Siman 182 — A man shall not wear a woman’s garment

Six seifim, reduced to one question: is this act a grooming of the other sex?

1. The axiom: the verse aims at grooming, not at cloth
The axiom. The verse speaks of a garment; the sages read it as aiming at every grooming of the other sex done for beauty. That is why the siman treats hair, hair colour and the mirror as much as dress — and why the same act changes status according to what it means in the place where it is done.
Three consequences. (1) Bodily hair is forbidden only rabbinically, and only where it is a woman’s act. (2) The other sex’s garment is from the Torah and carries lashes, because the difference is visible in it. (3) What has no purpose of adornment — shaving for treatment, a garment worn against rain — falls outside, each according to the opinions reported.
2. The three reflex questions
1. Is this act, in this place, the other sex’s doing? No — the prohibition does not bite. Yes — go to the next question.

2. Is it done for adornment? For treatment, against cold, out of suffering — opinions differ and several permit. For beauty — forbidden.

Four variables, and one question. The place (local usage), the instrument (razor, scissors, hand, garment), the extent (a part, or the whole body) and the motive (adornment, treatment, suffering). Each serves to answer the same question: is this act a woman’s grooming?
5. Two degrees of prohibition, and the criterion that separates them

This table explains an apparent oddity of the siman: the most obviously “feminine” act — removing hair — is the lightest, and the act that may be only one garment among others is the gravest. The criterion is not the intensity of the adornment but its visibility.

7. Disguise — three voices

The Taz and the Shach both refer to Orach Chayim, siman 696, where the question is treated in its own place. Whoever wishes to decide must go there: siman 182 reports, it does not conclude.

The Taz closes his ס״ק ז with a textual note: the Tur, as we read it, has a scribal error here. The Tur’s passage indeed says the opposite of what the Beit Yosef and the Taz establish.

10. Rules of thumb, mnemonic and classic pitfalls
Rules of thumb
- The verse aims at grooming, not at cloth.
- Bodily hair: rabbinic, and only where it is a woman’s act.
- The garment: from the Torah, because the difference is seen.
- What disfigures is no adornment — hence seif 2.
- Suffering displaces the purpose — hence seif 4.
- The dyeing has only one forbidden direction: from white to black.
Mnemonic. Four words to read any case in the siman — place, instrument, extent, motive. And a fifth question, which gives the degree: is it seen?
Classic pitfalls
- Thinking the siman is mostly about dress: only one of its six seifim is.
- Taking “from his head to his feet” literally: the Shach writes ל״ד, and refers to the previous siman.
- Thinking the permission of scissors extends to the razor: the Shach closes it at ס״ק ג.
- Thinking seif 3 holds only for the underarm: the Shach and the Taz both show the contrary.
- Settling the question of disguise from this siman: both commentators refer to Orach Chayim 696.
- Ascribing an entry to the Nekudot HaKesef or the Pitchei Teshuva on this siman: they do not comment here.
