Siman 180 — Tattooing, baldness and gashing

Siman 180 runs to twelve seifim — the Shulchan Arukh announces it itself: ובו י״ב סעיפים. It joins three prohibitions that at first sight have nothing in common: tattooing, gashing and baldness. What binds them the Tur says in a word — they are customs of the nations, and all three are done in the body. What separates them the siman says as well: tattooing depends on no mourning at all, whereas gashing and baldness make one liable only for a dead person — or, for gashing, before an idol.

1. The text of the Shulchan Arukh — the twelve seifim

The siman advances in three blocks. Seifim 1–4: the כתובת קעקע — its definition, the one to whom it is done, ash upon a wound, and the mark placed on a slave. Seifim 5–8: the שריטה — for what it makes one liable, by what means, even out of the presence of the dead, and its count. Seifim 9–12: the קרחה — its definition, its measure, its count, the case of doing it to another, and women.

Seif א — what a כתובת קעקע is: the gash, then the filling

איסור כתובת קעקע וקריחה על מת. ובו י״ב סעיפים:
כתובת קעקע היינו ששורט על בשרו וממלא מקום השריטה בחול או דיו או שאר צבעונים הרושמים:
Title of the siman: the prohibition of כתובת קעקע and of קריחה for a dead person; and it contains twelve seifim.

A כתובת קעקע, that is: that he gashes his flesh and fills the place of the gash with kohl, or ink, or other dyes that leave a mark.
Two acts, and the prohibition exists only with both. The seif does not define a tattoo by its appearance but by its making: one gashes, and then fills the gash with a substance that leaves a mark. The Rambam states it outright — writing without incising, or dyeing without writing, leaves one exempt, until he writes and incises. And the Chakh adds in the name of the Bach that the order is immaterial: to dye first and gash afterwards at the place of the dye is the same thing.
A note on the reading, and one does not correct it: our source here reads בחול; the Tur writes כחול and the Rambam כחל — the black pigment with which the eye is lined. We copy the reading as it stands and read it as the two works from which the seif is drawn.

Seif ב — the one to whom it is done

אם עושה כן על בשר חבירו אותו שנעשה לו פטור אא״כ סייע בדבר:
If he does so upon the flesh of his fellow, the one to whom it is done is exempt, unless he assisted in the matter.

Seif ג — ashes upon a wound

מותר ליתן אפר מקלה על מכתו:
It is permitted to place burnt ashes upon his wound.
Why ashes are permitted, though the gemara forbade them. Rav Malkia taught that it is forbidden to place burnt ashes upon one’s wound, because it looks like a כתובת קעקע. Rav Ashi answered that wherever there is a wound, the wound itself testifies about him. The Beit Yosef writes that we rule like Rav Ashi, who is the later authority; the Chakh gives the reason in his own words — the wound proves that he is not acting after the manner of the nations but for the healing of the wound.

Seif ד — marking a slave

הרושם על עבדו שלא יברח פטור (ונראה דלכתחילה מיהא אסור) (ד״ע):
One who marks his slave so that he should not flee is exempt. Gloss: (and it appears that a priori it is nevertheless forbidden) (the Rama’s own opinion).

Seif ה — for what the gashing makes one liable, and by what means

השורט בבשרו אינו חייב אא״כ עושה כן על מתו או לעבודת כוכבים אלא שעל מתו חייבים בין ביד בין בכלי ולעבודת כוכבים אינו חייב אלא בכלי:
One who gashes his flesh is liable only if he does so for his dead or for idolatrous worship; save that for his dead one is liable whether by hand or by an implement, and for idolatrous worship one is liable only with an implement.
Two motives, and they do not follow the same rule. Gashing is not forbidden in itself: it is forbidden for a dead person, or for idolatrous worship. And the two part company over the means. For the dead, hand and implement are equal; for idolatry, only an implement makes one liable. The Rambam gives the reason for the asymmetry: these are two verses and two practices — the mourning-gash of the nations, and self-laceration before the idol, of which Scripture says ויתגדדו כמשפטם.

Seif ו — even not in the presence of the dead

גדידה ושריטה על מת אסור אפילו שלא בפני המת (ועל צער אחר שרי) (ב״י מפי׳ הטור):
גדידה and שריטה for a dead person are forbidden even when not in the presence of the dead. Gloss: (and for another grief — it is permitted) (Beit Yosef, from the Tur’s exposition).

Seif ז — striking with the hand until blood flows: two opinions

יש מי שאומר דדוקא שריטה אבל אם מכה בידו על בשרו עד שדמו שותת מותר ויש מי שאוסר:
There is one who says that only gashing is meant, but if he strikes with his hand upon his flesh until his blood flows, it is permitted; and there is one who forbids.

Seif ח — five gashes, five penalties

המשרט ה׳ שריטות על מת אחד או על ה׳ מתים שריטה אחת חייב ה׳:
One who makes five gashes for one dead person, or one gash for five dead persons, is liable five times.

Seif ט — what a קרחה is, and its measure

קרחה הוא שתולש משער ראשו על המת בכל מקום בראש בין ביד בין בסם ושיעורו כדי שיראה מראשו כגריס פנוי בלא שיער וי״א שתי שערות ויש מי שאומר דאיסורא איכא אפי׳ בשער א׳:
A קרחה is that he tears out hair from his head for the dead, in any place of the head, whether by hand or by a depilatory; and its measure is that a gris-sized patch of his head be seen bare of hair; and some say two hairs; and there is one who says that there is a prohibition even with a single hair.
Three measures, and a prohibition that overruns them all. The gemara reports three views on the measure of the baldness — the size of a gris, “that his head be seen,” two hairs. The Shulchan Arukh takes the first and reports the second. But the last clause of the seif no longer speaks of a measure at all: there is one who holds that a prohibition exists even with a single hair. This is the distinction the Tur formulates and the Beit Yosef notes — liability and prohibition do not coincide.

Seif י — one baldness for five dead, five balds for one dead

קרח קרחה אחת על ה׳ מתים אינו חייב אלא אחת אבל אם קרח ה׳ קרחות על מת א׳ חייב על כל או״א:
If he made one baldness for five dead, he is liable only once; but if he made five baldnesses for one dead, he is liable for each one of them.

Seif י״א — one who does it to another, and the one who assists

הקורח בראשו של חבירו והמשרט בבשר חבירו וחבירו מסייע אם שניהם מזידים שניהם לוקים אחד שוגג ואחד מזיד המזיד לוקה:
One who makes a baldness on his fellow’s head, and one who gashes his fellow’s flesh, his fellow assisting: if both are intentional, both receive lashes; if one is inadvertent and one intentional, the intentional one receives lashes.

Seif י״ב — women too

גם הנשים מוזהרות בבל יקרחו: הגה וכל שכן בבל ישרטו (טור) ויש להזהירם שלא תתלשנה בשעריהן על מת שלא תבאנה לידי קרחה (טור בשם הירושלמי) וכן בשריטה:
Women too are warned concerning בל יקרחו. Gloss: and all the more so concerning בל ישרטו (Tur), and they must be warned not to tear out their hair over a dead person, lest they come to baldness (Tur in the name of the Yerushalmi), and likewise regarding gashing.

2. The mechanism — three prohibitions, and what holds them together

The Tur opens the siman by naming the category, and he names it twice — once for tattooing, once for baldness and gashing.

So there are three laws and one family. But the conditions do not coincide, and therein lies the whole craft of the siman.

Tattooing requires neither a dead person nor an idol: the Tur writes that he is liable for whatever he writes, and the Beit Yosef recalls that even Rabbi Shimon, who imposes the penalty only for an idolatrous name, holds the writing forbidden in any case.

Gashing, for its part, makes one liable only for a dead person or for an idol, and baldness only for a dead person. The proof is drawn by the gemara from the word לנפש: one who gashes himself over his fallen house or his sunken ship is not liable.

A line not to be crossed: exempt is not permitted. The word פטור appears twice in this siman — at seif 2 and at seif 4 — but the gap between liability and prohibition is marked at four places, and each time it is a commentator who marks it. At seif 2, the Chakh at ס״ק ד derives from the following siman that one to whom a tattoo is made, even without assisting, is still within the prohibition. At seif 4, the gloss says that a priori marking one’s slave is nonetheless forbidden. At seif 6, the Bach, reported at ס״ק ט, refuses the Beit Yosef’s permission for another grief. And at seif 9, one view forbids from a single hair, where liability requires the measure of a gris.

3. The sugya — מכות כ׳ ע״א – כ״א ע״א

The entire substance of the siman lies in the last two mishnayot of tractate מכות and their gemara. The mishna lists the four acts in a single breath and at once gives the rule of number.

The gemara adds four things to them, and the Shulchan Arukh takes them up one by one. First the measure of the baldness, disputed by three views.

Then the exclusion of what is not a dead person.

Then the division between the hand and the implement, which the gemara must reverse in order to fit the verse.

Finally tattooing, its definition in two acts and the question whether an idolatrous name is required.

The Nekudot HaKesef

An absence to be reported, and not to be misnamed. The Nekudot HaKesef — the Chakh’s reply to the Taz — do not comment on this siman: they have nothing to take up here, the work following only those places where its author chooses to answer. It is an absence of commentary, not an absence of a work: they are found on siman 174 as on siman 176. Nothing is therefore quoted from them here, and no column is filled in their name.

7. The Rambam — הלכות עבודה זרה וחוקות הגויים, chapter י״ב

The three prohibitions of this siman are gathered in a single chapter of the Mishneh Torah, and that chapter is the one on חוקות הגויים — the very chapter that opens with the ban on dressing and cutting one’s hair as they do. The Shulchan Arukh follows it closely: the definition in seif 1 is the Rambam’s language, and so is the rule of seif 11, as the Beit Yosef says expressly.

8. Contemporary cases

Case 1 — Being tattooed today

Seif 1 gives the definition, and it is technical: a gash, then a filling with a substance that marks. The modern tattoo does both in one motion. Seif 2 adds that the one to whom it is done is exempt — but the Chakh at ס״ק ד derives from the following siman that a prohibition remains even without assisting, and the Ba’er Hetev repeats it. Case 2 — Are letters required?

The Pit’hei Teshuva opens the question in the name of the Me’il Tsedaka: does the penalty presuppose writing properly so called, or does any mark suffice? He concludes that real letters are needed — but that one letter suffices. And he is careful to add that the permission of ash in seif 3 proves nothing against him: it might remove only the penalty, the rabbinic prohibition remaining. It is an entry about liability, not about permission. For the application to your situation, consult your Rav.

Case 3 — A mark made for treatment

Seif 3 permits burnt ash upon a wound, and the Taz extends the permission even to hard ash, which hollows out the place of the wound and whose trace is still visible long afterwards. The reason is single, and the Chakh states it: the wound itself proves that he is not acting after a custom of the nations but for healing. What this seif settles, then, is a case where the mark accompanies a treatment. For the application to your situation, consult your Rav.

Case 4 — Striking oneself in grief

Seif 7 gives two views without deciding: one who strikes his flesh until blood flows, for a dead person, is permitted according to one and forbidden according to the other. The Taz reports the episode from which the dispute arises — Rabbi Akiva over Rabbi Eliezer — and the reading that sets it aside: it was not for the dead but for the Torah that was lost. The Chakh draws the line: the one who forbids speaks only of the act done for the dead; done for the Torah of a great man who has gone, it remains permitted. Case 5 — Tearing out one’s hair at a bereavement

Seif 9 fixes the measure for liability, and reports a view forbidding even one hair. The gloss on seif 12 adds a practical instruction that presupposes no measure at all: one must warn against tearing out hair over a dead person, lest one come to baldness. The Tur cites a Yerushalmi for this, and the Beit Yosef recalls that the Terumat HaDeshen forbids even when one’s dead is not before him. For the application to your situation, consult your Rav.

Case 6 — A mark imposed upon another

Seif 4 exempts one who marks his slave so that he should not flee, and the gloss adds that a priori it is nonetheless forbidden. The Pit’hei Teshuva reports in the name of the Noda BiYehuda that the seif deals with a slave who was circumcised and immersed, and that the division runs there. Seif 11 no longer speaks of exemption at all: one who does it to another is liable, and the one who lends himself to it is liable with him once he acts knowingly. 9. Summary of Siman 180

One sentence. Three marks made in the body, and three distinct questions: the tattoo is judged by what is done — a gash filled with dye, and nothing else is required; the gash and the baldness are judged by what they are done for — a dead person, or an idol, and nothing else makes one liable. Between the two runs a line the siman never stops drawing: the line between what one is liable for and what is forbidden, for exemption from a penalty has never been a permission.
