Siman 163 runs to three seifim — the Shulchan Arukh announces it itself: ובו ג׳ סעיפים. In the previous siman wheat was lent. Here money is owed — and that debt is converted into wheat at the day’s price. The mechanism is the same, the answer reverses: what sufficed there no longer suffices here, and the reason is that a sum was lent first.

1. The text of the Mehaber — the three seifim

The siman reads in three stages. (1) The conversion itself: a money debt becomes a wheat debt, and the rule that decides. (2) The repeated conversion: the wheat becomes wine. (3) A device lawful in each of its steps and nonetheless forbidden — הערמת רבית.

Seif 1 — the money debt becomes a wheat debt

Title of the siman: the law of one who prices wheat so as to bind him at today’s rate; and it contains three seifim.

One who was owed money by his fellow, and said to him: “give me my money, for I wish to buy wheat with it”; the other said to him: “go, make them over upon me at today’s rate, and you will have wheat with me, as a loan” — if he has wheat to the measure of his money, it is permitted, even if the rate has not come out; and if not, it is forbidden, even if the rate has come out (Nimukei Yosef in the name of the Ramban and the Maggid Mishneh there, and that the Ramban and the Rashba wrote the same). (Parenthetical addition:) (And the seller is believed when he says he has some, and he needs no proof for his words) (Hagahot Mordechai, chapter Eizehu Neshekh), as above at siman 162.
Two “evens”, and they run in opposite directions. Permitted even if the rate has not come out: because the wheat he owns is acquired to the creditor at once, and a rate would add nothing. Forbidden even if the rate has come out: because here money was lent first, and the debtor has nothing in hand with which to buy. That is exactly the reverse of siman 162, where a rate sufficed though the borrower had not a penny.

Seif 2 — and the wheat becomes wine

הרי שהיה לו חטים ועשה הלואתו עליו ובא אחר זמן ואמר ליה תן לי חטים שאני רוצה למכרם וליקח בדמיהם יין א״ל צא ועשה אותם עלי יין כשער שבשוק עתה אם יש לו יין הרי זה מותר ואם לאו אסור (ר״ן ונ״י):
Now if he had wheat and made his loan over upon it; and after a time the other came and said to him: “give me the wheat, for I wish to sell it and buy wine with its price”; he said to him: “go, make them over upon me as wine, at the rate the market has now” — if he has wine, this is permitted; and if not, it is forbidden (the Ran and the Nimukei Yosef).
Seif 2 is not a repetition: it poses the question of iteration. The debt has already been converted once; now it is converted again. The rule does not change — אם יש לו יין הרי זה מותר ואם לאו אסור — and that is exactly what Rabbi Oshaya’s beraita teaches in three stages: money, wheat, wine, oil. כולם אם יש לו מותר.

Seif 3 — ninety for a hundred: ha’aramat ribbit

He said to him: “lend me a maneh”; the other answered: “a maneh I do not have; wheat worth a maneh I do have”; and he gave him wheat for a maneh, as the rate stands, and then bought it back from him for ninety (parenthetical addition:) (and it is still worth a hundred) (Beit Yosef in the name of the ת״ר — the disciples of the Rashba, as the Shach names them at ס״ק ז) — if he finally paid him the maneh in produce, it is permitted; but it is forbidden to pay in money, because of ha’aramat ribbit, since he first said to him “lend me a maneh”. And if he transgressed and did so, he recovers a hundred from him at law, for there is not even avak ribbit here.

Gloss: And some say that it is avak ribbit (the Tur in the name of the Ramban and the Rosh). And all this speaks only of where they did not stipulate from the outset; but if they stipulated from the outset to buy it back from him for less — that is characterised interest (the Maggid Mishneh, chapter 5 of Hilkhot Malve, in the name of the Ramban and the Rashba, and so it is in the Nimukei Yosef), even if he pays him produce [it is forbidden] (Nimukei Yosef, chapter Eizehu Neshekh).
Each step is lawful, the whole is not. Selling wheat at the market price: lawful. Buying wheat back at ninety: lawful. But the man who asked for a loan of a hundred receives ninety and will owe a hundred. The Sages did not forbid a step: they forbade the shape the three draw together. And the way out turns on a point of form — if he pays in wheat, there is no shape at all.
Siman 162 asked: did the borrower own what he will return? Siman 163 asks the same of the debtor — but it no longer settles for a drop, and no longer settles for a market rate. The whole difference lies in three words of seif 1: כשיעור מעותיו.

2. The mechanism — a money debt that becomes a wheat debt

A man owes a hundred to another. The creditor demands: “I want to buy wheat with it.” The debtor has no money, but he has wheat. He proposes: “do not take the money — let us count it in wheat, at today’s rate, and you will have wheat with me.” The money debt is extinguished; in its place a wheat debt is born.

Where is the danger? The creditor paid a hundred in money and will receive wheat — whose price may have risen by the time of delivery. The surplus was not agreed, but it is born of a loan: it is the same exposure as in siman 162, except that the money went first. And that detail hardens the whole rule.

Hence the rule of the seif, and its two “even”s running in opposite directions:

יש לו — “he has some”. The central condition, here as in siman 162; but its size changes. There a drop sufficed, because it was a loan and each se’ah borrowed leaned on the last. Here it is a sale — the debtor sells his wheat against the debt — and a sale bears only on what exists. Hence כשיעור מעותיו.

And why is it permitted even without a market rate? Because the wheat he owns is acquired to the creditor from now — זכי ביה מהשתא — and that even without his having drawn it to himself: were he to go back on his word, he would fall under מי שפרע. The wheat is therefore already, in a manner, the creditor’s, and the rise occurs in his hand.

The comparison to retain. Siman 162: wheat is lent — a drop suffices, and failing a drop a market rate suffices. Siman 163: money is owed — wheat is needed to the measure of the debt, and no rate stands in for it. One thing alone has changed: the direction in which the money went.

3. The sugya — the two beraitot of Bava Metzia

The three seifim come from two neighbouring beraitot in the chapter איזהו נשך. The first, taught by Rabbi Oshaya, gives seifim 1 and 2; the second, taught by Rav Safra in the name of the school of Rabbi Chiya, gives seif 3.

And Rava draws three lessons from it, the first of which names the operation:

Three lessons, and all three serve. (1) מעמידין מלוה על גבי פירות — a loan may be stood upon produce: that is the very principle of seif 1. (2) הוא דיש לו — provided he has some: that is the rule. (3) מה לי הן מה לי דמיהן — a thing and its price are interchangeable: that is what allows the cascading conversion of seif 2, and on it the question of payment in money at seif 3 will also depend.

Rav Safra’s beraita — seif 3

« יֵשׁ דְּבָרִים שֶׁהֵם מוּתָּרִין וַאֲסוּרִין מִפְּנֵי הַעֲרָמַת רִבִּית. כֵּיצַד? אָמַר לוֹ: הַלְוֵינִי מָנֶה! אָמַר לוֹ: מָנֶה אֵין לִי, חִטִּין בְּמָנֶה יֵשׁ לִי שֶׁאֲנִי נוֹתֵן לָך » (בבא מציעא ס״ב ע״ב)
« נָתַן לוֹ חִטִּין בְּמָנֶה, וְחָזַר וּלְקָחָן הֵימֶנּוּ בְּעֶשְׂרִים וְאַרְבַּע סֶלַע – מוּתָּר, וְאָסוּר לַעֲשׂוֹת כֵּן מִפְּנֵי הַעֲרָמַת רִבִּית » (בבא מציעא ס״ב ע״ב)
summary : there are things that are permitted and yet forbidden because of ha’aramat ribbit. How? He says, “lend me a maneh”; the other answers, “a maneh I do not have, wheat worth a maneh I do have”; he gives him wheat for a maneh and buys it back for twenty-four sela — it is permitted, and it is forbidden to do so, because of ha’aramat ribbit.
הערמת רבית — the device. The beraita uses two words that seem to contradict: מותרין and ואסור לעשות כן. There is no contradiction: each act taken alone is permitted; it is their sequence that is forbidden. The halakha therefore judges not only acts but arrangements.

4. The vocabulary of the siman

פוסק על שער שבשוק — “fixing a price on the market rate”: agreeing today, at today’s price, on a future delivery. It is the operation of which our siman is one case; the Rambam opens his chapter by putting it on a par with the loan in kind, and the Shulchan Arukh treats it in its own right at siman 175.
יצא השער — “the rate has come out”: the commodity has acquired a public price in the market. At siman 162 that sufficed to permit; here it no longer does — and the seif says so expressly: ואם לאו אסור אפי׳ יצא השער.
יש לו כשיעור מעותיו — “he has to the measure of his money”: the condition of seif 1, and it is stricter than that of siman 162. The reason, given by the Shach and the Taz: here it is a sale, and a sale bears only on what exists.
מעמידין מלוה על גבי פירות — “a loan is stood upon produce”: the name Rava gives the operation. The money claim is extinguished and replaced by a claim in kind, and that is lawful — provided the commodity exists.
מה לי הן מה לי דמיהן — “what is it to me, them or their price”: Rabbi Yannai’s principle, which Rava derives from the beraita. It grounds the cascading conversion of seif 2; and at seif 3 it governs the question whether one may pay in money what was promised in produce.
הערמת רבית — “the interest device”: an arrangement each of whose steps is lawful and whose whole has the shape of an interest-bearing loan. Forbidden by the Sages; and the question of what the court does with it is precisely the dispute of seif 3.
אבק רבית — the “dust of interest”, forbidden by the Sages and not recoverable at law. Seif 3 says that here there is not even that — שאפי׳ אבק רבית אין כאן — and the gloss reports the contrary view.

The Shach’s position, backed by the Beit Yosef, the Darkhei Moshe and the Bach. It is the point on which the Taz will contradict him at ס״ק ד.

Two rules running opposite ways, and one boundary between them. If money is given today against a future delivery, it is permitted once a rate exists, even with no goods: it is not a loan. But if money is lent with a stipulation that failing payment produce will be taken at today’s rate, it is forbidden — כיון דמחמת הלואה קאתי.

ס״ק ו — a real act of acquisition is needed

At seif 3 the wheat must have been drawn into the borrower’s domain, or acquired by a proper kinyan; failing which, says the Bach, the shape of interest remains in any case.

« דוקא משך החטים לרשותו או קנה בדרך קנין גמור הא לאו הכי משמע דנראה כרבית בכל ענין » (ש״ך יו״ד קס״ג ס״ק ו)

ס״ק ז — and if the wheat fell in the meantime?

Then there is nothing at all: no interest, not even a device. The seif specifies ועדיין הם שוים מאה precisely for this.

ס״ק ח — paying in money what was promised in produce

The Shach refers the question to the dispute of Rabbenu Tam and the Rashbam on מה לי הן מה לי דמיהן, at siman 175 — that is, to Rava’s third lesson.

ס״ק ט — everything turns on the first words spoken

Had he said “lend me wheat”, there would have been nothing to forbid. It is the request for a loan of money that gives the arrangement its shape.

ס״ק י — even on the stringent view, payment in produce is permitted

The Shach defines the scope of the gloss: even according to those who hold it avak ribbit, he may pay in wheat — only, he cannot be compelled to.

ס״ק י״א — “characterised interest”, or only its likeness?

The Bach qualifies the gloss’s formula: the decisors’ language suggests a likeness of characterised interest, not characterised interest itself. The nuance decides what the court makes one return.

ס״ק ה — when the second conversion escapes the rule

If the money had not come as a loan but as a price paid in advance, one may then fix a price on the wine without having any — provided one “stands the wine upon the wheat” and has not converted the wheat into a sum.

« הא דאסור באין לו יין היינו דוקא כיון שמתחילה נקנו לו החטין מחמת הלואה משום הכי בעינן בכל מה שיקח ממנו אח״כ שיש לו דוקא » (ט״ז יו״ד קס״ג ס״ק ה)

ס״ק ו — why the seif specifies “they are still worth a hundred”

Without that specification there would be nothing to discuss; and conversely, if the wheat had been worth only ninety from the start and he gave it for a hundred, that would be characterised interest, not a device.

ס״ק ז — the Taz’s leniency: an hour later

For the Taz, the prohibition bears only on an operation done at one stroke; if the buy-back comes after an interval, it is a complete leniency. The Nekudot HaKesef will contest it.

« ונ״ל פשוט דהאיסור שבסעיף זה הוא שבשעה אחת נעשה כן אבל אם לאחר שעה שלקח החטין במאה חזר ומכרן לו בתשעים היתר גמור הוא » (ט״ז יו״ד קס״ג ס״ק ז)

The Nekudot HaKesef — one entry, and it decides

On this siman they speak only of the Taz’s last point — and they refuse it: the comparison with siman 174 does not hold, because there it was a sale, whereas here the man began by asking for a loan.

The Pitchei Teshuva — two entries

The second is the more interesting: the Chatam Sofer reads the seif’s כמו שהוא השער as a specification of exclusion — at the rate, and not below it.

The Baer Hetev — six entries

The Baer Hetev sets the Shach, the Taz and the Nekudot HaKesef side by side, entry by entry; on the two contested points of the siman it is he who gives the exact state of the debate.

The most useful sentence in the siman is a parenthesis of the Baer Hetev. It says the Taz permits where the debtor has money, and at once adds his own reservation — להלכה ולא למעשה להקל. The Taz himself wrote it, and it settles the question in practice: the position exists, one does not rely on it to be lenient.

7. The Rambam — in which treatise is this rule codified?

The Rambam of this block is הלכות מלווה ולווה. Our siman appears there in two places, and the separation is instructive: seif 1 is the last halakha of chapter 10 — the chapter that carries the whole of siman 162 — whereas seif 3 is in chapter 5, among the general rules of interest, under the exact heading הערמת רבית.

The Rambam writes ואם אין [לו] אותו המין, not “if he has no money”. It is on that word that the Beit Yosef relies against the Taz: the condition bears on the kind, not on the ability to buy it. And the same at chapter 5: the Rambam holds that the creditor recovers his hundred — שאפלו אבק רבית אין כאן — which the Ramban and the Rosh refuse.

8. Contemporary cases

Case 1 — A supplier who cannot pay and offers goods

This is exactly seif 1. The question to ask is not “is the price fair?” but “does he have the goods, now, for the full amount of the debt?”. If he does, today’s price suffices; if he does not, no market rate makes up for it. For practice, consult your Rav.

Case 2 — A money loan with a clause of payment in kind on default

The Shach expressly rejects this at ס״ק ד: כיון דמחמת הלואה קאתי. The suspensive clause changes nothing about what the transaction is — a money loan that may unwind into a commodity whose price has moved. For practice, consult your Rav.

Case 3 — An advance payment for future deliveries

This is no longer our siman, and that is what the Shach stresses at ס״ק ד: where the money is given for the goods, and not lent, it is enough that a rate exists. The whole difficulty is knowing which side of that line one stands on. A question for your Rav.

Case 4 — A sale followed by an immediate buy-back

This is the shape of seif 3, and also that of many modern financial arrangements. The siman does not judge lawfulness step by step — it judges the shape. And it adds two markers: if the buy-back was agreed in advance, the classification is graver; if the final payment is in goods, it is lighter. A question for your Rav.

Case 5 — An arrangement already carried out, whose flaw is discovered

Seif 3 and the gloss give two opposite answers, and this is one of the few places in the block where the question of the remedy is expressly disputed: the Mehaber holds the creditor keeps the hundred, the gloss reports the view that it is avak ribbit. The Beit Yosef concludes like the Rambam. A question for your Rav.

9. Summary of Siman 163

One sentence. A money debt may be converted into a debt in kind at the day’s price on one condition: that the debtor have that commodity, for the full amount — a market rate does not stand in for it; and an arrangement that ends in returning a hundred for ninety remains forbidden even if each of its steps is lawful.
