1. הדין העולה — the rule that emerges from the siman

« אין פוסקין על הפירות על שער של עיירות מפני שאינו קבוע אבל פוסקין על שער שבמדינה שהוא קבוע » (שו״ע יו״ד קע״ה:א)
« ומשיצא השער של מדינה מותר להקדים מעות לחבירו ולפסוק עמו שיתן לו אותם פירות כל השנה כשיעור מעותיו כפי אותו השער » (שו״ע יו״ד קע״ה:א)
The line of psak of the siman. Paying in advance to receive later is a purchase, not a loan, when the buyer could have obtained the goods on the day of payment. Two routes establish this, and one suffices: a fixed and known rate, or the seller’s possession. But a third condition attaches in both cases, and it is the one that is forgotten: the buyer must gain nothing beyond the goods. Finally, the debt born of the fixing remains a debt of goods: it is settled in produce and spoken of in measures.
This siman governs entirely ordinary transactions — a deposit on an order, a subscription paid in advance, a discount for early payment — and its difficulty is almost never theoretical: it turns on facts, market rates, stock, costs saved. For the application to your own case, consult your Rav.

2. מהו שער — what must be checked first

The Mehaber and the Rama, and what the Shakh adds. The Mehaber admits only the great city’s rate; the Rama cites the view of Tosafot, the Rosh and the Tur, who admit the towns’, and is lenient because the prohibition is rabbinic. The Shakh explains why it is, and adds the practical rule: a great city’s rate governs the localities supplied from it.

Two grounds of invalidity to check before relying on a rate. (1) One commodity at two prices — new and old: this is not a rate, and the Taz expressly rules stringently like the Rambam. (2) The price of other goods — gleaners’ wheat for a householder’s wheat: two rates do exist, but each governs only its own goods.

3. יש למוכר — the second route, and its measure

« אם היה למוכר מאותו המין אע״פ שעדיין לא נגמרה מלאכתו מותר לפסוק עליו עד כדי השיעור שיש לו אף על פי שעדיין לא יצא השער » (שו״ע יו״ד קע״ה:ד)
« והוא שלא יהא מחוסר אלא מלאכה אחת או ב׳ אבל אם מחוסר ג׳ מלאכות אסור » (שו״ע יו״ד קע״ה:ד)
Two limits, and both are needed. (1) The quantity: up to what he has. The Taz expressly rejects the reading that would liken this case to the loan in kind, where a little suffices. (2) The state of the goods: one or two missing operations, even depending on heaven; three operations, never, even if all is in his power. The Shakh further cites Rabbenu Yitzhak’s view that, the goods being unfinished, one may not fix at the most advantageous but only at the lowest of the rates.

4. שלא ירויח כלום — the most forgotten condition

« הפוסק על השער צריך שלא ירויח בדבר כלום כגון שאם מנהג שהלוקח נותן שכר הסרסור צריך שיתן הוא » (שו״ע יו״ד קע״ה:ה)
« וצריך שינכה למוכר החסרון שראוין להתחסר לפי המדה ולפי הזמן » (שו״ע יו״ד קע״ה:ה)
« שאם לא כן הוי רבית שמרויח זה בשביל הקדמת המעות » (טור יו״ד קע״ה)
How to apply it. The rule does not say “no discount”: it says the buyer must gain nothing. A discount matching exactly a cost the seller no longer has to bear — an intermediary he does not employ, storage he avoids — makes nobody a gain. A discount without such a counterpart is a gain, and its cause is the advance. The wastage must be deducted, not set at a flat rate: the seif says “by measure and by time”, and the Shakh refers to the rules of deposit.

The Pit’hei Teshuva reports a case where all these questions meet — a talmid hakham, a rich man, wine delivered measure by measure — and the Havot Yair hesitates at length before permitting, for reasons of fact peculiar to the parties; then he warns against the practice that had spread from it. This is the very model of a question not decided from a text. For the application to your own case, consult your Rav.

5. סילוק החוב — how a fixing is settled

« ויש מי שאומר שיכול ליתן מעות » (שו״ע יו״ד קע״ה:ו)
Two views in the seif, two names in the Tur. The Rashbam, followed by the Rosh: produce yes, money no. Rabbenu Tam: money too. The Mehaber presents the first as the rule and the second as a cited view.
« והרשב״ם כתב ודאי מעות אינו יכול ליתן אבל יכול לשום פירות שפסק עליהם במעות וליתן לו בהם פירות אחרות ולזה הסכים א״א הרא״ש ז״ל » (טור יו״ד קע״ה)

The gloss’s practical rule, and it is easy to remember. One may convert the claim into another commodity, provided one speaks in measures and not in a sum: “so many se’ah of wheat are mine with you, give me wine for them.” As soon as one says “such is the value of the wheat, give me wine for it”, the claim has become a money claim — and the seller would then need to have the wine.

6. שער הגבוה והשליח — what is stipulated, and by whom

« כיון שנקבע השער מות׳ לפסוק על שער הגבוה » (שו״ע יו״ד קע״ה:ז)
« נתן לו המעות סתם ולא פסק עמו כשער הגבוה והוזלו נותן לו כשער שהיו שוים כשנתן לו המעות ומי שחזר מקבל מי שפרע » (שו״ע יו״ד קע״ה:ז)
« ואם היה שליח לאחרים אינו נוטל אלא כשער הזול או מחזיר דמים ואין השליח ולא המשלח מקבלים מי שפרע » (שו״ע יו״ד קע״ה:ז)
Why this clause is permitted. The Shakh, in the name of the Perisha: it does not look like interest, since the money, had it stayed with the buyer, could have bought at the low price. The Taz dismisses the objection of קרוב לשכר ורחוק להפסד with Tosafot’s answer: in fixing on produce the seller is not bound to determinate goods.

And the agent. One who buys through a third party is not bound by an omitted stipulation: the principal may say he sent him to set his affairs right and not to spoil them. Neither of them receives the mi shepara.

7. מקח שנעשה באיסור — what is done after the fact

« מקח שנעשה באיסור כגון שהוסיף במקח משום אגר נטר וכיוצא בזה המקח קיים בענין שלא יהא בו רבית » (שו״ע יו״ד קע״ה:ח)
« והוא שנתקיים המקח באחת מדרכי ההקנאות אבל אם לא נתקיים המקח אלא לענין מי שפרע בטל לגמרי » (שו״ע יו״ד קע״ה:ח)
The rule, its condition, and the point still debated. The sale is not annulled: it is brought back to the lawful price. The condition is that a mode of acquisition really took effect; failing that, there is nothing to bring back and the sale falls. The Shakh adds that interest already paid is not recovered from the seller — and the Pit’hei Teshuva notes that this last point was disputed.

8. מקרים בני זמננו — contemporary cases

The subscription paid in advance

A year of deliveries settled on the first day. Three checks, in order: do the goods have a known and stable price; if not, does the supplier hold stock; and in both cases, does the discount granted match a genuinely saved cost?

An order for a product that does not yet exist

A maker accepts a deposit for a batch he has not begun. Seif 4 gives the criterion: what he already has, and its state of completion. Three missing operations count as having nothing, and one must then fall back on the market rate — if one exists.

The price locked for a year

A customer pays in advance and is guaranteed today’s price, come what may. If the rate exists, this is the whole of seif 1, and the guarantee poses no difficulty — even if prices rise. If it is added that the customer will also benefit from any fall, this is seif 7, and the Taz explains at ס״ק 9 why it is not interest.

Settlement in kind

The supplier cannot deliver what was agreed and offers something else. Permitted in produce; disputed in money. The formula to use is the gloss’s: speak of the quantity still owed, not of its value.

The contract already performed

It emerges after the fact that the price included an increase for the delay. Seif 8 settles what follows: the sale stands and is brought back to the lawful price, provided a mode of acquisition took effect. The fate of what has already been paid is the subject of a discussion the Pit’hei Teshuva notes.

What the siman leaves to the Rav. Almost everything that matters here is a question of fact: is there a rate, where is it taken from, does the supplier hold stock, and what does the discount correspond to. The law itself holds in one line — paying in advance buys when the goods were available, provided nothing else is gained.
Note: the Admour HaZaken did not write a Shulhan Arukh on Yoreh De‘ah. This level 4 is a level of psak — Shakh, Taz, Ba’er Hetev, Pit’hei Teshuva, Tur, Beit Yosef and Rambam — not a “Daat HaRav”. The Nekudot HaKesef do not comment on this siman, and nothing of theirs is therefore cited here.
