המלוה לחבירו לא יעשה מלאכה בעבדו ולא ידור בחצרו. ובו ג׳ סעיפים:

1. שורש הפסק — what this siman settles, and what it does not

This siman settles neither the question of the rate nor that of the contract: it settles the question of form. Any benefit received from the debtor because one lent to him is interest, whatever its form — labour, lodging, reduction. What it does not settle is just as clear: it says nothing of commercial lending or of היתר עסקא, which come later in the block.

« וְכֵן הַמַּלְוֶה אֶת חֲבֵרוֹ וְהִתְנָה עִמּוֹ שֶׁיָּדוּר בַּחֲצֵרוֹ חִנָּם עַד שֶׁיַּחְזִיר לוֹ הַלְוָאָתוֹ. אוֹ שֶׁשָּׂכַר מִמֶּנּוּ בְּפָחוֹת וְקָצַב הַדָּבָר שֶׁפּוֹחֵת לוֹ מִן הַשָּׂכָר עַד שֶׁיַּחְזִיר לוֹ הַלְוָאָתוֹ. אוֹ שֶׁמִּשְׁכֵּן בְּיָדוֹ מָקוֹם שֶׁפֵּרוֹתָיו מְצוּיִין בְּעֵת הַהַלְוָאָה כְּגוֹן שֶׁמִּשְׁכֵּן חֲצֵרוֹ עַל מְנָת שֶׁיָּדוּר בּוֹ בְּחִנָּם. הֲרֵי זוֹ רִבִּית שֶׁל תּוֹרָה וְיוֹצְאָה בְּדַיָּנִין » (רמב״ם הלכות מלווה ולווה פרק ו׳ הלכה א׳)

Nor does it settle the case where there is no loan at all: the end of seif 3 shows this by an example, and that example is the only outright permission in the siman.

« מי שאינו צריך ללות מעות רק לטובת מלוה אומר לו בנה לך חורבה זו וכל מה שתוציא על זה עלי לשלם לך וכל זמן שאיני משלם לך דור בה בחנם מותר הואיל ואין כאן הלואה רק עשה לטובת המלוה » (שו״ע יו״ד קס״ו:ג)

Three seifim, three rulings, and they must be held apart lest one apply the wrong regime.

3. לכתחלה — the three prohibitions, and the Shach’s limit

The first point is the simplest and the most forgotten: there is no exception whatever in seif 1. The courtyard not rented out, the man who does not rent, the idle slave — all of these are named in the text in order to be included, not excluded.

« המלוה את חבירו לא יעשה מלאכה בעבדו אפילו הוא בטל ולא ידור בחצרו חנם ולא ישכור ממנו בפחות » (שו״ע יו״ד קס״ו:א)

The only real limit is the Shach’s, and it is one of scope: the prohibition targets what is conspicuous.

« דוקא הני שהן דברים של פרהסיא אסור אבל להשאילו כליו או בהמתו וכה״ג מותר אם היה משאילו בלאו הכי כיון שעושה אותו מדעת הלוה כדלעיל סי׳ ק״ס ס״ז » (ש״ך יו״ד קס״ו ס״ק א)

The Rosh is more lenient among people who already lent each other their courtyards; the Maharshal follows him only for objects, and sets down in passing the most demanding rule of the siman.

« וכ׳ עוד הרא״ש שי״מ היכא דידוע שקודם ההלואה היו אוהבים זא״ז כ״כ שהיו משאילים חצר זה לזה אם היו צריכים מותר להשאיל גם לאחר הלואה ואינו אסור רק בסתם בני אדם » (ש״ך יו״ד קס״ו ס״ק א)
« ומדברי מהרש״ל פ׳ הגוזל עצים סי׳ ט׳ נראה דלא שרי בכה״ג אלא דברים שאינן של פרהסיא כגון השאלת בהמה וכלים » (ש״ך יו״ד קס״ו ס״ק א)

In practice. Receive nothing conspicuous from the debtor: no lodging, no labour, no public honour — even if one is certain one would have received it without the loan. An object lent as one already used to lend it remains permitted. In doubt, ask.

4. בדיעבד — what is returned, and what is not

The lender has already lodged, or has already had work done. The question is no longer permission but restitution, and it is decided by the courtyard.

A courtyard not rented out, and a man not in the habit of renting: the Mehaber gives the first view without naming it — it is the Ramban’s, with the Rosh after him — and then the Rambam’s.

« ואם דר בו כבר כיון דחצר לא קיימא לאגרא אין צריך לתת לו אפילו לצאת ידי שמים ואפילו אם הוא גברא דעביד למיגר ולהרמב״ם אפילו אם גברא דלא עביד למגר הוי אבק רבית וצריך להחזיר אם בא לצאת ידי שמים » (שו״ע יו״ד קס״ו:א)
« וכתב הרמב״ן דוקא לכתחלה שבא לדור בו אבל אם דר בו כבר כיון דחצר לא קיימא לאגרא אפילו הוא גברא דעביד למיגר אם הלוהו ודר בו אין כאן שום צד רבית ואפילו לצאת ידי שמים א״צ לתת לו » (טור יו״ד קס״ו)
« וְאִם דָּר צָרִיךְ לְהַעֲלוֹת לוֹ שָׂכָר. וְאִם לֹא הֶעֱלָה לוֹ הֲרֵי זֶה אֲבַק רִבִּית לְפִי שֶׁלֹּא הִתְנָה עִמּוֹ שֶׁיַּלְוֵהוּ וְיָדוּר בַּחֲצֵרו » (רמב״ם הלכות מלווה ולווה פרק ו׳ הלכה ב׳)

A courtyard rented out: it is אבק רבית for all, hence no judicial recovery on the score of interest. But the Shach adds what the Mehaber did not write, and it is the most useful clause in the siman.

« ובחצר דקיימא לאגרא הוי אבק רבית (לכ״ע) (טור) » (שו״ע יו״ד קס״ו:א)
« דאע״ג דא״ר הוי ואינה יוצאה בדיינים מטעם רבית מ״מ חייב להעלות לו שכר דכיון דקיימא לאגרא אפילו בסתמא חייב להעלות לו שכר דחסריה ממונא ומשום דאית ביה איסורא לא הורע כחו » (ש״ך יו״ד קס״ו ס״ק ה)

And he at once gives its limit: if the lender said “dwell for free” after the loan, without naming the loan, he waived the rent.

« ומיהו אם אחר שהלוהו א״ל דור בחצרי חנם ולא הזכיר לו בשכר הלואתו בכי הא ודאי אע״ג דקיימא לאגרא לא הוי אלא א״ר כיון שלא קצץ עמו ואם דר פטור מלהעלות לו שכר » (ש״ך יו״ד קס״ו ס״ק ה)
In practice. (1) Courtyard not rented out: nothing is claimable, and nothing is owed on the view the Mehaber puts first; one who wishes to discharge his duty before Heaven follows the Rambam and returns it. (2) Courtyard rented out: the interest is not recovered, but the rent is claimable as an ordinary debt — barring an express waiver by the owner.

5. הלוני ודור בחצרי — the regime of stipulation, and the Shach’s ספיקא דדינא

Once the benefit has been spoken, the regime changes. Courtyard rented out: it is רבית קצוצה, and the court recovers it. Courtyard not rented out: the Mehaber says אבק רבית, and the Shach shows it is not so simple.

« אמר ליה הלוני ודור בחצרי אי קיימא לאגרא הוי רבית קצוצה ואי לא קיימא לאגרא הוי אבק רבית » (שו״ע יו״ד קס״ו:ב)
« ודעת הרמב״ם דבאומר הלוני אפילו בלא קיימא לאגרא הוי ר״ק » (ש״ך יו״ד קס״ו ס״ק ו)

The Shach declines to decide, and his conclusion is a rule of procedure — the possessor keeps. The Ba’er Hetev copies it as it stands, which brings it into practice.

« ותימה למה השמיט המחבר דעתו ולענין דינא נ״ל דספיקא דדינא הוא והמע״ה » (ש״ך יו״ד קס״ו ס״ק ו)
« ודעת הרמב״ם דבאומר הלוני אפילו בלא קיימא לאגרא הוי ר״ק ולענין דינא נ״ל דספיקא דדינא הוא והמע״ה » (באר היטב יו״ד קס״ו ס״ק ג)

The Rama, for his part, closes one door: once the loan is named as the counterpart, there is nothing left to discuss.

« ודוקא בסתם אבל אם אמר לו דור בחצרי בשכר הלואה אפי׳ לא קיימא לאגרא הוי כרבית קצוצה דמאחר שאמר לו בשכר מעותיך הוה ליה כאלו השכירו לו עכשיו » (שו״ע יו״ד קס״ו:ב)

There remains the case of the extension granted later. The Mehaber gives two views; the Shach writes where the agreement lies.

« ואם הלוהו ואחר זמן תבע חובו ואמר לו הלוה דור בחצרי יש אומרים שאינו אלא אבק רבית ויש אומרים שהוא רבית קצוצה והוא שיאמר לו כן בשעה שמרויח לו זמן » (שו״ע יו״ד קס״ו:ב)
« וכן הוא הסכמת רוב הפוסקים » (ש״ך יו״ד קס״ו ס״ק ח)
« אבל אם כבר הרויח לו זמן ובא בתוך הזמן ואמר דור בחצרי בשביל מעותיך שהן בטילות אצלי אסור » (ש״ך יו״ד קס״ו ס״ק ט)
In practice. Any formula tying the lodging to the money lent is absolutely to be avoided — that is where the siman’s only case of רבית קצוצה lies. On a courtyard not rented out, interest already taken will not be recovered in court (ספיקא דדינא), which does not make it permitted. And granting a benefit at the moment one gives an extension is treated as a stipulation by most decisors.

6. ניכוי — the Rama’s ruling, and its limit

The last case, and it is procedural: the debt is still running, the lender has consumed lodging, and the borrower asks that it be subtracted.

« היכא דהוי אבק רבית יש אומרים שאפילו אם לא פרעו עדיין ותובע הלוה שינכה לו מחובו שיעור השכירות לא מנכינן ליה ויש אומרים דמנכינן ליה » (שו״ע יו״ד קס״ו:ג)
« שאם אתה מנכה לו הוה כאילו אתה מוציא ממנו ודומה למשכנתא שבסי׳ קע״ב בהג״ה שאין לסלקו בלא מעות » (ט״ז יו״ד קס״ו ס״ק ה)

The Rama rules for the second view, and names those who carry it.

« והסברא אחרונה היא עיקר (היא סברת הרא״ש והטור ור׳ אפרים ורשב״א) » (שו״ע יו״ד קס״ו:ג)
« דדוקא במשכנתא דהוי ברשות המלוה והלוה מתחלה עליה לא מנכינן ליה כדלקמן סי׳ קע״ב ס״ס א׳ בהג״ה משא״כ הכא » (ש״ך יו״ד קס״ו ס״ק י״א)

The Pitchei Teshuva, in the name of the Noda BiYehuda, gives its exact limit, and it is decisive as soon as there are several creditors.

« עיין בתשובת נו״ב תניינא חי״ד סי׳ ע״ו שכתב דדוקא בכה״ג שהלוה טוען שינכה לו בזה הכריע הרמ״א כסברא אחרונה כיון דהלוה נקרא מוחזק והמלוה בא להוציאה ממנו אבל נגד שאר בעלי חובות אין נקראים מוחזקים נגד בעל חוב זה ולא מנכינן ליה » (פתחי תשובה יו״ד קס״ו ס״ק ג)
« לְפִיכָךְ אִם עֲדַיִן לֹא הֶחְזִיר לוֹ חוֹבוֹ וּבָא לְנַכּוֹת שְׂכַר הֶחָצֵר שֶׁדָּר בָּהּ מִן הַחוֹב אִם הָיָה הַשָּׂכָר כְּנֶגֶד הַחוֹב אֵינוֹ מְנַכֶּה לוֹ הַכּל אֶלָּא כְּמוֹ שֶׁיִּרְאוּ הַדַּיָּנִים » (רמב״ם הלכות מלווה ולווה פרק ו׳ הלכה ב׳)
In practice. Against the lender, the borrower may ask that the rent consumed be subtracted from his debt, and the Rama grants it to him. Against the debtor’s other creditors the deduction does not apply. The Rambam, for his part, deducts only as the judges see fit, so that the lender does not leave empty-handed.

7. מקרים בני זמננו — contemporary cases and summary

Case 1 — Lodging at your debtor’s home during a trip

Forbidden while the debt runs, even if the room would have stood empty, and even if one is certain one would have been invited regardless of the loan. This is the named case of seif 1, in its lightest form — and the text expressly includes it.

Case 2 — Asking an employee who borrowed from you for an extra hour

This is מלאכה בעבדו transposed. The criterion is not the cost to the employee but the origin of the hour: if it is given because there was a loan, it is interest. Recall that the Mehaber includes even an idle slave.

Case 3 — A tenant who borrows from you and offers you a free month of rent

This is ולא ישכור ממנו בפחות. If the reduction was agreed on the occasion of the loan, we are in seif 2 and it may be רבית קצוצה. If it came afterwards, unspoken, we are in seif 1.

Case 4 — “Lend me, and you will stay at my place”

The siman’s only clearly established case of רבית קצוצה, where the lodging is rented out. On lodging that is not rented out, the Shach leaves the law in ספיקא דדינא: nothing will be recovered, but nothing is thereby permitted.

Case 5 — The debtor who cannot pay and offers his studio in the meantime

This is the case of the extension. Two views in the Mehaber; the Shach writes that most see רבית קצוצה here. One must therefore abstain, and not rely on the lenient view.

Case 6 — A debtor who tutors your son and asks you for his expenses

The Rama treats this case by name: forbidden, even though he would have tutored without a loan, and even where the courtyard is not rented out. The way out he indicates is narrow: the money must be given as an outright gift, the borrower remaining free to pay nothing.

Case 7 — Honouring your lender with an aliyah to the Torah

The Maharshal, cited by the Shach and repeated by the Ba’er Hetev, forbids it: it is noticed. It does not suffice to know oneself that one would have done it without the loan; it must be known to all.

Case 8 — Building on your lender’s account, and dwelling there until repayment

This is the case of the ruin, and it is permitted: there is no loan, but an expense undertaken for the other’s benefit. The Shach at once gives its reverse: if the building serves the owner, the prohibition returns.

Case 9 — Claiming the deduction of rent against a debt still open

Permitted at the borrower’s request, on the Rama’s ruling. But if other creditors are competing, the Pitchei Teshuva writes that we do not deduct.
