1. מהו שכר — the Taz’s yesod

Ḥakira: what does rent pay for? (א) The owner’s deprivation. He did without his thing for a time, and the rent pays for that forbearance — like a price paid for a service. (ב) The wear of the thing. The rent pays for what use takes away from the object, which the owner bears. The Taz holds (ב), and at once draws the consequence: where there is no wear and the risk has passed to the taker, no rent is possible — it is money.
Nafka mina (1) Hiring out a silver or gold object: (א) would permit it, the owner having done without it; (ב) forbids it once the risk passes to the taker — and this is what the Taz concludes. (2) Seif 2, which permits selling the vessel: (א) struggles — what did the owner do without, if the object itself does not return?; on (ב) what is hired is the class, and the wear bears on it. (3) Seif 3: (ב) explains why the hirer pays the lost weight in addition to the rent — they are two distinct things.

And the Rivash’s formulation, cited by the Beit Yosef, on the case of Rav Hama. It was not a mistake of vocabulary: Rav Hama knew well that a name does not make a thing. What he thought was that by exempting the borrower from accidents he turned the loan into the hire of a vessel — and it is precisely this point the siman rejects. The Rivash’s conclusion is a general rule: language does not operate.

2. שלוש דרגות האחריות — and the emendation of the gloss

The dispute, as the Beit Yosef reports it. Tosafot, and the Hagahot Maimoniyot in the name of the Sefer HaTeruma, forbid even where the lessor assumes accidents. The Terumat HaDeshen, in the name of a gloss of Tosafot, permits where he assumes all the liability, and even suggests that Tosafot forbade only the partial case. But he adds that one should not act on this permission in practice.

The Shakh’s question on the Beit Yosef. The Terumat HaDeshen never said one should not act on this permission in our case: he said it in an entirely different situation — where the borrower stipulates that his word will not be trusted as to the principal. Where nothing of the kind is stipulated, the permission is obvious.

And a rare thing: the Shakh and the Taz both emend the same word of the gloss. The printed text says “it is forbidden to spend them for their rent”; both write that it should read “it is forbidden to hire them out to be spent”. The difference is not one of style: on the first reading it would be the taker who sins by spending; on the second the transaction itself is forbidden from the moment it is concluded.

3. הספינה והסיר — which of the two is the real novelty

The Taz’s question on the Tur. The Tur opens by permitting the value of the vessel to be fixed in advance; he ends by saying that if it breaks only what it was worth at the time of breaking is paid. The two statements seem to contradict: what use is fixing a price if that is not what is paid?

The Taz’s answer. The first statement does not speak of the amount to be paid: it teaches only that it is permitted to agree on a valuation at the day’s rate, and that such a valuation is not regarded as a loan. The second adds the rule of payment: if there has been a fall, one pays at the rate of the day of breaking — and this is what the Rama records in the name of the cited view at the end of seif 4. The Beit Yosef reads it otherwise: the price is fixed today precisely so that at the breaking one can measure how far the value has fallen.

The yesod, and it is the Taz who sets it out. The ship and the pot are not two examples of one case: the second is the stronger. In the ship the name of loan appears only at the end, at the moment of breaking; until then it is a hiring, and the object is at the owner’s risk. In the copper pot the wear begins with the first use — and so does the loan — and yet rent is taken, because what remains is genuinely diminished, and that is what the rent pays for.

4. הפרה — why this is not צאן ברזל

Question. A cow valued at thirty dinars “if it dies”, a monthly payment, and repayment in money — this is the exact picture of צאן ברזל, which the Rambam forbids as dust of interest. Why does our seif permit it?

The Shakh’s answer, in two strokes. (1) In צאן ברזל the taker does not put the beasts to work so that they weaken: there is therefore no wear, and the rent has nothing to pay for. Here the cow works and wastes away. (2) In צאן ברזל the owner sheds the risk from the outset; here he keeps it until death — the Rambam says it in an exact phrase: because he did not value it while alive, but only for after its death.

Nafka mina, and it lies in the cited view. If the cow is valued in advance and that sum is owed whatever happens, the second reason falls: the owner no longer bears the fall in value. That is why the Rama cites, in the name of the Ramban and the Tur, that the valuation must be made at the time of death. The Beit Yosef notes that the Rambam and the Rashba hold otherwise on this point.

5. בגוף הנכס — money that improves against money that circulates

The two halves of the seif, and the Tur’s word
« המשכיר שדה לחבירו בי׳ כורים לשנה וא״ל תן ר׳ זוז שאפרנס בהם השדה ואני אתן לך י״ב כור בכל שנה הרי זה מותר מפני שאם יפרנס השדה בדינרין אלו יהיה שכרה יותר » (שו״ע יו״ד קע״ו:ה)

Ḥakira: does the extra rent pay for the money, or for the thing made better? (א) The money. The Tur concedes it plainly: the sum is taken as a loan and will be returned at the end, and two kor are added for it. It would therefore be interest, but for a particular permission. (ב) The thing. The supplement pays not for the money but for a better-worked field, a better-fitted shop, a better-rigged ship — and the Shakh says it in a word: it turns out he is paying him the rent of a good ship rather than a bad one.
Nafka mina (1) The invested money in the end improves nothing — the works fail: on (א) the permission depended on the destination and stands; on (ב) the supplement no longer pays for anything real. (2) The supplement far exceeds the value of the improvement: (ב) invites measurement, (א) does not. (3) The money serves to equip the ship with tackle of its own: this too is בגוף הספינה for the seif, and the Taz and the Shakh explain it likewise.

6. שכירות אינה משתלמת אלא לבסוף — the rule that permits the discount

The mishna, and the reason the gemara gives

Ḥakira: does the permission come from the absence of a debt or from the nature of the price? (א) Absence of a debt. Nothing is yet owed, so nothing is awaited; there is no waiting to be paid for. (ב) Nature of the price. The gemara uses two successive expressions: משווא הוא דהכי שויא — this is its true worth — then אוזולי הוא דקא מוזיל גביה — he is granting him a discount. The monthly rate is therefore not an inflated rate: it is the normal rate, and the annual rate is a concession.
The Shakh holds both together, and shows it by the arithmetic. A sela a month makes twelve sela for the year; this is no wage of waiting, since he was not bound to pay before the end of each month. And if he pays in advance, the lessor remits part of the rent and lets it to him for less than its worth.

Nafka mina, and the gloss draws it itself. Once he has taken possession and bound himself for the year, the discount becomes forbidden; and all the more so once the rent is due. The Shakh makes of this a rule without exception, valid beyond our siman: there is no difference between rent money and loan money — every wage of waiting is forbidden. The Taz adds that in his view the latter case is even fixed interest.

And a divergence over the classification. The Rashba’s disciples, cited by the Beit Yosef, call this case genuine interest. The Beit Yosef hesitates: since it is not done by way of a loan, it ought not to be fixed interest, and the expression would serve only to exclude the idea of a mere contrivance. The Taz rules the other way for the second case, and the Nekudot HaKesef reply by pointing to the Beit Yosef’s hesitation.

7. החזיק או לא החזיק — the dispute the Nekudot HaKesef resolve

This is the central dispute of the siman, and it turns on a seemingly minor question: does the permission of seif 6 require that the tenant have entered the premises, or is it enough that he acquired them?

Two Rashbas, and they must not be confused. The Beit Yosef cites, in the name of the Hagahot Maimoniyot in the name of the Rashba Baal HaTosafot, that there is no permission unless the tenant enters the land at once; failing that it would be a wage of waiting. The Darkhei Moshe objects: the Maggid Mishneh writes in the name of the Rashba that even if he does not dwell there at once it is permitted, since in the hiring of land he acquires it immediately — unlike the hiring of a worker, who does not bind himself from the outset.

The Nekudot HaKesef rule, and give three arguments. (1) The Darkhei Moshe’s conclusion follows the Rashba ben Aderet, not the Hagahot Maimoniyot. (2) The reason is compelling: the worker, whose person is not acquired, may withdraw; the courtyard, by contrast, is acquired in its very body — and whether he dwells in it or not, he may do with it from now whatever he wishes. (3) A proof from the structure of the codes: the Rambam, the Tur and the Mehaber write of land without condition, then write of the worker separately requiring him to begin — had their rule been the same, they should have taught them together.

Nafka mina A lease signed for entry in three months’ time, with a discount for immediate payment. On the Hagahot Maimoniyot the discount is a wage of waiting; on the Rashba ben Aderet and the Nekudot HaKesef it is permitted, because the thing is acquired and the tenant may dispose of it. And one sees at the same stroke why seif 8 requires the worker to begin: his labour is acquired by nobody as long as he has not begun.

Ḥakira: is the supplement an addition to the dowry or the price of a delay? (א) An addition. As long as nothing is yet owed, the promisor may promise more or less; the annual supplement is only a way of saying how much he gives in total. (ב) The price of a delay. Once the dowry is owed, the money left with the father-in-law is a debt, and the supplement pays for it. The Taz identifies the tipping point precisely: it is not the ceremony, it is the moment the undertaking becomes binding.
The Taz shifts the line, and one must follow him. “Before the wedding” does not mean “before the huppa” but at the first undertaking, that of the תנאים: until then he had no obligation at all, and the supplement falls within the gift itself. If the תנאים recorded only the amount of the dowry, and at the moment of handing it over a supplement is written, the permission no longer applies — for he is already bound, and failing payment he owes the stipulated penalty: this is a debt like any other. The Taz further cites in support the very wording of the Rivash as reported by the Beit Yosef, and notes that the Levush says the same.

The Pit’hei Teshuva carries the rule into a real case. A mother owed her son two hundred gold pieces under the father’s will; she then undertook, in the תנאים of that son’s marriage, to give him a dwelling as long as she kept the sum. The Noda BiYehuda answers that this is not the case of a son-in-law’s dowry: the mother was already a debtor for that sum, and the benefit is therefore fixed interest. He adds that if the son has already collected, it is not taken back from him.

9. שכר האדם — why the worker must begin today

The two seifim, and the Rambam
« אסור לומר לאדם עשה עמי מלאכה היום ששוה דינר ואני אעשה עמך בשבוע אחר מלאכה ששוה שתים » (שו״ע יו״ד קע״ו:ז)

Question. The rent of a courtyard and the wage of a worker follow the same rule — neither is due before the end. Why then may a discount be given on the first and not on the second?
The Nekudot HaKesef’s answer. It is not the date of maturity that separates them but acquisition. In renting a courtyard the taker acquires the body of the courtyard at once; the worker, whose person is acquired by nobody, may withdraw — he is therefore bound in nothing as long as he has not begun, and the money he received is still only a loan. Let him begin today, and his work is under way: the wage no longer buys time.

And the Nekudot HaKesef’s remark on the Rashbam. They add a gloss: the Rashbam, explaining the gemara’s question “and do you think it is forbidden to lower a wage?”, laboured to say that a worker hires himself out for anything when he has nothing to eat. The Nekudot HaKesef find the labour needless: the question reads plainly — was it not taught in Eizehu Neshekh that one increases rent and not a sale price? — and the reason is precisely that rent falls due only at the end.

The yesod A single column decides every row: what remains with the owner? If the thing remains with him, with its risk and its wear, what is paid is rent. If only a claim remains, what is paid is interest. That is why money is the limiting case — once spent it leaves nothing — and why the copper pot is the strong case: it leaves metal diminished, and that suffices. The two ends of the siman, seif 1 and seif 8, are the same rule seen from money and seen from labour.
And the next siman takes up one of the two terms of this table. In siman 177 · קע״ז the Shulhan Arukh treats צאן ברזל, that arrangement in which the owner keeps the name of owner and sheds the risk: forty seifim there examine, one by one, every possible division of gain and loss.
