1. The axiom: two regimes in one siman

The axiom. This siman contains two regimes, and confusing them is the first mistake. The כתובת קעקע is judged by the act: a gash filled with dye suffices, and no motive need be established. The שריטה and the קרחה are judged by the motive: without a dead person — or, for gashing, without an idol — there is no liability, whatever the gesture. The first regime asks what was done; the second, for whom it was done.

Three consequences, and they order the siman. (1) One may be liable for a tattoo with no mourning at all and no idol at all — the Tur writes it: for whatever he writes. (2) One may gash oneself until blood flows over a fallen house and be liable for nothing, because the verse said לנפש. (3) And in both regimes, exemption is never permission: at four places — seifim 2, 4, 6 and 9 — a commentator recalls that the prohibition stands where liability falls away.

2. The three reflex questions

1. What was done to the body? A gash filled with dye — that is a כתובת קעקע, and nothing else need be sought. A gash alone, or hair torn out — move to the next question.
2. For whom was it done? For a dead person — gashing and baldness make one liable. For an idol — gashing alone, and only with an implement. For another grief — the gloss permits; the Bach maintains a prohibition.
3. Is one liable, or only forbidden? The two never coincide in this siman. A single hair, a tattoo received without assisting, the mark on a slave: exempt from penalty, and yet forbidden.

4. The כתובת קעקע — what makes the prohibition

The definition rests on two acts, and one without the other leaves one exempt. The order is immaterial — the Chakh says so in the name of the Bach, and the Shulchan Arukh in fact writes the gash before the filling, where the Rambam writes the writing before the incising.

No motive is required, and that is what separates this first block from the other two. The mishna does report a view requiring an idolatrous name — but for the penalty alone, the writing remaining forbidden in any case.

And the permission of seif 3 does not depend on the mark but on what accompanies it: a wound. The Taz shows that even hard ash, whose trace remains long, is included in the permission.

5. The שריטה — the motive, then the means

The motive first: without a dead person or an idol, no liability. The means next, and the two motives do not treat it alike — the dead admits hand and implement, the idol requires the implement.

Place and time do not matter: the gloss on seif 6 says so — even out of the presence of the dead. And seif 7 leaves open the question of the blow struck by hand, two views facing each other undecided.

6. The קרחה — the measure and the count

The measure of liability is a bare gris; a second view says two hairs; and a third statement, no longer a measure at all, holds that a prohibition exists from one hair.

The count does not follow that of gashing, and this is the point to retain: five baldnesses for one dead make five penalties, but one baldness for five dead makes only one. Gashing, for its part, counts the dead as it counts the gestures.

7. Done to another — the actor and the one who assists

One who does it to another is liable. The one to whom it is done is exempt — but if he assists, he becomes an actor. Seif 11 says so for baldness and gashing; the Perisha, reported by the Chakh, extends it to tattooing.
