1. שורש ההיתר — does the permission rest on the duty to sustain?

The siman opens with a permission, and the Tur at once gives its reason: the prohibition of interest is anchored in וחי אחיך עמך, and a non-Jew one is not commanded to sustain. The reason is elegant — and the Taz shows that it collides with an explicit gemara.

The Taz’s resolution: two occurrences of one clause The verse writes וחי אחיך עמך twice: once before the prohibition, where “stranger and resident” is included; and once after אל תקח מאתו נשך ותרבית. The second occurrence, says the Taz, does not repeat the first: it ties the taking of interest to a narrower circle.

Hakira: is the permission to lend to a non-Jew an exclusion or a non-inclusion? (א) An exclusion. The verse לנכרי תשיך is a positive norm — the Rambam makes it a commandment — and the permission is therefore stated in its own right. (ב) A non-inclusion. The prohibition addresses only אחיך, and the non-Jew is simply not within it; there is nothing to permit, only a norm that does not reach him. The Taz’s reading, which makes the taking of interest depend on the second וחי אחיך עמך, leans toward the second.
Nafka mina (1) The ger toshav: if the permission arose from not being commanded to sustain him, it should be forbidden, since one is. Yet the mishnah says וכן בגר תושב. (2) The apostate: seif 2 permits precisely because אין אתה מצווה להחיותו — the Tur’s reason, taken up as it stands by the Taz. It thus operates exactly where the Taz had just shown it insufficient.

The decree does not bear on interest: it bears on association. All its limits follow from that, and they are three — the Rambam gives them, the Tur expands them, the Mehaber counts them.

The sugya: the restriction, then the talmid hakham

Three limits, one reason The Rambam gives borrowing a factual reason — שהרי הוא בורח מלפניו ואינו רגיל אצלו — and it is the key to the other three. Kedei hayav: where the Jew lends in order to live, there is no chosen association. Talmid hakham: association exists, but it does not bite. Avak ribbit: the Torah having forbidden nothing, the Sages had no fence to build. Three divisions, but a single measure: the risk of absorption.
The Shakh states the reason in one line

3. והאידנא — is the decree annulled, or its reason extinguished?

The Tur writes והאידנא נהגו היתר — practice permitted. The Mehaber writes והאידנא מותר — it is permitted. The difference between those two formulas is exactly the question of this chapter.

The Taz’s difficulty If the concern of learning from the non-Jew’s deeds sufficed to forbid, why did the Sages of the Talmud not decree on all commerce? And if it did not suffice, how did they decree on interest?

The Taz’s resolution: what was peculiar to lending at interest In the days of the decree, ordinary commerce was also carried on with Jews; only lending at interest was, by construction, reserved for the non-Jew. That singularity justified the decree. Today all commerce is with them — and no decree is made — so neither is one made on interest.

Hakira: בטלה הגזירה, or בטל טעם הגזירה? (א) The decree never reached our situation. It addressed a singular case — the one relation we had with them — and our situation is not that case; there is nothing to annul. This is the reading the Taz’s reasoning carries. (ב) The decree stands, but its reason has died. We would then face the general rule that a decree does not lapse of itself — and one would need an established practice, which is exactly what the Tur says: נהגו היתר.
Nafka mina A place or an age in which commerce with non-Jews again became rare and lending at interest were once more the only economic relation. On (א), the decree’s concern would revive with the fact; on (ב), the established practice holds. The Mehaber, writing והאידנא מותר without the word נהגו, reads more readily as (א).
Note that the Baer Hetev, in ס״ק ב, gives the reason in the name of the Tur and not of the Shakh — whereas in ס״ק א he attributed it to the Shakh. This is no slip: the reason for the leniency belongs to the Tur, and the Shakh merely quotes it.

4. מומר — why lending is permitted and borrowing forbidden

Seif 2 stands in eight words and sets two opposite regimes for one and the same person. The whole difficulty is that the second prohibition — not to borrow from him — presupposes that the apostate is bound by the prohibition; and the first presupposes that he is not.

The Taz’s difficulty: what of lifnei iver on the lending side? If I lend to him and he pays me the interest, he takes interest from a Jew — so I have made him sin.

The Sefer HaTerumot’s resolution: the borrower’s prohibition is a prohibition of causing The verse addressed to the borrower is ולאחיך לא תשיך: it does not say “do not pay interest”, it says “do not bring it about that your brother bites you”. It is therefore a prohibition whose object is the lender. Where the lender is not warned against taking — the apostate — the borrower is not warned against giving.

And the other direction does not invert When it is the Jew who borrows from the apostate, the apostate takes interest from a Jew — and against that he is warned, since the Jew is still his brother. The giver therefore transgresses לא תשיך לאחיך; and the Tur adds לפני עור.

The Perishah’s difficulty, and the Taz’s answer The Perishah objects that nowhere do we find a Jewish borrower transgressing לפני עור. The Taz answers from the mishnah at the end of the chapter.

Nafka mina The Pithei Teshuva draws from this the question of אבק רבית with an apostate: if the prohibition on the borrower’s side is a prohibition of causing, then what is forbidden only rabbinically may not have been fenced that far. He leaves the question open and makes it depend on the Ramban.

The Rema does not rule against the Mehaber: he reports those who are stringent and offers counsel. But the Shakh and the Pithei Teshuva make two very different things of that counsel.

The Bah’s point of law An apostate in defiance who has not left the community is graver than one who has — although, as to his life, he was among those spoken of in siman 158. The Bah draws a stringency from this; the Shakh reports it while noting that his words are not compelling. The Bah’s logic assumes that formal belonging weighs more than the gravity of the sin.
The inversion in the Geonim’s responsum The reply attributed to the Rif permits the apostate דשביק היתרא ואכיל איסורא and forbids the מומר לתיאבון — the reverse of the ordinary scale of gravity. The reason is that the question is not “who sins more” but “who has broken away”.

Nafka mina — and it is counter-intuitive The Pithei Teshuva, in the name of the Tiferet Tsvi, refuses the middle course: one who follows the stringency should not lend without interest either. The stringency bears on entering the lending relation, not on the gain.

And the consequence for interest already taken The same Tiferet Tsvi distinguishes the prohibition from the positive commandment: transgressing אל תקח מאתו נשך does not oblige restitution, because the positive commandment וחי אחיך is not addressed to him. He leaves open the case of a borrower who became an apostate afterwards.

6. כותיים — a stringency that turns into a leniency

The Mehaber writes one sentence about the Kutim. The Shakh reads an implicit consequence into it, disputes it, and in passing states a general rule about the standing of decrees.

The underlying argument: חומרא דאתי לידי קולא The Shakh does not merely say that a decree cannot be cut in two. He adds that a stringency here produces a leniency elsewhere — the reasoning he lays out on siman 266, where the Kuti’s non-Jewish status invalidates a get, which lightens as much as it burdens. A status, he says, does not lend itself to selective use.
The Tiferet Tsvi’s answer, through the Pithei Teshuva Non-Jewish status as regards our stringencies does not release them from their own obligations — and so long as they are bound, לפני עור remains.

Seif 3 places the Karaites on the side of brothers. The Beit Yosef relies on the Rambam; the Shakh says he finds nothing of the sort in the Rambam; and the Nekudot HaKesef — that is, the Shakh himself — find the passage.

Hakira: is the tinok shenishba a brother who sins, or a sinner excused? (א) A brother who sins. He is fully within the covenant, and his sin does not remove him; the prohibition of interest therefore applies to him in full, and that is what the Mehaber writes of the Karaites. (ב) A sinner excused. What matters is not that he is within the covenant but that he has not broken away; he is כאנוס, and the Shakh writes כשוגג. Both lead to the same result here — but not elsewhere.

8. יסוד הסימן — גדר אחיך

The whole siman is the measure of a single word. The prohibition of interest is not a rule about money: it is a rule about brotherhood, and the verse says so explicitly — לא תשיך לאחיך. Each of the three seifim is a case in which one asks how far that word reaches: the non-Jew stands outside it, the apostate outside it as to sustaining him but inside it as to making him sin, and the captive child wholly inside.
« לֹא־תַשִּׁ֣יךְ לְאָחִ֔יךָ נֶ֥שֶׁךְ כֶּ֖סֶף נֶ֣שֶׁךְ אֹ֑כֶל נֶ֕שֶׁךְ כׇּל־דָּבָ֖ר אֲשֶׁ֥ר יִשָּֽׁךְ׃ » (דברים כ״ג:כ׳)
« לְאָחִיךְ אָסוּר וְלִשְׁאָר הָעוֹלָם מֻתָּר. וּמִצְוַת עֲשֵׂה לְהַשִּׁיךְ לְעַכּוּ״ם » (רמב״ם הלכות מלווה ולווה פרק ה׳ הלכה א׳)
And this is why seif 2 is not an exception but the demonstration One and the same man may not be “your brother” as to the duty of sustaining him, and still be one as to the duty of not making him sin. These are two different uses of the same word, in two different verses — the first in Leviticus, the second in Deuteronomy. The Sefer HaTerumot, in separating them, did not solve a local difficulty: it showed how to read the whole siman.
Summary of the mahlokot (1) The link between interest and sustaining: the Tur asserts it, the Taz restricts it to the second verse. (2) The nature of the leniency of ha-idna: an established practice (Tur) or a decree that never addressed our case (the Taz’s reasoning). (3) The apostate: the Mehaber permits, the Rema reports those who are stringent, the Bah aggravates the one who has not left, the Geonim lighten the one who has broken away. (4) The Kutim: the Shakh permits borrowing, the Tiferet Tsvi and the Havot Daat forbid. (5) The Karaites: the Beit Yosef forbids lending, the Shakh and the Maharshal permit, the Nekudot HaKesef leave the practical law in צ״ע.
