The siman is short — the Shulchan Arukh itself announces ובו ג׳ סעיפים — and yet it carries the principle of the whole block that follows. It does not ask which garments are handsome, but on what condition a usage becomes a ḥok one may not follow. Seif 1 enumerates: dress, hair, building. Seif 2 gives the exception of one close to the government. Seif 3 leaves dress for the table, and forbids setting a whole loaf there beside the crumbs.

1. The text of the Shulchan Arukh — the three seifim

The siman reads in three movements. Seif 1 enumerates the forbidden forms of resemblance — the garment peculiar to them, two ways of wearing the hair, and building assembly halls in their manner — and then the Rama’s gloss states on what condition a usage falls under the prohibition. Seif 2 lifts all of it for one who must appear before the government. Seif 3 moves to another order of thing entirely: not imitation of the nations but a superstitious gesture — setting a whole loaf on the table after the meal.

Seif א — the forms of resemblance, and the Rama’s criterion

שלא ללבוש כמלבושי עובדי כוכבים. ובו ג׳ סעיפים:

Title of the siman: not to wear garments like those of non-Jews; and it contains three seifim.

One does not follow the customs of non-Jews (and one does not resemble them) (Tur in the name of the Rambam), and one shall not wear the garment peculiar to them; and one shall not grow the tuft of his head like the tuft of theirs; and one shall not shave the sides and leave the hair in the middle; and one shall not shave the hair from the front of his face from ear to ear and leave the long hair; and one shall not build places in the manner of the construction of idolatrous temples, so that many should enter them as they do.

Gloss: Rather he shall be distinguished from them in his garments and in the rest of his deeds (ibid.). And all this is forbidden only in a matter that non-Jews have adopted out of licentiousness — for instance the practice of wearing red garments, which is a garment of princes, and the like among garments of licentiousness; or in a matter they have adopted as a custom and a statute with no reason in it, for one must suspect in it the ways of the Emorites and that it holds a trace of the idolatry of their fathers. But a matter they have adopted for a benefit — for instance their way that every expert physician has a particular garment by which he is known to be a physician of the craft — it is permitted to wear it; and likewise what they do out of honour or for another reason is permitted (Maharik, root 88). Therefore they said: one burns for kings, and there is no matter of the ways of the Emorites in it (Ran, first chapter of the tractate of idolatry).
Three prohibitions, and one opening. The seif enumerates: garment, hair, building. Then the Rama’s gloss turns the question around — it is not resemblance as such that is aimed at but the meaning of the usage. Two signs reveal it: licentiousness, and the absence of reason. A usage with no reason is suspect, because a forgotten reason may be a forgotten worship. A usage that has a useful reason is not a ḥok: it is a means, and a means belongs to no one.

Seif ב — one who is close to the government

מי שהוא קרוב למלכות וצריך ללבוש במלבושיהם ולדמות להם מותר בכל:
One who is close to the government and must wear their garments and resemble them — everything is permitted to him.
A complete permission, and a surprising one. The seif does not say “the garment is permitted to him” but מותר בכל — everything. The Taz stops at the difficulty: if this prohibition is that of the verse, how could the sages lift it? His answer opens everything that follows in the siman: the Torah specified no content, and handed the measure to the sages.

Seif ג — the whole loaf, and the table set for Gad

מי שאכל ושייר פתיתין על שלחנו לא יביא פת שלימה ויניח על השלחן: הגה יש מקומות שנהגו לערוך שלחן ולשום עליו מיני מאכל בלילה שלמחר מלין תינוק ויש בזה איסור משום העורכים לגד שלחן (תא״ו ני״ז) אבל לערוך מטה למזל התינוק יש מתירין (כ״כ האחרונים):
One who has eaten and left crumbs on his table — he shall not bring a whole loaf and set it on the table.

Gloss: There are places where the custom is to set a table and place foods upon it on the night before a child is circumcised; and there is a prohibition in this, on account of “those who set a table for Gad” (Toldot Adam ve-Ḥava, netiv 17). But to set a bed for the child’s fortune, some permit (so the Aḥaronim wrote).
העורכים לגד שלחן — “those who set a table for Gad”. The phrase comes from Isaiah: it denotes those who laid a place for a power of fortune, hoping it would answer. The Taz gives the sense the Shulchan Arukh means here, and that explains the seif: the whole loaf set beside the crumbs is not a leftover but an offering — and for that reason alone it is forbidden.

The three seifim hang on a single question: what does what I do say? A garment may say belonging to another world, or only the trade of the one who wears it. A head of hair may say war or adornment. A loaf set on a table may be a leftover, or an offering. The siman never judges form alone: each time it asks what the form means.

2. Where the prohibition comes from — the verse, the Rambam, the Tur

The siman cites no verse; the Tur and the Rambam cite three. The Tur opens the laws of the customs of the nations by distinguishing two layers at once: what the Torah named expressly — divination, augury, consulting the dead — and what it did not name, that is, plain usage.

The Tur’s point, and it governs the whole siman. Had the Torah forbidden only the named practices, the siman would not exist: dress and hair are not among them. The Tur answers that the verse ובחקותיהם לא תלכו adds a category of its own — even a mere usage they have adopted. The three seifim live on that surplus, and that is why the Rama’s gloss will then have to draw its boundary: a prohibition bearing on usage in general needs a criterion, or it has no edge.

The Rambam, in the first chapter of his laws of the customs of the nations, gives the three verses and draws a positive conclusion from them — not merely not to resemble them, but to be recognizable.

« אֵין הוֹלְכִין בְּחֻקּוֹת הָעוֹבְדֵי כּוֹכָבִים וְלֹא מִדַּמִּין לָהֶן לֹא בְּמַלְבּוּשׁ וְלֹא בְּשֵׂעָר וְכַיּוֹצֵא בָּהֶן » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק י״א הלכה א)
« אֶלָּא יִהְיֶה הַיִּשְׂרָאֵל מֻבְדָּל מֵהֶן וְיָדוּעַ בְּמַלְבּוּשׁוֹ וּבִשְׁאָר מַעֲשָׂיו כְּמוֹ שֶׁהוּא מֻבְדָּל מֵהֶן בְּמַדָּעוֹ וּבְדֵעוֹתָיו. » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק י״א הלכה א)
And that is the Rama’s word. The Rambam writes מֻבְדָּל מֵהֶן וְיָדוּעַ בְּמַלְבּוּשׁוֹ — distinguished, and known by his garment. The Rama takes that word and makes it the first line of his gloss: where the seif enumerates prohibitions, the gloss begins with an obligation. The prohibition of resembling and the duty of being distinct are one rule seen from two sides.

3. The Rama’s criterion — what is a חוק and what is not

The gloss is built in three clauses, and they must be read in order: two cases where the usage is forbidden, then one where it is not. The Rama takes it from the Maharik, root 88.

« וכל זה אינו אסור אלא בדבר שנהגו בו העובדי כוכבים לשם פריצות כגון שנהגו ללבוש מלבושים אדומים והוא מלבוש שרים וכדומה לזה ממלבושי הפריצות » (רמ״א יו״ד קע״ח:א)

פריצות — licentiousness. The first case. The Rama gives a dated example: the red garment, which was then the dress of grandees. The Shach explains why that example: red is not the colour of the modest, black is — and he brings the sages’ word about one whose inclination overpowers him, that he should wear black.
« שאין דרך הצנועים להיות אדומים בלבושם וצבע השחור הוא דרך צניעו׳ והכנעה » (ש״ך יו״ד קע״ח ס״ק ג)

מנהג ולחוק ואין טעם בדבר — usage without a reason. The second case, and the broadest. The Rama does not ask whether the usage comes from a cult: he asks whether it has a reason. The absence of a reason suffices to make it suspect, because a usage whose reason has been lost may have had the worship of their fathers for its reason. Two names are given to this suspicion: דרכי האמורי and שמץ עבודת כוכבים מאבותיהם.
And the way out: לתועלת. The Rama sets against the ḥok not a general permission but an example, and the example is chosen: the physician’s garment. It is particular, it is recognizable, it comes from them — and it is permitted, because it serves something. What has a function needs no origin. The Rama at once adds a second opening, wider still: what is done out of honour, or for another reason.

4. The vocabulary of the siman

In ס״ק ד the Shach brings his father and teacher’s objection to the Maharik’s proof, and concludes וצ״ע after referring to siman 157, seif 2 — the siman of times of persecution.

ס״ק ב goes on to refer to the responsa Ḥavot Yair, siman 70, the responsa Shevut Yaakov, part three, siman 36, and the Shaarei Teshuva on Orach Chayim, siman 551 ס״ק לג. The word that carries his ruling is the first: the meal of that night certainly has no standing of a mitzva.

The Nekudot HaKesef

The Nekudot HaKesef — the Shach’s notes on the Taz — do not comment on this siman. They are found elsewhere in Yoreh De‘ah, and nearby: they appear at siman 174 and at siman 176. No entry is therefore ascribed to them here, and none will be invented to fill a column.

7. The Rambam — הלכות עבודה זרה וחוקות הגויים, chapter י״א

Seif 1 is the Rambam’s language, taken over by the Tur and abridged by the Shulchan Arukh. The correspondence is literal: the first halakha of chapter eleven gives the whole list, and the third gives the case of one close to the government.

Two words the Shulchan Arukh left out, which the Taz restores. The Rambam writes וְיַנִּיחַ הַפֶּרַע מִלְּאַחֲרָיו — the hair behind. The printed text of the seif stops at ויניח הפרע. The Taz writes that the missing word should be read, and the Baer Hetev repeats it. The detail is not decorative: without “behind”, the clause describes any head of hair; with it, it describes a definite cut.

8. Contemporary cases

Case 1 — A garment that came from elsewhere

The gloss gives two questions and one alone rarely suffices: does this garment carry a mark of licentiousness, and does it have a reason? A professional uniform, working clothes, a garment adopted for cold or convenience fall under לתועלת and the Rama permits them expressly. For practice, ask your Rav.

Case 2 — A haircut

The seif aims not at length but at two named forms: the sides shaved with the hair left in the middle, and the front shaved from ear to ear with the hair behind. The Taz adds a third reading — long hair never cut, which was the mark of fighting men. The three readings of ס״ק א are set out at level 2. A question for a Rav.

Case 3 — Building a hall

The seif forbids raising a place built like their cultic halls so that many should gather there. The Bach, quoted by the Shach and the Baer Hetev, excludes council and court buildings from that prohibition. The Taz, on the Raavad’s words, holds both readings possible and concludes that one should forbid on either. A question for a Rav.

Case 4 — The loaf on the table

Seif 3 forbids a precise gesture: bringing a whole loaf to set beside the crumbs after the meal. The Shach removes two neighbouring cases — if the loaf was already there it need not be taken away, and the Zohar even wants the blessing made on a whole loaf. The Taz adds that the crumbs themselves, left alone, are a mitzva: they stay ready for a poor man. A question for a Rav.

Case 5 — The night before the circumcision

The gloss forbids setting there a table laid with foods; the Shach at once notes that the meal made on that night in these lands carries no prohibition, the prohibition bearing only on foods set down and left. The Pitchei Teshuva adds the consequence: that meal has no standing of a mitzva. As for setting a bed for the child’s fortune, the gloss reports that some permit. A question for a Rav.

Case 6 — The whole loaf on Shabbat night

The Levush wished to extend the prohibition of seif 3 to the practice of leaving the whole loaf on the table all Friday night. The Taz opposes him in two words: “Gad” is a term of fortune, and the Shabbat loaf is set for the honour of the day, not for a fate — all the more since it is already set on the table straight from the oven. A question for a Rav.

9. Summary of Siman 178

One sentence. The prohibition bears not on resemblance but on what resemblance says: a usage that comes from them is forbidden when it is marked by licentiousness, or when it has no reason — and it is permitted once it serves something or is done out of honour. Hence the three seifim: the list of forbidden forms, the complete permission of one close to the government, and the whole loaf set on the table, forbidden only because it says nothing but an offering.
