא לקיים מצות עשה אין צריך לקיימו ושיהרג » (רמ״א יו״ד קנ״ז:א)
« מיהו אם השעה צריכה לכך ורוצה ליהרג ולקיימו הרשות בידו » (רמ״א יו״ד קנ״ז:א)
The reservation reproduces, for the positive commandment, the same structure as the Mehaber’s word רשאי: the law does not demand it, the permission stands.
« תירץ הר״ן בפרק במה טומנין דלא אמרו יהרג ואל יעבור אלא לעבור על מל״ת אבל לא בגזרו לבטל מ״ע כיון שאינו עובר בידים » (בית יוסף יו״ד קנ״ז)
« דהא גם העובדי כוכבים יכולים לבטלו ממנו כגון שישימוהו בתפיסה וממילא יבטל מההיא מצות עשה » (ט״ז יו״ד קנ״ז ס״ק ד)
The Ran gives two reasons: he does not transgress with his hands, and they can prevent him in any case. The Taz keeps only the second and makes it concrete — prison suffices.
« ואם תאמר היכי אמרינן הכא דאפי׳ אערקתא דמסאנא יהרג ואל יעבור והא אמרי׳ בפרק במה טומנין (שבת מט.) באלישע בעל כנפים שכשראוהו קסדור אחד נטל תפילין מראשו » (בית יוסף יו״ד קנ״ז)
If one dies for a shoe-strap, how did Elisha Baal Kenafayim remove his tefillin before the officer? The distinction of the positive is the answer.
« אבל מצות עשה אפילו מצוה עוברת א״צ לבזבז יותר מחומש כמ״ש הרב בא״ח ס״ס תרנ״ו » (ש״ך יו״ד קנ״ז ס״ק ג)
The same asymmetry recurs, one degree lower, in money: all one has for a negative commandment, a fifth for a positive. The Shakh places this rule at exactly the same point of the seif, and the proportion is no accident: it flows from the same source — in the positive, what is lacking is a fulfilment, not an act committed.
The gloss extends the three transgressions to what borders them, then excepts לפני עור. The Shakh sees in this a decided position in a dispute of Rishonim; the Noda BiYehuda sets the bound of the extension, and points out in passing a tension within the Shakh himself.

Speaking behind a fence is not a forbidden union. Yet the Gemara says he dies rather than that: this is the textual basis of what the Rishonim call אביזרייהו.
« ובודאי שדברים אלו אינם ג״ע ממש אלא שעובר בהן בלא תקרבו לגלות ערוה שהוא לאו דג״ע » (ש״ך יו״ד קנ״ז ס״ק י)

If the act falls under לא תקרבו, that verse must be an actual negative commandment. The Rambam holds it is; the Ramban disputes it. The Shakh decides like the Rambam, and his proof is the story itself.

The Shakh bounds his own ruling twice. First in content: the Rambam speaks only of what is done דרך חיבת ביאה, and he proves it from the amoraim who embraced their daughters. Then in reach: a rabbinic ervah falls outside the rule by all views.

The first point is a bound, and it converges with the Shakh’s second limit. The second is an objection: having decided like the Rambam at ס״ק י, the Shakh cites at ס״ק י״ב the Nimukei Yosef — and the two, writes the Noda BiYehuda, contradict one another.

The exception of לפני עור shows the exact measure of the extension: it bears on what approaches the act, not on what makes it possible for another. The Shakh gives the minimal instance — lending an object under compulsion — and it is not trivial: it separates what I answer for from what another will answer for.
The gloss removes one case from גילוי עריות, and both the Shakh and the Taz close its sides. The discussion is not about the gravity of the act but about the definition of the category — and on it depends, in the end, the very reading of Esther’s story.

By way of licentiousness, the prohibition is an ancient decree; by way of marriage, it comes from לא תתחתן בם. Neither is גילוי עריות in the siman’s sense.

The Taz draws the consequence the sugya imposes: had Esther’s case been that of a married woman, Rava’s answer — that the intent was not apostasy — would have settled nothing, since the three transgressions do not admit that dial.

The converse case is included in the category; and the gloss holds only of an unmarried woman. Rabbenu Tam extended further, but the Shakh writes that this is not the view of all the decisors.

Grant that the converse case is in the category: on what ground? If it is because קנאים פוגעים בו, that presupposes the public, and the Orchot Chayim infers that the regime applies only in public. If it is on the ground of כרת, the Nimukei Yosef infers that it applies even in private.
The mishnah of Terumot speaks of women; the Yerushalmi extends it to men and opens a dispute there. The Rambam rules against the ordinary principle, the Beit Yosef wonders at it, and the Taz, in the longest ס״ק of the siman, offers a reading of the story that accounts both for the ruling and for the clause attached to it.

The two views do not bear on the handing over but on its condition. And the general principle — the halakhah follows Rabbi Yohanan against Resh Lakish — yields the broader view.

The Taz first removes the difficulty he raises against himself: if Elijah withdrew where the mishnah permitted, on what could one ever rely? His answer shifts the fault: it lies not in the outcome but in the agent. From this he derives the Rambam’s clause — ואין מורין להם כן לכתחלה: one does not instruct so, one leaves the matter be.

The Taz adopts the more restrictive view; the Shakh, on the side of the Darkhei Moshe, adds a procedural requirement that is not to be confused with the substantive condition: before even putting the question, one must have exhausted every side.

The siman does not reason here by degrees of gravity: the rule comes from a sevarah — מי יימר דדמא דידך סומק טפי — which admits of no proportion. From this the Taz infers that where one does not hand over, one hands over to nothing: not to death, not to suffering, not even to a loss of money; and he rests it on Rav’s saying, that suffering can be harder than death.
The last two seifim step outside the alternative of seif 1: they no longer ask what one does when there is no choice, but how far one may go so as not to be placed there. Seif 2 does so by speech and dress, seif 3 by place.

The Gemara permits a phrase that, to the hearer, says he serves the fire, and to the speaker something else. The reason given is לאברוחי אריא מיניה.

Two limits cross. The first lies in the motive: danger to life, not money — and that is the closing clause of the Rama’s gloss. The second lies in the person: the Maharshal confines to a תלמיד חכם what the Gemara permits, for fear of laxity.

The Beit Yaakov reads the Maharshal otherwise: his restriction bears only on one who has the means to pay. He adds that if they come to rob him on the road, any man may — for in robbery there is no distinction.

The Rosh, cited by the Taz, separates two things that resemble one another: in the cure, virtue is ascribed to the tree; in the flight, the wall has no virtue, it has thickness.

The Taz sets two cases side by side and runs the line between them. At siman 149 the man goes to the place to get something, and that remains forbidden even at the price of life. Here he does nothing, he removes himself from harm. The difference is not one of degree: it lies between acting and abstaining.
