1. שורש האיסור — interest where no one loses anything

Seif 1 forbids in a case where, at first sight, there is nothing to forbid: a courtyard nobody rents out, a man who would never have paid rent. No one loses, no one pays. And yet it is forbidden — and that clause is the key to the whole siman.

The mishnah and the gemara — the rule, then its novelty
« הַמַּלְוֶה אֶת חֲבֵירוֹ לֹא יָדוּר בַּחֲצֵרוֹ חִנָּם, וְלֹא יִשְׂכּוֹר מִמֶּנּוּ בְּפָחוֹת – מִפְּנֵי שֶׁהוּא רִבִּית » (בבא מציעא ס״ד ע״ב)
« אַף עַל פִּי שֶׁאָמְרוּ הַדָּר בַּחֲצַר חֲבֵירוֹ שֶׁלֹּא מִדַּעְתּוֹ – אֵינוֹ צָרִיךְ לְהַעֲלוֹת לוֹ שָׂכָר. הִלְוָהוּ וְדָר בַּחֲצֵירוֹ – צָרִיךְ לְהַעֲלוֹת לוֹ שָׂכָר » (בבא מציעא ס״ד ע״ב)
The gemara does not say that lodging is worth money. It says something finer: outside a loan, one who dwells in another’s courtyard without his consent pays nothing; with a loan, he pays. It is not the value of the lodging that changed — it is the title under which it is received. It is no longer an inconsequential fact: it has become the counterpart of a waiting.
The Taz’s difficulty: what was a favour becomes a transgression The Taz observes that the very same act, the day before, was not merely permitted but welcome: it is better for a master that his slave not learn the way of idleness. How can an act that benefited the owner become a disguised theft?

Ḥakira: does the prohibition of seif 1 bear on a taking or on an appearance? (א) A taking. The lender receives a benefit — lodging, labour — and its origin is his money tied up. It matters not that it cost the debtor nothing: what is forbidden is to receive something because one has lent. (ב) An appearance. Nothing real is taken where the courtyard is not rented out; what is forbidden is that the scene should look like interest. That is the Shach’s own word, who writes of the permitted case that it does not look like interest.
Nafka mina (1) The case of one who has already dwelt there, in seif 1: on (א) he took, and should restore; on (ב) there is no appearance left to correct once the deed is done. The Ramban/Rambam dispute reads exactly there. (2) The case where the borrower knows nothing of the benefit: on (א) the lender took; on (ב) nothing is seen.

Seif 1 continues with an “and if he has already dwelt there” that is not a concession but a full dispute, which the Mehaber carries in two movements: first one view, then ולהרמב״ם.

The Beit Yosef draws the map: where the line runs exactly The Beit Yosef does not present the divergence as a disagreement about lodging, but about the scope of Rav Nachman’s novelty. For the Ramban, הלוהו ודר says what it says only lechatchila; for the Rambam it holds after the fact as well, and אבק רבית results.

The difficulty: what is left of the gemara’s novelty? The gemara asks what Rav Nachman adds to the mishnah, and answers: from the mishnah alone one might have thought it spoke only of a courtyard held for rental and a man who rents; Rav Nachman teaches that even in the contrary case one must pay. If that is the novelty, how can the Ramban say that after the fact nothing is owed — not even before Heaven?

The Shach’s answer: the novelty is a novelty of לכתחלה The Shach reads the Mehaber’s clause as a gloss on that very word, and adds the condition the text lacks: it must further be a case where, without the loan, the occupant would have owed nothing at all — the factual situation being referred back to חושן משפט.
« כלומר אע״ג דלכתחלה בכל ענין אסור מיהו אם בדיעבד דר בו כיון דחצר לא קיימא לאגרא והוא בענין שאם לא הלוהו לא היה חייב לתת לו שכר מחמת שדר בו » (ש״ך יו״ד קס״ו ס״ק ב)
Ḥakira: where does the payment owed in הלוהו ודר come from? (א) From the prohibition of interest. The loan turns a free stay into a counterpart; the payment is then the repair of an interest, and follows the regime of אבק רבית — no recovery in court, but restitution before Heaven (Rambam). (ב) From a presumption of intent. Outside a loan we presume the owner claims nothing; with a loan that presumption falls, and the rent becomes an ordinary debt again. On (ב), where the courtyard is not rented out in any case there is nothing to presume — hence the Ramban.
Nafka mina The clause לצאת ידי שמים, which the Mehaber writes into the text itself. On the Ramban’s view there is nothing, not even that — not even a duty of conscience. On the Rambam’s view there is אבק רבית, hence no judicial compulsion but a duty to restore for one who wishes to discharge himself. A second nafka mina: the lender who asks a Rav, years later, whether he must return it.

3. הלוני ודור בחצרי — the view the Mehaber passed over in silence

Seif 2 looks clean: a courtyard held for rental, קצוצה; one not held for rental, אבק. The Shach shows that a line is missing — and that the practical law is not what the Mehaber lets one believe.

The Shach’s difficulty: a missing view, and a practical consequence The Shach observes that the Rambam holds a courtyard not held for rental to be רבית קצוצה once there was a stipulation, and that the Mehaber does not mention him. He does not merely note it: he draws a conclusion, and it is procedural.

The answer: the stipulation creates the rental value The Beit Yosef gives the Rambam’s reasoning in one sentence, and the disciples of the Rashba say it more sharply still: once he offered his courtyard against the money, he revealed that he was willing to rent it out — and from that moment it is קיימא לאגרא.

And the Rama, who adopts that reasoning without saying so The Rama’s gloss on this seif is precisely the reasoning of the disciples of the Rashba, applied to a slightly different formula: not “lend me and dwell”, but “dwell in exchange for the loan”. The Mehaber had not adopted the Rambam; the Rama brings his sevara in through the door of the explicit wording.

Ḥakira: does רבית קצוצה require an objective value, or does the stipulation suffice? (א) An objective value. There is Torah interest only if the lender received something of worth; a courtyard nobody rents is worth nothing, and a stipulation does not create value. That is the Mehaber’s reading. (ב) The stipulation suffices. What makes the קצוצה is the agreement, not the price: two parties who agree upon a rent make the rent. That is the Rambam’s reading, and it is the one the Rama takes up.
Nafka mina Recovery in court, and nothing else. On (א) the court does not recover — it is אבק רבית; on (ב) it does. The Shach declines to decide and leaves the matter in ספיקא דדינא: the possessor keeps. The Ba’er Hetev copies that conclusion as it stands, which carries it into practice.

4. קצץ בשעת מתן מעות — does the moment of stipulation make the קצוצה?

Seif 2 ends on two views, and what they disagree about is not the lodging: it is the very definition of רבית קצוצה. For Torah-level interest, must the stipulation have accompanied the handing over of the money?

The opposing view: the Tur, and the Shach’s position The Tur sees no difference between stipulating at the handing over of the money and stipulating later, when granting an extension: that extension is itself a handing over of money. The Shach writes that this is the agreement of most decisors.

The Shach’s difficulty with the Hagahat Derisha: how far does the second view reach? If an extension counts as a handing over of money, what of a lender who comes within an extension already granted and then obtains the lodging? The Tur forbids it. The Hagahat Derisha makes it רבית קצוצה; the Shach writes that he demonstrated the opposite in his own work.

Ḥakira: what exactly does the verse לא תתן לו בנשך do? (א) It ties the prohibition to the act of giving. The Torah forbids only what is agreed at the moment of handing over; all the rest is rabbinic. That is the Maggid Mishneh’s reading of the Rambam. (ב) It names the thing, not the moment. The verse says what interest is, and a late agreement is interest just as well. It then remains to explain why the Rambam speaks of רבית מאוחרת as a distinct case — precisely because there the money has already come back.

Nafka mina The Rama writes it himself, and it is a considerable generalisation: the same divergence holds for any interest not stipulated at the outset. The debate over the courtyard thus becomes the debate over every case of late interest.

5. שני חיובים במעשה אחד — the claim of interest and the claim of rent

Here is the most useful distinction in the siman, and it is written neither in the Mehaber nor in the Rama: what the court refuses to recover as interest, it may recover as unpaid rent. These are two claims, and they do not overlap.

The Shach — the most useful sentence in the siman
« דאע״ג דא״ר הוי ואינה יוצאה בדיינים מטעם רבית מ״מ חייב להעלות לו שכר דכיון דקיימא לאגרא אפילו בסתמא חייב להעלות לו שכר דחסריה ממונא ומשום דאית ביה איסורא לא הורע כחו » (ש״ך יו״ד קס״ו ס״ק ה)
The yesod: the prohibition does not strip the owner of his right The formula is the Beit Yosef’s, in the name of the disciples of the Rashba, and it deserves to be learnt as it stands: because there is a transgression in it, his claim is not weakened. In other words: that the lodging is interest does not cancel that it is also lodging, whose rent is owed.

The limit: what the lender said changes the rent claim If the lender said “dwell for free” after the loan, without naming the loan, he waived the rent: אבק רבית remains, but there is nothing left to claim. The rent claim can be waived; the interest claim is not created by speech.

And the Shach’s extension to a courtyard not held for rental The Shach adds that the same reasoning holds even in a courtyard not held for rental, wherever, without the loan, he would have had to pay — for instance if the owner had told him to leave, or if the occupation caused even a slight loss.

Seif 3 leaves definition for procedure. The debt is not yet paid, and the borrower asks that what the lender consumed in lodging be subtracted from his debt. Is that returning the interest to him — hence excluded — or merely not finishing the taking of it?

The Taz’s difficulty: to deduct is to recover The Taz gives the first view’s reasoning precisely: if one subtracts the rent from the debt, one has put a hand into the lender’s pocket exactly as if one had ruled against him. And אבק רבית is not recovered in court.

The Maharshal’s word אוושא מלתא leans to (א), but his exclusion of the house among friends leans to (ב).

The siman ends on a rare case: one commentator correcting the printed text of the Rama, and another answering him that the correction was not needed.

The yesod: interest is measured by benefit, not by loss. The eight chapters of this level all return to one point. Seif 1 forbids where no one loses; seif 2 gives birth to a rent out of a spoken word; seif 3 refuses to recover what was taken, yet agrees not to finish taking it. What the Torah forbids is not impoverishing the borrower: it is charging for time.
