Siman 175 — Fixing a price at the market rate

1. The axiom: money that could have bought has bought
The axiom. An advance of money is a loan only if it gives the one who receives it something he would not otherwise have had. When the goods were available at a known price — or when the seller already had them — the buyer obtained nothing beyond what his money already gave him: he bought.
Three consequences. (1) What must be checked is not the balance of the price but the availability of the goods. (2) Two routes lead to that availability, and they are independent: the market rate, or the seller’s possession. (3) Everything the buyer obtains beyond the goods falls outside the axiom and becomes interest again — hence seif 5.
2. The three reflex questions
1. Do the goods have a fixed and known rate? In a great city per the Mehaber; the towns suffice per the gloss. One price for the species, and the price of those goods.

2. If not: does the seller possess? Up to the amount he possesses, and provided three operations are not lacking.

3. Does the buyer gain anything else? The broker, the wastage — if he escapes them, the permission falls, whatever the answers to the first two questions.

5. The seller’s possession — how much, and how far
Two questions, two answers. How much? Up to the amount he possesses — and not “a little suffices”, as in the loan in kind of siman 162. The Taz gives the reason: here it is a sale, and what one does not have, one does not sell. How far may it be unfinished? One or two missing operations, yes, even if they depend on heaven; three, no, even if they are in his hands.
The pitfall. Goods “in production” are not automatically goods possessed. The criterion is neither the certainty of completion nor the seller’s power: it is the number of operations remaining. The Rambam gives the example: a stack that must still dry in the sun, be threshed and winnowed lacks three; if it is dry and only threshing and winnowing remain, it lacks two.
6. To gain nothing: the broker and the wastage
Seif 5 is the easiest condition to forget, because it bears not on the price but on what surrounds it. Two examples, and they are only examples: the broker’s fee, which the buyer must pay where custom places it on him; and the wastage the goods suffer in storage, which the seller must be able to deduct — by measure and by time. The Tur gives the reason in eight words.
7. Substitution — produce, money, measures
Giving other produce of equal value — permitted per the Mehaber, and it is the view of the Rashbam and the Rosh.

10. Golden rules, mnemonic and classic pitfalls
Five golden rules.
- 1. What permits is not the fairness of the price but the availability of the goods on the day of payment.
- 2. A rate is the price of a thing: two prices for one thing make none; two things have two rates.
- 3. The seller’s possession replaces the rate, but only up to the amount he has.
- 4. The buyer must gain nothing but the goods — neither the broker nor the wastage.
- 5. A debt of goods must not become a money debt again: one speaks in measures.
Mnemonic — R · O · P · N · M
Rate: does one exist, and where? · One single price for the commodity? · Possession of the seller, up to the amount? · Nothing gained beyond? · Measures and not a sum, at settlement?
Five classic pitfalls.
- Taking a posted price for a rate: it must be fixed, and the price of one single thing.
- Applying a great city’s rate to a locality supplied from elsewhere.
- Believing that “he has a little” suffices here as in siman 162: here the quantity is required.
- Forgetting seif 5: a discount for early payment matching no saved cost is interest.
- Converting the debt into a sum at the moment of substitution — the gloss’s forbidden formula.
