1. אימת קנאה — what a pledge does not give

The gemara does not ask whether the rent is excessive. It asks when the lender acquired the field. The whole matter of seif 1 turns on a question of ownership, not of price.

The Neresh device, and why it fails The men of Neresh had seen the difficulty and dealt with it by a clause: we acquired from him, several terms elapsed, and then he leased it back. The clause supplies on paper what is missing in fact — an interval, an acquisition. The gemara sweeps it away in three words.

Hakira: is the clause set aside because it is false, or even when it is true? (א) Because it is false. The clause describes an interval that never occurred; it is a scribe’s formula, and a deed does not manufacture a fact. (ב) Even when it is true. A real interval would change nothing, because what the lender lacks is not time but title: a pledge does not make him an owner, and a hundred years of holding will add nothing. The Shakh rules expressly for (ב) — ואפילו האמת נמי הכי.
Nafka mina On (א), a truthful deed and a long actual holding would suffice to permit the lease; on (ב), they would not — and this is just what the Taz says at ס״ק א, pressing it to the case where the lender took no possession at all: there, there is not even a pledge, only a loan.

הממשכן שדה לא יחכירנו. ובו ה׳ סעיפים:
מי שהיתה שדה ממושכנת בידו לא יחזור וישכיר אותה לבעל השדה ויש מי שמתיר לעשות כן במשכנתא דסורא: הגה ובלבד שלא התנה מתחילה על כך (ריב״ש סי׳ ש״ה) וגם שכבר החזיק המלוה בשדה אבל בלאו הכי לכולי עלמא אסור (ב״י סימן קע״ב בשם תשובת רשב״א):

2. רבית קצוצה או הערמת רבית — Rashi against the Rambam

Everyone forbids. The question is which prohibition it is — and the answer decides everything that follows: restitution, the effect of a third party, the reach of the משכנתא דסורא.

What each position must maintain For Rashi, the rent is the interest on the loan: it appears retroactively — איגלאי מילתא למפרע — that the loan had been made on that condition. The position therefore requires reading into the sequence a stipulation never uttered. For the Rambam, each piece is lawful and only the assembly is vicious: it is a הערמה, a rabbinic prohibition, and nothing is recovered.

Hakira: where does the fault lie — in the loan, or in the lease? (א) In the loan. The loan was made in order to obtain the lease; the loan is what is tainted, and the lease is merely the mode of collection. This is Rashi’s reading, and it explains the למפרע. (ב) In the lease. The loan was sound; it is the later lease that, being made with the borrower, takes on the appearance of interest without being it. This is the Rambam’s reading, and it explains why there is nothing to restore: no sum was paid as interest.
Nafka minot (1) Restitution: recoverable in court for Rashi, not for the Rambam. (2) The effect of a third party: on (א), his interposition erases the proof of the stipulation and removes the fixed interest — the Shakh says so expressly. On (ב), there never was a stipulation to erase, and what remains is an appearance, which the third party also dispels. (3) The gloss on seif 1: the condition “that he did not stipulate at the outset” carries real weight only on (א).

3. דעת המחבר — what the Shakh deduces from where seif 2 stands

The Mehaber nowhere says whether he holds with Rashi or with the Rambam. The Shakh makes him say it, by noting where he placed the third-party permission.

The Shakh’s reasoning

The argument, unfolded The Rashba’s disciples had written that a third party’s interposition permits in the case of seif 1 itself. Yet the Mehaber writes it only at seif 2, for the משכנתא דסורא. Why the narrowing? Because for one who holds the case of seif 1 to be fixed interest, the third party only removes the fixed interest — dust of interest remains, and it stays forbidden. In the משכנתא דסורא, by contrast, there is not even dust: it is permitted according to all. The Mehaber’s narrowing is therefore the signature of a position.
Kashya: does the Mehaber really follow Rashi? The same Mehaber writes at seif 4 that the fruits are fixed interest — the position of the Rambam and the Rif. If he follows the Rambam at seif 4, how does the Shakh attribute Rashi’s position to him at seif 1?
Teruts: two distinct questions There is no contradiction, because the two seifim do not ask the same question. At seif 4 the clause is void, and the fruits were eaten from another’s property by reason of the loan: they are interest outright, and the Rambam himself writes so. At seif 1 the lender takes a rent for property he holds legitimately in pledge: nothing there is interest in law, and the question is whether the sequence reveals a stipulation. The Mehaber may therefore be with the Rambam where the Rambam speaks of Torah interest, and with Rashi where the Rambam sees only a circumvention.

4. תמיהת הט״ז — the Levush, the Taz and the Nekudot HaKesef

The Taz’s question on seif 2 If seif 1 has already reported a view permitting the משכנתא דסורא even to the borrower himself, what is seif 2 for, which permits the משכנתא דסורא only with a third party interposed? It permits less than what precedes it.

The Levush’s answer, as the Taz reports it Seif 2 would deal with a case where the lender never took possession of the field; there the permission of seif 1 does not apply, and a third party is needed.

The Taz’s teruts: seif 2 attaches to the first view Seif 2 does not continue the יש מי שמתיר but the opening view of seif 1, the one that forbids — including in a משכנתא דסורא. Upon that view the Mehaber adds that an interposed third party permits all the same, according to all; and this presupposes that the lender took possession.

The Nekudot HaKesef’s reply The Shakh, in his notes on the Taz, denies the premise: the Ritva holds that the permission applies even where the lender never entered into the pledge. If so, the argument by which the Taz dismissed the Levush falls — and with it the need to attach seif 2 to the opening view.

Nafka mina A lender who never took possession of the property, and a third party who comes between. For the Taz nothing is saved: without possession there is no pledge, only a loan, and the rent is interest. For the Ritva reported by the Shakh, the permission applies. And the Rama’s gloss on seif 1, which expressly requires שכבר החזיק המלוה בשדה, stands on the Taz’s side.

5. משכנתא דסורא — a name of lease, and why the Beit Yosef does not permit

The Taz’s yesod: a change of name, not of degree The Taz does not write that the משכנתא דסורא is a milder pledge. He writes that it no longer bears the name of a loan: אין שם הלואה עליו אלא שכירות. The creditor has nothing to claim at the term — the field goes out בלא כסף — hence there is no debt outstanding, hence there is no one of whom it could be said that he takes a surplus on a loan. It is the only place in the siman where the prohibition falls not for want of proof but for want of an object.
And yet the Beit Yosef does not permit The Mehaber reports the permissive view in the style ויש מי שמתיר — a singular, which already tells of the position’s isolation. And in the Beit Yosef he rules expressly the other way.

A rule of conduct, not a refutation Note the form of the ruling: כיון שגדולים אוסרים אין להקל. The Beit Yosef does not refute the permissive view; he declines to rely on it. That is why the Mehaber can write it in the Shulhan Arukh without contradicting himself: he reports it as an existing opinion, not as a practice.

6. מכר וחכירות — what the קנין גמור changes in seif 3

Kashya: seif 3 reverses the condition of seif 1 The gloss on seif 1 requires that the lease not have been stipulated at the outset; seif 3 expressly permits selling while stipulating the lease. The same stipulation vitiates here and does not vitiate there.
Teruts: the stipulation proves interest only where a debt remains What the stipulation revealed at seif 1 is that the loan had been made in order to obtain the rent. At seif 3 there is no loan: there is a price paid and property gone out of the seller’s estate. The stipulation there reveals nothing but a commercial preference. The Beit Yosef says so in so many words.

The Beit Yosef’s criterion, and the Taz’s condition The criterion is that of lasting mastery: the buyer is גדול באדנות הבית — greater in lordship over the property — than the one who rents from him. The Taz draws from this the material condition the text leaves unsaid.

Hakira: is the קנין גמור a requirement of form or of substance? (א) Of form. Without a valid act of acquisition there is no sale, and one falls back mechanically under seif 1; the requirement belongs to the law of sales and is not peculiar to ribbit. (ב) Of substance. The Taz writes דאם לא כן הוה כהלואה: it is not only that the sale is missing, but that the money paid becomes a loan again. The requirement is then peculiar to our matter — it prevents a loan from disguising itself as a price.
Nafka mina A sale perfect in its forms, but carrying a right of repurchase for the seller. On (א), the sale holds and the lease is lawful. On (ב), the right of repurchase gives the price back the face of a loan, and the whole becomes the arrangement of seif 1 again.

Two steps, not one The mishna said הרי היא שלו — the field is his. It is the general rule of אסמכתא, laid down elsewhere, that overturns it: what is promised on a condition is not acquired. And only then does the question of ribbit arise: the field not being acquired, the fruits were consumed from another’s property, and were consumed by reason of the loan.
The Rambam, who links the two steps

Hakira: are the fruits interest, or robbery? (א) Interest. The lender took them by virtue of the loan: this is the surplus the Torah forbids, and it is recoverable in court on that footing. So the Rambam and the Mehaber. (ב) Robbery. The field not being his, he simply ate another’s property, and restitution owes nothing to the law of ribbit. The Taz uses that word at ס״ק ו — שזהו אכל בגזל — but only for the period after the three years.
Nafka minot (1) If the lender has died: fixed interest is not recovered from the heirs, robbery is. (2) If the debtor expressly waived: a waiver is effective for robbery, it is not effective for interest of the Torah. (3) The qualification also decides how much the “after three years” period owes to מחילה בטעות rather than to ribbit — and that is the next chapter.

8. תוך ג׳ ולאחר ג׳ — the dividing line

Kashya: why should three years make a difference? The field is not acquired, before or after. If the fruits are interest, they are so from the first day; if they are not, they do not become so after three years. The break cannot therefore come from ribbit.
Teruts of the Rosh: the break comes from מחילה, not from ribbit Within the three years the lender eats by way of interest — and dust of interest is not reclaimed. After the three years he eats as a man who believes himself the owner, by the sufferance of an owner who believes himself dispossessed: that is a waiver, and a waiver made in error is none. The question of restitution therefore changes its footing along the way.

The Shakh’s criterion: what was in his power The Shakh gives the reason why the silence of the first three years is no error: during that time the owner could still repay and take back his field. His sufferance was informed. After the term he believed the field lost, and his sufferance no longer bore on anything real.

Nafka mina A debtor who, during the three years, materially had no means of repaying. The Shakh’s criterion — שהרי בידו וברשותו היה להחזיר המעות — is no longer met, and the ground of a waiver made in error might extend to the first period. The Shakh does not treat this case; he supplies its criterion.
A difficulty the Shakh himself notes The Mehaber rules here without reporting the contrary view, whereas in the parallel place in Choshen Mishpat he did report it. The Shakh notes it — וק״ק, this is a slight difficulty. The Rama’s gloss comes precisely to fill that silence.

9. יסוד הסימן — טובת המלוה הבאה מחמת ההלוואה

The four seifim may be read by a single measure: does the advantage the lender draws from the property come to him from the loan? The rent paid by the borrower, yes — the Rambam gives the image: זה עומד בשדהו כשהיה. The rent paid after a third party has come between, one can no longer say so — and the Shakh shows that this is the whole reach of seif 2. The rent of a property that was bought, no: the loan is gone, replaced by a price. And the fruits of a field that an “if” clause could never make his, yes — until the day the owner believed himself dispossessed, and his very sufferance became an error.

The siman therefore knows no gradation of gravity: it knows a gradation of legibility. That is why the gloss on seif 1 sets not conditions of degree but conditions of proof — nothing stipulated, and a real possession — and why the משכנתא דסורא is the one case where the prohibition falls not because it can no longer be seen, but because there is no loan at all.
The word of the siman is neither שכירות nor רבית: it is מוכחא מילתא — what the thing shows.
