Siman 171 — What the זקיפה does, and how far a reason carries

A single seif, one ‘hakira, and three disputes that follow from it

The siman is one line long and carries three disagreements. They look independent; they are not. Each is settled by the answer one gives to a single question: does the settlement of account do something in law — does the interest become principal — or is it merely a date the Sages chose to mark a stringency?

1. גדר הזקיפה — the ‘hakira that governs the whole siman

The seif makes the whole first case depend on a date: that of the זקיפה במלוה. Before asking what follows from it, one must ask what that act does.

The seif, and the reason the Tur gives it
« ישראל שלוה מעות מהעובד כוכבים ברבית וזקפן עליו במלוה ונתגייר אם עד שלא נתגייר זקפן עליו במלוה גובה קרן ורבית » (שו״ע יו״ד קע״א:א)
« שהרי קודם שנתגייר חזר כולו כקרן דמשעת זקיפה חשוב כגבוי » (טור יו״ד קע״א)
‘Hakira: what does the settlement of account do? (א) It transmutes. The interest is deemed received at that date — חשוב כגבוי — and what is received licitly does not become illicit again: the new debt is entirely principal. (ב) It does nothing, and is only a marker. By strict law, what accrued during the licit period is recoverable in any case; the Sages merely chose the settlement as the line from which they impose a stringency.
Both views are written, and on the same page The Tur and the Taz give (א): from the settlement, all is deemed received. The Maggid Mishneh, reported by the Shach, the Taz and the Ba’er Hetev, gives (ב): by strict law he could collect, but the Sages ordained to follow the settlement stringently.

(3) The seif’s second case without a settlement, where the Shach concludes with a stringency.

2. Maharik and Terumat HaDeshen — how far does the recovered interest reach?

First consequence, and it is debated by name. Where the settlement preceded the conversion, does one recover also the interest that accrued after it?

Machloket, in reading the Rosh (א) The Maharik, shoresh 136. For the Rosh, the interest recovered is only that which accrued before the conversion. (ב) The Terumat HaDeshen, siman 303. For the Rosh, even interest that accrued afterwards is recovered, because from the settlement everything became like principal. And the Beit Yosef adds that the Tur’s words incline towards (ב).

The division follows the ‘hakira exactly The Terumat HaDeshen reasons by (א): the transmutation is done, there is no interest left to forbid, and what accumulates accumulates on principal. The Maharik reasons by (ב): the conversion remains the true frontier, and the settlement did not move it.
Deciding The Shach, at ס״ק א, follows the Terumat HaDeshen and writes that “the Acharonim” follow him. He also refers to the end of the previous siman, where the same rule is written — and the reference is exact.

3. לא זקפן כלל — the Shach against the Prisha

Second consequence. The seif speaks only of the case where there was a settlement. And if there never was one?

Kushya The Maggid Mishneh writes that by strict law one may collect, and that the Sages ordained to follow the settlement stringently. If the stringency consists in following the settlement, then where there was none, only the strict law would remain — so one would collect. That is the Prisha’s reading.

The Shach’s answer What the Maggid Mishneh named, he named לרבותא: to state the stronger case. Even where there was a settlement — that is, where something argued for collecting — the Sages tightened; all the more so where there was nothing. The Bach and the Ateret Zahav write likewise, and not like the Prisha.

What separates the two readings The Prisha reads the Maggid Mishneh’s sentence as a condition: the stringency attaches to the settlement, and without it it has no object. The Shach reads it as a maximal example: it holds a fortiori without it. And the ‘hakira returns: on (א), the settlement is what produces the effect, so its absence should tell against the creditor — which is indeed the Shach’s conclusion.
Nafka mina A loan never settled in account, whose non-Jewish lender converted: on the Prisha he would recover the interest predating his conversion, on the Shach he recovers only the principal. The Ba’er Hetev reports the Shach’s position, with the same supports.

4. The Mechaber’s silence — reading a silence through its source

Third consequence, and it bears on the seif’s second case. The Mechaber writes אע״פ שזקפן עליו אחר שנתגייר — so he presupposes a settlement. And if there was none?

Machloket (א) The Tur and some decisors. The same holds: the interest is recovered, since he borrowed while he was a non-Jew. (ב) The Maggid Mishneh, in the name of “some”, and the Rambam. Without a settlement, no.

And here is how the Shach decides — worth keeping for its own sake He does not weigh the views: he looks at where the Mechaber’s wording comes from. It is copied from the Rambam; and the Rambam is taken, per the Maggid Mishneh, to exclude the case without a settlement. The Mechaber’s silence is therefore not a permission: it is the silence of his source. Hence וטוב להחמיר.

Nafka mina, and a lesson in method Reading a silence of the Shulchan Arukh through the work whose language it copies is a powerful and limited tool: it holds where the copying is established — and here it is, the Shach says so expressly. Elsewhere the same reasoning would be a conjecture.

5. The רמ״ה and the Rosh — may the Sages make a man pay interest?

One question remains, which the seif settles without naming it, and which the Tur and the Beit Yosef set out at length: does the convert-borrower also pay the interest that accrued after his conversion?

Machloket (א) The רמ״ה, the Rambam and the disciples of the Rashba. He pays only the interest predating his conversion. (ב) The Rosh. He pays even what accrued afterwards, until payment.

The substance of the disagreement, and it is considerable After the conversion, taking interest from this man would be a Torah prohibition. The Rosh accepts that and gives the reason: the Sages have the power to uproot a matter of Torah, even where a transgression is at stake. The רמ״ה and the Rambam do not accept it: the takana covers what he already owed as a non-Jew, and no further.

The conclusion, and it is written twice Once in the Beit Yosef, who weighs the number and the reasoning; once in the seif itself, whose last clause limits recovery to what he became liable for when he was a non-Jew. The Mechaber did not have to decide: he wrote the decision into his wording.

6. The asymmetry — why the two cases are not treated alike

It remains to understand why the two cases do not receive the same treatment, whereas the baraita treated them alike.

Kushya The baraita states both cases in the same terms, with the same test of date. Rabbi Yosi disputes only the second. Why only that one?
« תָּנוּ רַבָּנַן: יִשְׂרָאֵל שֶׁלָּוָה מָעוֹת מִן הַנׇּכְרִי בְּרִבִּית, וּזְקָפָן עָלָיו בְּמִלְוֶה, וְנִתְגַּיֵּיר. אִם קוֹדֶם שֶׁנִּתְגַּיֵּיר זְקָפָן עָלָיו בְּמִלְוֶה – גּוֹבֶה אֶת הַקֶּרֶן וְגוֹבֶה אֶת הָרִבִּית. וְאִם לְאַחַר שֶׁנִּתְגַּיֵּיר זְקָפָן עָלָיו בְּמִלְוֶה – גּוֹבֶה אֶת הַקֶּרֶן וְאֵינוֹ גּוֹבֶה אֶת הָרִבִּית » (בבא מציעא ע״ב ע״א)

Terutz — Rabbi Yosi’s reason is not a reason of loans It is one of reputation: if the convert were released from a debt by his conversion, he would be suspected of having converted for that. And that fear can arise only where the convert gains — that is, where he is the borrower. Where he is the lender, his conversion costs him, and no one will say he converted for that money.

Nafka minot (1) The first case’s stringency extends to where the transmutation did not occur; the second case’s takana does not extend beyond what he owed as a non-Jew. (2) Hence the contrast: in the first case the Shach broadens what is lost; in the second the Beit Yosef narrows what is gained.

7. יסוד הסימן — a takana grounded in a name, not in property

This siman is short, and it teaches two things that do not resemble each other.

The first is a tool: a date can suffice to change how a sum is characterised. The settlement adds nothing to anyone’s estate and alters no figure; it recasts what exists as a new debt, and that debt is principal. Three of the siman’s disagreements turn on the single question of whether that recasting operates or merely marks.

The second is rarer, and must be named precisely. The rule of the second case does not protect an estate: it protects a name. Rabbi Yosi does not say the lender is entitled to it; he says it must not be possible to say of the convert that he converted for money. A rule founded on what will be said reaches exactly as far as what could be said — and not an inch further. That is why it operates only in the direction in which the convert would gain, and that is why the seif, in its last clause, bounds it to what he had become liable for before entering the covenant.

The disagreement of the רמ״ה and the Rosh is where that boundary is argued, and it is no small matter: it asks how far an institution of the Sages may go when it meets a Torah prohibition. The Rosh answers that it may go far; the Beit Yosef concludes with those who answer that it stops where the reason sustaining it stops.
The word of the siman is not גר but זקיפה — and where the זקיפה no longer decides, a name decides.
