Seif א names four categories: those who gaze at the stars and lots in the body of the seif, diviners, readers of omens and sorcerers in the gloss. The source is single and it is a demand. The question the A’haronim worked on is that of the sick man, and it arises precisely because the source is a demand and not a prohibition of act.
| The view | What it holds | Where |
|---|---|---|
| Piskei Maharai, as the Shakh reads them | A sick man may consult, since the only obstacle is
| Maharshal | Forbidden short of danger to life — even where a limb is in danger; permitted if the illness came through sorcery, accident or an evil spirit |
| Beit Yosef in the name of the Zohar | A great prohibition, even for a sick man | בית יוסף יו״ד קע״ט |
| Mishkenot Yaakov, reported by the Pit’hei Teshuva | Defends the lenient practice, and nevertheless closes with
| A view the Ba’er Hetev brings in parentheses | Holds that the sorcery the Torah forbade was that of ancient times |
Three consecutive seifim set up three distinct standings, and they must be held apart. Seif ב: a recorded custom, of which the gloss says that there is no augury but there is a sign — and which at once closes by forbidding investigation. Seif ג: augury proper, in nine forms. Seif ד: the sign, permitted, which the Shakh widens to the point of permitting action upon it.
This is the siman’s most singular mechanism, and it works twice in opposite directions. At seif ג the gloss permits slaughtering the hen on condition that he not say why. At seif י״ז the table on the night of the circumcision is forbidden because they say that it is for the child’s mazal. The same act in both cases, and the sentence decides.
Seif ה defines the prohibition at its widest: the Shakh adds that an intention to protect changes nothing. Then two seifim open the only breach the siman knows here, and they are not of equal force. Seif ו protects the mind of a man in danger, by an act the seif itself says avails nothing. Seif ז protects his life, and the Shakh there invokes the general rule.
Five seifim, and one rule runs through them: words of Torah protect, they do not heal the body. It explains why seif ט forbids the verse over the stricken child, why seif י permits it to the healthy man, and why seif י״ב restricts verse-amulets to protection alone. Seif ח, upstream, grades the offence when the verse is used all the same; and seif י״א recalls that some practices are permitted by name.
| What is done | Standing | Source |
|---|---|---|
| To whisper a verse over the wound, while spitting | No share in the World to Come | שו״ע יו״ד קע״ט:ח |
| The same, without spitting | Forbidden |
| The same, in a foreign tongue | Permitted per the gloss; the Bach forbids |
| The same, where there is danger to life | Permitted |
| Verse or scroll over the stricken child | Forbidden |
| The same, where there is danger to life | Permitted |
| A healthy man reading for protection | Permitted |
| To measure the belt and whisper over it | Permitted, even on Shabbat |
| An amulet bearing Names, for healing | Permitted |
| An amulet of verses, so as not to fall ill | Permitted |
| An amulet of verses, for healing | Forbidden |
| To write verses in an amulet | Forbidden |
Two very short seifim, and two opposite directions. Seif י״ג defines the דורש אל המתים by three joint acts, which makes the definition narrow — and that is why the Shakh can report that the custom of going to the cemetery is established and carries no prohibition. Seif י״ד permits adjuring the sick man to return after his death, because the adjuration is addressed to a living man; and the view reported in parentheses goes further, distinguishing the body of the dead from his spirit.
Seif ט״ו is the most commented in the siman: eleven words, four apparatus entries, and two competing solutions to the Rambam’s contradiction — the Beit Yosef’s, which maintains that there is an act, and the Taz’s, which accepts that there is none and distinguishes by what the eyes receive. The second half of the seif permits Sefer Yetzira; the Shakh and the Ba’er Hetev close it with conditions. Seif ט״ז gives the same movement concerning demons, and it is the Rama himself who closes.
The last three seifim run from the lightest to the gravest. Seif י״ז forbids a table because of a sentence. Seif י״ח forbids fumigating the house with a fragrant herb, and the Shakh gives the reason: it appears like fumigating for a demon — so it is seif י״ט that explains seif י״ח. And seif י״ט itself carries two clauses, which the Shakh takes up one after the other.
| The word | What it denotes |
|---|---|
The demand that opens the siman. It forbids no act: it forbids consulting. Everything the siman permits on the side of speech is decided in relation to it. |
| ניחוש | Making a rule of conduct out of a portent. Nine forms at seif ג, and always the same verb. |
Its exact opposite, and the two words touch in one sentence. A marker that obliges nothing. |
To gather beasts by an incantation. The Shakh adds that a protective intention changes nothing. |
Illusion — including produced by tricks and quickness of hand, with no sorcery at all. |
Three regimes not to be confused: healing by Names, carrying verses for protection, writing verses. |
To starve oneself, to lodge in the cemetery, and to do so for that purpose. Three joint acts — which is what lets the custom of going to the cemetery stand. |
| סגולה | The word is not in the seifim: it enters through the Pit’hei Teshuva at sק 6, and enters as a limit. |
It too is not in the seifim. The Pit’hei Teshuva uses it twice, to characterise practices the seifim had not foreseen. |
1. Asking is not doing. The Shakh lays it down at the first sק, and that line serves in almost every seif.
2. Danger to life lifts everything — seif ח says it, the Shakh gives the rule at sק 9, and the Taz draws at sק 4 that the man may act himself.
3. Words of Torah protect and do not heal. It is the Rambam, then the Taz at sק 8 and the Shakh at sק 12; and it is what reconciles seifim ט, י and י״ב.
4. The stated reason changes the standing of the act. The gloss of seif ג makes a permission of it, seif י״ז makes a prohibition of it.
5. A permission in this siman is rarely a bare permission: the Rama, the Shakh and the Pit’hei Teshuva each close it with a rule of bearing.
