Siman 179 stands in nineteen seifim — the Shulchan Arukh announces it itself: ובו י״ט סעיפים. Its title names three prohibitions, but the substance of what it teaches lies elsewhere: in the line, often very fine, that separates what falls under those prohibitions from what does not. A sign is not an augury; an incantation over a man in danger is not a חובר חבר; a verse read for protection is not a verse read to heal. The siman draws that line nineteen times, and the apparatus — fifty-three entries of the Shakh, the Taz, the Ba’er Hetev and the Pit’hei Teshuva — discusses almost nothing else.

1. The text of the Shulchan Arukh — the nineteen seifim

The siman advances in blocks. Seifim 1 to 4: what one does not enquire of, and the line between augury and sign. Seifim 5 to 7: the חובר חבר, and the two cases where danger opens a breach. Seifim 8 to 12: verses and amulets — healing, protecting, writing. Seifim 13 and 14: the dead. Seifim 15 and 16: illusion, Sefer Yetzira and demons. Seifim 17 to 19: the table, the incense, and the gravest case of the siman.

Seif א — one does not consult astrologers or lots

שלא לכשף לעונן ולנחש. ובו י״ט סעיפים:
אין שואלין בחוזים בכוכבים ולא בגורלות: הגה משום שנאמר תמים תהיה עם ה׳ אלהיך (ב״י בשם תוספות דע״פ ובשם ספרי) וכ״ש דאסור לשאול בקוסמים ומנחשים ובמכשפים (פסקי מהרא״י סי׳ צ״ו):
Title of the siman: that one not practise sorcery, augury or divination; and it contains nineteen seifim.

One does not enquire of those who gaze at the stars, nor of lots.

Gloss: because it is said, “you shall be wholehearted with Hashem your God” (Beit Yosef in the name of the Tosafot on Avodah Zarah and in the name of the Sifri). And all the more so is it forbidden to enquire of diviners, of those who read omens, and of sorcerers (Piskei Maharai 96).
The siman’s first word is not a prohibition — it is a demand. תמים תהיה עם ה׳ אלהיך lists no forbidden act: it asks for a bearing. The Shakh, at the first sק, draws from it the distinction that governs the whole siman: asking belongs to that demand, whereas acting by divination, augury or sorcery is a Torah prohibition.

Seif ב — the days, and the course of the moon

נהגו שאין מתחילין בב׳ ובד׳ ואין נושאין נשים אלא במילוי הלבנה: הגה ולכן נהגו ג״כ להתחיל ללמוד בר״ח כי אע״פ שאין ניחוש יש סימן (סמ״ק סימן קל״ו) במה שאדם יודע שהוא כנגד המזל לא יעשה ולא יסמוך על הנס אלא שאין לחקור אחר זה משום תמים תהיה (תשובת רמב״ן סימן רפ״ו) כמו שנתבאר:
It became the custom not to begin anything on Monday or Wednesday, and not to marry except while the moon waxes.

Gloss: and therefore it also became the custom to begin studying on Rosh Hodesh, for although there is no augury, there is a sign (Semak 136). What a man knows to be against his mazal he shall not do, and he shall not rely upon a miracle; only, one must not investigate this, because of “you shall be wholehearted” (responsum of the Ramban 286), as has been explained.
A sentence the A’haronim did not let pass. “There is no augury, and there is a sign” — two propositions in one line. The Taz, at the first sק, gives the reason for the days; the Shakh refers to Orah Haim 664 for a practice of the same shape. And the gloss closes of itself: one does not go looking — one must not investigate this.

Seif ג — the list of divination, and the hen that crowed

האומר פתי נפלה מפי או מקלי מידי או בני קורא לי מאחרי או שצבי הפסיקו בדרך או שעבר נחש מימינו או שועל משמאלו ולמי שאירע לו אחד מאלו עושה ממנו ניחוש שלא לצאת לדרך או שלא להתחיל במלאכה וכן המנחשים בחולדה ובעופות ובכוכבים וכן האומר אל תתחיל לגבות ממני שחרית הוא מוצאי שבת הוא מוצאי ר״ח הוא וכן האומר שחוט תרנגול שקרא כעורב ותרנגולת זו שקראה כתרנגול אסור: הגה י״א אם אינו אומר הטעם למה מצוה לשחוט התרנגולת אלא אומר סתם שחטו תרנגולת זו מותר לשחטה כשקראה כתרנגול (ב״י בשם הר״א והוא בתשו׳ מהרי״ל סימן קי״ח) וכן הוא המנהג:
One who says “my piece of bread fell from my mouth”, or “my staff fell from my hand”, or “my son is calling me from behind me”, or “a deer crossed my path”, or “a snake passed on my right” or “a fox on my left” — and to whom one of these happened, and who makes of it an omen not to set out on the road or not to begin a task; and likewise those who divine by the weasel, by birds and by the stars; and likewise one who says “do not begin collecting from me — it is morning, it is the going-out of Shabbat, it is the going-out of Rosh Hodesh”; and likewise one who says “slaughter this rooster that crowed like a raven, and this hen that crowed like a rooster” — it is forbidden.

Gloss: some say that if he does not state the reason why he orders the hen slaughtered, but says simply “slaughter this hen”, it is permitted to slaughter it when it crowed like a rooster (Beit Yosef in the name of HaRa, and it is in the responsa of the Maharil 118); and such is the custom.
What the seif lists, and what it does not say. Six mishaps, three practices of observation, one formula for deferring payment, two fowl: nine clauses and one verb throughout — he makes of it an omen. The seif does not forbid having seen one’s bread fall; it forbids ordering one’s conduct by it. The gloss then moves the line to an unexpected place: the reason said aloud. The Taz at sק 2 and the Pit’hei Teshuva at sק 3 both weigh that move.

Seif ד — house, child and wife: no augury, but a sign

בית תינוק ואשה אף על פי שאין ניחוש יש סימן: הגה אם הצליח אחר זה ג׳ פעמים או לא (ב״י בשם רש״י) וכן מותר לומר לתינוק פסוק לי פסוקיך (טור) י״א דאדם מותר לעשות לו סימן בדבר שיבא לעתיד כמו שעשה אליעזר עבד אברהם או יהונתן (טור והר״ד קמחי) ויש אוסרין (רמב״ם וסמ״ג) וההולך בתום ובוטח בה׳ חסד יסובבנו:
A house, a child and a wife: although there is no augury, there is a sign.

Gloss: whether he succeeded three times after that, or not (Beit Yosef in the name of Rashi). And likewise it is permitted to say to a child, “recite me your verse” (Tur). Some say a man may make himself a sign concerning a thing still to come, as Eliezer the servant of Avraham did, or Yonatan (Tur and Rabbi David Kimhi); and some forbid it (Rambam and Semag). And he who walks in wholeness and trusts in Hashem — kindness shall surround him.
Where exactly the line runs here. The Shakh at sק 4 brings Rashi’s explanation: the house, the child and the wife are not auguries but mere markers — if the business that follows succeeds, it is an indication; if not, let him not make too much of a habit of it. At sק 5 he goes further and reads in the Rama and the poskim that one may even act on the strength of the verse recited by the child, “for it counts somewhat as prophecy” — and the Taz at sק 3 says the same. The gloss nevertheless closes with a rule of bearing, not with a criterion.

Seif ה — חובר חבר: he who gathers by an incantation

חובר חבר זהו שעל ידי לחש מקבץ חיות או נחשים ועקרבים יתושים ופרעושים:
חובר חבר — this is one who, by an incantation, gathers beasts, or snakes and scorpions, gnats and fleas.
A definition, and at once its widest reach. The seif says nothing of intent. It is the Shakh, at sק 7, who takes it up and sets it aside: even though he means that they should do no harm, and gathers them towards a desert place so they not be found in settled land, it is forbidden. The next two seifim will open the only breach the siman knows here — danger.

Seif ו — the scorpion’s bite, and the incantation permitted even on Shabbat

מי שנשכו עקרב מותר ללחוש עליו ואפילו בשבת ואע״פ שאין הדבר מועיל כלום הואיל ומסוכן הוא התירו כדי שלא תטרף דעתו עליו:
One whom a scorpion has bitten: it is permitted to whisper over him, and even on Shabbat; and although the thing avails nothing, since he is in danger they permitted it, so that his mind should not become deranged over him.
A permission grounded on what the thing does not do. The seif itself says the incantation avails nothing; what it serves is the man in danger, whose mind one fears may become deranged. The Shakh, at sק 8, explains why Shabbat was at issue: he refers to Orah Haim 307, where the matter is multiplying speech.

Seif ז — pursued by a snake: one may “bind”

מי שרודפים אחריו נחש ועקרב מותר לחבר כדי שלא יזיקוהו:
One whom a snake and a scorpion pursue: it is permitted to “bind”, so that they should not harm him.
Here it is no longer the mind that is protected — it is life. The Shakh, at sק 9, gives the general rule: nothing stands before the saving of a life, apart from the three cardinal prohibitions. And the Taz, at sק 4, draws a conclusion wider than our case: where the saving of a life depends on a transgression, a man may himself perform that transgression.

Seif ח — he who whispers over the wound, and spits

הלוחש על המכה או על החולה ורוקק ואחר כך קורא פסוק מן התורה אין לו חלק לעוה״ב ואם אינו רוקק איסורא מיהא איכא ואם יש בו סכנת נפשות הכל מותר: הגה וי״א דכל זה אינו אסור אלא כשקורא הפסוק בלשון הקדש אבל בלשון לעז לא (רש״י בשם רבו) ומיהו ברוקק טוב ליזהר בכל ענין בפרט אם מזכירין השם שאין לו חלק לעוה״ב (כן משמע מהטור לדעת ר״י):
One who whispers over the wound or over the sick man and spits, and thereafter reads a verse from the Torah — he has no share in the World to Come; and if he does not spit, there is at least a prohibition; and if there is danger to life, all is permitted.

Gloss: and some say that all this is forbidden only when he reads the verse in the Holy Tongue, but not in a foreign tongue (Rashi in the name of his teacher). Nevertheless, as to spitting, it is good to be careful in every case, particularly if the Name is mentioned, for he has no share in the World to Come (so it is implied from the Tur according to the view of the Ri).
Three degrees in a single sentence. To spit and then read a verse: no share in the World to Come. To read a verse without spitting: a prohibition, no more. Danger to life: all is permitted. The Taz, at sק 5, gives the reason for the first degree — mentioning the Name of Heaven over a spittle is an affront — and himself answers the objection one might draw from the custom of spitting at ואנחנו כורעים. At sק 7 he fixes the reach of the second degree: even without mentioning the Name, and for any illness, not only for a wound.

Seif ט — the stricken child: no verse is read over him

תינוק שנפגע אין קורין עליו פסוק ואין מניחין עליו ס״ת:
A child who has been stricken: one does not read a verse over him, nor place a Torah scroll upon him.
The shortest seif, and the widest reason. The Taz, at sק 8, states it: there he needs healing, and words of Torah were not given for the healing of the body but for the healing of the soul. He at once draws the two consequences that order the next three seifim: the healthy man may read for protection — that is the following seif, and it is why one recites the Shema at his bedside — and if there is danger to life in the stricken child, it is permitted even to be healed by words of Torah. The Shakh, at sק 12, extends the rule to an adult who has fallen ill.

Seif י — the healthy man may read verses for protection

הבריא מותר לקרות פסוקים להגן עליו מהמזיקין:
A healthy man — it is permitted to him to read verses to protect himself from harmful beings.
One of the only two seifim in the siman on which none of the four commentaries writes — the other being seif י״ז. Neither the Shakh, nor the Taz, nor the Ba’er Hetev, nor the Pit’hei Teshuva places an entry here. Yet it carries the counter-proof of the preceding seif, and the Shakh points to it from sק 12: an adult who has fallen ill is not healed by words of Torah, except to protect, as in the seif that follows.

Seif י״א — measuring the belt, and the reference to Orah Haim

למדוד האזור וללחוש עליו מותר ואפי׳ בשבת: הגה ועיין בא״ח סימן ש״ו וה״ה שאר לחשים ועיין בא״ח סי׳ ש״א איזה לחש וקמיע אסור:
To measure the belt and whisper over it is permitted, and even on Shabbat.

Gloss: and see in Orah Haim at siman 306; and the same applies to other incantations. And see in Orah Haim at siman 301 which incantation and which amulet are forbidden.
Two references, and the Shakh pins them down to the seif. At sק 13 he gives Orah Haim 306 seif 7; at sק 14, Orah Haim 301 seifim 25 and 57. These are his two shortest entries in the siman, and they are what make the gloss usable: the Rama refers, the Shakh supplies the address.

Seif י״ב — amulets: healing, protecting, and what is not written

מותר להתרפאות בקמיע אפי׳ יש בהם שמות וכן מותר לישא קמיעין שיש בהם פסוקי׳ ודוקא להגן שלא יחלה אבל לא להתרפאות בהם מי שיש לו מכה או חולי אבל לכתוב פסוקים בקמיעים אסור:
It is permitted to be healed by an amulet, even if they contain Names. And likewise it is permitted to carry amulets that contain verses — and this only to protect oneself from falling ill, but not to be healed by them, for one who has a wound or an illness. But to write verses in amulets is forbidden.
Two matters in one seif, and they must be held apart. The seif first permits healing by an amulet bearing Names; it then deals with amulets bearing verses, and there it restricts to protection alone. The restriction follows exactly the rule the Shakh states at sק 12 on seif ט: words of Torah were not given for healing the body, except to protect. The closing clause is of another order, and it is the only one the Taz comments on: at sק 9 he gives its reason from Perek Kol Kitvei — writing texts one will not be able to save from a fire on Shabbat.

Seif י״ג — דורש אל המתים: he who starves himself and lodges in the cemetery

דורש אל המתים זה שמרעיב עצמו ולן בבית הקברות כדי שתשרה עליו רוח הטומאה:
דורש אל המתים — this is one who starves himself and lodges in the cemetery, so that a spirit of impurity should rest upon him.
The definition is narrow, and that is what allows the custom to stand. What the seif describes holds in three joint acts: to deprive oneself of food, to spend the night in the cemetery, and to do so for that precise purpose. The Shakh, at sק 15, reports that a responsum of the Maharah saw something of this order in vows to go to the cemetery, and that the Bach replied that the custom has long been established and there is no prohibition in the matter. The Ba’er Hetev, at sק 9, brings both.

Seif י״ד — adjuring the sick man to return after his death

להשביע את החולה לשוב אליו לאחר מיתה להגיד לו את אשר ישאל אותו מותר: (ויש מתירין אפי׳ לאחר מותו אם אינו משביע גופו של מת רק רוחו) (כן משמע בהגהות מיימוני בשם רא״ם דלא כבית יוסף):
To adjure the sick man to return to him after his death, to tell him what he will ask of him — this is permitted. (And some permit even after his death, if he does not adjure the body of the dead man but only his spirit) (so it is implied in the Hagahot Maimoniyot in the name of the Ra’em, not like the Beit Yosef).
The permission rests on the adjuration being addressed to a living man. The parenthesis adds the view that goes further, and that is where the disagreement lies: the Beit Yosef set aside the Ra’em’s proof, and the Darkhei Moshe — reported by the Shakh at sק 16 — sets aside that rejection in turn. The Shakh further brings the Levush’s objection to the distinction between body and spirit, and answers that it is not garbled according to the masters of Kabbalah.

Seif ט״ו — אוחז את העינים forbidden, ספר יצירה permitted

אוחז את העינים אסור וע״י ספר יצירה מותר (אפילו לעשות מעשה) (טור):
אוחז את העינים — forbidden; and by means of Sefer Yetzira — permitted (even to perform an act) (Tur).
The most commented seif of the siman: four entries on eleven words. The Shakh, at sק 17, brings from the Bach in the name of the Rambam that even an illusion produced without sorcery — by appearance, by tricks, by quickness of hand — is forbidden; the Ba’er Hetev at sק 10 repeats it. The Taz, at sק 10, conducts the longest discussion in the whole siman on the Rambam’s two formulations. And the Shakh, at sק 18, closes the permission of Sefer Yetzira with the conditions that put it out of practical reach.

Seif ט״ז — מעשה שדים, and the clause that closes the permission

מעשה שדים אסור ויש מי שמתיר לישאל בהם על הגניבה: הגה וכיוצא בזה (ב״י והגהות מיי׳ פי״א מהלכות גזילה) וע״י השבעה שמשביע אותם ע״י שמות יש מתירין בכל ענין (ב״י בשם נ״י ושם בהג״ה הנ״ל) מ״מ רוב העוסקים בזה אינן נפטרים מהם בשלום על כן שומר נפשו ירחק מהם (ב״י):
The work of demons is forbidden; and there is one who permits enquiring of them about a theft.

Gloss: and of similar things (Beit Yosef and Hagahot Maimoni chapter 11 of Hilkhot Gezelah). And by an adjuration, adjuring them by Names, some permit in every case (Beit Yosef in the name of the Nimukei Yosef, and there in the aforementioned gloss). Nevertheless, most of those who occupy themselves with this do not come away from them in peace; therefore he who guards his soul will keep far from them (Beit Yosef).
The permission and its reason lie in the same word. The Shakh, at sק 20, gives the ground of the view that permits enquiring about a theft: because he performs no act — and the Ba’er Hetev, at sק 12, says nothing else. This is exactly the line the Shakh laid down at the first sק: speech on one side, act on the other. And the Rama, having brought the widest permission, himself closes it with a rule of bearing.

Seif י״ז — the table set on the night of the circumcision

הנוהגים לערוך שלחן עם מיני מאכל בליל המילה ואומרים שהוא למזל התינוק אסור. (ועיין לעיל סוף סימן קע״ח):
Those who are accustomed to set a table with kinds of food on the night of the circumcision, saying that it is for the child’s mazal — it is forbidden. (And see above, at the end of siman 178.)
It is not the table that is at issue but the sentence. The seif describes a widespread custom and rejects it on one ground: and they say it is for the child’s mazal. It is the same mechanism as the gloss of seif ג, where the stated reason is what makes the prohibition — except that here the reason is stated, and the custom falls. The seif’s reference to the end of siman 178 is the siman’s only internal cross-reference, and none of the four commentaries adds an entry here.

Seif י״ח — fumigating the house with a fragrant herb

לקטר הבית בעשב שיש לו ריח טוב יש מי שאוסר אא״כ עושה כן כדי להסיר ריח רע:
To fumigate the house with a herb that has a good smell: there is one who forbids it, unless he does so in order to remove a bad smell.
The reason for the prohibition comes from the next seif. The Shakh, at sק 21, gives it in four words: because he appears like one who fumigates for a demon. It is therefore a prohibition of appearance, and the way out the seif leaves — removing a bad smell — removes the appearance itself by giving the act its ordinary purpose.

Seif י״ט — fumigating to a demon, and learning from the אמגושי

המקטר לשד לחברו ולכופו לעשות כרצונו חייב משום עובד עבודת כוכבים הלומד מן האמגושי אפילו דברי תורה חייב מיתה:
One who fumigates to a demon, to join it to himself and to compel it to do according to his will, is liable as one who serves idolatry. One who learns from the אמגושי — even words of Torah — is liable to death.
The gravest seif, and the Shakh disputes both of its clauses. On the first he brings, at sק 22, the disagreement between the Ramah — who held the fumigator liable as a בעל אוב — and the Beit Yosef, who emended the reading; he follows Sanhedrin 65a and draws out the practical consequence: liable as an idolater, the man is a מומר for the whole Torah; liable as a בעל אוב, he is one only in a single matter. On the second he writes, at sק 23, that in his humble opinion the main view, from Shabbat 75a, is that one may learn from a sorcerer — in order to understand and to rule.
The nineteen seifim do not ask: does it work? They ask: what are you doing, and why do you say so? Seif ו permits an incantation of which it itself says that it avails nothing; the gloss of seif ג forbids or permits the very same act according to the reason stated; seif י״ז forbids a table because of a sentence. The siman’s line almost never runs through efficacy, and almost always through what a man puts into his act.

2. The siman’s frontier — asking, doing, and תמים תהיה

The siman opens with a prohibition that is not one. “One does not enquire”: the Rama at once gives its source, and that source is a verse that forbids no act. The Shakh, at the first sק, then separates the two registers — and that separation is the tool used throughout the rest of the siman.

Two registers, not two degrees. The Shakh does not say that asking is less grave than doing: he says they are two different things. Asking runs against a demand — תמים תהיה — which lists no act. Doing runs against a Torah prohibition. That is why the siman’s permissions lodge almost all of them on the side of speech, or in an act of which one can say that it is not the act aimed at.

The consequence is immediate, and it decides almost every case in the siman. Asking remains in the order of speech; what the siman pursues elsewhere is the act. That is why seif ט״ז can permit enquiring of demons about a theft — the Shakh gives the reason in four words — and why seif י״ז can forbid a table for what is said around it.

There remains the question that most occupied the A’haronim: the sick man. Since the only obstacle is תמים תהיה, and not a prohibition of act, might one consult on behalf of a sick man? The Shakh brings the reading that would permit it, then the Maharshal’s conclusion which closes it, then the Beit Yosef in the name of the Zohar, which closes it more tightly still.

The Pit’hei Teshuva reopens the question at sק 2, and it is the one entry in the siman that discusses the very ground of the Zohar’s position. He draws an opening from it, and at once closes it with a rule of bearing — the same clause the Rama uses at seif ט״ז.

Four views, one closing clause. The Shakh’s wide reading, the Maharshal’s strict conclusion, the Zohar reported by the Beit Yosef, the Mishkenot Yaakov’s defence: four distinct positions on the sick man, and the last — the most lenient — ends in the very words the Rama uses at seif ט״ז to close the widest permission in the siman.

Chapter י״א of Hilkhot Avodah Zarah ve-Hukot HaGoyim is the direct source of most of our siman: it defines the מנחש, the קוסם, the מעונן, the חובר, the דורש אל המתים and the מכשף, and it closes on the verse that the Rama makes the siman’s first word.

Something the Rambam does and our siman does not. Chapter י״א defines each term before judging it: what a קוסם is, what a מעונן is, what a חובר is. Our siman takes up only three of these definitions — the חובר at seif ה, the דורש אל המתים at seif י״ג, the אוחז את העינים at seif ט״ו — and assumes the rest known. It is the Tur, at the head of the siman, who sets them out; and that is why the Taz, discussing the אוחז את העינים, must go back to the Rambam’s two halakhot to find something to decide with.

4. The vocabulary of the siman

תמים תהיה — “you shall be wholehearted”. The siman’s first word, and the only one that describes no act. The Rama sets it at seif א as the ground of what one does not enquire of; the gloss of seif ב uses it to forbid investigating one’s mazal; the Shakh, at the first sק, makes it the register proper to speech, distinct from that of act. The Rambam closes his chapter י״א on the same verse.

ניחוש — augury. Not noticing a portent, but making a rule of conduct out of it. Seif ג gives nine forms of it, and the verb is always the same: he makes of it an augury not to set out, not to begin. The Rambam, in chapter י״א halakha ד, gives the definition and the same list.

סימן — the sign. The exact opposite of the preceding, and the two words touch in the same sentence: although there is no augury, there is a sign. The Shakh explains at sק 4 what this covers — mere markers — and at sק 5 how far one may go.

חובר חבר — he who “binds”. Seif ה gives its definition: to gather by an incantation. The Rambam, in chapter י״א halakha י, gives a wider definition still, and specifies what makes one liable: holding something in the hand, performing an act with one’s speech, even pointing a finger.

מעונן. Our siman uses the word in its title but does not define it. The Rambam does so in chapter י״א halakha ח: those who set times and declare one day good, another bad. And at halakha ט he places under that same name the אוחז את העינים — of which the Taz will make the heart of his sק 10.

קוסם — the diviner. Another word our siman uses without defining: the gloss of seif א forbids enquiring of them, and the apparatus returns to it constantly. The definition is in the Rambam, chapter י״א halakha ו, and it describes procedures: sand, stones, the iron mirror, the staff.

אוחז את העינים — “he who seizes the eyes”. Illusion. Seif ט״ו forbids it in three words; the Shakh specifies at sק 17 that even produced without sorcery — by tricks, by quickness of hand — it is included; and the Taz, at sק 10, must set side by side two halakhot of the Rambam that do not classify it in the same place.

קמיע — the amulet. Seif י״ב separates three questions readily confused: being healed by an amulet bearing Names, carrying an amulet bearing verses, and writing verses in an amulet. The third alone is forbidden without reservation, and it is the only one the Taz comments on, at sק 9.

סגולה. The word does not appear in the seifim: it enters the siman through the Pit’hei Teshuva at sק 6, and it enters as a limit. The Hinukh Beit Yehuda there sets aside the use of a Torah scroll on that footing, distinguishing the protection the merit of Torah gives from what one would expect of a סגולה or a remedy.

דרכי האמורי — “the ways of the Emorite”. The generic name for the practices the Torah sets aside, and it too is not in the seifim: it enters through the Pit’hei Teshuva, twice. At sק 4, concerning a builders’ practice; at sק 7, concerning a household act on Shabbat. In both, it serves to characterise a practice the seifim had not foreseen.

אמגושי. The last new word of the siman, and it is the Shakh who fixes its reach. Seif י״ט appears to forbid learning from him absolutely; the Shakh writes at sק 23 that the main view, from Shabbat 75a, is that one may learn from a sorcerer in order to understand and to rule, and that the seif’s severity aims at a narrower case.

Nekudot HaKesef

The Nekudot HaKesef — the Shakh’s reply to the Taz — do not comment on this siman: they carry no entry here. They are found elsewhere in Yoreh De‘ah, and this site cites them for example at simanim 174 and 176. No line of this level is therefore attributed to them, and the apparatus table has no column in their name.

7. The Tur — the definitions from which the seifim come

The Tur opens the siman with a heading that names everything the block 178–181 will treat, and then sets out in turn the קוסם, the מעונן, the מנחש, the חובר חבר, the אוב, the ידעוני, the דורש אל המתים and the מכשף, almost always in the Rambam’s language. Several seifim of our siman are their abridgement.

8. Contemporary cases

Case 1 — Consulting an astrologer or a “seer”

This is seif א itself, and the gloss adds diviners and sorcerers to it. The Shakh, at the first sק, distinguishes: asking belongs to תמים תהיה, doing belongs to a Torah prohibition. The Ba’er Hetev brings at sק 1 a very wide view that holds the practices of his day to be empty; the Pit’hei Teshuva, at sק 2, examines the ground of the strictest position and nevertheless closes with the clause of caution. For practical application, consult your Rav.

Case 2 — A remedy that is not a medicine

The Pit’hei Teshuva treats exactly this case at sק 5: for a child who could not sleep, it was proposed to cut his nails and some of his hair, place them in an egg, and set it in a willow tree. The Panim Meirot forbids it, and draws from it a criterion — what is done far from the sick person. The Pit’hei Teshuva himself adds that the proof from Rashi requires study. For practical application, consult your Rav.

Case 3 — A psalm, an amulet, a Torah scroll

Seifim ט to י״ב are entirely on this, and the line is the one the Taz lays down at sק 8: words of Torah were not given to heal the body. To protect, yes — that is seif י, and it is the reason for the Shema at bedtime. The Pit’hei Teshuva, at sק 6, brings the case of the woman in labour, where danger permits, and the view that nevertheless restricts out of regard for the honour of the scroll. For practical application, consult your Rav.

Case 4 — Days, dates and “signs”

Seifim ב to ד mark out three distinct positions here: a custom the Shulchan Arukh records and the Taz explains at sק 1; a sign that is not an augury, on which the Shakh comments at sק 4; and an investigation the gloss forbids. The Pit’hei Teshuva, at sק 3, raises the question of the inner court — one who says nothing but refrains — and brings the Tosafot, who seem to say the opposite. For practical application, consult your Rav.

Case 5 — A conjuring show

Seif ט״ו forbids the אוחז את העינים, and the Shakh specifies at sק 17 that even illusion produced without sorcery — by appearance, by tricks, by quickness of hand — is included; the Ba’er Hetev repeats it at sק 10. The Pit’hei Teshuva, at sק 7, applies the rule to the wedding entertainers of his day and draws three distinct consequences, down to the act of watching. For practical application, consult your Rav.

9. Synthesis of Siman 179

In one sentence. The siman does not judge powers but bearings: asking belongs to תמים תהיה, a demand of stature; acting by augury, divination or sorcery is a Torah prohibition. Everything permitted in these nineteen seifim is permitted because it falls on one side or the other of that line — the sign that commands nothing, the incantation that only settles the mind of a man in danger, the verse that protects instead of healing, the question asked with no act accompanying it. And wherever a permission remains, a rule of bearing follows it: שומר נפשו ירחק מהם, המונע יבורך, וההולך בתום ובוטח בה׳ חסד יסובבנו.

  1. Seif א forbids enquiring, and the Rama gives a verse as its source. Why does that verse not make consultation a prohibition of act, and where does the Shakh say so?
