1. שורש האיסור — a rabbinic prohibition, and what it does not reach

The Shach opens the siman with a classification, not a reason — and it is that classification which governs everything else, down to the burden of proof in seif 5.

The Shach: the prohibition and its procedural consequence
« הלואת סאה בסאה הוא מדרבנן והלכך אינה יוצאה בדיינים » (ש״ך יו״ד קס״ב ס״ק א)
« ואינו אלא מדרבנן והלכך אינה יוצאה בדיינים » (באר היטב יו״ד קס״ב ס״ק א)
Ḥakira: what does the prohibition target — the outcome or the form? (א) The outcome. What is forbidden is the surplus actually received if the price rises; the prohibition would then be a fence against a real ribbit that might arise. (ב) The form. What is forbidden is the structure of the contract — a debt whose amount is not fixed — regardless of what happens afterwards. Seif 1 leans to (ב): it forbids אפילו לא קצב לו זמן לפרעון, that is, even where nothing says the price will move before payment.
The Taz draws a considerable leniency from (ב) If the prohibition targets only the form of the loan, then the same operation done by way of sale is not caught: the Torah permits a sale even “near to gain and far from loss”, and the Sages forbade only a loan here.

Nafka mina (1) At law: on (ב) nothing is recovered, since nothing was taken — that is the Shach’s אינה יוצאה בדיינים. (2) The Taz’s device: selling a se’ah payable in a se’ah at a fixed date. On (א), the outcome being identical, it should be forbidden; on (ב), it is entirely permitted. (3) A commodity whose price objectively cannot move before repayment: (א) would permit, (ב) would not.

Coin is excepted: on that all agree. But why? The Shach and the Taz give two reasons with nothing in common, and the Rama’s gloss on the gold coin separates them.

The Shach: a historical reason, then one of principle
« כלומר אפילו מאן דאוסר בזמן הש״ס להלות דינר זהב בדינר זהב היינו משום דבזמנם היו המטבע כסף טובים וחשובים ומעט נחשת היה בהן והיה הדינר זהב נחשב פירי לגבייהו » (ש״ך יו״ד קס״ב ס״ק ד)

The Taz: not a point of monetary law, but a יש לו
« הטעם דבזמנינו רוב בני אדם יש להם מטלטלין ברשות׳ דשוה זהב ואם היו רוצים למכרם בזול יכולים למכרם והוה כלוה סאה בסאה ויש לו » (ט״ז יו״ד קס״ב ס״ק ב)
Two foundations for one permission For the Shach, the gold coin is permitted because it is money: it does not become dearer, it measures. For the Taz it is permitted because everyone owns movables worth one: it is a universal יש לו. The Taz is himself aware that his reason does not extend to produce, and says so: movables are sold for gold coins, but produce is not bought with movables.
The Baer Hetev’s difficulty on the Taz If having the means to buy sufficed, then having money should permit a wheat loan — which the decisors do not say, and which the Shach expressly denies at ס״ק ה.

Nafka mina A man who owns no movables at all: for the Shach the gloss’s permission still stands, since it rests on the nature of the coin; for the Taz it falls. And conversely, a place where movables are not sold for gold would collapse the Taz’s reason without touching the Shach’s.

3. מנגנון היש לו — a real acquisition, or a slight ground?

The Ran, reported by the Nimukei Yosef and quoted by the Taz, gives the mechanism: what the borrower holds is acquired to the lender from now. The Beit Yosef is puzzled — surely that is obvious — and his puzzlement is the real opening of the chapter.

The Shach: the Beit Yosef’s answer, and its scope

Ḥakira: is the little he owns really acquired to the lender? (א) Yes, really. The Sages instituted a transfer: the lender becomes owner, and the rise occurs within his own estate. That is the Ran’s reading — נקנים למלוה — and the Shach’s at ס״ק ו: נחלטת מיד למלוה. (ב) No: it is a slight ground. Nothing is acquired; the prohibition being rabbinic, a mere pretext sufficed to set it aside — בטעמא כל דהו אקילו ביה. That is what the Shach writes at ס״ק ז, answering the difficulty of the unlettered man.
The Bach, and why the question is not academic The Bach requires the parties to intend the transfer — failing which, he says, one of them will have aimed at interest. That fits (א): an acquisition presupposes a will. The Shach, who holds (ב), needs no intent; he concedes only that lekhatchila it is desirable, and rescues the bedieved.

Nafka mina (1) A loan made while the borrower had wheat without anyone knowing: permitted on (ב) and per the Shach; problematic per the Bach. (2) The se’ah he owned is destroyed after the loan: on (א) it perished in the lender’s hand and he bears the loss; on (ב) nothing changed hands. (3) The lender wishes to assert ownership of that se’ah against a third party: (א) would let him, (ב) would not.

4. ידיעת שניהם — why seif 3 requires it and seif 2 does not

Seif 3 writes וידוע לשניהם. Seif 2 writes nothing of the sort. Is this a real asymmetry, or did the Mehaber simply write the condition once for both? The Bach says the latter; the Taz proves the former, and his proof is the longest entry in the siman.

The Taz’s answer: the difference lies in whose wheat it is With יש לו, the wheat is the borrower’s: the Sages can convey it to the lender, and knowledge becomes superfluous. With the market rate, the wheat belongs to the people of the market: nothing can be conveyed, and only the knowledge of both parties is left to ground the permission.

The Bach against the Beit Yosef, and the Taz’s balanced position The Bach requires both parties’ knowledge in both cases. The Taz maintains the asymmetry but concedes lekhatchila: in advance, both must know, in either case. The distinction therefore operates only bedieved — and that is exactly where it matters.

Nafka mina A wheat loan concluded without either party thinking of the permission. If there was a יש לו: permitted, and the borrower must pay in wheat (Taz, Shach ס״ק ז). If there was only an unnoticed market rate: the Taz forbids handing over the wheat if the price rose. The one case where the distinction is decisive — and it is common.

5. או ילוהו לו — can a loan ground a יש לו?

Seif 2 offers the lender a way to manufacture the missing יש לו: give the borrower a little wheat, or lend it to him. On that “or” the Mehaber notes that he writes against the disciples of the Rashba — the only place in the siman where he signals an opposition.

The reasoning of the Rashba’s disciples, reconstructed by the Taz The יש לו works because the se’ah the borrower owns can be held against what he will have to return. But a se’ah that has been lent is not held: it is given to be consumed, and another will replace it. It cannot therefore stand in the place it is asked to stand.

Three positions The Mehaber permits both — gift and loan. The Bach and the Levush hold with the Rashba’s disciples: only a gift or a proper conveyance. The Taz distinguishes: an earlier and legitimate loan does leave a se’ah in the borrower’s hand and can serve as a base; what is refused is to manufacture the base by a loan made for that very purpose.

Nafka mina The common device of a lender facing a borrower with nothing. Per the Mehaber he may lend him one se’ah and then a hundred. Per the Bach he must give him the first. Per the Taz he may rely on a loan already made for another reason, but not on one made for the occasion. And the Taz himself notes that the Rashba in responsa, the Semak and the Kol Bo all write give and not lend.

6. קביעת זמן — the Rambam against the Rosh, and the Shach’s reversal

The Rambam attaches both permissions to one reservation: בלא קביעת זמן. The Rosh draws no such distinction. The debate is over what a term adds — and the Shach’s answer is that it adds nothing in itself, but that it may reveal an intention.

The Shach: why the decisors did not follow the Rambam A fixed term is set for the borrower’s benefit: it stops the lender from demanding before the date, but it does not stop the borrower from paying earlier. Nothing therefore is locked that would expose the loan to a rise.

The Rosh’s reservation, and the Baer Hetev’s extension If the lender expressly says he will not accept payment before the date, the reason above falls and a loan on the market rate is forbidden — but not a loan grounded on a יש לו. And he need not even mention a rise: “I will not accept before the term” suffices.

The Shach’s reversal — and it is his own The whole debate assumes the danger is a rise, and that the term, by making it possible, serves the lender. The Shach turns the picture round: if the term was fixed for fear of a fall, it no longer serves the borrower at all — it stops the lender from being paid while the commodity is still worth something. And there, he writes, all forbid, even with the lender saying nothing.

Nafka mina A six-month loan of produce in a market known to be seasonal. Per the Rambam: forbidden, a term was fixed. Per the decisors: permitted. Per the Shach: it depends on the expected direction — a rise expected, permitted; a fall expected, forbidden to all. The factual question has become the halakhic one.

7. הקנאה שלא בפניו — a צ״ע, an answer, and a reversal

Seif 5 refuses to let the lender say, “I conveyed a little of my wheat to the borrower through a third party”, for want of consent. The Taz stops there, and his objection opens the only three-voiced exchange in the siman.

The Taz’s difficulty: the prozbul With the prozbul one acquires for a man in his absence, even though the acquisition brings him a liability — and the reason given is that the institution is rabbinic. Here too the prohibition is rabbinic, and all the more so, says the Taz, since the borrower benefits from the transfer: without it, he too transgresses.
« קשה לי מאי שנא מפרוזבול בח״מ סי׳ ס״ז סעיף כ״ב דמהני אפילו שלא בפניו דהקילו בו כיון שהוא מדרבנן וכאן נמי הוא מדרבנן דהא סאה בסאה הוא מדרבנן » (ט״ז יו״ד קס״ב ס״ק ח)
The Nekudot HaKesef’s answer, in three moves (1) The argument is turned round: it is not the prohibition that is rabbinic in the prozbul, it is the permitting institution — the Taz’s reasoning conflates the two. (2) The prozbul is a case of its own: the Ran writes that one acquires there despite the liability because of נעילת דלת בפני לווין, a motive absent here. (3) And even granting the general rule, the prozbul’s liability comes only at the shemitta, whereas here it can come at once, with the first rise. The Nekudot HaKesef rest this last point on Kiddushin, where one refuses to acquire for another as soon as a liability attaches too.

And the Pitchei Teshuva reopens the file The Yeriot HaOhel attacks the Nekudot HaKesef and concludes that the law is with the Taz. The Pitchei Teshuva reports him without contradiction — which, in his idiom, amounts to assent. The question the Taz raised is therefore not closed: an Acharon carries it against the Shach himself.

Nafka mina A lender who, learning afterwards that the borrower had nothing, has a small quantity conveyed to him through a third party — and the borrower, brought to court, maintains he never knew of it. Per the seif and the Shach: the conveyance is void, the borrower swears and pays in money. Per the Taz and the Yeriot HaOhel: it operates, and he must pay in wheat. The whole difference between paying the value at the day of the loan and at the day of payment.

8. יסוד הסימן — what counts as “his”

Seven chapters, one question. The siman never asks whether the lender gained: it asks whether the borrower already owned what he undertakes to return. All the casuistry of the siman is a list of answers to that single question.

The yesod The last line of the table is the most instructive. The market rate does not make the commodity his: the Taz says so expressly — the wheat in the market is other people’s. It is therefore a second permission, of another kind, resting on something else: not on ownership but on availability. Which explains at a stroke the two features of seif 3: the rate must be fixed, and both must know it. Availability exists only if it is known.
And that same question governs the next siman. At siman 163 a money debt is converted into wheat: there too everything turns on יש לו. But the answer reverses on two points — the commodity is needed in a sufficient quantity, and the market rate does not stand in for it. The reason is that money, there, was lent first.
