summary: the husband must separate from his wife during the days of her impurity until she counts and immerses. The Rama adds that time dissolves nothing: even if a long period has passed without immersion, she remains a niddah. The Mechaber then forbids levity and light-headedness with her, lest it lead to transgression — and the Rama specifies that this applies even in speech. Seclusion with her, however, is permitted. Seif 2 lays down the prohibition of touch: not even with the little finger, and nothing passed from his hand to hers or from hers to his; the Rama adds throwing.
One point of reading, and it governs the whole page: what Sefaria renders in small type inside the seif is the Rama, not the Mechaber. Thus « תמיד היא בנדתה עד שתטבול » (רמ״א יו״ד קצ״ה:א) and « אפילו בדברים » (רמ״א יו״ד קצ״ה:א) are glosses of the Rama; whereas « ולא ישחוק ולא יקל ראש עמה » (שו״ע יו״ד קצ״ה:א) belongs to the Mechaber.
1. Opening of the sugya — the obligation to separate and the gader of impurity
The foundation of the siman: as long as she is a niddah, the husband must separate from her. Two novelties in the opening. (a) The separation lasts « חייב אדם לפרוש מאשתו בימי טומאתה עד שתספור ותטבול » (שו״ע יו״ד קצ״ה:א) — it does not suffice that the days of the flow end; everything depends on the tevilah. (b) « תמיד היא בנדתה עד שתטבול » (רמ״א יו״ד קצ״ה:א) — even after a long wait without immersion, time does not remove her status. We learn from here that the gader of niddah is extinguished only by an act, the tevilah, and not by the passing of days.
What belongs to the Mechaber and what to the Rama. The required separation covers not only the relationship itself, but also levity and light-headedness — « ולא ישחוק ולא יקל ראש עמה » (שו״ע יו״ד קצ״ה:א) — and the Rama adds that this holds even in speech. The Shach brings the Tur’s measure of it, and it is a narrow one: not every word, but those alone.
The source the Rama points to (טור וב״י בשם רשב״א מאבות דרבי נתן) is a derashah on the verse ואל אשה בנדת טומאתה לא תקרב(ויקרא י״ח:י״ט), which the Aruch HaShulchan cites in full: the verse does not say “do not come upon her” but “do not draw near”, and from there it includes whatever brings one closer.
חקירה — why is seclusion permitted? With all other arayos, יחוד is forbidden; here the Mechaber expressly permits it — « אבל מותר להתייחד עמה דכיון שבא עליה פעם א' תו לא תקיף יצריה » (שו״ע יו״ד קצ״ה:א). There is therefore room to examine: does the permission of יחוד prove that niddah is lighter than the other arayos, or does it rest on something else? The Pitchei Teshuva, at פ״ת ס״ק י, reasons from the other side: he recalls that the gemara in Shabbos equates niddah with אשת רעהו, and that יחוד is permitted there only because of סוגה בשושנים(שיר השירים ז׳:ג) — that is, by a testimony of the Torah about the restraint of Israel, not by a relaxation of the gader. We present the chakira and do not decide it; yet it governs the reading of the entire siman, for on its answer depends whether the harchakos are an added stringency peculiar to niddah or the common rule of the arayos.
The root in Shas — שבת י״ג. The mishnah teaches that a zav does not eat with a zavah because of the habit of transgression, and the gemara sees in this the measure of restraint. It is this baraisa, and not a general formula, that underlies seif 3.
Here lies the foundation of foundations on which the whole siman rests: what is the nature of the forbidden touch, and from which gader does it come.
חקירה — the touch that is not a gesture of affection. The Mechaber, in seif 2, forbids « לא יגע בה אפילו באצבע קטנה » (שו״ע יו״ד קצ״ה:ב) — although there is here neither a gesture of affection nor any pleasure of desire. And there is room to examine: if the touch forbidden by the Torah is precisely touch by way of desire, why is the brush of a finger forbidden too, and even handing over an object or throwing it from one hand to the other?
The root in Shas — עבודה זרה י״ז. The gemara there sets two formulations against one another, and from them comes the whole machlokes that follows. Rabbi Pedas restricts the Torah prohibition to the drawing near of gilui arayos alone; Ulla holds that any drawing near is forbidden, and supports it with the adage of the nazir who is told to go around the vineyard.
The machlokes over the gader of touch — Rambam and Ramban:
Shitah
Gader of touch
Source
Rambam
Drawing near by way of desire — embracing and kissing — is forbidden by the Torah and carries malkos; the verse לא תקרבו לגלות ערוה means “do not draw near to things that bring one to uncovering nakedness”
Ramban
In his השגות on that same לאו he holds that לא תקרבו is not an independently counted prohibition; the Torah prohibition falls on the relationship, and the acts of drawing near are rabbinic
Where this machlokes is decided in our siman — and it is at the last seif. One might think the question purely theoretical. It is not: it surfaces at seif 17, concerning the husband who is a doctor. The Beis Yosef raises a difficulty there, which the Shach brings at ס״ק כ — if the touch of a niddah is only rabbinic, it yields before danger to life; but if, as the Rambam holds, the touch of an erva is forbidden by the Torah, perhaps it is an אביזרא דג״ע, and then even danger would not set it aside. He leaves the matter on a צריך עיון.
The Shach answers, and his answer is the keystone of everything that precedes it: even according to the Rambam there is no Torah prohibition except where the act is done by way of desire and the affection of relations. All the rest — the finger, the object handed over, the object thrown — is forbidden only as a fence.
Handing over and throwing (seif 2). It is forbidden to hand an object from his hand to hers and to receive it from her hand — « ולא יושיט מידו לידה שום דבר ולא יקבלנו מידה שמא יגע בבשרה » (שו״ע יו״ד קצ״ה:ב) — and the Rama adds throwing. The Shach, at ס״ק ג, extends the measure: even a long object, where contact of the hands is materially impossible. The Aruch HaShulchan gives the reason plainly: the Sages did not distinguish.
On throwing, the Pitchei Teshuva brings the Acharonim without deciding: the Minchas Yaakov forbids, the Har HaCarmel and the Kreisi uPleisi are lenient, and he records an observed practice.
יסוד — the two heads of the harchakos:
From here on the harchakos divide into two branches:
• the fence of touch — that he should not come to touch her (finger, object handed over, object thrown, bed, seat);
• the fence of affection and of היכר — that he should not come to closeness of heart (eating together, pouring the cup, making the bed, pouring water) — and this is done by a change, a visible sign.
Both branches have one root: a סייג around the arayos, to keep one far from what is near the prohibition. This is Ulla’s adage quoted above, and it should be taken seriously: the vineyard is not forbidden because one walks around it; one walks around it because it is forbidden.
3. The foundation of the היכר — table, cup and service
The text of the Mechaber and the Rama (seifim 3–4)
summary: he does not eat with her at the table without a change — something separating his dish from hers, a loaf, a jug — or else each eats on his own cloth. The Rama’s gloss is lenient: it distinguishes according to the couple’s practice, and if, when she is pure, they eat from a single dish, it then suffices that she eat from a dish of her own, with no further sign — “and such is the practice”. The Rama then brings an opinion forbidding eating what she has left over. In seif 4, he does not drink what she has left in her cup; the Rama gives the remedies (a person interposed, or the liquid poured into another cup), specifies that she need not warn him if he does not know, and that she, by contrast, may drink from the cup he has drunk from.
יסוד — what is a היכר?
The reason for the separation set on the table is not a physical partition: it is a reminder. From a shared meal and a cup taken up again come familiarity and affection, and forgetting is what is feared. A change is therefore required — a loaf, a jug, a separate cloth, an interposed person. The Shach says where the model is taken from, and it is a word worth a whole page: the היכר here is built on the היכר of meat and milk.
The machlokes over the gader of the היכר — and it changes what one expects of it:

What the היכר prevents
Source
Shach
It is built like that of בשר בחלב: a sign preventing one from taking from the other what is forbidden to him
Aruch HaShulchan
The comparison does not hold: there the food itself is forbidden to the other, here the prohibition does not come from the food but from closeness of heart — and so it is not taking from her dish that creates the closeness, it is eating together
The nafka mina of this machlokes, and it is immediate. If the היכר is that of בשר בחלב, what must be prevented is the act of drawing from the other’s dish; if the היכר is a barrier against familiarity, what must be prevented is the shared table itself. This is exactly the axis on which the Rama’s gloss turns: those accustomed to share a dish when she is pure already find a sign in the mere fact that she eats separately — provided one holds that the sign is aimed at the dish. The Shach, at ס״ק ז, brings the Bayis Chadash’s restriction — that the leniency would hold only in the presence of the household — and he does not accept it.
The cup, and the asymmetry that says a great deal. He does not drink what she has left — « לא ישתה משיורי כוס ששתתה היא » (שו״ע יו״ד קצ״ה:ד) — but the Rama writes the opposite expressly for her: « והיא מותרת לשתות מכוס ששתה הוא » (רמ״א יו״ד קצ״ה:ד). The Taz gives the reason in five words, and it illuminates the whole siman: it is not she who draws him on, it is he who is being held back. In other words, the harchakos of this family are aimed at the husband; the reciprocity of seif 13, « כשם שאסורה למזוג לו כך הוא אסור למזוג לה » (שו״ע יו״ד קצ״ה:י״ג), is therefore not a general rule but an extension laid down by name for the act of pouring.
The same logic governs the case where he knows nothing: « אינה צריכה להגיד לו שלא ישתה » (רמ״א יו״ד קצ״ה:ד), and the Rama himself gives the reason — where she has already gone, « דמאחר שכבר הלכה אין כאן חבה » (רמ״א יו״ד קצ״ה:ד). Where there is no awareness of the act, there is no affection to fear.
Leftover food — an open machlokes. The Rama brings, in the name of a קונטרס, an opinion forbidding one to eat what she has left. The Shach, at ס״ק ח, refuses to treat it as a mere “some say”: in his eyes it is a קל וחומר from drinking. The Aruch HaShulchan brings the other side — that the Beis Yosef, in his Bedek HaBayis, expressly permits leftover food — and gives the reason: with drinking, since one cannot drink together from the same cup, sharing is the act of affection; with eating, the very fact of not eating together already constitutes the sign. The Acharonim dispute this, and we do not decide.
As to what counts as a sufficient sign, the Taz adds a measure at ס״ק א: the loaf or the jug is a sign only if one neither eats of it nor drinks from it — otherwise the object ceases to be a boundary and becomes common property. And the Shach recalls at ס״ק ד that the היכר is not reducible to simultaneity: eating from the same dish one after the other is forbidden too.
The text of the Mechaber and the Rama (seifim 5–6)
summary: he does not sit on the bed set aside for her, even in her absence. The Rama adds the long bench that is not fixed to the wall and sways when she is seated on it, and brings those who permit when a person is interposed; he also adds that he shall not travel with her in one wagon or one boat if it is for a stroll, whereas travel for his affairs is permitted, provided they sit so as not to touch one another. In seif 6, he does not sleep with her in one bed, even each in his own garment and not touching; the Rama: even with a separate mattress for each, and even in two beds, if the beds touch.
יסוד — fear of closeness, not fear of impurity:
One must look closely: there is no fear of tumah here — we are all impure today and nothing turns on it. The fear is of closeness. From this:
• the bed set aside for her — forbidden even outside her presence, because it is her own place;
• the swaying bench — it moves because she is seated on it, and whoever sits there feels that movement; fixed to the wall, it is permitted;
• two beds that touch — forbidden, and a separation or a gap is needed.
The root of seif 6 in Shas — שבת י״ג. The gemara derives the prohibition from a hekesh carried by the verse in Yechezkel, which places the wife of another and the niddah wife on one line. The consequence is literal, and it is the Mechaber’s very text: “each in his own garment” does not suffice.
Sitting on the bed set aside for her — sitting only, or lying down?

Only lying down and sleeping there, when he removes his clothes, is forbidden; ordinary sitting, while dressed, carries no prohibition

A word on who is speaking. When the Taz writes מו״ח he means his father-in-law, the author of the Bayis Chadash — never himself. At ס״ק ו the Taz is thus reporting the Bayis Chadash’s reading, which held that the word לא ישב is a scribal error since the Tur and the Shulchan Aruch write לא יישן elsewhere, and the Taz writes that this does not seem right to him — so it is a Taz against the Bayis Chadash, not two positions of one author.
The swaying bench — the root of the prohibition. The reason for the moving bench (מרדכי פ״ק דשבת בשם צפנת פענח בשם רש״י, as the Rama himself indicates): whoever sits on it feels its movement, and that sensation takes the place of contact; a bench fixed to the wall, which does not move on her account, is permitted. From here we learn a principle: the fence covers not only direct contact but the shared movement that awakens closeness. The Rama himself draws the consequence for travel, and his distinction is not movement but purpose — « וכן לא ילך עם אשתו בעגלה אחת או בספינה אחת אם הולך רק דרך טיול » (רמ״א יו״ד קצ״ה:ה) — a stroll being forbidden and a journey on business permitted.
Two beds that touch, and the degrees of separation. The Shach brings at ס״ק י״א a leniency in the name of the R”M Alashkar (responsum 91, drawn from עירובין ס״ג ע״ב): with a wooden or built-in bed, he in his and she in hers. The Pitchei Teshuva, at ס״ק י״א, brings from the Mekor Chaim a finer measure — the prohibition would cover only beds whose feet touch, since then they lie face to face — while noting that the practice follows the plain sense of the Rama. And the same Pitchei Teshuva, at ס״ק ח, extends seif 5 to the pillows set aside for her, in the name of the Chochmas Adam. On absence, he lays down an obvious point that has practical bearing.
summary: he looks neither at her heel nor at the covered places of her body; the gloss, by contrast, permits looking at her in the revealed places, even though he takes pleasure in it (the Beis Yosef in the name of the Rambam). It is fitting that she set aside garments for the days of niddah, so that both should constantly remember. And only with difficulty was she permitted to adorn herself during those days — solely so that she should not become displeasing to her husband.
The chakira of looking — the pleasure of sight:
Case
Ruling
Reason
The covered places, and even her heel
Forbidden to look
Looking at what is covered is a thought, hence a drawing near
The revealed places
Permitted, even though he takes pleasure in it
The Shach, ס״ק י״ב: since she will be permitted to him later, he does not come to stumble
What this reason teaches, and it holds beyond the seif. The Shach does not write that the pleasure of sight is nothing: he writes that the time limit disarms it. A niddah is not an erva whose prohibition is permanent, and that is what makes looking bearable where touch is not. We shall meet exactly the same logic at seif 9, where the prohibition of adornment gives way before a consideration of duration — what decays today is not repaired tomorrow.
Reserved garments — a היכר, and not only modesty. The reason for the reserved garment is not modesty in general: the Mechaber gives it himself, « כדי שיהיו שניהם זוכרים תמיד שהיא נדה » (שו״ע יו״ד קצ״ה:ח). The garment thus becomes an instrument of remembrance, exactly like the separation placed on the table. And the Shulchan Aruch’s method throughout the siman comes into view: wherever a sign of memory can be fixed, one is fixed.
חקירה — “only with difficulty did they permit”: the tension between two fears. On one side, adornment awakens affection and draws close; on the other, if she neglects herself, there is fear of « בקושי התירו לה להתקשט בימי נדתה אלא כדי שלא תתגנה על בעלה » (שו״ע יו״ד קצ״ה:ט). The leniency is therefore given with difficulty: it is a balance between the fence and the preservation of the bond. The Aruch HaShulchan states the difficulty in full — seifim 8 and 9 seem to pull in opposite directions, one requiring a visible sign and the other fearing that it will disfigure — and his answer is not a rule but an observation: dispositions differ from one man to another. Which is to say that the measure of this harchakah is not the same for everyone, and we do not decide it.
What looking carries with it, and what the Acharonim leave open. The Taz, at ס״ק ז, recalls the penalty stated in the gemara for one who looks. Around this seif the commentaries raise two neighbouring questions without closing them: the Pitchei Teshuva brings at ס״ק א — though its anchor is on « ולא ישחוק ולא יקל ראש עמה » (שו״ע יו״ד קצ״ה:א) of seif 1 — the prohibition of smelling her perfume in the name of the Birkei Yosef; and at ס״ק י, anchored on seif 6, he leaves on a צריך עיון the question of hearing her singing voice, because he holds that the hekesh of the gemara in Shabbos would apply to this as well. We report, and we do not conclude.
6. The criterion of דרך חבה — pouring the cup, making the bed, pouring water
Here the thin line becomes precise between an ordinary task, which is permitted, and a service that is a gesture of affection, which is forbidden.
The text of the Mechaber (seifim 10–13)
summary: all the tasks a wife performs for her husband, a niddah performs for him, except pouring the cup — in his presence — and setting it before him on the table, unless she makes a sign: setting it down with her left hand, or on the cushion or the bolster, and then even with her right hand. She is forbidden to make his bed in his presence, but only to spread the sheets and the cover, which are a gesture of affection; arranging the cushions, which is exertion and not a gesture of affection, is permitted, and outside his presence everything is permitted — even if he knows that she is the one arranging them. She is forbidden to pour water for him to wash his face, hands and feet, even without touching him and even with cold water. Seif 13 finally lays down the reciprocity of pouring, and forbids even sending her a cup of wine designated for her.
The root in Shas — כתובות ס״א. The Mechaber copies here an Amoraic teaching almost word for word, and two of his qualifications come from that same page: the restriction “in his presence” at seif 11 is Rava’s, and the signs at seif 10 — the left hand, the cushion — are the practices reported from the houses of the Amoraim. The (בפניו) carried by seif 10, by contrast, is not in the gemara: the Mechaber adds it in the name of the Beis Yosef, as the source parenthesis indicates.
יסוד — the standard of “gesture of affection” against “exertion”:
A general rule of the siman: all tasks are permitted — baking, cooking, laundering — except that three were withdrawn, because they are a gesture of affection:
• pouring the cup — and this is why a sign is required;
• making the bed in his presence — spreading the sheets is affection, arranging the cushions is exertion;
• pouring water for his face, hands and feet — an act of service, even without contact and even with cold water.
The dividing line — what makes a task a gesture of affection. Why are cooking and laundering permitted, and making the bed forbidden? The Taz gives the criterion explicitly at ס״ק ג, and it is notable that he gives it in connection with an entirely different question, that of leftover food: the Sages assessed that a task of service, which involves exertion, produces no closeness, unlike the cup that is poured. And the Taz himself refers to seif 11, where the Shulchan Aruch makes exactly this cut between the sheets and the cushions.

“Outside his presence” — how far? The Bayis Chadash wished to narrow it: even poured outside his presence, the cup set before him would be forbidden, since presence would be regained at the moment of setting down. The Shach, at ס״ק י״ד, does not accept this and supports himself on the Rosh: outside his presence there is no prohibition at all. The question is no small one, for it decides whether the criterion is the act or the perception of the act — and it is the second that the Mechaber himself adopts when he writes « ושלא בפניו הכל מותר אפילו הוא יודע שהיא מצעת אותם » (שו״ע יו״ד קצ״ה:י״א).
Pouring water — and a divergence that must be left open. The Taz brings at ס״ק ח the words of the Rashba, which bound the prohibition of seif 12: what is forbidden is that she pour while he washes; washing him with her own hands would be forbidden on an entirely different ground, that of contact. The Taz infers that she may prepare the water for him in a vessel which he then uses. Yet the Shach, at ס״ק ט״ז, brings from Rabbeinu Yonah that it is forbidden to place before the husband the pitcher and vessels for his washing, because it is a gesture of affection — which runs the other way. The Acharonim dispute this, and we do not decide.
On the reach of the word “pour”, the Shach further brings at ס״ק י״ג the stringency of the Bayis Chadash in the name of the Maharash of Austria — who wished to extend it to carrying dishes to the table — and sets against it the distinctions of the Rishonim: pouring without handing over, or handing over without pouring, would not be forbidden. The Aruch HaShulchan draws the same line for food.
summary: all these harchakos are observed during the days of niddah as much as during the days of libun, that is, all the days of her counting; and in all this there is no difference between one who actually sees and one who finds a stain. The Rama brings an opinion that does not hold stringency necessary, during the days of libun, on the point of eating with her from one dish — and then writes both that such is the practice of leniency and that there is room to be stringent.
יסוד — one gader for both periods:
The Mechaber lays down a single rule, and extends it at once to the stain: the days of the flow and the seven days of counting are equal. The reason follows from what was laid down at seif 1: as long as she has not immersed she is in the category of “niddah” as regards closeness — and so one does not relax during the days of counting, though she no longer sees. Separation is measured by the tevilah, not by the flow, and that is the root of the unity of the rule across both periods.
The root in Shas — שבת י״ג ע״ב. The teaching of dvei Eliyahu tells of the talmid who died in the midst of his days, and of his widow questioned about his conduct. The division is set out by her own words, and it is precisely the division that seif 14 refuses: blameless during the days of niddah, relaxed during the days of libun. The conclusion of the baraisa is unambiguous.
No difference — the same harchakos in niddah and in libun
Ravya (the י״א of the Rama)
There is no need for stringency during libun on this point; the Rama writes that such is the practice of leniency, and adds that there is room to be stringent
The reason for the leniency — and it is not the one supposed. One might think the Ravya is lenient because, once the counting has begun, the fence loosens of itself. That is not what he writes. The Shach brings at ס״ק י״ז the Darchei Moshe, where the Rama gives the Ravya’s own words: after the days of libun there is no longer any habit of transgression, and it is good to eat with her so that she will consent to immerse. The leniency is thus motivated by the coming tevilah, not by a relaxation of the gader. And the Bayis Chadash immediately draws a restriction: on that reckoning, the Ravya would have permitted only on the seventh day, the one immediately preceding the tevilah.
קושיא — the Rama against the Rama. In the Darchei Moshe, as the Shach brings it, the Rama writes that it does not seem to him that one may rely on this, and that the Ravya stands alone in this view. In his gloss on the Shulchan Aruch, however, he writes “and such is the practice, to be lenient in this”. How do the two hold together?
What the Rama’s own text carries. His gloss does not stop at the leniency: it ends with ויש להחמיר. The Rama therefore reports a practice without endorsing it — which is exactly the position of the Darchei Moshe. The Taz goes the same way at ס״ק ט, first reporting his father-in-law, the author of the Bayis Chadash — that is what מו״ח denotes — then the Drishah in the name of the Rashal, and finally adding his own reason: one ought to be more stringent during libun, precisely because on seeing that she is no longer quite impure one would come to relax. We report the tension and do not decide it; for practice — ask your Rav.
The text of the Mechaber and the Rama (seifim 15–17)
summary: if he is ill and has no one but her to attend him, she is permitted to attend him, provided she takes special care, so far as she can, to avoid washing his face, hands and feet, and making his bed in his presence. If it is she who is ill, the husband is forbidden to touch her in order to attend her — to raise her, lay her down, support her; the Rama brings an opinion permitting everything if she has no one else, and writes that such is the practice when she has great need of it. And if the husband is a doctor, he is forbidden to take her pulse; the Rama: following the practice of leniency above, all the more is it permitted where there is no other doctor, she needs him, and there is danger in her illness — and he then refers to או״ח סימן פ״ח.
יסוד — three levels in the leniency of illness:
Three rulings, and in each the gravity of the closeness is weighed against the patient’s need:
• he is ill (seif 15) — she attends him, provided she avoids the washing and the bed in his presence, which are gestures of affection;
• she is ill (seif 16) — he is forbidden to touch her to attend her; for want of anyone else, the י״א is lenient, “and such is the practice”;
• the husband is a doctor (seif 17) — forbidden to take her pulse; in danger and for want of another doctor, permitted.
Why is “he is ill” lighter than “she is ill”? The answer does not lie in who performs which gesture but in the state of the יצר, and the Shach gives it at ס״ק י״ט in the name of the Terumas HaDeshen: when he is the patient, there is no fear of the habit of transgression, for his inclination does not overpower him, his strength being spent; but when she is ill and he is healthy, there is ground to fear. The Aruch HaShulchan adds the second limb: and the woman, for her part, does not draw one to transgression. The criterion is therefore not “who touches whom”, but in whom the inclination is strong.
And why does the Rama nonetheless permit when she is ill? The Aruch HaShulchan gives the reason, and it meets the Shach’s answer at ס״ק כ brought above: what is done by way of service and not out of desire does not fall within the gader of גילוי עריות. That is why the Rama writes « וכן נוהגין אם צריכה הרבה לכך » (רמ״א יו״ד קצ״ה:ט״ז) without speaking of danger: the leniency of seif 16 rests not on pikuach nefesh but on the nature of the act.
חקירה — the husband as doctor and the pulse: what danger sets aside. Taking the pulse is contact, and the Mechaber forbids it — « אם בעלה רופא אסור למשש לה הדפק » (שו״ע יו״ד קצ״ה:י״ז). But the Rama builds his leniency as a קל וחומר from seif 16: since we already relax for one who has great need of being attended, all the more so « אם אין רופא אחר וצריכה אליו ויש סכנה בחליה » (רמ״א יו״ד קצ״ה:י״ז). His source is an inference of the Beis Yosef from the wording of a responsum of the Ramban (§127) — and it is precisely here that the machlokes of section 2 resurfaces: for the Ramban, for whom the touch of a niddah is only rabbinic, danger sets it aside without difficulty; for the Rambam, the Beis Yosef stopped at a צריך עיון, and it is the Shach’s answer at ס״ק כ that unties the knot. The Rama’s closing reference to או״ח סימן פ״ח bears on an entirely different question, that of a niddah entering the synagogue.
The Acharonim on the patient — what they add, and what they bound. The Pitchei Teshuva brings at ס״ק ט״ו the Radvaz, who distinguishes our case from one where we say “let him die and not transgress”: there the illness came from the transgression itself, here it did not. At ס״ק י״ז he brings from the Mekor Chaim a practice of poskim — placing a cloth over the pulse, which then interposes. The Aruch HaShulchan, at סעיפים כ״ו–כ״ז, marks the limit for his part: a doctor who examines is permitted because he is engaged in his craft, but with his own wife who is a niddah and outside of danger, the closeness arises of itself. For practice — ask a Rav and a doctor.
The overall chakira of the siman: what is the root of the harchakos, and what is their measure in each situation?
The gader of touch — touch by way of desire (Torah law for the Rambam, rabbinic for the Ramban), and every other touch as a fence; the Shach’s answer at ס״ק כ holds the two together.
היכר and change — the mechanism of the reminder at the table, at the cup, in the garment and in service; and the machlokes of the Shach (ס״ק ה) and the Aruch HaShulchan (קצ״ה:ז) over what it is meant to prevent.
Gesture of affection against exertion — the standard of seif 11, stated by the Taz at ס״ק ג: exertion does not bring closeness.
Libun and niddah — one gader, measured by the tevilah; the Ravya’s leniency, and the ויש להחמיר with which the Rama himself closes it.
Illness and danger — levels set by the state of the inclination (ש״ך ס״ק י״ט) and by the nature of the act (ערוך השולחן קצ״ה:כ״ז), not by the gravity of the illness alone.
נפקא מינה — what follows, each with the commentary that supports it:
The separation lasts until the tevilah, and time does not dissolve her status
One neither hands nor throws from hand to hand, and does not touch even with a finger — including by way of a long object
A shared meal requires a sign; on the reach of the Rama’s leniency for those who share a dish when she is pure, the Bayis Chadash restricts and the Shach does not follow him
He does not drink what she has left; she, by contrast, may drink from his cup
Separate and separated beds; one does not sit on the bed or on the moving bench set aside for her — and on whether sitting alone is included, the Taz and the Bayis Chadash differ
Three tasks are forbidden in his presence — pouring the cup, spreading the sheets, pouring water — and exertion is permitted; outside his presence everything is permitted
The same harchakos in niddah and in libun; the Ravya’s leniency for the shared dish is a practice the Rama reports while adding that there is room to be stringent
In illness, levels; and in danger, for want of another, the Rama permits
ט״ז ס״ק ח, בשם הרשב״א — permitted to prepare, forbidden to pour during
ש״ך ס״ק ט״ז, בשם ר׳ יונה — forbidden to set the pitcher before him
The shared dish during libun
מחבר — no difference
ראבי״ה ברמ״א — the practice is lenient; and the Rama adds ויש להחמיר
She is ill and has no one to attend her
מחבר — forbidden to touch her
י״א ברמ״א — permitted in everything, “and such is the practice”
Table — the sources of the sugya
