Siman 198 — Immersion and Interposition (Tevilah and Chatsitsa): the Whole Body at Once, What Interposes, and the Criterion of Makpid

She must immerse כל גופה בפעם אחת (her whole body at once), so that nothing interposing (חוצץ), even the smallest (כל שהוא), remains on her ; the decisive criterion of מקפיד (רובו ומקפיד → מדאורייתא, מקצתו ומקפיד or רובו ואינו מקפיד → מדרבנן, and « דרך בני אדם להקפיד » suffices), then the hair (threads, ribbons, a קליעה, matted hair), the eye and the face (the לפלוף and the כחול), wounds, dried blood, dressings and a thorn, the skin, the nails and dirt, jewelry, and the conduct of the טבילה (dust of the feet, immersed clothed or without intent, the Rama's יש מחמירין) — the חפיפה and modern interpositions (nail polish, contact lenses, fillings, a cast), a practical and modest subject to be learned from the Rav, the balanit and the moret kalla (Shulchan Aruch, Yoreh De'ah 198 — 48 se'ifim)

She must immerse כל גופה בפעם אחת (her whole body at once) ; therefore nothing interposing (חוצץ) may remain on her. If there was a חוצץ: רובה ומקפדת → חוצץ (מדאורייתא) ; מקצתו ומקפדת, or רובו ואינו מקפדת → חוצץ מדרבנן ; מקצתו ואינו מקפדת → אינו חוצץ.

Basics — Beginner & Intermediate

The 48 se'ifim grouped into 7 families, the vocalized Hebrew text of the key se'ifim with a fluent English translation: the principle of כל גופה בפעם אחת and the grid of מקפיד, the hair (threads, ribbons, a קליעה, matted hair), the eye and the כחול, wounds and dressings, the skin, the nails and dirt, jewelry, and the conduct of the טבילה — with the practical cases of the חפיפה and modern interpositions (nail polish, contact lenses, fillings, a cast), always referring to the Rav, the balanit and the moret kalla.

The shitah of the Tzemach Tzedek of Lubavitch and the Chabad mesorah on the חפיפה, the examination against interpositions and the conduct of the טבילה — a living Chabad domain, presented at the level of principle while referring for conduct to a Chabad Rav —, then the halacha le-ma'aseh according to the Beit Yosef, the Rama, the Shach, the Taz, the Sidrei Tahara, the Chochmat Adam, the Aroch haShulchan and contemporary pesak (Taharat haBayit, Shevet haLevi, Badei haShulchan, Nishmat Avraham for modern interpositions). Every conclusion refers to the Rav, the balanit and the moret kalla.

Frequently asked questions — Siman 198

What is a chatsitsa, and what is the criterion of מקפיד?

The principle of Siman 198 is that she must immerse כל גופה בפעם אחת (her whole body at once): so that nothing interposing (חוצץ), even the smallest (כל שהוא), remains on her. Anything that interposes between the water and the body invalidates the טבילה. The decisive criterion is the מקפיד (caring to remove it): if the thing covers most of the body (or hair) and she is מקפדת → חוצץ מדאורייתא ; מקצתו ומקפדת, or רובו ואינו מקפדת → חוצץ מדרבנן ; מקצתו ואינו מקפדת → אינו חוצץ. And the fact that « דרך בני אדם להקפיד » (people sometimes care) suffices to make it חוצץ. This is the key to the whole siman ; the concrete application is put to the Rav and the balanit.

What interposes in the hair, the eye, or on a wound?

The hair is the subject of several se'ifim: wool or linen threads and ribbons tied in the hair interpose (until untied ; in a braid (קליעה), mere loosening is not enough) ; חוטי שער (hairs) do not interpose, except when gilded or dirty (then she is מקפדת) ; hair matted by sweat interposes against the heart or in the beard, but not on the head or at the armpit (and for a married woman the law is stricter). For the eye: the לפלוף (rheum) outside the eye interposes (even moist), inside the eye not ; the כחול (kohl) inside the eye does not interpose, outside the eye it interposes. On a wound: dried blood interposes, the ריר (ooze) within does not ; a רטיה (dressing) interposes. Each real case is checked with the balanit and the Rav.

What is the חפיפה, and what must be removed before immersing?

The חפיפה is the preparation that precedes the טבילה: to wash, to comb, and to remove anything that could interpose — matted hair, remnants of makeup and kohl, nail polish, jewelry (rings, bracelets, earrings), dressings, and the examination of the nails and the dirt beneath them. Modern interpositions are each a שאלה: nail polish and false nails, permanent makeup, contact lenses, dental fillings and crowns, a cast and stitches — according to the criterion of מקפיד and the Rav's ruling (Taharat haBayit, Shevet haLevi, Nishmat Avraham for the medical angle). The חפיפה is learned and each case verified with a moret kalla, the balanit and the Rav.

What do the se'ifim say on the conduct of the טבילה (dust, clothed, without intent)?

The final se'ifim deal with the conduct of the טבילה and borderline cases. The dust of the feet (§45) is subject to a מחלוקת (יש מי שאומר it interposes, or not): one does not immerse with it, unless it has been rubbed off or removed with hot water. The woman immersed clothed (§46) is permitted: loose garments do not make a חציצה since water penetrates them. Lice stuck to the skin (§47) must be removed with hot water or a fingernail, otherwise they do not interpose. The woman immersed without intent (§48) — fallen into the water or descended to cool off — is permitted בדיעבד per the Mehaber, but the Rama brings a יש מחמירין requiring another טבילה. All this depends on the Rav's ruling and the balanit's check.
