Twenty-seven seifim are badly remembered as a list. They are well remembered by their hinges: three questions asked in the same order for every case, and three words that answer them. This level does not repeat the text: it gives the structure, and shows where each seif hangs on it.

The Rambam gives the principle, and seif 4 is its one-line demonstration: interest paid to a Jew is permitted, once the lender is the non-Jew.
For any case in the siman, four questions in this order and no other.
| # | The question | What it decides |
|---|---|---|
| 1 | Did the non-Jew act for a Jew? (שליחות) | If so, the transaction is the Jew’s — but the prohibition is only rabbinic, and Rabbeinu Tam denies it. |
| 2 | On whom does the loss fall if the borrower repays nothing? (אחריות) | This is the decisive criterion of seifim 10 to 24. Whoever loses is the lender. |
| 3 | Was the right sold or only pledged? (מכר) | A question proper to seifim 18 to 20. A sale severs the link; a pledge does not. |
| 4 | What does the onlooker see? (מראית העין) | It arises after the first three have permitted. Seifim 22, 23, 24. |
The twenty-seven seifim, grouped by movement, with the word that governs each.
| Seifim | The movement | What is decided there |
|---|---|---|
| 1-3 | A Jew’s debt to a non-Jew, taken over by another Jew. | Forbidden (1); permitted if the non-Jew took and gave in hand (2), or if laid on the ground, or as a deposit (3). |
| 4-8 | The circuits, and the question of agency. | A non-Jew’s interest paid to a Jew is permitted (4); the three-way circuit is forbidden (5); the mirror of seif 1 is permitted (6); borrowing in a non-Jew’s name binds the borrower alone (7); an agent who deviates breaks the agency (8). |
| 9-12 | The pledge: what the lender knows and what he does not. | Ignorance protects (9); knowledge binds (9); a pledge taken by force is not presumed conveyed (10); a pledge lent to the non-Jew binds him (11); an agent who withholds is not the borrower (12). |
| 13-17 | The agent: the formula, its burdens, its limits. (13); the rate gap belongs to the agent, and he must not say he will pay (14); he has no say in the pledge’s sale (15); the risk decides (16, 17); and suretyship is referred to siman 170. |
| 18-19 | The sale of the right in the pledge — and its counterfeit. | The formula of sale permits (18); זקיפה and credit debts bound it (18); and where the non-Jew is only scenery, it is תחבולות רשעים (19). |
| 20-24 | The reversal: a Jew’s money or pledge in a non-Jew’s hand. | A Jew’s pledge with a non-Jew is permitted (20); deposited money follows the אחריות (21, 22); a wage does not shift the risk (23); nor does guardianship (24) — and appearance forbids what substance permits. |
| 25-27 | Proof, and two closing cases. | The presumption לא שביק היתירא dispenses with the oath (25); undertaking to pay is permitted when the loan comes from the non-Jew (26); the agent does not redeem but must produce the non-Jew (27). |
Two views, and almost the whole siman is read in the gap between them.
| Rashi and his school | Rabbeinu Tam | |
|---|---|---|
| The principle | No Torah agency, but the Sages upheld it for stringency. | No agency at all, not even for stringency. |
| Seif 6 | Forbidden — and rabbinic, per the Shach. | Permitted. |
| Seif 9 | Lending on a Jew’s pledge handed over by a non-Jew is forbidden if one knows. | Permitted even lekhatchila, even on his own books. |
| The ruling | The Mehaber, and the Rama: | The Tur attributes it to the Rosh; the Beit Yosef disputes it. The Rama does not protest against the custom. |
This table is the most useful in the level. Three closely similar clauses, three regimes, and seif 16 distinguishes them in one sentence.
| The regime | What it says | Its status |
|---|---|---|
I answer for these funds as a bailee — even for force majeure.” | Permitted. So long as the funds subsist in kind, he has borrowed nothing. |
| ערב | “If you find nothing of his at the time of payment, I shall pay you principal and interest.” | Permitted — כדין ערב. He pays only in default, not in place. See siman 170. |
If the debts are lost I shall pay them to you.” Or: “so long as he has not paid, I pay.” | Forbidden. It is a borrowing, and the loan becomes Jew to Jew. |
The pledge occupies twelve seifim, and six configurations exhaust the matter. The table is read by crossing two data: whose the pledge is, and in whose hand it lies.
| The pledge belongs to… | …and lies with | Its status |
|---|---|---|
| Un non-Juif · של עובד כוכבים | a Jewish lender, given willingly | Permitted (seif 9). And if a Jew comes to claim it, he is not believed. |
| Un non-Juif · של עובד כוכבים | a second Jew, by sale of the right | Permitted (seif 18) — provided it is a sale and not a loan. |
| Un non-Juif · של עובד כוכבים | a second Jew, the money serving the first Jew | Forbidden (seif 19) — תחבולות רשעים. |
| Un Juif · של ישראל | a non-Jew, lent by the Jew for that purpose | Permitted (seif 11); and the Rama settles the case of the violent non-Jew. |
| Un Juif · של ישראל | a non-Jew, then re-pledged with a Jew | Permitted per the Rosh (seif 20); some require קנה מעכשיו. |
| Un Juif · של ישראל | a Jewish lender who knows it is a Jew’s | Forbidden (seif 9); and if merely recognisable, מכוער הדבר. |
Seif 18 is the most relied-upon seif of the siman. Its permission has an exact form and two limits never to be forgotten.
| What is required | Who requires it | |
|---|---|---|
| The form | A sale of the right in the pledge, expressly stated. | The Mehaber and the majority of decisors. |
| The leniency | The sale is presumed: one who re-pledges without saying anything intends the licit. | The Rama, in the name of the Mordechai and a responsum of the Rosh. And such is the custom. |
| The objection | A sale coupled with an obligation to reconvey is no sale. | The Taz — פסק זה נ״ל תמוה; and the Shach states the same difficulty. |
| The rescue | The pledge not having been acquired by the first Jew, it remained the non-Jew’s: nothing passes from Jewish hand to Jewish hand. | The Shach, through the Rosh and the Baal HaIttur; and the Nekudot HaKesef against the Taz. |
Three consecutive seifim lay down a prohibition unrelated to what precedes, and not lifted in the same way.
| The case | In substance | By appearance |
|---|---|---|
| A non-Jew’s money deposited with a Jew, at the non-Jew’s risk (22). | Permitted. | Forbidden — and the Shach extends it even to a plain deposit. |
| A non-Jew hires a Jew to lend out his money (23). | Permitted. | Forbidden — unless the matter is publicly known. |
| A Jew is a non-Jew’s guardian over all his property (24). | Permitted. | Permitted too — the role is public, says the Taz: the appearance falls away of itself. |
Eleven words, and the siman is legible. Five come from the block on interest, six belong to it alone.
Mnemonic. Four words in order, and neither the question nor its rank is forgotten: The first asks about the act, the second about the risk, the third about title, the fourth about the eye.
The classic pitfalls.
| The pitfall | What is supposed | What the siman says |
|---|---|---|
| 1 | Routing through a non-Jew suffices to make the loan licit. | No — seif 1. So long as the money leaves the Jew’s hand as a loan, it is his debt, and it is stipulated interest. |
| 2 | If the interest is paid to a non-Jew, there is no prohibition. | No — seif 1 again. And the reverse is true: seif 4 permits interest paid to a Jew. |
| 3 | Taking responsibility for the funds is forbidden in any case. | No — seif 16. A bailee’s liability, even extended to force majeure, does not make a borrower. |
| 4 | Telling the lender one will oneself pay principal and interest is always forbidden. | No — compare seif 14 with seif 26. The direction of the loan decides: borrowed from a Jew, forbidden; from a non-Jew, permitted. |
| 5 | Explaining the situation to the borrower lifts the prohibition of appearance. | No — the Shach expressly rejects it. Only notoriety lifts it: שאומנתו בכך. |
| 6 | The custom of seif 18 permits any assignment of a claim. | No — two limits: זקיפה destroys the arrangement, and credit debts require an express release. |
