Siman 162 runs to five seifim — the Shulchan Arukh announces it itself: ובו ה׳ סעיפים. Until now interest was counted in money. Here it changes its nature: one lends a measure of wheat and returns a measure of wheat, without a penny being stipulated — and it is nonetheless forbidden. The whole siman lies in the reason for that prohibition, and in the two ways out that the halakha leaves open.

1. The text of the Mehaber — the five seifim

The siman reads in five stages. (1) The prohibition and its single exception, coin. (2) The first way out: יש לו, the borrower already owns a little of the commodity. (3) The second: שער שבשוק, the commodity has a market rate. (4) A particular case, the sharecropper. (5) The litigation: who must prove what, and how far the permission reaches.

Seif 1 — the prohibition, and the one thing it does not reach

שלא להלוות סאה בסאה. ובו ה׳ סעיפים:

Title of the siman: that one may not lend a se’ah for a se’ah; and it contains five seifim.

It is forbidden to borrow a se’ah for a se’ah, even if no term was fixed for repayment; and likewise anything else — except a silver coin (parenthetical addition:) that is (then) current as legal tender —, for perhaps they will rise in price, and it will turn out that he gives him more than was lent to him. Unless he turns it into a sum of money: if they rise, he will give him that sum. And if he did not turn it into a sum and they rose, he gives him the value they had at the time of the loan; and if they fell, he gives him the se’ah that was lent to him.

Gloss: Some have written that nowadays a gold coin has the status of silver, and one borrows a zahuv for a zahuv; and such is the lenient custom, and one should not object, for they have on whom to rely (Piskei Mahara’i 54). Some say that it is permitted to borrow a loaf of bread for a loaf of bread, like a silver coin: since it is a small matter, people are not particular with one another about it (the Tur and many decisors, and see the Beit Yosef); and such is the lenient custom.
The prohibition is not about a profit, it is about an exposure. Nobody stipulated interest: a se’ah goes out and a se’ah comes back. But a se’ah has a price, and that price moves — שמא יתייקרו. If wheat rises, the lender recovers more value than he gave, without having demanded anything. That exposure is what the Sages forbade. And the one thing the prohibition does not reach is a current silver coin: a coin does not become dearer — it is the measure by which everything else does.

Seif 2 — יש לו: he already owns a little

If he has a little of that same kind — even if the key is not in his hand — he borrows upon it as many se’in as he wishes, to repay a se’ah for a se’ah. And if he has nothing at all of that kind, let the lender give him a little of that kind, or lend it to him, and afterwards lend him as many se’in (the author’s own view, against the disciples of the Rashba).

Gloss: If the borrower had a little of that kind on deposit with a third party, it is as though it were in his hand; but if others owe it to him, that is not called “he has” (Beit Yosef, and so it appears from the gemara of Eizehu Neshekh). And likewise if he has some elsewhere and the lender has no road to get there (Hagahot Mordechai). A borrower who says he has a little of that kind — the lender may lend to him, and he needs no proof for his words (ibid. in the name of Rabbenu Tam). And this permission to lend him when he has of that kind holds without condition; but if the lender stipulates that should wheat rise he will pay him in wheat, and should it fall he will give him money, their worth at today’s rate — that is forbidden, for it is “near to gain and far from loss” (Rivash 18).
Why a single se’ah opens a loan of a hundred. The little he owns is regarded, from the instant of the loan, as made over to the lender — נחלטת מיד למלוה. The lender therefore already owns wheat: if wheat rises, it rises in his own hand, not at the borrower’s expense. And since the se’ah borrowed becomes in its turn a se’ah he owns, the mechanism rolls: one se’ah suffices for a hundred.

Seif 3 — שער שבשוק: the commodity has a rate

היה לאותו מין שער בשוק קבוע וידוע לשניהם מותר ללוות סאה בסאה: הגה וע״ל סי׳ קע״ה איזה מקרי שער קבוע והא דיכול ללוות על שער שבשוק היינו דהלוה יכול לפרוע לו אימת שירצה אבל אם התנה שלא יקבל פרעון עד שעת היוקר אסור (הרא״ש בתשובתו וסמ״ק וכל בו):
If that kind had a fixed market rate, known to both of them, it is permitted to borrow a se’ah for a se’ah.

Gloss: And see below, siman 175, what counts as a fixed rate. And this permission to borrow on the market rate holds where the borrower may repay whenever he wishes; but if he stipulated that he would not accept repayment until the time of high prices — that is forbidden (the Rosh in his responsum, the Semak and the Kol Bo).
Two words not to lose: קבוע and ידוע לשניהם. The rate must be fixed, and known to both parties. The reason is plain: where the commodity can be bought at any hour, borrowing wheat amounts to saying “lend me until my son comes home” — the borrower could have bought it this minute. But the wheat in the market belongs to others: nothing is acquired to anyone, and that is why both parties’ knowledge is required here, where it was not in seif 2.

Seif 4 — the sharecropper, and why this is not a loan

מלוה אדם את אריסיו (פי׳ אריס הנוטע או זורע שדה חבירו ויש לו חציו או שליש בפירות) סאה בסאה לזרע בין קודם שירד האריס לשדה בין אחר שירד במה דברים אמורים במקום שנהגו שיתן האריס הזרע אבל במקום שדרך בעל הקרקע ליתן הזרע אם כבר ירד האריס לשדה אסור:
A man lends to his sharecroppers (inserted gloss:) (explanation: an aris is one who plants or sows another’s field and receives a half or a third of the produce) a se’ah for a se’ah for seed, whether before the sharecropper went down to the field or after he went down. Of what case is this said? Of a place where the custom is that the sharecropper provides the seed; but in a place where it is the landowner’s way to provide the seed, if the sharecropper has already gone down to the field — it is forbidden.
The sharecropper is not borrowing: he is receiving his share in advance. So long as the landowner may still dismiss him, the seed handed over is not a loan but an advance on the division — as though they had agreed that the owner would take the first se’ah. From the moment the sharecropper can no longer be dismissed, he becomes an ordinary third party again, and the prohibition returns.

Seif 5 — the deed, the oath, and the two limits

הלוה לו סאתים חטים ועשה לו שטר עליהם אם לא יברר המלוה שיצא השער בשעת הלואה או שהיה ללוה מעט מאותו המין ישבע הלוה שלא יצא השער ושלא היה לו כלום מאותו המין ולא יפרע אלא דמים שהיו שוים בשעת הלואה (ואין המלוה יכול לומר הקניתי לו מעט משלי ע״י אחר דלא מהני בלא דעת הלוה) (שם) ואם יתחייב לו חטים וההלואה היתה במקום אחד והתביעה במקום אחר והחטים יקרים יותר במקום התביעה לא ישלם לו אלא כשויין במקום ההלואה: הגה לא התירו ללוות כשיש לו אלא סאה חטים בסאה חטים אבל סאה חטין בסאה דוחן אסור אע״פ שהן בשער אחד ויש לו דוחן (טור בשם הראב״ד ובה״ת):
If he lent him two se’in of wheat and drew up a deed for them: if the lender does not prove that the rate had come out at the time of the loan, or that the borrower had a little of that kind, the borrower swears that the rate had not come out and that he had nothing of that kind, and he pays only the value they had at the time of the loan. (Parenthetical addition:) (And the lender cannot say: “I conveyed a little of my own to him through a third party”, for that does not work without the borrower’s consent) (ibid.). And if he owes him wheat, and the loan took place in one place and the claim in another, and wheat is dearer in the place of the claim, he pays him only according to its worth in the place of the loan.

Gloss: They permitted borrowing, where he has, only a se’ah of wheat for a se’ah of wheat; but a se’ah of wheat for a se’ah of millet is forbidden, even though they stand at one rate and he has millet (the Tur in the name of the Raavad and the Baal HaTerumot).
Who must prove? The lender. This is the practical consequence of everything above: a loan in kind is forbidden by default, and the two permissions are exceptions. Whoever claims wheat must therefore establish that he stood in one of them; failing that, the borrower swears and pays only the value at the day of the loan. The gloss adds the limit of the device: יש לו holds only from a kind to its own kind.
The five seifim ask one question in five forms: is what comes back to the lender what he gave? In money the answer is immediate — a hundred against a hundred. In kind it never is, because the commodity carries a moving price. The whole siman is the art of making that answer immediate again.

2. The mechanism — where is the interest in a se’ah for a se’ah

A money loan can be checked by eye: I gave a hundred, a hundred comes back. A loan in kind seems to be checked the same way — I gave a se’ah, a se’ah comes back — and that is an illusion. A se’ah is not a stable quantity of value: it is worth four today and five tomorrow. If wheat rises between the loan and the repayment, the lender receives five for four. Nobody demanded that surplus, nobody stipulated it, it could even have gone the other way — and yet it is there, and the loan was built to receive it. That is what the Shulchan Arukh says in six words.

« היוצא (אז) בהוצאה דשמא יתייקרו ונמצא שנותן לו יותר ממה שהלוהו » (שו״ע יו״ד קס״ב:א)
summary : a silver coin then current is excepted; the rest is not, for the commodity may become dearer, and it will turn out that he gives him more than he lent him.
יוקרא וזולא — rising and falling. This is the name of the risk, and there is nothing accidental about it: it is the permanent property of any commodity. A debt denominated in wheat is a debt whose real amount is known only on the day of payment. That is what distinguishes it from a money debt, and that is where the prohibition is born.

But then: what degree of prohibition is this? The Shach answers in his very first word, and his answer governs the whole practice of the siman.

« הלואת סאה בסאה הוא מדרבנן והלכך אינה יוצאה בדיינים » (ש״ך יו״ד קס״ב ס״ק א)
אבק רבית — the “dust of interest”. Interest that was not stipulated, and that the Torah does not reach: it is forbidden by the Sages. Two immediate consequences, which the Shach draws here. (a) The prohibition exists and must be guarded against. (b) But if the thing was done, the court undoes nothing — אינה יוצאה בדיינים — unlike רבית קצוצה, stipulated interest, which the court makes one restore.

There remains the question that opens the seif: why is coin excepted? The Shach gives the reason in the name of the Rashba, and it is a sentence to remember for the whole block of interest.

« דינר זה שהוא מטבע היוצא ודאי מותר דאיהו מטבע ולאו איהו דאייקר וזול אלא הפירות » (ש״ך יו״ד קס״ב ס״ק ד)
The decisive words are לאו איהו דאייקר וזול אלא הפירות: it is not the coin that rose or fell, it is the produce. Money is the measuring instrument; a measuring instrument does not measure itself. And the exception is written narrowly — a coin that is current: the Shach at once specifies that a coin withdrawn from circulation becomes produce again.
« לאפוקי אם אינו יוצא אז אע״פ שהיתה יוצאת מקודם כגון מטבע שנפסל אסור כדאיתא בטור ובפוסקים » (ש״ך יו״ד קס״ב ס״ק ג)

Three ways then remain of lending in kind without falling into the prohibition, and the siman gives them in order: turning the commodity into a sum, owning a little of the commodity, or there being a market rate.

The three ways out, and what each repairs. עשיית דמים: the debt is converted into money, and the commodity is now only a mode of payment — the amount no longer moves. יש לו: the lender becomes owner of the wheat from the moment of the loan, and the rise occurs in his hand. שער שבשוק: the borrower could have bought the commodity this minute, and the loan is now only a convenient delay.

3. The sugya — the mishna in Bava Metzia, Hillel, and the permitted formulas

The material of the siman comes from the fifth chapter of Bava Metzia, איזהו נשך. There the mishna forbids one formula and permits two others — and the difference between them is exactly the subject of the siman.

« לֹא יֹאמַר אָדָם לַחֲבֵירוֹ: הַלְוֵינִי כּוֹר חִטִּין וַאֲנִי אֶתֵּן לָךְ לַגּוֹרֶן. אֲבָל אוֹמֵר לוֹ: הַלְוֵינִי עַד שֶׁיָּבֹא בְּנִי אוֹ עַד שֶׁאֶמְצָא מַפְתֵּח » (בבא מציעא ע״ה ע״א)
summary : a man should not say to his fellow, “lend me a kor of wheat and I will give it to you at the threshing floor”; but he may say to him, “lend me until my son comes, or until I find the key”.
The key to the siman is in this mishna. “Until my son comes”: I already own the wheat, it is merely not to hand — that is seif 2. “Until I find the key”: the same, and that is why seif 2 specifies אפילו אין המפתח בידו. And “I will give it to you at the threshing floor” is forbidden because there is nothing there that I own: between the loan and the threshing floor, only the price can have changed.

Hillel, in the same mishna, goes further and forbids even the two permitted formulas:

« וְכֵן הָיָה הִלֵּל אוֹמֵר: לֹא תַּלְוֶה אִשָּׁה כִּכָּר לַחֲבֶרְתָּהּ עַד שֶׁתַּעֲשֶׂיהָ דָּמִים, שֶׁמָּא יוּקְרוּ חִטִּין, וְנִמְצְאוּ בָּאוֹת לִידֵי רִבִּית » (בבא מציעא ע״ה ע״א)

The halakha does not follow Hillel, and so Shmuel says — and from there seif 1 draws its אפילו לא קצב לו זמן לפרעון:

« אָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: זוֹ דִּבְרֵי הִלֵּל, אֲבָל חֲכָמִים אוֹמְרִים: לֹוִים סְתָם וּפוֹרְעִים סְתָם » (בבא מציעא ע״ה ע״א)

The gemara then gives the mechanism of יש לו, and extends it from one se’ah to a hundred:

« אָמַר רַב הוּנָא: יֵשׁ לוֹ סְאָה – לֹוֶה סְאָה. סָאתַיִם – לֹוֶה סָאתַיִם. רַבִּי יִצְחָק אוֹמֵר: אֲפִילּוּ יֵשׁ לוֹ סְאָה – לֹוֶה עָלֶיהָ כַּמָּה כּוֹרִין » (בבא מציעא ע״ה ע״א)
« תָּנֵי רַבִּי חִיָּיא לְסַיּוֹעֵיהּ לְרַבִּי יִצְחָק: טִיפַּת יַיִן אֵין לוֹ, טִיפַּת שֶׁמֶן אֵין לוֹ. הָא יֵשׁ לוֹ – לֹוֶה עָלֶיהָ כַּמָּה טִיפִּין » (בבא מציעא ע״ה ע״א)
summary : Rav Huna: if he has a se’ah he borrows a se’ah; two, two. Rabbi Yitzchak: even if he has one se’ah, he borrows on it several korin. And Rabbi Chiya teaches in support: “a drop of wine he does not have” — but if he has, he borrows on it as many drops as he likes.

Seif 4 comes from another mishna, immediately preceding, and from the beraita that refines it:

Two tannaim, two customs, one rule. The mishna does not distinguish between “went down” and “did not go down”; the beraita does. Rava, in Rabbi Idi’s name, explains: in the country of our mishna the sharecropper provides the seed — so long as he has not provided it, the owner may dismiss him, and the advance remains an advance. In the country of the outside tanna the owner provides it: once the sharecropper has gone down he can no longer be dismissed, and the advance becomes a loan again. The Mehaber fused both into one sentence — it is exactly the במה דברים אמורים of seif 4.

4. The vocabulary of the block — to be laid down once and for all

סאה בסאה — “a se’ah for a se’ah” — the very name of the operation: lending a quantity of a commodity to receive the same quantity of the same commodity. It is the title of the siman, and it is what is forbidden.
אבק רבית — the “dust of interest”: interest not stipulated, forbidden by the Sages and not by the Torah. Practical consequence: the court does not make it restored — אינה יוצאה בדיינים (Shach ס״ק א). Its opposite is רבית קצוצה, stipulated interest, which the court does make one return.
יוקרא וזולא — rising and falling — the movement of price, which is the only “interest” present in this siman. It is not intended, not stipulated, and it can move both ways; it is the exposure to that movement that is forbidden.
עשיית דמים — “making it money”: fixing, at the time of the loan, the cash value of the commodity. The debt becomes a money debt, and the commodity is now only a means of paying it. It is the first solution of seif 1, and the formula Hillel always required.
יש לו — “he has”: the borrower already owns, however little, of the commodity borrowed. That little is regarded as made over to the lender from the instant of the loan (Shach ס״ק ו), and the lender therefore owns wheat before any rise. A deposit with a third party counts; a debt owed to him by others does not (Rama seif 2).
שער שבשוק · יצא השער — “the market rate” · “the rate has come out”: the commodity has a fixed and public price in the market. Then borrowing amounts to saying “lend me until my son comes”, since the borrower could have bought it this minute (Taz ס״ק ה). Seif 3 requires two things: that the rate be קבוע and that it be ידוע לשניהם.
פוסק על שער שבשוק — “fixing a price on the market rate”: agreeing today on a future delivery at today’s price. It is the seller-and-buyer form of the same mechanism; the Rambam opens our chapter by saying that it and the loan in kind follow one rule. It is treated in its own right in siman 175, and siman 163 gives one case of it.
אריס — the sharecropper: one who works another’s field for a share of the crop — the Shulchan Arukh itself gives the definition in parentheses at seif 4. What decides his case is not his status but a question of fact: can the owner still dismiss him?

The siman carries forty-five apparatus entries: sixteen of the Shach, nine of the Taz, twelve of the Baer Hetev, four of the Pitchei Teshuva and four of the Nekudot HaKesef. They do not scatter: almost all come back to a single question — what must be known, and by whom, for the permission to operate?

The Shach — sixteen entries

ס״ק א — the degree of the prohibition, and its consequence at law

The Shach opens with what decides everything else: this prohibition is rabbinic. One must therefore guard against it — and yet, if it was transgressed, the court undoes nothing.

« הלואת סאה בסאה הוא מדרבנן והלכך אינה יוצאה בדיינים » (ש״ך יו״ד קס״ב ס״ק א)

ס״ק ג — a coin no longer current becomes produce again

The word אז in the seif, which Sefaria prints in parentheses, is not decorative: it requires the coin to be current at the time of the loan.

ס״ק ד — the gold coin: two reasons for one leniency

The Shach first gives a historical reason — in Talmudic times silver coins were good, and gold counted as produce beside them; today silver coins are mostly copper. Then he cites the Rashba, whose reason is one of principle and holds at all times.

ס״ק ה — money does not stand in for the commodity

A capital point, and counter-intuitive: owning enough to buy the whole commodity is not owning the commodity. This is the sentence the Taz will contest at ס״ק ב, and that siman 163 will put back in play.

« אבל מעות אפי׳ בכדי שיכול ליקח כל אותו המין אסור כן הסכמת הפוסקים » (ש״ך יו״ד קס״ב ס״ק ה)

ס״ק ו — why one se’ah suffices for a hundred

Here is the mechanism in one sentence: for each se’ah borrowed, the se’ah he owns is regarded as made over to the lender there and then; if it rises, it rises in the lender’s hand.

ס״ק ז — must one intend it? the Beit Yosef against the Bach

If the mechanism required an intent to convey, a plain man who is unaware of it would be forbidden. The Shach concludes that the reason lies elsewhere: the prohibition being rabbinic, a slight ground sufficed. The Bach requires intent; the Shach confines it to lekhatchila.

ס״ק ח — giving a little, or lending it?

The Mehaber permits both; the Bach, with the disciples of the Rashba, permits only a gift or a conveyance — for what is lent is given to be spent, and cannot therefore stand as security for the repayment.

ס״ק ט — knowing the rate, or knowing its figure?

It is enough to know that a rate exists; one need not know its figure.

ס״ק י — the borrower need not have money

Against the Raavad: on the market rate one lends even to a man with nothing in his pocket. Compare siman 163, where the rule is reversed.

ס״ק י״א — the fixed term, and the Shach’s reversal

Against the Rambam, a fixed term does not forbid. But the Shach adds of his own accord the case nobody had posed: if the term was fixed because a fall is feared, it is forbidden to all.

If the deed states that the lender is believed on everything touching the debt, he is believed here too.

ס״ק י״ג — the burden of proof is not always on the lender

The seif puts the burden on the lender; the Shach confines it to where a side of interest is visible — a loan dated to a time of low prices. Otherwise the lender is believed.

ס״ק י״ד — one does not convey to a man against his will

Conveying a little wheat to the borrower through a third party works only if the borrower consents — and here, precisely, he maintains that he had none.

The gloss speaks of millet; the rule holds for any pair of kinds.

ס״ק ט״ז — even if both kinds have a rate

One might have thought a market rate on both kinds suffices; the Levush, quoted here, says no — two kinds are worse than one.

ס״ק א — what is a loan, and what is a sale

The Taz draws from the rabbinic nature of the prohibition a broad consequence: by way of a sale, the same operation is entirely permitted.

ס״ק ב — the gold coin: the Taz gives a different reason from the Shach

For the Taz, the gloss’s leniency is not a point of monetary law: it is an application of יש לו — everyone today owns movables worth a zahuv.

ס״ק ג — why יש לו needs no knowledge, and שער שבשוק does

The longest entry in the siman. Its conclusion is the distinction to retain: with יש לו, the wheat is the borrower’s and is acquired to the lender by the Sages’ enactment; with the market rate, the wheat is other people’s, and nothing remains but the knowledge of both.

The Taz reconstructs the argument of the Rashba’s disciples, and it is sharp: the wheat lent is destined to be spent, and cannot therefore stand against the repayment.

The Pitchei Teshuva at ס״ק ב matters in practice: “making it money” does not suffice if the lender reserves the choice between wheat and cash. An option left to the lender does not repair the exposure — it aggravates it, since he will always take the rising side. It is the same flaw as the קרוב לשכר ורחוק להפסד of the gloss to seif 2.

The Baer Hetev does not decide: entry by entry, it sets side by side what the Shach, the Taz, the Bach, the Levush and the Nekudot HaKesef say. It is the best place to see the state of a question at a glance.

7. The Rambam — in which treatise is this rule codified?

From siman 159 onward, the Rambam of reference is no longer הלכות עבודה זרה but הלכות מלווה ולווה. For our siman the reference is more precise still: chapter 10 in its entirety is siman 162, seif by seif. Chapter 9, which precedes it, deals with פוסק על הפירות — the seller-and-buyer form of the same mechanism, which the Shulchan Arukh will treat at siman 175.

A point where the Rambam was not followed. He writes בלא קביעת זמן in both permissions: for him a fixed term forbids in every case. The Tur reports that the Rosh does not draw that distinction, and the Shach concludes at ס״ק י״א that the decisors agree against the Rambam.

8. Contemporary cases

Case 1 — Borrowing a kilo of flour from a neighbour

This is exactly the case of the mishna, and the custom reported in the gloss to seif 1 applies here: people are not particular over small quantities, and one is lenient. Still, the question arises only if the neighbour himself has nothing of the commodity, which is rare — and seif 2 would then suffice to permit. For practice, consult your Rav.

Case 2 — Lending fuel, materials, goods

The rule of the siman knows no list of commodities: וכן כל דבר. Everything whose price moves is subject to it, which, outside coin, is very nearly everything. Both permissions remain available, and the simplest is still to fix the cash value in advance. For practice, consult your Rav.

Case 3 — A currency in sharp inflation

The seif excepts coin because it does not become dearer. The Rashba’s reason is explicit on this, and the Shach at ס״ק ג shows at the same time that the exception is bounded by a fact — a coin no longer current no longer enjoys it. The question of a currency that is current but loses value quickly is not posed in our siman; it is not settled here. A question for your Rav.

Case 4 — A loan between partners, repayable “in goods”

This is the commonest form of the problem today, and it is also where the gloss to seif 2 bites: as soon as one side reserves the option — goods if it rises, money if it falls — one is in קרוב לשכר ורחוק להפסד, and the Pitchei Teshuva (ס״ק ב) adds that the option clause aggravates rather than repairs. A question for your Rav.

Case 5 — A loan in kind already repaid, discovered to have been forbidden

This is the practical consequence of the Shach’s ס״ק א: the prohibition being rabbinic, the court makes nothing be restored. Which does not say that nothing is to be done — only that what remains to be done is not the court’s business. A question for your Rav.

9. Summary of Siman 162

One sentence. Lending a commodity to receive the same commodity is forbidden — because the commodity carries a moving price — unless its cash value was fixed in advance, or the borrower already owns a little of it, or it has a fixed market rate known to both.
