1. The axiom: the advantage that comes from the loan
The starting point:
The siman never asks whether the rent is fair, nor whether the pledge is equitable. It asks one thing: what the lender draws from the property, does he draw it by reason of the loan? The Rambam gives the decisive image — the borrower עומד בשדהו כשהיה, he has not moved from his field: what he pays therefore buys nothing.
Hence the axiom: the siman grades not gravity but legibility. When the advantage can be read, it is forbidden; when a third party, a sale, or the very absence of a debt erases it, the prohibition falls with it.

2. The 3 reflex questions
1. Is there an outstanding debt? If the property was sold (seif 3), no. If the משכנתא is of Sura, the Taz says it no longer bears the name of a loan. Otherwise, yes.

2. Who pays, and to whom? If the one paying the rent is the borrower himself, the advantage is legible. An interposed third party makes it illegible — and seif 2 draws the consequence only in a משכנתא דסורא.

3. Was title acquired? A pledge does not acquire — אימת קנאה. An “if you do not pay” clause does not acquire either — כל דאי לא קני. Only a sale completed by a קנין גמור acquires.

Do not confuse the gloss’s two conditions. “Not having stipulated” is a condition of intention; “having already taken possession” is a condition of fact, and it is the only one of which the gloss says לכולי עלמא אסור. Without possession there is no pledge at all.

What to retain
The Taz explains why one view permits: in a pledge of Sura the field goes out at the term without payment, hence there is no debt, hence no lender taking a surplus. But the Beit Yosef declines to rely on that view — not by refuting it but by abstaining: כיון שגדולים אוסרים אין להקל.
7. The sale of seif 3 and its hidden condition
The trap of seif 3. The text permits stipulating a lease at the time of the sale — which the gloss on seif 1 forbade. The difference lies not in the stipulation but in what was transferred: a קנין גמור passes the body of the property. Without it the price becomes a loan again, and one falls back entirely under seif 1.

💡 The three-year break does not come from ribbit. It comes from מחילה: what changes at the term is not the nature of the gain but the reason why the owner kept silent.

10. Golden rules, mnemonic, pitfalls and a flash card
The 5 golden rules
- A pledge does not acquire. אימת קנאה — the gemara’s question holds for every variant of the arrangement.
- A clause in a deed does not manufacture a fact, and a true fact would not suffice either: the Shakh writes ואפילו האמת נמי הכי.
- The interposed third party erases a proof; he does not cure a fault. Hence the limited reach of seif 2.
- A sale permits what a pledge forbids — provided it is a sale: קנין גמור.
- Silence is not a waiver when it rests on an error: מחילה בטעות.
Mnemonic — the word משכן
מ — מוכחא מילתא : what the thing shows decides
ש — שכירות ולא הלואה : the משכנתא דסורא, the only one whose name changes
כ — קנין גמור : what makes a sale a sale
ן — אין המקח קיים : the “if” clause acquires nothing
The 4 classic pitfalls
- Thinking the amount of the rent is at issue. It never is: the question is whether the lender had title.
- Reading seif 2 as an extension of seif 1. The Taz shows it permits less, not more — and the Shakh draws the Mehaber’s position from it.
- Taking seif 3 for a general permission. Without a קנין גמור there is no sale, and one is at seif 1.
- Thinking the field becomes the lender’s after three years. It never does: אסמכתא לא קניא. Only the question of the fruits remains open.
