1. יסוד ההיתר — what the buyer can say

The Shakh and the Taz give the same reason, and yet they do not formulate it in the same way — one through the buyer’s plea, the other through a fiction of acquisition. The entire siman depends on which is retained.

Ḥakira: is the heter an excuse or an acquisition? (א) An excuse. Nothing was acquired; simply, the gain is not called interest, because the buyer obtained nothing he could not have obtained by himself. The permission is then negative: it records the absence of a favour. (ב) An acquisition. We regard it as if the seller had bought the goods for the buyer and acquired them on his behalf; the rise occurred in his domain, as an owner. The permission is then positive: a transfer took place.
Nafka mina (1) A buyer who in fact could not have bought — he was away, or his money was tied up: on (א) the excuse falls; on (ב) it does not depend on him. (2) Seif 4, where the seller possesses but there is no rate: (ב) explains it by itself — there is something to acquire; (א) must say the buyer could have bought from that seller. (3) Seif 5, which forbids any gain, reads better on (א), for the extra gain is precisely what the buyer would not have obtained on his own.
And the reason the prohibition is only rabbinic. The Taz gives it in a decisive aside: the buyer did not draw the goods to himself, so there is no real acquisition — but since it is the way of a sale, the Sages did not decree. The Shakh says the same more briefly, and this is what will allow the Rama to be lenient.

2. שער של עיירות — Rashi against Tosafot

The source, and what is at stake

The dispute is a dispute of reading. Another statement of the gemara — Rava’s in the name of Rabbi Yannai — permits fixing on “the market rate”. Rashi reads it as agreeing with Rabbi Yohanan: hence the towns remain forbidden. Tosafot read it as contradicting him: hence the towns are permitted. The Beit Yosef sets out both readings, tallies the decisors, and rules stringently.

And yet the Rama is lenient — not by a new proof but by a rule of method. He cites the view of Tosafot, the Rosh, the Tur and the Hagahot Ashiri, then adds four words that do everything: this is a rabbinic prohibition. The Shakh at once explains why it is rabbinic, closing the loop on the first ס״ק of the previous section.

Nafka mina, and a very practical one. The Shakh adds a precision found neither in the Mehaber nor in the Rama: a great city’s rate governs the localities supplied from it — even where they have no rate of their own — and does not govern those which, though neighbouring, are supplied elsewhere. And if a locality has no fixed rate, one follows the largest of the cities from which it is supplied.

3. חדש וישן — the Rambam against the Tur

The Taz’s question. The seif writes simply: “one does not fix until the rate has come out for the new and for the old”. But what does “one does not fix” mean? May one fix nothing at all — not even the old at three, which is after all its own price? Or may one merely not fix the new at four?

Two readings, resting on two versions of the text. The Maggid Mishneh, explaining the Rambam, holds that one fixes nothing at all — and gives the reason: as soon as there is a difference between new and old, this is not a fixed rate, for the two will converge towards an unknown level. The Tur, by contrast, writes that one may not fix even of the new at four — which implies that of the new at three, and a fortiori of the old at three, one may. The Taz shows that this reading rests on another version of the gemara, Rashi’s.

The Taz’s conclusion, and it is explicit. He sets out Rashi’s reason — the new is cheaper because it is not yet dry enough, and one who fixes on the new will only take it once dried; whence, if he takes it now at his own risk, the permission — and then rules: and here he ruled stringently, like the Rambam.

4. לקוטות — why two rates are better than one double rate

Question. In seif 2 two prices for one commodity prevent there being a rate. In seif 3 two prices — the gleaners’ and the householder’s — prevent nothing: one fixes with each at his own. Where is the difference?

The Taz’s answer, and it is sharp. In seif 2 the new and the old are one species: their prices will converge, and towards what is unknown — neither is therefore the price of the commodity. In seif 3 the gleaners’ wheat is mixed with rye: it is almost another species, its prices will never join the householder’s, and each of the two is therefore, permanently, the price of its own goods. The Taz adds that even the Rambam, so stringent in seif 2, concedes here.

The yesod A rate is not a figure, it is the price of a thing. Two figures for one thing do not make a rate; two figures for two things make two. The criterion is therefore not the spread of prices but the identity of the goods — and that is why seif 3 ends by forbidding only one operation: fixing with the householder at the gleaners’ price, which amounts to paying for one commodity at another’s price.

5. שני תירוצים — the gemara’s two answers and their nafka mina

Rava’s question to Rav Nahman. If one may fix with a gleaner because, having none, he will borrow from another gleaner — the householder too could borrow from a gleaner. Why then does one not fix with him at the gleaners’ price?

Two answers, and the gemara sets them side by side. First: it would be beneath a householder to borrow from a gleaner. Second: one who gives his money to a householder gives it for fine produce — so whatever he says, he expects the householder’s own.

The nafka mina, and the Taz builds it himself. What if the householder says expressly that he will deliver gleaners’ wheat? On the first answer it is still forbidden: he will not stoop to borrow, and he will give his own. On the second it is permitted: the expectation of fine produce is lifted by his words. The Taz observes that the Tur followed the first stringently, and that the Shulhan Arukh reads the same way.

6. כדי השיעור — how much must the seller possess?

Question. In siman 162 a single se’ah possessed permits borrowing a hundred se’in. Here the seif writes עד כדי השיעור שיש לו — up to the amount he has. Why does the same possession not have the same force?
« אם היה למוכר מאותו המין אע״פ שעדיין לא נגמרה מלאכתו מותר לפסוק עליו עד כדי השיעור שיש לו אף על פי שעדיין לא יצא השער » (שו״ע יו״ד קע״ה:ד)
The Beit Yosef shows that the question divided the Rishonim. The Nimukei Yosef and the Maggid Mishneh, in the name of the Ramban and the Rashba, say one does not fix beyond what he has. The Rambam, read literally, seems to say the opposite — as in the loan in kind of siman 162 — and the Maggid Mishneh explained his words according to the Ramban and the Rashba.

The Taz gives the reason, and it is structural. In a loan, the se’ah possessed serves to make the lender an owner of wheat, and one suffices for that office. In a sale, the issue is not a status but goods: what one does not have, one does not sell. Here it is a sale — and it is only in the loan in kind that this point was relaxed.

And the degree of completion of the goods, where the Tur brings two views. Rashi permits fixing even at the most advantageous price, since he has the goods, though a little preparation is lacking. Rabbenu Yitzhak restricts: lacking a little preparation, it is not treated as fully in hand — so one may not fix five for the price of four, but only at the lowest of the rates. The Shakh cites this second view, and adds the asymmetry in the number of operations.

7. שלא ירויח כלום — the broker, the wastage, and the threshold of gain

The seif, and the reason the Tur gives for it

Ḥakira: where does the requirement of gaining nothing come from? (א) From the heter itself. The permission says: it is as if the buyer had bought today. But one who buys today pays the broker and bears the wastage. If the buyer escapes them, the fiction ceases to be exact, and whatever exceeds it is interest. (ב) From a rule of its own. The bar on surplus stands independently: even if the heter held, any advantage attached to the advance of money is forbidden in itself. The Tur leans to (א), and his phrase says so: for this one gains through the advance of his money.
Nafka mina (1) An advantage unrelated to price — priority delivery, better packaging: on (א) one must ask whether today’s buyer would have had it; on (ב) any advantage is suspect. (2) The wastage: the Shakh refers to the rules of deposit in Hoshen Mishpat 292, and the Taz gives its physical cause — mice, scattering. It is therefore not a flat rate but a calculation, by measure and by time. (3) Where the custom is that the seller pays the broker, the buyer has nothing to pay: the seif says if the custom is that the buyer gives.

The Pit’hei Teshuva carries this seif into a real case, and it deserves reading. The Havot Yair is asked about a talmid hakham who advances to a rich man the price of a quantity of wine, to receive it measure by measure through the year. He begins with the difficulty: the Sages required that the buyer gain nothing, and the usual wastage must be deducted; to which are added the labour, the care, and the loss of repeated measuring. He adds that in those lands it is hard to rely on a rate for wine, so much do the vineyards differ. He then inclines to permit in that particular case — for reasons of fact touching the rich man himself — and ends with a warning.

8. פירות או מעות — Rabbenu Tam against the Rashbam

The seif reports two views without naming them; the Tur names them. Rabbenu Tam: just as he may give the produce, so he may give its value at the price of the rise. The Rashbam: money certainly not — but he may value in money the produce agreed upon and deliver other produce for that value. And the Rosh sides with the Rashbam.

Ḥakira: what does the seller owe — a thing, or a value? (א) A thing. The buyer acquired wheat; the seller owes him wheat, and may, with both parties’ consent, replace it with another thing of equal value — a barter, not a payment. To give money would be to sell the wheat and hand over the proceeds: a money profit born of a money advance. (ב) A value. What the buyer acquired is a right of a certain value; the form of settlement is then indifferent. This is Rabbenu Tam’s position, and the principle מה לי הן ומה לי דמיהן carries it.
And the Rama’s gloss draws the practical line. One may fix, upon other produce, at the market rate — as if giving money now — provided the first produce was not converted into a sum. To say “so many se’ah of wheat are mine with you, give me wine for them”: permitted. To say “such is the value of the wheat, give me wine for it”: forbidden, for it has become a money loan. The Shakh adds the consequence: there, the seller would need to have the wine.

Nafka mina The Taz refers here to siman 162, where it is forbidden to borrow wheat against millet: the comparison shows that substituting one commodity for another is never trivial, and that it passes here only because this is a sale and the market rate measures it.

9. קרוב לשכר — why the more favourable rate is not one-sided

The Taz’s question. The buyer stipulates that he will receive at the more advantageous rate: if the goods fall he receives more, if they rise he receives what was agreed. This is exactly קרוב לשכר ורחוק להפסד — and it is for that reason that at siman 173 seif 13 the buyer is required to bear the risk of the fall. Why not here?

Tosafot’s answer, cited by the Taz. In fixing on produce the notion of “close to profit and far from loss” has no purchase, because the seller is not bound to determinate goods: if he wishes he eats the produce he had and gives other. Possession is required only as a condition of permission, and only at the moment of fixing. At siman 173, by contrast, it is a known and identified barrel that he bought — and there the risk must follow the thing.

The Shakh gives it at ס״ק 11, in the name of the Perisha: it does not look like interest, for had the money stayed with the buyer he could have bought wheat at the low price. Then he sets the limit: in a loan in kind the borrower may not stipulate that he will repay at the low rate — for there the money was never a purchasing power.

And the agent. The Taz explains why neither he nor his principal receives the reproach: the agent, because the matter is not his; the principal, because he can say — I sent you to set my affairs right, not to spoil them; you should have stipulated the low rate. The Shakh refers for this to the rules of agency, and the Beit Yosef recalls that a view of the Semag requires the stipulation wherever the reckoning was in money and not in measures.

The yesod All the siman’s conditions serve one proposition: the money advanced has already bought. The market rate proves it from outside — the goods were available at that price; the seller’s possession proves it from inside — the goods existed with him. Seif 5 prevents the price paid from buying anything else; seif 6 prevents the debt from becoming a money debt again; and seif 8 says what remains when all this was lacking: not a void sale, but a sale brought back to what the money ought to have bought.
And the rule of seif 8, which goes beyond our siman. The Shakh puts it practically: one gives at the permitted rate, and interest already paid is not taken back from the seller’s hands. The Tur had said it before him, and the Pit’hei Teshuva notes that this last point was disputed by several Aharonim, who concluded otherwise.

And the next siman changes its object without changing its question. In siman 176 · קע״ו it is no longer a matter of buying but of renting — money, vessels, a ship, a field, a worker — and the question becomes the same again: does what is paid pay for a thing, or does it pay for time?
