1. Opening of the sugya — a fixed vesset and separation before the vesset

↩ Detailed explanation (Level 1)

The foundation — the chazakah of

The siman begins from a fact of nature: רוב הנשים יש להם וסתות — most women have a vesset, a fixed time at which they are accustomed to see, and the Mechaber gives as examples כגון מעשרים לעשרים יום או מל׳ לל׳ יום. Upon this fact the gemara builds a presumption: the guest comes at its appointed time.
From there, two opposite movements within the same seif. Outside the time of the vesset the woman stands in chezkat taharah, and her husband comes to her without a prior bedikah.
But when the hour of the vesset approaches a concern arises, and the husband must separate from her — which will be the matter of seif 2. The vesset is therefore the pivot of the whole siman: as long as it has not arrived, full presumption of purity; once it arrives, a concern that obliges separation. Everything else in the siman is only the determination of the edges of that concern — its duration, its extent, and what it leaves standing.
The two poles in the Mechaber’s language: seif 1 is written on the side of leniency — «
The stringency will come in seif 2. The lamdan notes the shape of the statement: the Mechaber does not say that the woman is doubtful and that we permit her; he says she has no need of a bedikah — the chezkat taharah is not breached, it is intact. What follows, therefore, will not come to resolve a doubt but to install a concern at a precise hour.
The Rama’s gloss — שלא יהא לבו נוקפו ופורש: the Rama adds that she should not even impose upon herself the stringency of examining herself before or after tashmish — « גם אין לה להחמיר לבדוק עצמה לא לפני תשמיש ולא לאחר תשמיש שלא יהא לבו נוקפו ופורש » (הגהת רמ״א, שולחן ערוך יורה דעה קפ״ד:א)
The Shach (ס״ק ד) supplies the psychological reason, and it is striking: if the husband sees his wife examining herself, he tells himself that had she felt nothing she would not be examining — and he withdraws. And outside that moment? There the Mechaber himself concludes: שלא בשעת תשמיש — כל המרבה לבדוק הרי זו משובחת. The bedikah is therefore not judged good or bad in itself: it is judged by the moment at which it falls.

2. The underlying chakira — וסתות דאורייתא or דרבנן

↩ Detailed explanation (Level 1)

This is the machloket that stands beneath the whole siman, and from which most of the practical nafka minot derive.

The chakira — what force does the concern of the vesset have? When the hour of the vesset has passed and she has not examined herself, is she held to be certainly impure — as though she had seen — or is there here only a concern? Everything turns on the question put to Rav Nachman in Niddah 16a: « וְסָתוֹת דְּאוֹרָיְיתָא אוֹ דְרַבָּנַן » (נדה ט״ז ע״א) Is the presumption “the guest comes at its appointed time” a law of the Torah that fixes impurity, or only a rabbinic concern?
The root of the machloket:
ShitahWhat the concern of the vesset is worthמקור
וסתות דאורייתא The presumption אוֹרַח בִּזְמַנּוֹ בָּא has the force of Torah; Shmuel teaches in Niddah 16a that even if she examined herself and found herself pure she is impure — מִפְּנֵי שֶׁאוֹרַח בִּזְמַנּוֹ בָּא נדה ט״ז.
A rabbinic concern only; the chezkat taharah is not uprooted. This is the accepted view: היינו מדרבנן כן הסכמת רוב הפוסקים והאחרונים דוסתות דרבנן ש״ך ס״ק ה
The Noda BiYehuda’s distinction Both at once, but upon two different objects — see the following box
The Noda BiYehuda’s distinction (Pitchei Teshuva ס״ק ג): the Pitchei Teshuva refers to the responsa of the Noda BiYehuda (Yoreh De’ah, nos. 55-56), and his thesis cuts the question into two objects:
« שהעלה דמה שאמרו וסתות דרבנן היינו לענין שלא אמרינן שכבר ראתה בשעת וסתה משום דנגד חזקה אורח בזמנו בא יש חזקת טהרה » (פתחי תשובה יו״ד קפ״ד ס״ק ג)
— that is, “rabbinic” bears only upon the retrospective: we shall not say that she has already seen. But as to the future:
« אבל לענין לפרוש מאשתו סמוך לוסתה הוא מן התורה דחיישינן שמא תראה » (פתחי תשובה יו״ד קפ״ד ס״ק ג)
and he supports this from a known principle:
« ודמי להא דאמרו שמא מת לא חיישינן ושמא ימות חיישינן » (פתחי תשובה יו״ד קפ״ד ס״ק ג)
We do not fear that a man has died, but we do fear that he may die; likewise we do not apply chezkat taharah to what has not yet happened. The Pitchei Teshuva adds, in the name of the Chatam Sofer, that this sevara is already found in the Ra’ah’s Bedek HaBayit, that he himself received it from his teacher, and — this is the consequence — « ולכן חושש מאד לסברא זו ומשוי לה ספק דאורייתא » (פתחי תשובה יו״ד קפ״ד ס״ק ג)
The question remains open, and the Pitchei Teshuva leaves it open: he notes that as a matter of din, the distance between the Ra’ah and the Noda BiYehuda is great.
Nafka minot of the chakira — three places in the siman where the answer can be read:
  1. Poked ishto (seif 10) — the Taz (ס״ק י״ד) draws an explicit proof from it: « כיון דוסתות דרבנן במקום מצוה לא גזור » (ט״ז יו״ד קפ״ד ס״ק י״ד)
  2. Chibbuk and nishuk (Taz ס״ק ג) — the Beit Yosef permits, בב״י כתב דאפילו חיבוק ונישוק מותר ולא חיישינן לביאה כיון שביאה איסור דרבנן: the reasoning presupposes that the prohibition at stake is only rabbinic.
  3. Sunrise (seif 4; Shach ס״ק י״ג) — « דכיון דוסתות מדרבנן ה״ל ספק דרבנן לקולא » (ש״ך יו״ד קפ״ד ס״ק י״ג): a rabbinic doubt is resolved leniently, and that is why she is forbidden only by day.
What these proofs reach is itself disputed: two of them — the ט״ז ס״ק י״ד and the ש״ך ס״ק י״ג — bear on the perishah itself, which is precisely what the Noda BiYehuda calls מן התורה, and not on what we presume after the fact; and the Chatam Sofer, cited above, makes of it a ספק דאורייתא, which presupposes the question open. We leave it where the Pithei Teshuva leaves it. — And for practice, ask your Rav.

3. The measure of the onah — day or night

↩ Detailed explanation (Level 1)

The text of the Mechaber and the Rama (seif 2)

The foundation — what an “onah” is:
The gemara (Niddah 63b) derives from the warning וְהִזַּרְתֶּם אֶת בְּנֵי יִשְׂרָאֵל מִטֻּמְאָתָם (Shevuot 18b): « אַזְהָרָה לִבְנֵי יִשְׂרָאֵל שֶׁיִּפְרְשׁוּ מִנְּשׁוֹתֵיהֶן סָמוּךְ לְוִסְתָּן » (נדה ס״ג ע״ב) and then it asks how long — « וְכַמָּה? אָמַר רָבָא: עוֹנָה » (נדה ס״ג ע״ב) and above all it asks whether this is another onah than that of the vesset, and answers: « לָא, אוֹתָהּ עוֹנָה » (נדה ס״ג ע״ב) The separation therefore falls on the onah in which the vesset falls, and not on the one preceding it. The Mechaber says so in his own words: בשעת וסתה צריך לפרוש ממנה עונה אחת, and he adds « אותו היום כולו אפי׳ אם הוסת בסופו ומותר מיד בלילה שלאחריו » (שולחן ערוך יורה דעה קפ״ד:ב)
Machloket — how long is an onah?
ShitahLengthמקור
Beit Yosef, Taz, and the Acharonim The day as it is, or the night as it is, without counting hours: דאין איסור אלא ביום לחוד — and ואין חילוק בין יומי ניסן ותשרי ליומי תמוז וטבת ט״ז ס״ק ב ; פ״ת ס״ק ז
Aviasaf, Hagahot Maimoniyot, Ra’avan — and the Shach inclines this way Twelve hours: וכמה עונה יום או לילה ביומי ניסן ותשרי וחצי יום וחצי לילה ביומי תמוז וטבת ש״ך ס״ק ז
Or Zarua Twenty-four hours: פורש אדם מאשתו סמוך לווסתה כ״ד שעות אם רגילה לראות ביום פורש ממנה כל אותו יום והלילה שלפניו אור זרוע, בש״ך ס״ק ז
The Taz (ס״ק ב) against counting hours, and the reduction to absurdity: the Taz begins by setting aside the Or Zarua together with the Beit Yosef, דאין איסור אלא ביום לחוד. He then attacks the twelve-hour count with a question that must be followed step by step: if the measure is in hours, how shall we count for a woman who sees at the end of the day? If we count twelve hours forward, she will be forbidden the following night and permitted earlier in that very same day — « וזה ודאי אינו שהרי אסורה כל היום » (ט״ז יו״ד קפ״ד ס״ק ב). And if we count twelve hours backward, one who sees at the beginning of the day would be permitted later in that same day. The Taz concludes that the measure is not hourly but is the day or the night as they happen to be, long or short, and he adds: « ותמוה הוא להחמיר על מה שמפורש בתלמוד לקולא בפרט בווסתות דרבנן » (ט״ז יו״ד קפ״ד ס״ק ב)
The Shach’s defence (ס״ק ז), and what it shifts: the Shach does not read the Or Zarua as the Beit Yosef reads it. In his view the Or Zarua speaks of the case where אבל אם רגילה לראות ביום ואין לה שעה קבועה — sometimes at the beginning of the day, sometimes in the middle, sometimes at the end — and then א״כ כל היום וסתה: the entire day is her vesset, so that one must also separate during the night preceding it. The Pitchei Teshuva (ס״ק ז) reports that the Nekudot HaKesef carries this reading to its end: « ובנה״כ כתב דנשי דידן אין להם שעה קבועה וצריכה לפרוש כל היום והלילה שלפניו » (פתחי תשובה יו״ד קפ״ד ס״ק ז) And he immediately reports the Chokhmat Adam in the opposite direction: « ועח״ד שכ׳ דמסברא נראה שאין להחמיר בזה » (פתחי תשובה יו״ד קפ״ד ס״ק ז)
Both readings hold, and the apparatus does not decide here: the Taz defends the text of the Mechaber, the Shach defends the Or Zarua by narrowing its case. For practice — ask your Rav.

4. Separation and not distancings — from tashmish alone

↩ Detailed explanation (Level 1)
Chakira — the separation of the vesset against the distancings of the niddah: if the hour of the vesset has arrived and we fear she may have seen, why not impose the distancings as for any niddah — touch, pouring, making the bed? Out of doubt it should be forbidden!
Answer — the Mechaber’s own language: the Mechaber writes « ולא משאר קריבות אלא מתשמיש » (שולחן ערוך יורה דעה קפ״ד:ב) The separation of the vesset therefore falls on tashmish alone. The Shach (ס״ק ו) derives it from that same language: « משמע אפילו חיבוק ונשוק שרי כמו שפסק ב״י ממשמעות הפוסקים ודלא כת״ה » (ש״ך יו״ד קפ״ד ס״ק ו) — and he adds that the Bach nevertheless concludes מיהו נראה דהמחמיר באלה תע״ב. The Beit Yosef’s reasoning, as reported by the Taz, is that we do not fear that embracing will lead to relations, בב״י כתב דאפילו חיבוק ונישוק מותר ולא חיישינן לביאה כיון שביאה איסור דרבנן — that is, because the prohibition of tashmish itself is here only rabbinic.
⚠️ The Taz (ס״ק ג) does not agree, and this must be said: after reporting the Beit Yosef’s permission and the Bach’s וכתב מו״ח ז״ל המחמיר בזה תע״ב, the Taz concludes for himself: « ולי נראה שאסור מן הדין לדעת הרא״ש » (ט״ז יו״ד קפ״ד ס״ק ג)
His proof comes from elsewhere: the Rosh, in siman 342 (mourning), writes that one should be stringent regarding embracing and kissing because they lead to desire; and here, says the Taz, all the more so — « וכ״ש הוא דיש לו חשק טפי כשהולך לדרך » (ט״ז יו״ד קפ״ד ס״ק ג)
The Taz therefore holds that embracing and kissing are forbidden mi-din according to the Rosh, against the Beit Yosef and the Shach. The question remains open between them.
The Radbaz (Pitchei Teshuva ס״ק ה) — “do not invent stringencies”: the Pitchei Teshuva refers to the Radbaz’s new responsa (no. 163): « שפסק דחבוק ונשוק שרי כדעת ב״י וכתב דאין לחדש חומרות על ישראל » (פתחי תשובה יו״ד קפ״ד ס״ק ה) — and he adds: would that they kept what is already incumbent upon them. The Radbaz therefore sides with the Beit Yosef, and gives that position a reason of conduct as much as of din.
The foundation of the distinction — separation ≠ distancings:
• The separation of the vesset (our siman) falls, according to the Mechaber, on tashmish alone: ולא משאר קריבות אלא מתשמיש.
• The distancings of the niddah (siman 195) presuppose an established impurity, and extend to touch, serving, and what is passed from hand to hand.
These are two degrees, and the siman does not confuse them. But the distinction is not unanimous: for the Taz, embracing and kissing are forbidden mi-din according to the Rosh — so that for him the separation of the vesset is not as light a degree as it appears.

5. Gedolah · ketanah · zekenah, and a vesset that continues

↩ Detailed explanation (Level 1)

The text of the Mechaber (seifim 3 to 6)

Ketanah and zekenah — they have no chazakah of a guest at its time: the whole foundation of the separation is the presumption that the guest comes at its appointed time, and that presumption holds only for one whose way this is. Seif 3 therefore excludes אבל בקטנה שלא הגיעה לימי הנעורים ולא הביאה סימנים and והוא הדין לזקנה שנסתלקו דמיה, so long as she has not fixed her vesset three times. The Shach (ס״ק י) specifies what the days of youth are: « היינו י״ב שנים ויום א׳ » (ש״ך יו״ד קפ״ד ס״ק י) And he adds (ס״ק י״א) that the Mechaber’s vav is disjunctive: « וי״ו מחלקת היא כלומר או לא הביאה סימנים » (ש״ך יו״ד קפ״ד ס״ק י״א) — minority attaches to one or the other, not to both together. The Taz (ס״ק ה) goes the same way: ור״ל תרי גווני קטנה יש — there are two kinds of ketanah.
Sunrise (seifim 4 and 5) — and the nafka mina of the chakira: when the sighting falls on the border of day and night and it is not known whether it precedes or follows sunrise, the Mechaber rules The Shach (ס״ק י״ג) gives the reason, and it comes straight from the chakira of chapter 2: « דכיון דוסתות מדרבנן ה״ל ספק דרבנן לקולא » (ש״ך יו״ד קפ״ד ס״ק י״ג) — the day was in any case within her days of niddah, the night is doubtful, and a rabbinic doubt is eased. But he immediately reports
A vesset that continues (seif 6) — and a צריך עיון left open by the Taz: when the vesset extends over two or three days, the Mechaber is lenient: « אינה צריכה לפרוש אלא עונה הראשונה של הוסת » (שולחן ערוך יורה דעה קפ״ד:ו) The Taz (ס״ק ט) observes that strictly it should have forbidden all three days, just as in seif 5 the day is forbidden for as long as the sighting continues, and that this is indeed the Ra’avad’s view in the Tur for both cases. He reports the Acharonim’s answer — in seif 5 the flow is part of the sighting itself, whereas here it is no longer a single sighting but an excess of blood, which falls away with it — and then he stops: « אלא דצ״ע מנ״ל לחלק בכך » (ט״ז יו״ד קפ״ד ס״ק ט)
And the vesset bound to the body: the Rama specifies that all this holds only for וכל זה לא מיירי אלא בוסת התלוי בימים, אבל לא בוסת התלוי בשינוי הגוף — for which he refers to siman 189; and the Shach (ס״ק ח) notes that there one separates only for the time of the vesset when it does not come at a known hour.

6. Chezkat orach bizmano ba and chezkat taharah — the rules of bedikah

↩ Detailed explanation (Level 1)

The text of the Mechaber and the Rama (seifim 8 and 9)

Chakira — why is the bedikah not indispensable? If the hour of the vesset has passed and she has not examined herself, why should she be pure without a bedikah? The guest comes at its appointed time, and there is room to fear that she has seen!
Answer — two presumptions in collision: this is exactly the point the Pitchei Teshuva (ס״ק ג) draws from the Noda BiYehuda: « שהעלה דמה שאמרו וסתות דרבנן היינו לענין שלא אמרינן שכבר ראתה בשעת וסתה משום דנגד חזקה אורח בזמנו בא יש חזקת טהרה » (פתחי תשובה יו״ד קפ״ד ס״ק ג) The two presumptions face one another, and that of the guest is not strong enough to uproot that of purity. Hence the structure of seif 9: a priori, bedikah; after the fact,
The Shach (ס״ק כ״א) explains why the hidden woman of seif 8 is nevertheless not treated like the pregnant woman of seif 7: « דמעוברות ומניקות חזינן דדמיהן מסולקים אבל היתה במחבא לא ברי לן כולי האי דתהא מסולקת דמים » (ש״ך יו״ד קפ״ד ס״ק כ״א) — fright does not remove the blood with the same certainty as pregnancy does.
The Rama — והכי נהוג: the Mechaber reports a view (וי״א) that if she has a fixed vesset, or if it is the thirtieth day even without a fixed vesset, she is forbidden until she examines herself; and the Rama glosses והכי נהוג — such is the practice — referring to siman 189. How far does this stringency reach? The Shach (ס״ק כ״ג) reports two readings: the Beit Yosef holds that even if she delayed, once she examined herself and found herself pure she is pure; the Bach rules on the contrary « דדוקא בבדקה עצמה מיד לאחר וסתה תוך שיעור וסתה » (ש״ך יו״ד קפ״ד ס״ק כ״ג) — otherwise the presumption of the guest makes us say that the blood fell to the ground. The Taz (ס״ק י״ב) reads the Mechaber leniently: « פי׳ אפילו אם לא בדקה אלא עד זמן הרבה ולא אמרינן שמא נפל לארץ בזמן הוסת » (ט״ז יו״ד קפ״ד ס״ק י״ב) And the Pitchei Teshuva (ס״ק י״ט) adds that והאחרונים כתבו שאין לחוש לחומרא זו.
On this point the apparatus does not speak with one voice. For practice — ask your Rav.
If they transgressed (Pitchei Teshuva ס״ק ב): upon the words צריך לפרוש ממנה the Pitchei Teshuva sets down a short and blunt consequence: « ואם עברו ושמשו האיש והאשה שניהם צריכים כפרה » (פתחי תשובה יו״ד קפ״ד ס״ק ב)
He attributes it to the Shach and refers to the Torat HaShelamim. Note where this line falls: it does not bear on the woman’s din — seif 9 says that after the fact she is pure — but on what the couple owes for the fault of having transgressed a priori. The Pitchei Teshuva (ס״ק ט״ו) adds, in the name of the Taz, that in seif 8 too relations are forbidden even during the fright, דגבי סילוק דמים משום פחד איכא למיחש שמא באותה שעה שתזקק לבעלה יצא הפחד מלבה. And for practice — ask your Rav.

7. Pregnant and nursing —

↩ Detailed explanation (Level 1)

The text of the Mechaber (seif 7)

« אם הגיע וסתה בימי עיבורה משהוכר עוברה או בימי מניקתה שהם כ״ד חדשים משנולד הולד אפי׳ מת הולד א״צ לפרוש סמוך לוסתה ואפי׳ בתוך וסתה מותרת בלא בדיקה » (שולחן ערוך יורה דעה קפ״ד:ז) (וע״ל סוף סי׳ קפ״ט):

The foundation — why they are exempt:
The entire duty to separate rests on the presumption that the guest comes at its appointed time. For the pregnant and the nursing woman, the Taz (ס״ק י) gives the reason in so many words: « והטעם שאז אין דמים מצוין באשה » (ט״ז יו״ד קפ״ד ס״ק י) The presumption therefore falls away, and falls away completely enough that the Mechaber writes not merely that they need not separate before the vesset, but ואפי׳ בתוך וסתה מותרת בלא בדיקה — even during it.
The Taz (ס״ק י) — the reason for the nursing woman: for the pregnant woman the reason is that the blood is not found; but for the nursing woman, and above all אפי׳ מת הולד, something further is needed, and the Taz supplies it: « דמתוך צער חבלי לידה אבריה מתפרקין ודמיה מסתלקים ואינן חוזרין עד כ״ד חדש » (ט״ז יו״ד קפ״ד ס״ק י)
Two distinct reasons, then, and not one: in the pregnant woman the blood is not found; in the woman who has given birth the body has come apart and the blood has withdrawn, and it does not return for twenty-four months. It is this second reason that explains why the exemption does not depend on actual nursing.
⚠️ A limit the siman does not state, and which the Shach (ס״ק י״ט) goes to fetch: the Shach reports a gloss of the Maharshal on the Tur, taken up by the Pitchei Teshuva (ס״ק י״ד): « דמיירי שלא קבעה וסת ג״פ בימי עיבורה או מניקתה אלא שחושש לוסת הראשון » (פתחי תשובה יו״ד קפ״ד ס״ק י״ד) That is, the exemption of seif 7 concerns one who did not establish a vesset during her pregnancy or nursing, and who is concerned only for her former vesset. The Pitchei Teshuva adds that in siman 189:33 it is explained that even if she saw only once during those days she must take it into account as a non-fixed vesset — and he notes an error of the Me’ir Netiv on this point.
The intercalated month — does it enter the count of the twenty-four months? (Pitchei Teshuva
ShitahThe month added in a leap yearמקור
Shach It does not enter the count: ואין חודש העיבור עולה למנין — so that a leap year in fact yields twenty-five months. The Shach (ס״ק י״ח) refers for this to Even HaEzer: עי׳ בא״ע סי׳ י״ג סי״א דאין חדש העיבור עולה למנין ש״ך ס״ק י״ח ; פ״ת ס״ק י״ג
Kreti u-Pleti It does enter the count: ועי׳ כו״פ שחולק ופסק דחודש העיבור עולה למנין ואין לה אלא כ״ד חדשים הן בשנה פשוטה או מעוברת כו״פ, בפ״ת ס״ק י״ג
What is at stake in this machloket: the question is not when the exemption begins — on that the Mechaber is clear, משהוכר עוברה for pregnancy, and birth for nursing. It bears on the end of the count: are the כ״ד חדשים משנולד הולד counted as calendar months, so that a leap year adds a thirteenth, or as twenty-four bare months? The Shach ties them to the count of Even HaEzer 13:11; the Kreti u-Pleti refuses that tie. The nafka mina is sharp and practical: is a woman whose twenty-four months cross a leap year exempt for twenty-five months or for twenty-four?
A further point of language, from the Shach (ס״ק כ): the Perishah wished to infer from the word סמוך לוסתה that during the time of the vesset itself one would have to separate; the Shach answers that this is not a conclusive inference, since the Mechaber writes expressly ואפי׳ בתוך וסתה מותרת בלא בדיקה. And for practice — ask your Rav.

8. Poked ishto —

↩ Detailed explanation (Level 1)

The text of the Mechaber and the Rama (seif 10)

The foundation — “visiting one’s wife”:
The gemara teaches in Yevamot 62b, in the name of Rabbi Yehoshua ben Levi: « חַיָּיב אָדָם לִפְקוֹד אֶת אִשְׁתּוֹ בְּשָׁעָה שֶׁהוּא יוֹצֵא לַדֶּרֶך » (יבמות ס״ב ע״ב) The Mechaber takes this up and goes further: הרוצה לצאת לדרך צריך לפקוד אשתו אפילו סמוך לוסתה. And the Rama adds the decisive word — ואפילו בתשמיש שרי, permitted even in tashmish, in the name of the Tur, Rashi, the Ra’avad, the Rashba and Rabbenu Yerucham.
The Taz (ס״ק י״ד) — the proof that the vesatot are rabbinic: the Taz gives this permission its reason in a single line, and that line is among the most quoted in the siman: « כיון דוסתות דרבנן במקום מצוה לא גזור » (ט״ז יו״ד קפ״ד ס״ק י״ד)
The reasoning is a direct nafka mina of the chakira of chapter 2: if the concern of the vesset were of Torah force, there would be no room to permit tashmish for a mitzvah; since it is permitted, there is here only a rabbinic decree — and where there is a mitzvah, the Sages did not decree.
The Taz (ס״ק ט״ו) — what the option of words of appeasement is worth: the Rama reports in the name of the Semag that המחמיר שלא לפקדה רק בדברי רצוי תע״ב — one who is stringent and “visits” her only with words of appeasement, a blessing will come upon him. The Taz specifies what this option adds: « אע״ג דגם באין יוצא לדרך שרי בדברי ריצוי כדלעיל סעיף ב׳ מ״מ ביוצא לדרך חייב בכך » (ט״ז יו״ד קפ״ד ס״ק ט״ו)
That is, words of appeasement are not the diminution of an obligation but an obligation of their own for the one who is departing. The Shach (ס״ק כ״ו) for his part notes that the Levush (עט״ז), who writes here like the Rama, contradicts himself with what he writes in Orach Chaim 246:16 — where he makes the “visit” on the eve of departure a mitzvah even near the vesset — and he concludes that the essential position is as the Rama’s words here. And the Shach (ס״ק כ״ז) goes further: although he reported (ס״ק ו) in the name of the Bach that דהמחמיר בחיבוק ונישוק תבא עליו ברכה, here — « נראה דהכא אין להחמיר כלל כיון די״א דאפי׳ בתשמיש חיוב ומצוה איכא » (ש״ך יו״ד קפ״ד ס״ק כ״ז)
Nafka minot of seif 10:
  1. One who departs for a mitzvah: the Rama writes ואם הולך לדבר מצוה א״צ לפקוד אשתו, in the name of the Maggid Mishneh and the Hagahot Sha’arei Dura, and he gives no reason for it here. And the Shach (ס״ק כ״ט) extends this to waiting: « מיהו אם הולך לדבר מצוה א״צ להמתין » (ש״ך יו״ד קפ״ד ס״ק כ״ט) — and even for an optional journey, if he departs for a pressing need.
  2. Waiting for the tevilah: the Rama reports a view (Nimukei Yosef) that if his wife is a niddah and is to immerse within the onah, he should wait. The Pitchei Teshuva (ס״ק כ״ה) reports the Kreti u-Pleti in the opposite direction: « שכתב דאם נזדמן שטבילתה יהיה סמוך לוסתה אין צריך להמתין » (פתחי תשובה יו״ד קפ״ד ס״ק כ״ה)
  3. And the weightiest point, which refers back to the chakira (Pitchei Teshuva ס״ק כ״ב): there the Pitchei Teshuva gathers a whole literature on a tevilah falling near the vesset, and finally reports the Chatam Sofer, asked precisely about the meeting of two mitzvot — the night of the tevilah and the day of departure. His answer follows his position on the chakira: « ומעתה כיון דאיכא ספק דאורייתא בודאי אין להקל בתשמיש בעונה הסמוך לוסתה » (פתחי תשובה יו״ד קפ״ד ס״ק כ״ב) The Pitchei Teshuva reports; he does not decide for us. For practice — ask your Rav, and in matters of family purity possibly a qualified halakhic advisor as well.

9. A vesset of days and the duty to ask

↩ Detailed explanation (Level 1)

The text of the Mechaber (seifim 11 and 12)

The foundation — “until he asks her,” and the chezkat taharah:
In a vesset fixed by days, when the hour comes, But ואם שהתה אחר הוסת שיעור שתספור ותטבול — if the time elapsed since the vesset suffices for her to count and to immerse, he comes to her without asking: even had she seen, she would already have purified herself. This is the direct application of the chezkat taharah: as long as the doubt is live, one asks; once enough time has passed for it to resolve itself, one no longer asks. The Shach (ס״ק ל) bounds the rule from the other side: « אבל קודם שעת וסתה וכן באין לה וסת קודם ל׳ א״צ שישאלנה » (ש״ך יו״ד קפ״ד ס״ק ל׳) And the Pitchei Teshuva (ס״ק כ״ז) specifies the form of the asking: « ואפי׳ היא ערה ושוכבת אצלו מ״מ צריך דוקא שישאלנה ותוציא מפיה שהיא טהורה » (פתחי תשובה יו״ד קפ״ד ס״ק כ״ז)
Seif 12 and the Shach’s objection (ס״ק ל״ב): the Mechaber writes that when a woman has both a vesset of days and a vesset bound to the body — jumping, for instance — כיון שהוסת תלוי במעשה אימור לא קפצה ולא ראתה: the vesset depends on an act, and one may say that she did not jump; but אבל חוששת לעונה בינונית שהיא ל׳ יום.
The Shach (ס״ק ל״ב) objects at length, and his objection is simple to state: « דודאי אם יש לה וסת לימים ולוסת מוסתות הגוף חוששת לעולם לוסתה ולא שייך לומר אימור לא ראתה » (ש״ך יו״ד קפ״ד ס״ק ל״ב) — if she has a vesset of days she always takes it into account, and there is no room to say “perhaps she did not jump,” nor to be concerned for the onah beinonit, since she has a vesset. He shows that the Rashba and the Tur write this rule only regarding jumping, which depends on her own act, and not regarding the other bodily vesatot; and he concludes that the Beit Yosef’s words require examination. The Pitchei Teshuva (ס״ק כ״ח) takes up the objection and reports the answers: « משמע דהיינו פיהוק ועיטוש ודכוותייהו » (פתחי תשובה יו״ד קפ״ד ס״ק כ״ח) — so one would read it simply; whereas the Torat HaShelamim, the Sidrei Taharah and the Kreti u-Pleti explain that “and the like” refers rather to having eaten garlic or pepper, and the Chokhmat Adam gives yet another reading.
The Shach (ס״ק ל״ד) finally adds the practical consequence of seif 12: « ואסור לבא עליה אחר העונה בינונית עד שישאלנה או ששהתה שיעור שתוכל לספור ולטבול » (ש״ך יו״ד קפ״ד ס״ק ל״ד)
“From twenty to twenty” (Shach ס״ק א and ס״ק ב): the Mechaber opens the siman with כגון מעשרים לעשרים יום או מל׳ לל׳ יום. The Shach (ס״ק א) notes in the name of the Beit Yosef that these numbers are only examples: « או לכ״ה או לל׳ » (ש״ך יו״ד קפ״ד ס״ק א) And he adds (ס״ק ב) that the presumed vesset for one who has fixed none is thirty days, so that within those thirty days one is “outside the time of her vesset.” The Pitchei Teshuva (ס״ק א) reports that the Kreti u-Pleti contests this inference of the Shach, while the Sidrei Taharah and the Chokhmat Adam uphold it with a refinement: at the beginning of her sightings, while it is not yet known when she will fix her vesset, one is indeed “outside the time of the vesset” and no bedikah is required; but once it is established that she has no vesset, a bedikah is always required. The essential point, then, is not the number but the fixity of the time.

10. Chakira and practical nafka minot

↩ Detailed explanation (Level 1)
The overall chakira of the siman: what is the nature of the concern of the vesset, and what is its measure?
What the siman settles, seif by seif:
  1. Outside the time of the vesset, one who has a fixed vesset needs no bedikah before tashmish; and the Rama adds that she should not impose that stringency upon herself (seif 1).
  2. At the hour of the vesset, separation for one onah, and from tashmish only; the whole day or the whole night, even if the vesset falls at its end (seif 2).
  3. A ketanah and a zekenah need not separate so long as they have not fixed their vesset three times (seif 3).
  4. A vesset at sunrise: forbidden by day only; if the sighting extends on both sides of sunrise, the night and the day for as long as it continues (seifim 4 and 5).
  5. A vesset that lasts two or three days: the first onah alone (seif 6).
  6. A pregnant woman once the pregnancy is recognised, and a nursing woman for twenty-four months: exempt, and even during the vesset without a bedikah (seif 7).
  7. One hidden out of fright: she need not be concerned; and the Rama reports a view that requires it a priori nonetheless (seif 8).
  8. Other women examine themselves at the hour of the vesset; if the vesset passed without bedikah and without sensation she is pure — and the practice follows the stringent view for a fixed vesset or the thirtieth day (seif 9).
  9. One who sets out on a journey visits his wife, even in tashmish; if he departs for a mitzvah he need not (seif 10).
  10. A vesset of days: forbidden until he asks her; if the time to count and immerse has passed, without asking (seif 11).
  11. A vesset of days joined to a vesset of jumping: we say perhaps she did not jump, but she is concerned for the onah beinonit — the thirtieth day (seif 12).
This table recapitulates what the siman says; it takes the place of no ruling. For practice — ask your Rav, or a qualified halakhic advisor.

What the concern of the vesset is worth Rabbinic — this is the accepted view (ש״ך ס״ק ה) The Noda BiYehuda: the separation itself is of Torah force, and the Chatam Sofer makes of it a doubt of Torah law (פ״ת ס״ק ג)
The length of an onah The day or the night as they happen to be (ב״י, ט״ז ס״ק ב, פ״ת ס״ק ז) Twelve hours — Aviasaf and Hagahot Maimoniyot, and the Shach (ס״ק ז); twenty-four hours — Or Zarua
Embracing and kissing before the vesset Permitted — only tashmish is forbidden (ב״י ; ש״ך ס״ק ו ; רדב״ז בפ״ת ס״ק ה) The Taz: forbidden mi-din according to the Rosh (ט״ז ס״ק ג); and for the Bach, one who is stringent, a blessing will come upon him
The vesset passed without a bedikah Pure — the chezkat taharah prevails (מחבר ס״ט) Forbidden until the bedikah for a fixed vesset or the thirtieth day (י״א שבמחבר ; רמ״א — והכי נהוג)
